THIS IS A BRIEFING, NOTHING MORE, UNLESS YOU COMMENT AT ANOTHER MEETING IN MAY, IT WILL BE TOO LATE TO MEET THE PROPOSED JUNE 3RD SCHEDULE OF COUNCIL APPROVAL. THIS IS A HORRIBLY FLAWED PROCESS. I AM SPECIFICALLY ALARMED THAT AUSTIN ENERGY WILL NOT ENACT STANDARDS TO BAN THE USE OF ELECTRIC RESISTANCE WATER HEATING BY MY GENERAL ESTIMATE, STRIP WATER HEAT WILL ADD OVER $6 MILLION IN ADDITIONAL ELECTRICITY COSTS OVER A 10 YEAR LIFE OF A WATER HEATER. JUST FOR [00:05:01] ONE YEAR'S GROSS IN AUSTIN'S ALL ELECTRIC RESIDENTIAL CUSTOMERS. IT WOULD ALSO ADD ABOUT FIVE MEGAWATTS A YEAR TO SUMMER PEAK LOAD, WHICH WOULD RAISE BILLS FOR ALL OF US. AND THE BULK OF THE EXTRA COSTS WILL FALL ON APARTMENT DWELLERS WHO CAN LEAST AFFORD IT. THEIR INCOME IS GENERALLY HALF THAT OF HOMEOWNERS AND UNLIKE HOMEOWNERS, THEY WILL HAVE NO CONTROL OVER THE APPLIANCES THAT ARE INSTALLED. THERE IS AMPLE PRECEDENT FOR WHAT I'M ADVOCATING THE ENERGY CODE OF THE STATE OF CALIFORNIA BANS, STRIP, WATER HEATING AND RESIDENCES. AT LEAST TO MY KNOWLEDGE AND THIS SIMILAR MEASURES EXIST INTO OTHER STATE CODES. SIMILAR MEASURES HAVE EXISTED IN OUR CITY'S ENERGY CODE SINCE 1984. I HAVE BEEN PERSONALLY TOLD BY AUSTIN ENERGY STAFF THAT THEY DID NOT WANT TO ADD THIS TO THE CODE BECAUSE OF EXPECTED OPPOSITION FROM BUILDERS. UM, YOU KNOW, IN 2020, GIVEN THE PANDEMIC, THERE WERE LOVE IMPACTS TO OUR PROGRAMS AND OUR ABILITY TO DELIVER IN HOME FREE WEATHERIZATION PROGRAMS. WE ALSO REVISITED OUR APPLICATION PROCESS TO REMOVE BARRIERS FOR CUSTOMERS AND REALLY REVAMPED THE ENTIRE APPLICATION PROCESS AS WELL AS SOME OF THE PROGRAM DESIGN. SO IN FISCAL YEAR 20, WE SAW JUST OVER 240 APP, UH, APPLICATIONS OR REQUESTS FOR WEATHERIZATION. UM, AND WITH THE CHANGES THAT WE'VE MADE WE'VE, WE ARE SEEING A LOT MORE PARTICIPATION THIS YEAR. UM, THERE WAS A REQUEST FROM THE LOW-INCOME TASK FORCE THAT ANY UNSPENT FUNDS FROM PRIOR FISCAL YEARS BE CARRIED FORWARD INTO THE CURRENT FISCAL YEAR TO ENSURE THAT FUNDING IS ALLOCATED TO THESE LIMITED INCOME CUSTOMERS. SO THAT IS THE REQUEST IS TO CARRY FORWARD. THESE UNSPENT FUNDS FROM THE FISCAL YEAR 20 INTO FISCAL YEAR 21, AND THE TOTAL AMOUNT OF FUNDING FOR FISCAL YEAR 21, UM, INCLUDES ESSENTIALLY THE ORIGINAL, UH, 2.377 MILLION, UM, FOR BOTH THE CUSTOMER SYSTEMS PROGRAM WEATHERIZATION AS WELL AS THE FREE AUSTIN ENERGY WEATHERIZATION PROGRAM. IN ADDITION TO THE 1.165 MILLION THAT IS BEING CARRIED OVER FROM FISCAL YEAR 24, A TOTAL OF JUST OVER $3.5 MILLION FOR THIS. WHAT IF I MIGHT ASK THE PRINCIPAL CHANGES, UH, UH, WHEN THE PROGRAM WAS REVAMPED AND THE I'M REFERRING TO THE LOW-INCOME [00:15:01] INCOME LOW-INCOME PROGRAM. THANK