AT LEAST I COULDN'T FIND IT IN THE VERSION OF THE DOCUMENT THAT I LOOKED AT. SO I'M NOT SURE IF THESE HAVE BEEN ADDRESSED, BUT I WANTED TO ASK YOU IF THEY HAVE BEEN IN, IF THEY HAVEN'T, I'D LIKE TO MAKE A RECOMMENDATION THAT WOULD INVOLVE, UM, RESPONDING TO SOME OF THE SPECIFIC CONCERNS THAT THEY ADDRESSED. UM, I COULDN'T FIND THE, UM, THE CHART THAT SHOWS THE FUND ALLOCATION, BUT IS THAT SOMETHING THAT YOU COULD COMMENT ON? I CAN, I THINK WHAT WOULD BE HELPFUL IS WE HAVE CREATED A DASHBOARD, UM, THAT WE ARE, UM, IT'S, IT IS UNDER CONSTRUCTION. WE HAVE DANIEL WORD WITH THE AUSTIN CODE DEPARTMENT. HI, GOOD EVENING. CAN EVERYBODY HEAR ME? OKAY. GOOD EVENING. COMMUNITY DEVELOPMENT COMMISSION MEMBERS. I AM DANIEL WORD. I'M AN ASSISTANT DIRECTOR WITH THE AUSTIN CODE DEPARTMENT. UM, MY PURPOSE TODAY IS TO PROVIDE YOU A BRIEFING ON THE HEALTH AND SAFETY PROPERTY DAMAGE RELATED TO WINTER STORM JURY. UM, WE'LL GIVE IT A MINUTE AS THE SLIDE DECK CATCHES UP AND THERE WE GO. UM, WE MOVED TO THE NEXT SLIDE. UH, SO AS YOU'RE AWARE, UM, THE CITY SHUT DOWN NON-ESSENTIAL OPERATIONS AS ROAD CONDITIONS BECAME UNSAFE DUE TO THE FREEZING WEATHER. UM, THAT STARTED FEBRUARY 15TH AND CONTINUED THROUGH FEBRUARY 19TH. UH, THE AUSTIN CODE DEPARTMENT DID HAVE A GROUP OF FIELD INSPECTORS ON STANDBY. UM, IN THE EVENT, THERE IS A CATASTROPHIC STRUCTURAL FAILURE SOMEWHERE THAT WE NEEDED TO RESPOND TO, UH, FORTUNATELY THAT WASN'T NECESSARY. BUT, UH, DURING THIS TIME THE CODE DEPARTMENT COLLABORATED AND DEVELOPED, UH, SERVICES, UH, TO DETERMINE PERMITTING PROTOCOLS FOR EMERGENCY REPAIRS THAT WOULD BE NECESSARY TO DO THEIR WINTER STORM. AND WE COORDINATE THE TIMELINES FOR OBTAINING SUCH PERMITS. UH, OUR IT GROUP ALSO WORKED WITH CTM TO PUSH THROUGH PROGRAMMING CHANGE AND AMANDA, WHICH IS OUR CASE DATABASE, UH, TO ALLOW THE DEPARTMENT TO TRACK WINTER STORM RELATED CASES. AND WE WORKED WITH OUR PARTNERS AT 3 1, 1, UH, TO CREATE SOME STANDARDIZED RESPONSES TO WINTER STORM RELATED COMPLAINTS. UH, NEXT SLIDE. OKAY. UM, AUSTIN CODE, UH, WE LAUNCHED OUR OPERATIONS ON SATURDAY, SATURDAY, FEBRUARY 20TH, UH, TO BEGIN THE PROCESS OF DRESSING, THE RESULTING BACKLOG OF COMPLAINTS, UH, THAT CAME INTO 3 1 1 DURING THE SHUTDOWN PERIOD, UH, DEPARTMENT LEADERSHIP MADE A STRATEGIC DECISION TO PRIORITIZE INSPECTIONS FOR COMPLAINTS THAT WERE CLASSIFIED INTERNALLY, EITHER AS COVID-19 COMPLAINTS, UM, OR AS WHAT WE CONSIDER PRIORITY TO, UM, WHICH INCLUDES COMPLAINTS THAT ARE RELATED TO OCCUPIED SUBSTANDARD CONDITIONS IS BE THINGS LIKE LACK OF HOT WATER OR NO WATER SERVICE AT ALL, NO HEAT AND