I WAS THE, UH, PERSON WHO OVERSAW THE REDISTRICTING PROCESS, THE ACTIVITIES FOR THE OFFICE OF THE CITY AUDITOR, ALL OF OUR REQUIREMENTS THAT ARE LAID OUT IN THE CITY CHARTER.

UM, SO WE'VE INTERACTED WITH EACH OF YOU TO SOME DEGREE OVER THE PAST FEW MONTHS.

UM, SO I WANTED TO TALK A LITTLE BIT, UH, ABOUT, UM, HOW WE GOT TO THE POSITION WE'RE AT, WHERE WE NEED TO FILL A COUPLE OF SPOTS, UH, ON THE COMMISSION.

UM, AS YOU KNOW, RECENTLY THERE WAS SOME CONCERNS RAISED ABOUT SOME, UH, ELIGIBILITY QUESTIONS OR CONCERNS FROM A COUPLE OF PEOPLE THAT WERE SELECTED FOR THE COMMISSION.

SO WHEN, WHEN THOSE, WHEN THOSE DISCUSSIONS FIRST TOOK PLACE, WE OBVIOUSLY IMMEDIATELY STARTED REVIEWING WHAT HAD, UM, WHAT HAD TAKEN PLACE DURING THE APPLICATION PROCESS.

AND ON MARCH 31ST, WE DISCOVERED A UNIQUE ERROR RELATED TO THE DATA DOWNLOAD FOR THE APPLICATION SITE.

UM, AND I SAY UNIQUE HERE.

I CAN GET INTO THE TECHNICAL PART OF THAT, UH, LATER ON, BUT WHAT WE FOUND WAS, UM, THERE WERE 10 PEOPLE WHO WERE IMPACTED 10 APPLICANTS FOR THE COMMISSION THAT WERE IMPACTED.

FIVE WERE INDIVIDUALS WHO MET THE MINIMUM QUALIFICATIONS, WHOSE NAMES WERE NOT INCLUDED IN THE POOL OF APPLICANTS THAT WE SENT TO THE APPLICANT REVIEW PANEL.

AND AS A REMINDER, THE APPLICANT REVIEW PANEL WAS THE CITIZEN BODY THAT WAS RESPONSIBLE FOR SELECTING SELECTING THE 60 MOST QUALIFIED.

SO WE FOUND FIVE INDIVIDUALS WHO WERE ELIGIBLE TO BE ON THE COMMISSION WHOSE NAMES DID NOT GET SUBMITTED TO THE APPLICANT REVIEW PANEL.

AND WE FOUND ANOTHER FIVE INDIVIDUALS WHO DID NOT MEET THE MINIMUM QUALIFICATIONS WHOSE NAMES WERE INCLUDED IN THAT LIST AND CONSIDERED FOR THE 60 MOST QUALIFIED, UM, OF THOSE FIVE, TWO OF THEM WERE ACTUALLY SELECTED FOR THE 60 MOST QUALIFIED.

AND ONE OF THEM WAS ENDED UP, UH, BEING SELECTED FOR, FOR THE COMMISSION, NOT THROUGH THE RANDOM DRAWING, BUT FROM THE FIRST EIGHT THAT WERE, THAT WERE DRAWN.

UM, WE IMMEDIATELY UPON DISCOVERING THIS STARTED EVALUATING A NUMBER OF DIFFERENT ITEMS, INCLUDING HOW THIS TOOK PLACE, WHAT THE FULL IMPACT WAS.

UM, I REACHED OUT PERSONALLY TO EACH ONE OF THE 10 INDIVIDUALS THAT WAS, UH, IMPACTED BY THIS TO OFFER OUR APOLOGIES AND EXPLANATION FOR, FOR WHAT TOOK PLACE.

UM, BASED ON THE TIMELINE THAT YOU GUYS HAVE IN FRONT OF YOU, THE REQUIREMENTS THAT YOU HAVE SET FORTH IN FRONT OF YOU, I REGRET THAT WE'RE, WE'RE TOO FAR ALONG TO REALLY REMEDY THE SITUATION FOR THOSE FIVE INDIVIDUALS WHO MIGHT'VE BEEN ELIGIBLE, BUT WERE NOT CONSIDERED.