YOU FOR YOUR QUESTION. SO THE MAIN CHANGES THAT REALLY HAS MADE A DIFFERENCE IN THIS FISCAL YEAR HAVE BEEN A CHANGE TO THE APPLICATION PROCESS TO SIMPLIFY IT TO A SINGLE PAGE APPLICATION FROM A MULTIPLE, UM, YOU KNOW, PAGE APPLICATION. SO MAKING IT A LOT MORE, UM, USER-FRIENDLY EASY FOR FOLKS TO ACTUALLY SEND IT TO THE APPLICATION. IN ADDITION, THERE WAS A SHIFT IN, UM, THE INCOME THRESHOLD FROM 200% OF THE FEDERAL POVERTY LEVEL TO 80% OF THE MEDIAN FAMILY INCOME. UM, THE THAT'S THE LAST PIECE THAT REALLY MADE THE DIFFERENCE IS THE INCOME VERIFICATION PROCESS AND ALLOWING FOR SELF-ACTUALIZATION FROM THESE LIMITED CUSTOMERS. I LARGELY DO THAT POWER SUPPLY REVENUE AND OUR OPERATING EXPENSES WERE 372 MILLION, WHICH IS 23% UNDER BUDGET. AGAIN, DRIVEN BY POWER SUPPLY COST. THIS RESULTED IN AN OPERATING INCOME OF 129 MILLION. AND AFTER YOU PAY DEBT SERVICE AND 65 MILLION TO MAKE YOUR TRANSFERS, AND ABOUT 117 MILLION, WE ENDED THE QUARTER WITH DEFICIENCY OF 51 MILLION, WHICH IS INLINE WITH OUR FORECAST OF 52 MILLION IN FIND THE ONLY REAL VARIANCE IS OUR INTEREST INCOME, WHICH WAS, UH, UNDER FORECAST BY 3 MILLION. AND THAT'S, UM, THE RESULT OF HAVING A SLIGHTLY LOWER INTEREST RATES PAIRED WITH THE REDUCED AVERAGE CASH BALANCE. WHEREAS THAT CASH BALANCE HAS PICKED UP NOW AS A RESULT OF THE STORM, BUT ON AVERAGE, IT'S BEEN LOWER THAN WE WERE A YEAR. WE'RE ON TRACK HERE. SO OUR, OUR ENERGY SALES TO THE END OF SECOND QUARTER WERE ABOUT EIGHT GIGAWATT HOUR UNDER FORECAST FOR THE YEAR, WHICH IS ABOUT A 0.1%. SO WE INTENTIONALLY SET THAT PSA RATE SLIGHTLY LOWER TO RETURN THAT, THAT, THAT EXCESS TO THAT, TO THE CUSTOMERS. HOWEVER, WE POINTED OUT, WE ARE TRACKING SEVERAL LEGISLATIVE AND REGULATORY EFFORTS IN TEXAS THAT COULD HAVE AN IMPACT ON ELIMINATING THAT POSITIVE BALANCE FOR US AS A PSA. AND SO A LOT OF THAT DECREASE IS, UM, THAT THE COVID IMPACT, BUT IT'S ALSO A TREND THAT, THAT WE'VE BEEN SEEING, UH, I'LL POINT OUT TO YOU HERE IN A MINUTE, BUT, UM, SO, YOU KNOW, SO THIS CHART KIND OF DEMONSTRATES THAT OUR, THE NUMBER OF CUSTOMERS HAS GROWN AT A COMPOUNDED RATE OF ABOUT 2.2% PER YEAR, SINCE 2016. UM, AND DURING THAT SAME PERIOD, YOU CAN SEE THERE ARE RETAIL SALES HAVE EXPERIENCED ABOUT A 0.3% COMPOUND GROWTH RATE DURING THE SAME PERIOD. SO, UM, YOU CAN SEE THAT THAT TREND LINE THERE, UM, TWO 16 AND 21 ARE FORECAST AT 22 AND, UM, IN 20 AND 21, YOU'RE SEEING THOSE IMPACTS OF COVID THERE. AND SO, YOU KNOW, THIS IS REALLY ASSOCIATED WITH ADVANCES IN OUR ENERGY EFFICIENCY AND BUILDING CODES, HOUSING STOCK, DG, OVERALL AWARENESS OF ENERGY CONSERVATION FROM OUR CUSTOMERS, BUT IT'S BEEN A LONG ONGOING TREND. WE'RE SEEING