OTHER TIME-SENSITIVE SITUATIONS THAT CAN HAVE AN IMMEDIATE IMPACT ON THE HEALTH AND SAFETY OF AN OCCUPANT OF A DWELLING. UM, ADDITIONALLY AUSTIN CODE PROVIDES STAFF TO ASSIST WITH THE IDENTIFICATION OF PROPERTIES THAT WERE LACKING ACCESS TO WATER. UM, AND THEN WE WERE ALSO INVOLVED IN THE SUBSEQUENT DISTRIBUTION OF DRINKING WATER TO THOSE PROPERTIES. UM, THERE WERE EFFECTED BY THE WATER OUTAGE OUTAGES THAT WERE OCCURRING THROUGHOUT THE CITY. UM, WE GENERALLY FOLLOWED OUR STANDARD POLICIES AND PRACTICES THAT WE HAVE ESTABLISHED FOR OUR CASE MANAGEMENT. UM, WE DID HOWEVER, TEMPORARILY DELAY ISSUANCE OF NOTICES OF VIOLATION, UH, TO TENANT OCCUPIED HOUSING. IF WE RECEIVED AN ACTION PLAN FROM THE LANDLORD WITHIN 48 HOURS OF OUR INITIAL INSPECTION, UH, FOR OWNER OCCUPIED HOUSING CODE INSPECTORS ADVISED HOMEOWNERS TO CONTACT THE DEVELOPMENT SERVICES DEPARTMENT TO SEEK EMERGENCY REPAIR PERMITS. AND WE ALSO PROVIDED A REFERENCE TO A WEBSITE THAT WAS SET UP, UM, WITH THE AIM TO ASSIST HOMEOWNERS AND FINDING ADDITIONAL INFORMATION RELATED TO PERMITTING REQUIREMENTS, UH, THINGS LIKE TREE REMOVAL AND OTHER AVAILABLE COMMUNITY RESOURCES, UH, FOR THE TENANT OCCUPIED PROPERTIES INSPECTIONS WERE PERFORMED. UH, TENANTS WERE ADVISED TO REACH OUT THROUGH THEIR LANDLORD TO REQUEST A SERVICE REPAIR ORDER. UM, CASES WERE NOT CLOSED UNTIL IT WAS DETERMINED. THE LANDLORD HAD CORRECTED VIOLATIONS, UH, FOR COMPLAINTS RELATED TO ACCUMULATIONS OF, YOU KNOW, BRUSH TREE LAMBS, [00:50:01] CONSTRUCTION DEBRIS, UM, OTHER MATERIALS THAT ARE PLACED AT THE CURB. UH, WE ADJUSTED COMPLIANCE TIMELINES, UH, DEPENDENT UPON AUSTIN RESOURCE RECOVERY, HIS ABILITY TO CONDUCT ADDITIONAL BRUSH AND BULK BULK PICKUPS. UM, NEXT SLIDE THIS IS A SNAPSHOT OF OUR AVAILABLE DATA RELATED WINTER STORM CASES. UH, AS YOU, YOU CAN SEE FROM THE CHART CASE VOLUME GENERALLY PEAKED IN THE LAST WEEK OF FEBRUARY AND FIRST WEEK OF MARCH, UM, AN NOV IS A NOTICE OF VIOLATION, UH, WHICH IS THE DEPARTMENT'S FORMAL NOTICE TO A PROPERTY OWNER THAT A VIOLATION HAS BEEN FOUND. UM, GENERALLY A CITATION IS NOT ISSUED UNTIL THE NOTICE OF VIOLATION HAS BEEN PROVIDED. THE TIMELINE FOR COMPLIANCE STATED IN THE NOTICE OF VIOLATION HAS BEEN EXCEEDED AND THE INSPECTOR IS NOT SEEING PROGRESS TOWARDS COMPLIANCE. UH, NEXT SLIDE UH, SO THIS CHART ABOVE, UH, THIS REPRESENTS, UH, THE SECTION OF THE INTERNATIONAL PROPERTY MAINTENANCE CODE THAT THE CODE INSPECTOR NOTED IN THE NOTICE OF VIOLATION. UM, AS YOU CAN SEE THE BULK OF THE WINTER STORM RELATED CASES INVOLVED DAMAGE TO INTERIOR SURFACES, UM, THAT'S THINGS LIKE DAMAGED