I'VE ALREADY COMMUNICATED THAT TO THEM.

THEY UNDERSTAND THE SITUATION AND, AND TOOK THE NEWS, UM, PRETTY WELL.

UM, YOU KNOW, WE APOLOGIZE FOR THIS.

THIS WAS, UH, EXTREMELY UNFORTUNATE SITUATION.

UM, AS FAR AS I'LL TRY NOT TO GET INTO TOO MANY DETAILS, UNLESS YOU ALL HAVE QUESTIONS, BUT, UM, TRYING TO FIGURE OUT WHAT TOOK PLACE, WE HAVEN'T EVEN BEEN ABLE TO RECREATE THE SITUATION.

UM, BUT WHAT WE CAN TELL IS THAT IT W IT TOOK PLACE WHEN WE WERE DOWNLOADING DATA FROM THE BACKEND OF THE WEBSITE WHERE YOU ALL SUBMITTED YOUR APPLICATIONS TO BE ON THE COMMISSION.

AND, UM, THERE WAS, UH, A SHIFTING OF THE DATA ONLY IN THE COLUMN THAT INDICATED WHETHER OR NOT THE INDIVIDUAL WAS QUALIFIED TO BE ON THE COMMISSION, BUT IT ONLY IMPACTED THOSE 10 INDIVIDUALS, HOW THAT TOOK PLACE, WHERE WE'RE NOT ABLE TO, UM, TO DETERMINE, UM, BUT WE ARE, WE ARE COMMITTED TO BEING TRANSPARENT WITH THE MATTER, AS MUCH AS POSSIBLE AND DO WHATEVER WE CAN TO FIX THE SITUATION GOING FORWARD.

SO, UM, I THINK THAT'S IT IN A NUTSHELL, AS FAR AS MY BRIEFING OF THE SITUATION, BUT IF ANYONE HAS ANY DETAILED QUESTIONS, UM, ABOUT ANYTHING THAT I'VE DISCUSSED, I'M HERE TO ANSWER ANY QUESTIONS OR CONCERNS THAT YOU ALL MIGHT HAVE.

YES, SIR.

WHAT KIND OF THING OR THINGS WOULD DISQUALIFY SOMEBODY? UH, THERE'S A NUMBER OF CRITERIA THAT ARE BUILT INTO CITY CHARTER.

SO, UM, SOME OF IT IS A RESIDENCY.

IF YOU, YOU, YOU NEED TO HAVE BEEN IN AUSTIN FOR FIVE YEARS SO THAT YOU CAN BE A REGISTERED VOTER FOR FIVE YEARS.

YOU HAD TO HAVE PARTICIPATED IN THREE OF THE LAST FIVE GENERAL ELECTIONS.

UM, AND THEN THERE'S A HOST OF CONFLICT OF INTEREST, UH, RELATED, UM, QUALIFICATIONS THAT COULD DISQUALIFY SOMEBODY.

SO IF YOU'VE BEEN APPOINTED TO A STATE OR LOCAL OFFICE, UM, IF YOU HAVE BEEN A CITY EMPLOYEE, IF YOUR SPOUSE HAS BEEN A CITY EMPLOYEE OR A CITY CONTRACTOR, THERE'S A NUMBER OF DIFFERENT CRITERIA.

AND ACTUALLY I'M GLAD YOU BROUGHT THAT UP BECAUSE OUR DATA ERROR, UM, OUR DATA ERROR IMPACTED THOSE 10 INDIVIDUALS, ONLY ONE OF WHICH HAD BEEN SELECTED TO THE COMMISSION.

THERE WAS ACTUAL ACTUALLY ANOTHER INDIVIDUAL WHO WAS SELECTED FOR THE COMMISSION THAT WE'VE DETERMINED THROUGH ALL OF THIS WASN'T ACTUALLY ELIGIBLE THAT THEY WERE ABLE TO PROCEED, NOT

BECAUSE OF ANYTHING RELATED TO OUR DATA ERROR, BUT THERE WAS A PORTION OF THEIR APPLICATION THAT CONTAINED A MISREPRESENTATION AND ALLOWED THEM TO BE FLAGGED AS QUALIFIED WHEN THEY WERE ACTUALLY INELIGIBLE.