DECREASED CONSUMPTION PER CUSTOMER, UM, AS A WHOLE. AND SO COVID HAS HAD AN IMPACT ON THAT NEXT PAGE. HERE'S A INTERESTING, UH, CHART HERE. AND SO, YOU KNOW, ENERGY EFFICIENT REALLY HAS INTEGRATED ITSELF INTO THE QUALITY OF THE CONSTRUCTION AND THE LIGHTING, THE HEATING AND COOLING SYSTEMS AND THE HOUSEHOLD APPLIANCES IN GENERAL. AND SO THE WAY YOU READ THIS CHART IS THAT YEAR ON THE BOTTOM OF THE CHART, THERE THAT'S THE YEAR THAT, THAT, UM, THAT CUSTOMER FIRST TOOK SERVICE. AND SO THAT PROBABLY REPRESENTS NEW OR, UM, UH, NEW CONSTRUCTION REALLY. AND SO YOU CAN SEE THAT, UM, HOMES THAT WERE EXISTED BEFORE 2012 OVERALL, WE'RE USING ABOUT 909 ON AVERAGE KWH PER MONTH. AND SO, UM, YOU KNOW, SO AS THE HOUSING MARKET GETS FULLY SATURATED, LIKE IT IS NOW REALLY ALL THE, ALL THE NEW, THE NEW CUSTOMERS EVER GETTING ARE REALLY MOVING INTO, UM, NEW CONSTRUCTION IS REALLY ENERGY EFFICIENT AND SMALLER UNITS. AND SO THAT, THAT'S WHAT WE'RE SEEING IN TERMS OF, UM, CONSUMPTION, UH, ALSO BASIS EXPANSION. WHAT DOES THAT MEAN TO OUR PRICING STRUCTURE? SO ALL THOSE NEW CUSTOMERS ARE, UM, IT WAS REALLY NEW, EFFICIENT HOMES. YOU'RE REALLY AGGREGATING IN THE FIRST TWO TIERS, UM, THAT REPRESENTS ABOUT 76% OF OUR SALES. UH, MORE KIDS WHO ARE GOING BACK TO SCHOOL AND SORRY, WE'RE SETTLING DOWN TO MORE NORMAL PATTERN, UM, UH, UNDER RESIDENTIAL SIDE. SO THAT CONSUMPTION IS, IS SELLING DOWN AND GOING BACK TO MORE NORMAL, YOU GO TO THE NEXT, THIS IS THE, UM, COMMERCIAL SIDE. AND, UM, ON THE, ON THE COMMERCIAL SIDE, YOU CAN SEE THAT, UM, WE SORT OF HAD THE OPPOSITE. SO, UM, AS WE PUT IN THE, UH, THE STAYING AT HOME, UM, WE SAW A, UH, UH, LESS DEMAND AND LESS CONSUMPTION ON THE COMMERCIAL SIDE. SO IT'S MEAN WE'RE NOT NECESSARILY COVERING OUR CURRENT EXPENSES WITH OUR CURRENT REVENUES. AND WHILE WE EXPECT OUR ECONOMY TO RESUME AT A MORE NORMAL, OR EVEN BETTER THAN NORMAL GROWTH, UH, STARTING IN JANUARY HERE AND PANDEMICS, IT'S GOT A LASTING IMPACT ON OUR FINANCIAL HEALTH. UH, THEY DEVELOP THOSE CODES ON THREE-YEAR CYCLES, UH, JUST BECAUSE THEY DEVELOP THOSE CODES ON THREE-YEAR CYCLES DOESN'T MEAN THAT THEY ADOPT THEM ON THREE-YEAR CYCLES. SO AUSTIN IS CURRENTLY UNDER THE 2015 I UCC, AND WE LOOKED AT THE 2018 CODE FOR ADOPTION, AND THERE WERE A NUMBER OF MITIGATING FACTORS WHERE WE DECIDED NOT TO PURSUE THE, THE 18 CODE. UH, FIRST AND FOREMOST WAS THAT THERE WASN'T A SIGNIFICANT INCREASE IN EFFICIENCY OVER THE 15 CODE, BUT ALSO IT COINCIDED WITH, UH, SIGNIFICANT WORK IN DEVELOPS W OR A DSD LOOKING AT, UH, THE LAND DEVELOPMENT CODE. [01:25:01] UH, AND ALSO WE WERE COMING UP ON SOME DIFFICULTIES IN, IN ADOPTING THE REST OF THE CODE. SO