DRYWALL, PEELING, PAINT, UM, WATER HEATING, WATER SERVICE ISSUES, UM, HVAC EQUIPMENT, AND THEN WORK WITHOUT PERMIT. UM, NEXT SLIDE. SO THIS IS A HEAT MAP THAT WAS GENERATED BY OUR IT DIVISION. UM, YOU CAN SEE THE CONCENTRATION OF CASES IN THE URBAN CORE OF THE CITY. UH, IN GENERAL, WE HAVE OBSERVED THAT OLDER STRUCTURE SUFFERED MORE DAMAGE, UM, LIKELY DUE TO AGED INFRASTRUCTURE. HOWEVER, THAT SAID, WE HAVE SEEN SITUATIONS WHERE SIMILARLY AGED PROPERTIES IN CLOSE PROXIMITY, EACH OTHER HAVE EXPERIENCED DIFFERENT LEVELS OF DAMAGE. UM, WE'VE ALSO OBSERVED THE BUILDINGS WITH FIRE SPRINKLER LINES WERE SUSCEPTIBLE TO BURSTING, UM, LIKELY FROM THE EXPOSURE TO PROLONGED PERIODS OF COLD WEATHER. UM, NEXT SLIDE, UH, THIS MAP IN SHARP, UH, SHOWS A BREAKDOWN OF CASES BASED ON COUNCIL DISTRICT, UM, COMPLAINTS RECEIVED, UM, AND VIOLATIONS FOUND ARE MOST PROMINENT IN DISTRICT FOUR. UM, BUT ALL DISTRICTS WERE IMPACTED IN SOME WAY. NEXT SLIDE. UM, SO THE ALSO CO DEPARTMENT, YOU KNOW, TO KIND OF SUMMARIZE A AUSTIN CODE DEPARTMENT HANDLED THE INFLUX OF CALLS BY PRIORITIZING COVID-19 AND WINTER STORM RELATED ISSUES, UH, THAT PRESENTED, UH, ISSUES FOR OCCUPIED HOUSING WITH SUBSTANDARD CONDITIONS. UH, WE DID DELAY NOTICE OF VIOLATIONS TO OWNERS THAT PROVIDED ACTION PLANS WITHIN 48 HOURS. UM, IT'S IMPORTANT TO NOTE THE AVAILABILITY OF BOTH PARTS AND LABOR WAS SEVERELY CONSTRAINED, UM, AT THE TIME. SO DELAYING THOSE NOTICES OF VIOLATIONS WAS A WAY TO PROVIDE SOME REASONABLE FLEXIBILITY TO PROPERTY OWNERS THAT ACTED IN GOOD FAITH TO CORRECT ISSUES CAUSED BY THE WINTER STORM, UH, OWNERS THAT FAILED TO COOPERATE. WHEREAS YOU'D NOTICED THIS VIOLATION, UM, CASES WHERE PROGRESS IS NOT BEING MADE IN A TIMELY MANNER ARE BEING EXPEDITED TO OUR LEGAL ENFORCEMENT AVENUES. UM, WE'VE ALSO DEVELOPED AN ENHANCED OUR ABILITY TO PERFORM REMOTE INSPECTIONS. UM, THIS IS IMPORTANT WHEN TENANTS ARE UNCOMFORTABLE PROVIDING ACCESS TO THE INTERIOR OF THEIR DWELLING, UH, PARTICULARLY IN THE TIME OF THE PANDEMIC, UM, WHICH IS STILL ONGOING. OF COURSE. UH, ADDITIONALLY, OUR T GROUP HAS CREATED A PUBLIC FACING DASHBOARD THAT HIGHLIGHTS ACTIVITY AT WINTER STORM AFFECTED PROPERTIES. UH, NEXT SLIDE. UM, OKAY. WE'VE ALSO TAKEN A PROACTIVE APPROACH, UH, TO MONITORING CONDITIONS AT OUR RENTAL PROPERTIES THAT ARE PART OF THE REPEAT OFFENDER PROGRAM. UM, WE REVIEW EACH PROPERTY IN THAT PROGRAM EVERY 30 DAYS, UH, TO IDENTIFY ANY THAT MIGHT WARRANT A SUSPENSION FROM THE ABILITY TO RENT VACANT UNITS, UM, WHICH IS ONE OF THE ELEMENTS OF THE REPEAT OFFENDER PROGRAM. UM, OUR IT GROUP HAS ALSO MADE SOME