- two and has the honor of serving on the zoning and planning commission, which I joined to help with our self-inflicted housing
- recommended by the Planning Commission. I'm sorry, can you speak a little louder? Yeah, can you hear me? Yes, that's better
- support the safe Fencing Code Amendment unanimously recommended by the Planning Commission. It will help reduce the risk of injuries and
- Council member Vela on this, just given that's his original, um, article and his profession on the planning commission
- rezoning is incompatible with the guidelines of the planning commission incompatible with the aims of affordable housing incompatible
- mixed uses appropriate at this location. The applicant's, um, request was supported by planning commission with the 120
- much to offer today in the way of presentation other than to say we still agree with the planning commission recommendation
- me just a few minutes ago about an additional setback. Um, the planning Commission recognized the importance of the
- not near a neighborhood. Compatibility is not an issue. Again, i I said this at planning commission, if not here
- >. And from the preserve, the Planning Commission wanted an additional US to set back an additional 60 feet from
- the planning commission you've had, and I know since I was here last, I've had 23 ccs of letters to
- Brock and number two at the planning commission. At the planning department. Nine months later, you contacted us, you
- , but the planning commission, um, brought that down to 75 and of course you could, you know, amend that with
- for staff, but were there considerations that were not taken up at planning commission? Is there something we think
- , so I just had imagined planning commission probably discussed it. Can you talk a little bit about those aspects
- I'm, I'm late to, to this, uh, discussion, uh, is that the 60 foot setback that the planning commission, uh
- code for items to go before the planning commission and come before council. We are not meeting those deadlines
- recommendation and the planning commission recommendation. Thank you very much. Does anybody have any questions? Appreciate that. Um

- to planning commission, a super majority is required on the recommendation stage. Um, initiation is just kind of a research
- eight. Gotcha. Thank you. Okay. And I believe it's, uh, in either the, uh, planning commission or council would need to
- have three quarters as well. That would be not just the planning commission, but council also is that, so it
- and Planning Commission, staff recommends approval of the proposed code amendment only with the following conditions. First, the amended
- revisions are still subject to review by the law department who will be drafting the ordinance, uh, prior to planning
- commission review on June 27th. Uh, staff will collect revisions requested by the commission tonight to be included in that legal

- meeting our needs has only grown. And city council and or planning commission have initiated more than 60 ad hoc amendments to the
- or planning commission. Next slide. Once the code amendment is initiated and a lead department has identified, staff will work through
- by the codes and ordinances, joint committee review and public Hearing by Planning Commission, and any other commissions that are warranted
- prior to planning commission and city council hearings, and the law department is involved in the review and ordinance preparation. Next
- direction from previous councils and limited time and resources to enact the many policies that we are, that we or planning commission have
- ordinances and the planning commission or anything that needs to go through, uh, zoning and platting. And so I know
- approval is and here's where planning commission is. Um, but we had, I think one along the way that came into it
- committee, what exactly is their role in all this? What do they bring to the table that let's say Planning commission doesn't
- or? Sure. So the codes and ordinances joint committee includes members from the Planning Commission and the zoning and
- they would will be involved if planning commission initiates the code amendment that is a staff-led code amendment, typically staff
- would take it to the codes and ordinances joint committee to, for a recommendation to planning commission to initiate, and
- Commission. So the, the Planning Commission really relies very heavily on the codes and ordinances joint committee, um, for their
- because they are a joint committee, it is Planning Commission and Zap. And so that's Zaps, um, real opportunity to weigh
- in to this, which is very valuable to the members of the Zoning and Planning Commission. So we do follow that
- Planning commission or to go to codes and ordinances. Are those required by state law or is that a requirement We've
- put on ourself? We are required to go to the planning commission if we are amending zoning regulations. So anything
- and want it to go through the planning commission. Got it. All right. That's all My questions. Council Avela, I, um
- at the planning commission hearing to testify against it. Um, mostly representing the, the groups, the neighborhood plan contact
- the planning commission, you get told no mm-hmm. , because then, then we're stuck. And so we're, we're gonna have
- flu amendment that was voted down by the planning commission passed on consent without any opposition on council. I mean
- as it kind of leaves council and then, you know, goes to staff and then comes back through the planning commission and
- codes and ordinances, joint committee for planning commission. There's a set, the public hearing date that gets scheduled for counsel
- we could do that. But as far as I'm aware, I don't think we ever implemented, I was on planning commission at
- board. I mean it, uh, but, but the planning commission is a sovereign board and they have, they have authority by
- then it would move back to codes and ordinances joint committee for review as a draft before it hits the Planning
- in 25 2 are our regulating plans or something of that nature. We are required by state law to go to the Planning
- commission. Other amendments to Title 25 Council, uh, made a decision that that's the process they want, want to follow

- . I call that to your attention because many of the nonprofits and some of the members are on the Planning Commission as well
- public comment, uh, period was open from late January to late April. And then after the planning commission recommendation, um, we plan
- that I had was a brief conversation we'd had with y'all already. This has come up on planning commission multiple times
- it's, it's something that we need to do on our end as planning commission or not. Um, I just know it's
- from planning commission were applied to the final document and ready for basically review by counsel, which will be happening
- code review with the planning commission, where we can sort of finalize these, um, last details prior to the council
- bring those amendments to the planning commission. Okay. Uh, Steph, do you all have any concerns about this postponement? Okay
- derived from. Okay. So both the, uh, um, iton and Planning and Planning Commission, uh, have the opportunity to do, do
- for discussion. We have, uh, as discussed, planning and commission has not always made budget recommendations. And it was
- meeting at the planning Commission. It's 7 0 6. Thank you About feeling yourself. Think about feeling yourself. Think yourself.