WE WERE A LITTLE LATER ON SOME OF THOSE, SO WE DIDN'T WANT TO ENGAGE IN THAT. SO WE DIFFERED ON THE 2015 CODE OR ON THE 2018 CODE ADOPTION. UH, AS FAR AS THE PURPOSE OF THE CODE IS TO REGULATE DESIGN AND CONSTRUCTION, UH, FOR USE AND CONSERVATION OF ENERGY. NOW, THE IECC REALLY IN THIS LAST CODE AND I'LL SPEAK TO THIS A BIT MORE LATER, BUT THEY REALLY WANT TO LOOK MORE AT CONSERVATION OF ENERGY IN, IN CODE AS AN OBJECTIVE, UH, FOR THE PROCESS MOVING FORWARD. AND THEN LIGHTING, UH, THERE'S THREE DIFFERENT METHODS OF MEETING THE REQUIREMENTS AND THREE DIFFERENT WAYS THAT WE, WE TRY AND JUDGE THAT, UH, THERE'S THE PRESCRIPTIVE APPROACH. AND YOU CAN LOOK AT THE TOTAL EFFICIENCY FOR THE BUILDING. AND IF YOU MEET THE PARAMETERS THAT ARE OUTLINED WITHIN THE MODELING SOFTWARE, THEN YOU WERE JUDGED TO BE COMPLIANT WITH CODE. AND THEN YOU'VE GOTTEN KIND OF A COMBINATION OF THOSE TWO LOOKING AT PRESCRIPTIVE AND PERFORMANCE BASED THROUGH SOMETHING LIKE EITHER COMCHECK OR REST CHECK, WHICH USE, UH, BOTH THE MODEL, BUT A VERY SIMPLISTIC MODEL, AND THEN A LIST OF, OF PRESCRIPTIVE MEASURES AS WELL. SO DO YOU HAVE AN EDUCATION PART OF THIS THAT EITHER YOU OR CITY OF AUSTIN TAKES CARE OF THAT TRIES TO HELP BRIDGE THE, THE MIGRATION TO THE NEWEST CODES TO MAKE? ABSOLUTELY. ABSOLUTELY. AND, AND I DON'T KNOW THAT THAT APPROACH HAS BEEN ENTIRELY CONSISTENT OVER THE YEARS IN THE CODE CYCLES, BUT JUST FOR INSTANCE, THE LAST CODE CYCLE, WE PUT TOGETHER EDUCATIONAL CURRICULUM AND SCHEDULED, UH, APPOINTMENTS WITH DSDS INSPECTORS AND WENT THROUGH THE CODES AND THE DIFFERENCES TO HELP INFORM THEM WITH WHAT THEY WERE DOING. AND THEN ALSO MADE THAT AVAILABLE AS WELL FOR THE TRADE ORGANIZATIONS, THINGS LIKE, UH, AIA AND THE HOME BUILDERS ASSOCIATION. SO YEAH, WE DO WHAT WE CAN TO HELP WITH THAT. SO WE DIDN'T HAVE A CODE TO DISCUSS AT THE TIME. AND WE WERE HESITANT TO MOVE FORWARD WITH STAKEHOLDER ENGAGEMENT THROUGH THE HOLIDAYS, BECAUSE IT'S REALLY HARD TO GET BANDWIDTH. AND IT'S REALLY HARD TO GET FOLKS ENGAGED AND THINGS THEY'RE JUST OTHER PRIORITIES. SO WE DEFERRED TIL JANUARY AND AGREED TO COME BACK AND TALK WITH, UH, DSD IN JANUARY ABOUT THIS VERY TOPIC. WHEN WE CAME BACK TO THEM IN JANUARY, THEY SAID, HEY, WE REALLY DO WANT TO DO THIS BY THE END OF THE YEAR. WE'VE GOT SOME VERY GOOD REASONS FOR THAT. UH, LET'S GO AHEAD AND KICK THIS OFF. UH, WE WERE TOO LATE IN JANUARY TO GET ON THE AUC IN THE RNC AGENDAS. SO WE PUSHED IT OFF TO FEBRUARY. WELL, FEBRUARY, IF YOU'LL REMEMBER, ADD THE JOINT EUC RMC MEETING, WHICH WASN'T AVAILABLE TO US, AND IT WAS A VERY RESTRICTED AGENDA. SO WE COULDN'T GET ON THAT. WE LOOKED TO PUSH IT OUT TO MARCH