SO THAT'S WHY YOU HAVE TWO SPOTS ON THE COMMISSION THAT YOU'RE GOING TO NEED TO FILL ONE WITH THE FIRST AID AND THEN ANOTHER ONE LATER WITH, UH, WITH, UH, THE LARGER BODY.

UM, MY QUESTION PERTAINS TO, UM, NOT THAT YOU GAVE SOME DATES FOR CATCHING IT AND FIXING IT, WE'LL JUST INTERFERE LATER WITH, UH, WITH THE WORD THAT DISTINGUISHING PRODUCES AND DELIVERS AT THE END OF THE DAY.

UM, WHEN WE STARTED LOOKING INTO THIS AND, AND THAT'S WHY THERE'S A REPRESENTATIVE FROM THE LAW DEPARTMENT, CAROLINE WEBSTER, WHO WE'VE WORKED CLOSELY WITH SINCE THE BEGINNING OF THE REDISTRICTING PROCESS, ACTUALLY MONTHS BEFORE WE EVEN HAD A WEBSITE, WE WERE WORKING WITH CAROLINE.

AND SO ONE OF THE THINGS WE DISCUSSED WAS JUST THAT VERY QUESTION.

AND WE DID A REVIEW, UM, I'M NOT THE ATTORNEY CAROLINA, SO MAYBE SHE CAN EXPLAIN IT BETTER, BUT, UH, WE'VE BEEN ASSURED THAT WE, THAT WE CAN PROCEED AND THAT, UM, WE SHOULD BE ABLE TO DEFEND AND SUCCESSFULLY VALIDATE THE WORK THAT YOU ALL ARE TASKED WITH DOING REGARDING THE MAPS AND, AND EVERYTHING THAT YOU HAVE TO DO GOING FORWARD.

AND WE DECIDED THIS COURSE FORWARD IS IN, THAT IS IN THE SPIRIT, MAKING SURE THAT EVERYONE WE DO HAVE ON THE BOARD HAS BEEN CAREFULLY SELECTED, MAKING SURE EVERYONE IS ELIGIBLE, UH, TIME IS OF THE ESSENCE.

YOU KNOW, WE JUST DIDN'T HAVE TIME TO GO BACK AND REDO EVERYTHING.

WE ALSO HAD NO AUTHORITY IN THE CHARTER TO GO BACK AND REDO EVERYTHING.

UH, SO WE THOUGHT GIVEN ALL OF THOSE CIRCUMSTANCES, UH, THIS WAS THE BEST WAY FORWARD.

AND JUST TO BE CLEAR, WE'VE CONFIRMED THAT THE REMAINING APPLICANTS THAT YOU'LL BE CHOOSING FROM, UM, ARE IN FACT QUALIFIED BASED ON THE INFORMATION THEY PROVIDED TO US DURING THE APPLICATION STAGE.

UM, WE'VE HAD THAT QUADRUPLE CHECKED ACTUALLY.

SO YOU FEEL MORE COMFORTABLE ABOUT THAT.

UM, AND, UM, AND THEN FOR FUTURE REDISTRICTING EFFORTS, YOU KNOW, WE KNOW THIS WILL COME UP EVERY 10 YEARS.

WE, WE HAD DEVELOPED A LESSONS LEARNED DOCUMENT TO TRY TO HELP, UH, FUTURE STAFF IN THE AUDITOR'S OFFICE, GO THROUGH THIS PROCESS AS IN SOMETHING WE DO FREQUENTLY.

AND, UM, DEFINITELY NOT IN OUR BREAD AND BUTTER OF SERVICES THAT WE PROVIDE.

WE DON'T DO REDISTRICTING VERY OFTEN.