AND WE HAD A WINTER STORM THAT CONSUMED ALL OF OUR TIME. SO THAT MEETING GOT CANCELED, WHICH UNFORTUNATELY BRINGS US TO THE APRIL TIMEFRAME. SO AGAIN, WE REALLY DIDN'T WANT TO RUN WITH THIS KIND OF TIMEFRAME, BUT THIS IS KIND OF WHERE WE FOUND OURSELVES. UM, UM, AND CAN YOU SPEAK TO WHY, WHY THE, WHY IT'S IMPORTANT TO GET IT TO CITY COUNCIL FOR APPROVAL ON JUNE 3RD, SO THAT IT'D BE IMPLEMENTED ON SEPTEMBER ONE. WHAT'S THE, WHAT'S THE RUSH VERSUS WAITING TILL, SAY JANUARY OF 12 ON EACH ONE, UH, AS THE IMPLEMENTATION. SURE. UH, SO THERE'S REALLY THREE REASONS THAT WE'RE LOOKING TO TRY AND GET APPROVAL FOR THIS IN, IN JUNE AND FIRST, JUST HISTORICALLY, UH, DSD HAS BROUGHT THE CODES FORWARD ON SEPTEMBER 1ST. SO THE COMMUNITY KIND OF KNOWS FROM A HISTORICAL PERSPECTIVE, THE GENERALLY NEW CODES BECOME EFFECTIVE IN SEPTEMBER. NOW THERE ARE ALL KINDS OF OUTLIERS THERE, BUT THE EXPECTATION IN THE COMMUNITY IS THAT WE LOOK FOR THAT DATE FOR THOSE, THOSE TO BECOME EFFECTIVE. THE OTHER THING IS THAT WE'D LIKE TO ALL OF THE CODES COME FORWARD AT THE SAME TIME THAT AVOIDS A LOT OF CONFUSION. YOU DON'T HAVE TO WORRY ABOUT WHAT CODE IS EFFECTIVE WHEN YOU'RE LOOKING AT EITHER AN ENFORCEMENT ISSUE OR A DESIGN ISSUE THAT, YOU KNOW, WHEN THIS BUILDING, BECAUSE THESE, YOU KNOW, THE DESIGN PROCESS AND CONSTRUCTION PROCESS ON THESE BUILDINGS CAN TAKE YEARS. SO IF WE'VE GOT A CODE THAT'S EFFECTIVE FOR SIX YEARS, YOU'VE GOT TO HAVE SOMEBODY THAT KNOWS WHEN THESE CODES WENT EFFECTIVE AND IT'S VERY CONFUSING. SO WE TRY TO ALIGN ALL THE CODES TOGETHER. AND THEN THE THIRD ISSUE IS AROUND A REQUIREMENT THAT THE CITY HAS, OR THE, UH, AN ENTITY THAT THE CITY WORKS WITH. THERE'S A GROUP CALLED THE INSURANCE SERVICES OFFICE, NEURO PROVIDERS, STATISTICAL ANALYSIS, ACTUARIAL ANALYSIS, AND UNDERWRITING, UH, AND CLAIMS INFORMATION AND DATA. AND THEY REALLY FOCUS ON PROPERTY AND CASUALTY INSURANCE ISSUES. AND THEY HAVE A SCORECARD CALLED A BUILDING CODE EFFECTIVENESS RATING SCHEDULE. AND WHAT THAT REALLY LOOKS LIKE IT LOOKS AT IS AMONGST OTHER THINGS. THIS IS JUST ONE OF THE STORING CRITERIA, BUT THEY, THEY ASSESS THE BUILDING CODES THAT A CITY HAS ADOPTED AND THEIR ENFORCEMENT. AND THEY PARTICULARLY LOOK AT THEM FROM A PERSPECTIVE OF HOW THEY MITIGATE LOSSES FROM NATURAL DISASTERS. AND THEY AUDIT THE CITY ON THIS PERIODICALLY. WE DON'T KNOW WHEN OUR NEXT AUDIT IS GOING TO BE, UH, BUT RELATED TO TWO BUILDING CODES, THEY HAVE A REQUIREMENTS THAT THE MUNICIPALITY OR THE ENTITY THEY'RE AUDITING HAVE A, AN ACTIVE CODE OR A CODE THAT HAS BEEN AT IT IS NEWER THAN SIX YEAR OR NEWER THAN FIVE YEARS FROM, FROM THE ADOPTION CYCLE. SO BASICALLY WE FIND OURSELVES WITH THE 2015 CODE RIGHT NOW, AND WE'RE NOW IN 2021. SO WE'RE NOW A YEAR OUT FROM WHERE THEY ARE WITH THIS. SO WE NEED TO SHOW GOOD EFFORT AND GOOD FAITH THAT WE'RE MOVING TOWARD THAT ADOPTION. [01:40:01] UH, AGAIN, WE DON'T KNOW WHEN WE'RE GOING TO BE AUDITED. ONE POINT HERE MAY NOT MAKE THE DIFFERENCE, BUT THERE ARE OTHER OTHER FACTORS THAT GO INTO THIS. ULTIMATELY, WE DON'T WANT TO SUBJECT OURSELVES TO THE POTENTIAL RISK, WHICH IF THERE'S AN, A BIG ENOUGH DROP IN THIS, IT COULD NEGATIVELY IMPACT INSURANCE RATES FOR THE COMMUNITY. SO THAT'S KIND OF THE TRIUMVIRATE OF THINGS THAT WE'RE LOOKING AT AS, AS DRIVERS FOR PUSHING THEM. AND THE REASON YOU WANT CITY COUNCIL TO ADOPT IT IN EARLY JUNE IS BECAUSE YOU WANT TO GIVE THE BUILDING COMMUNITY KIND OF 90 DAYS APPROXIMATELY NOTICE IS THAT RIGHT? ABSOLUTELY. AND IT ALSO THEN GIVES US TIME FOR THE EDUCATION COMPONENT THAT YOU TALKED ABOUT, THAT IT GIVES US TIME TO GO OUT AND DO PUT TOGETHER THE CURRICULUM AND DO THE ROAD SHOW TO TEACH PEOPLE WHAT'S COMING. SO, UM, SO SPEAKING TO THIS, THIS, THIS OUTLINES, THE, THE TIMELINE THAT WE'VE GOT FOR BOARDS AND COMMISSIONS, YOU KNOW, WE TALK ABOUT ERNEST, THESE COURTESY REVIEWS. THE OTHER THING THAT WE'VE GOT HERE IS ON, ON THE, UH, MAY 6TH ITEM, THAT IS A SET HEARING ANNOUNCEMENT WHERE COUNCIL ANNOUNCES THAT THEY WILL HAVE A HEARING IN THE JUNE MEETING TO DISCUSS ENERGY CODE. SO IT'S THEIR PUBLIC NOTIFICATION THAT CONSIDERATION TO THE ENERGY CODE IS COMING THROUGH THE COUNCIL IN MAY, OR EXCUSE ME IN JUNE. SO ANY OTHER QUESTIONS ON THE SCHEDULE? OKAY, NEXT SLIDE PLEASE. DUBROSKI SLIDES ABOUT WHERE WE ARE FROM AN EFFICIENCY PERSPECTIVE AND AN ENERGY USE PERSPECTIVE, YOU'LL SEE THAT WE'RE TAKING, YOU KNOW, WE'RE, WE'RE TRYING TO TAKE A SLICE OUT OF AN INCREASINGLY SMALLER PIE. UH, IF YOU LOOK AT THIS COLLECTIVELY, THIS IS A SIGNIFICANT INCREASE OVER THE PREVIOUS CODE. AND WE LOOK AT REALLY THE, AT THIS AS, UH, AS AN AGGRESSIVE MEASURE IN A REACH CODE, THIS IS NOT GOING TO BE, UH, IT WILL NOT BE, YOU KNOW, SIMPLISTIC, IT WILL REQUIRE SOME EDUCATION AND, UH, AND SOME WORK ON FOLKS, UH, HAVE TO IMPLEMENT IT. SO, UH, WE TAKE THAT INTO CONSIDERATION WITH WHAT WE'RE DOING. UM, YOU, YOU MAY OR MAY NOT HAVE SEEN THIS, BUT TODAY THE DUI DOE ISSUED THEIR PRELIMINARY DETERMINATION OF THE, UM, OF THE, UH, WHAT'S THAT LAB CALLED PACIFIC NORTHWEST LAB. THEY HAD VERY SIMILAR NUMBERS, THEY SAID 9.3, 8% SITE ENERGY, AND 8.7, 9% SOURCE ENERGY COMPARED TO THE PREVIOUS CODE FOR, FOR RESIDENTIAL. SO THAT THOSE ARE VERY SIMILAR. THEIR PRELIMINARY ARE VERY SIMILAR TO WHAT YOU GUYS GUESSTIMATE. SO, SO WE WENT WITH OUR, WITH OUR