AND, UH, WE WILL DEFINITELY BE, UH, REFINING THAT, THAT DOCUMENT TO ENSURE THAT THINGS LIKE THIS ARE HOPEFULLY CAUGHT, UH, PROACTIVELY AND NOT REACTIVELY BY FUTURE AUDITOR STAFF.

SO THERE STILL WAS A LARGE POOL OF QUALIFIED ELIGIBLE APPLICANTS THAT PARTICIPATED IN THE PROCESS IN BOTH THE COMPETITIVE STAGES AND THE RANDOM STAGE.

AND SO WE, WE FEEL CONFIDENT THAT EVERYBODY WHO IS CURRENTLY ON THE COMMISSION AND EVERYBODY WHO WILL BE ON THE COMMISSION, UM, PROCEEDED THROUGH ALL THOSE PROCESSES THAT WERE DESIGNED WHEN, WHEN OUR CHARTER WAS AMENDED.

SO, UM, THE WORK THAT THIS COMMISSION WILL ULTIMATELY DO WILL HAVE BEEN COMPLETED BY INDIVIDUALS WHO MET ALL OF THE REQUIREMENTS AND WENT THROUGH THE RIGOROUS PROCESS TO END UP ON THE COMMISSION.

AND, AND THAT FEELS LIKE A PRETTY PROFOUND STATEMENT GIVEN THE LEVEL OF WORK THAT YOU HAVE IN FRONT OF YOU.

AND, UM, YOU KNOW, THAT IS THE SITUATION WE'RE IN IDEAL, OBVIOUSLY NOT, BUT, UH, ULTIMATELY EVERYBODY WHO ENDS UP ON THE REDISTRICTING COMMISSION WILL MEET ALL THE REQUIREMENTS SET FORTH IN THE CHARTER AND WE'LL HAVE PROCEEDED THROUGH EVERY PROCESS AS DESIGNED BY THE CHARTER.

I FEEL LIKE WE ARE BEHIND, BUT I CAN'T TELL HOW FAR MAYBE IT GETS HARD, BUT I'D LOVE TO UNDERSTAND THAT.

YEAH, THAT'S UM, THAT'S A GOOD QUESTION.

I THINK, I THINK WE ARE A BIT BEHIND WHEN FOR WHAT THE CHARTER LAYS OUT.

UM, UH, BUT, BUT THE OTHER THING THAT'S OUT THERE, THAT'S TOUGH IS JUST THE RESULTS FROM THE 2020 CENSUS.

SO, UM, SO WHAT WE'VE HEARD IS THOSE RESULTS WILL COME IN, UM, IN SEPTEMBER, BUT THOSE ALSO RUMBLINGS THAT WE MIGHT GET THOSE THIS MONTH PRELIMINARY RESULTS OF THAT.

UM, SO REALLY THAT'S, ONCE WE HAVE THAT INFORMATION, THEN Y'ALL CAN REALLY GET IN AND KIND OF DIVE INTO GETTING THOSE, THOSE MAPS AND, AND DISTRICTS AND, AND START WORKING ON THAT.

BUT BEFORE WE GET THE RESULTS OF THAT, THE 20, 20 CENSUS, UM, IT'S A, THERE'S A NUMBER OF KIND OF ADMINISTRATIVE LOGISTICAL TYPE THINGS WE NEED TO DO PROCESSING.

SO WE NEED TO DO, BUT THE, AS FAR AS THE CONTENT GOES, WE'RE REALLY WAITING ON THE RESULTS OF THAT 20, 20 CENSUS.

UM, BUT THE, YOU KNOW, THE TIMELINE IS A CONCERN.

IT'S, YOU KNOW, IF WE GET THOSE RESULTS IN SEPTEMBER, UM, I THINK THE CHARTER LAYS OUT THAT WE'RE SUPPOSED TO HAVE OUR WORK DONE BY NOVEMBER.

UM, I'M NOT REALLY SURE HOW WE'D BE ABLE TO DO THAT.

SO, UM, YEAH, JUST DEALING WITH A LOT THIS YEAR, BUT YEAH, GOOD QUESTION.

AND SO THE TIMELINE IS CONCERNED, UM, EXCUSE TO HAVE TO DELAY.