MODELING GROUP AND LOOKED AT DIFFERENT BUILDING TYPES. AND FOR RESIDENTIAL WE'RE ESTIMATING AN AVERAGE OF 4%, UH, INCREASE IN EFFICIENCY. UH, THERE'S SOME VARIATION BY BUILDING TYPES AND THEN ON COMMERCIAL, THERE'S A BROADER DIFFERENTIAL IN THE RANGE, EVERYTHING FROM FOUR TO 17%, BUT WE ANTICIPATE ABOUT A 10% INCREASE IN THE COMMERCIAL SIDE OF THINGS. SO, UH, YOU KNOW, DEFINITELY MOVING THINGS SIGNIFICANTLY ON THE COMMERCIAL SIDE AND STILL NOT, UH, NOT A LOW HURDLE ON THE RESIDENTIAL SIDE. UM, SO ELECTRIC VEHICLE READY AND ELECTRIFICATION, OR THE IDEA OF PREPARING, UH, BUILDINGS FOR CONVERSION FOR NATURAL GAS, FUEL SOURCES FOR ENERGY NEEDS TO ELECTRIC, FUEL SOURCES WERE BOTH REALLY FOREFRONT ISSUES IN DEVELOPMENT OF THE 21 CODE. AND WHEN THEY GOT TO THE VOTING PART OF THE CODE TO APPROVE IT, THERE WAS A STRONG RALLY AND EFFORT [01:45:01] ON BEHALF OF BUILDERS, ASSOCIATIONS, AND THE NATURAL GAS INDUSTRIES TO REVISIT EVIE READY AND ELECTRIC READY. AND THE RESULT WAS THAT THEY WERE STRUCK DURING THE APPEALS. AND THERE WERE TWO THINGS THAT WERE REALLY CITED THERE. ONE WAS THE POTENTIAL COST ISSUES. AND THE OTHER WAS, AGAIN, THIS IDEA OF RELEVANCE IS, ARE THESE CONSERVATION AND OR EFFICIENCY MEASURES, OR ARE THESE SOMETHING ELSE? AND DO THEY BELONG IN THE CODE? AND WHILE THE ICC DIDN'T COME OUT AND SAY, THEY DON'T BELONG HERE, THEY DID SAY, WE CAN'T SAY THEY DO BELONG HERE. AND WE DON'T THINK THEY SHOULD BE INVOLVED IN THIS CODE CYCLE. SO AS SUCH, THEY'VE BEEN STRUCK, UH, THAT LEAVES US IN A LITTLE BIT OF A, A TRICKY PLACE IN IT. WE DON'T HAVE THE FIRM CONVICTION OF THE GOVERNING GROUP FOR IECC THAT EVIE READY AND ELECTRIFICATION BELONG, UH, IN THAT CODE AS WELL. WE'VE GOTTEN A LOT OF PUSHBACK, UH, POTENTIAL PUSHBACK ON THE LEGISLATIVE FRONT, LOOKING AT, UH, LEGISLATION AROUND BUILDING CODES AND WHAT WE MAY OR MAY NOT HAVE PURVIEW TO LOOK OVER OVERSEE WITH REGARDS TO SPECIFIC BUILDING PRODUCTS AND, AND THE, LIKE, AS SUCH GIVEN ALL OF THIS GIVEN WE'VE GOT A STRETCH CODE, UH, AND WE'VE GOT SOME UNCERTAINTY AROUND WHERE WE CAN IMPACT THINGS WITH CODE. THE DECISION WE'VE MADE IS TO NOT LOOK AT NEW LOCAL AMENDMENTS, UH, IN THE 21 CODE AT THIS TIME, WE WOULD LOOK TO CARRY OVER THE RELEVANT 2015 AMENDMENTS. SO THAT WOULD INCLUDE THINGS LIKE SOLAR, FOR BOTH RESIDENTIAL AND COMMERCIAL WOULD CARRY FORWARD AS THEY ARE IN THE 15 CODE. UH, ONE THING WE'LL LOOK TO REMOVE IS CURRENT IN THE CURRENT CODE, THERE'S A REQUIREMENT THAT ANY RESIDENTIAL SITE THAT IS ADJACENT TO NATURAL GAS SERVICE MUST USE, UH, NATURAL GAS WATER HEATING FOR RESIDENTIAL CONSTRUCTION. AND WE WILL LOOK TO WAIVE THAT, UH, THERE'S BEEN A LOT OF TALK IN THE LEDGE ABOUT NON-DISCRIMINATION AGAINST MY UTILITY TYPE, AND WE FEEL PRETTY STRONGLY THAT THAT FITS INTO THAT CATEGORY. SO WE'LL LOOK TO MOVE THAT WE HAVEN'T GOTTEN PUSHBACK FROM THAT FROM THE STAKEHOLDERS. UH, SO WE'RE, WE, WE DON'T HAVE BIG CONCERNS ABOUT THAT. UH, AND THEN YOU TALKED ABOUT ERI THE ENERGY RATING INDEX, AND THAT'S ONE WAY OF LOOKING AT THE OVERALL EFFICIENCY FOR THE, FOR THE BUILDING, PARTICULARLY ON THE, ON THE RESIDENTIAL SIDE. WE JUST DON'T THINK GIVEN THE TIMELINES THAT WE HAVE AND THE IMPERATIVES THAT WE HAVE FOR LOOKING AT, UH, AT ADVANCING THIS CODE, THAT THIS IS THE COMA TO TRY AND SHOEHORN THESE IN TO THE CURRENT CURRENT CODE PROCESS. WE WANT TO ALLOW MORE TIME FOR THAT DISCUSSION TO HAVE A MORE, BOTH ROBUST DISCUSSION AMONGST OUR STAKEHOLDERS, MAKE SURE THAT THEIR CONCERNS ARE ADDRESSED. WE DID HAVE CONSIDERABLE, UH, FEEDBACK FROM CUSTOMERS, FROM STAKEHOLDERS IN THIS PROCESS THAT THEY WANTED TO LOOK AT THESE ISSUES. SO WE WANT TO ALLOW THAT TIME. WE HAVEN'T DEFINED THAT PROCESS YET. UH, I KNOW THAT MULTIFAMILY HAS A PROBLEM WITH FOOTPRINT AND THAT THE, UH, SOME OF THE HEAT PUMP OPTIONS, UH, TAKE UP A LOT MORE FOOTPRINT AND THEY'RE RELUCTANT TO GIVE UP THAT FOOTPRINT BECAUSE IT'S COSTLY TO THEM. THERE ARE ALSO SOME ECONOMIC, UH, ISSUES. UH, WE NEED TO LOOK AT WHAT THE AFFORDABILITY IMPACT COULD BE. UM, YOU KNOW, SO IT IS A VERY COMPLEX ISSUE. UH, WE'RE NOT, WE'RE NOT RESOLUTE IN, IN, IN OUR RECOMMENDATION YET. WE'RE STILL WORKING ON THAT AND WE'LL CONTINUE TO WORK WITH, UH, MR. ROBBINS ON THAT AND, AND TALK WITH HIM SPECIFICALLY ABOUT THAT AS WELL. SO, UH, SO WE ALREADY TALKED ABOUT SOME OF THE IMPACTS YOU GUYS HAVE HEARD IT AS GOOD AS INFORMATION IS. UH, WELL, WE'RE WORKING WITH LEGAL NOW, SYDNEY LEGAL ON REVIEW OF SOME OF THESE ISSUES THAT WE'VE ALREADY TALKED ABOUT. UH, WE'VE BEEN WORKING WITH, UH, THE CONSULTANT DNV, UH, ON BENCHMARKING OUR PROGRAMS AND STRONG RECOMMENDATIONS COMING DIRECT TO BENCHMARK OUR CODE SAVINGS AGAINST THE CURRENT STATE CODE. UH, WE FEEL STRONGLY THAT THAT'S A, UH, A VALID RECOMMENDATION. WE'RE GOING TO HAVE TO LOOK AT HOW WE CLAIM SAVINGS ON CODE BASED OFF OF THAT RECOMMENDATION. SO IT REALLY WON'T IMPACT THEM THERE. UM, WE WILL TRY AND QUANTIFY THE IMPACT AS BEST WE CAN. IF YOU LOOK AT WHAT HAPPENED IN THE RECENT WINTER, WINTER STORM AND URI, UH, WE SAW SIGNIFICANTLY LESS IMPACT TO BOTH BUILDINGS AND RESIDENTS FOR RESIDENTS IN, IN HOMES, BUILT WITH NEWER CODES, WHERE THEY HAD FEWER PURE WATER ISSUES, THAT SORT OF THING. SO WE'LL DO OUR BEST TO DRAG QUANTIFY IT. I DON'T KNOW IF IT ANSWERED YOUR QUESTION OR NOT. YEAH. YES. I UNDERSTAND THAT AT ALL.