ENHANCEMENTS TO THAT QUERY, UM, THAT WE RUN TO HELP ENSURE THAT WE, UH, IDENTIFY PROPERTIES THAT NEED TO BE ADDED INTO THE PROGRAM. AND WE RUN THAT QUERY EVERY QUARTER. UM, WE'VE ALSO ADDED OUR INTERIOR, UH, PERIODIC INSPECTION CALENDAR TO THE ROP WEBSITE, UH, TO ENHANCE TRANSPARENCY AND ALSO PROVIDE SOME ADDITIONAL NOTIFICATION TO TENANTS, UM, OF OUR ACTIVITIES AT THEIR PROPERTIES. UM, AND AS WE DID WITH ALL RENTAL PROPERTY RE REQUESTED ACTION PLANS WITHIN 48 HOURS OF VALIDATING A VIOLATION, UM, AND WE ARE ESCALATING CASES TO OUR LEGAL AVENUES WHEN NEEDED, UM, FURTHER, WE HAVE STAYED IN CONSTANT CONTACT WITH KEY STAKEHOLDERS, UM, AND COLLABORATE WITH THEM, [00:55:01] UH, TO ENHANCE OUR COMMUNICATION INSPECTION EFFORTS. NEXT SLIDE, UH, FOR LEGAL ESCALATION IN THE AUSTIN CODE DEPARTMENT GENERALLY HAS THREE VENUES WITH WHICH WE CAN ESCALATE CASES, UH, WHEN COMPLIANCE IS NOT BEING ACHIEVED VOLUNTARILY. UH, WE HAVE A THIRD-PARTY ADMINISTRATIVE HEARING PROCESS. UH, WE HAVE THE BUILDING AND STANDARDS COMMISSION, WHICH IS A COUNCIL APPOINTED GROUP OF CITIZENS, UM, THAT HAVE THE ABILITY TO ISSUE ORDERS TO REPAIR, UM, TO DEMOLISH OR, UH, VACATE. UM, AND THEN WE ALSO HAVE THE MEN'S MUNICIPAL COURT, UM, SPECIFICALLY TO WINTER STORM YURI. THE AUSTIN CODE DEPARTMENT CONDUCTED A SPECIAL CALLED MEETING OF THE BUILDING STANDARDS COMMISSION ON MAY 13TH. UM, TWO PROPERTIES THAT, THAT HEARING REISSUED REPAIR ORDERS. UM, THE THIRD PROPERTY WAS GIVEN A REPAIR ORDER AT THE MAY 26TH REGULAR MEETING, AND THEN A FOURTH PROPERTY WAS GIVEN A REPAIR ORDER AT THE JUNE 23RD REGULAR MEETING. UM, NEXT SLIDE, OKAY. THE DEPARTMENT WILL CONTINUE TO MONITOR CONDITIONS, UH, PROPERTIES AFFECTED BY WINTER STORM URI. UM, AND WE WILL ESCALATE CASES AS NEEDED TO OUR LEGAL PROCESSES WHEN WE'RE NOT SEEING PROGRESS IN RESOLVING ISSUES. UM, IN ADDITION, WE'RE ALSO PARTNERING WITH AUSTIN PUBLIC HEALTH, HOUSING AND PLANNING. UM, ONCE THAT COMPLIANCE TIME TIMELINE IN THAT ORDER HAS EXPIRED, UH, AND THAT CASE HAS NOT COME INTO COMPLIANCE. UM, THE PENALTY SET OUT IN THE ORDER, WHICH ARE ALSO ESTABLISHED BY THE COMMISSION, UM, BEGIN TO ACCRUE, UM, SOMETHING IS UNIQUE ABOUT THE BUILDING STANDARDS COMMISSION PENALTIES IS THAT, UM, WHEREAS IF WE TAKE IT, SOMETHING'S THAT A THIRD PARTY ADMINISTRATIVE HEARING WILL GO TO MUNICIPAL COURT, IT'S A, ONE-TIME FINE AND ACTION, UM, BUILDING AND STANDARDS COMMISSION, ISN'T A COOL PENALTY. SO, UH, FOR EXAMPLE, THEY MAY ASSESS A PENALTY OF A THOUSAND DOLLARS PER WEEK PER VIOLATION. THE SOUTH CENTRAL WATERFRONT IS THE AREA FROM, UH, WHERE THE LANDRY'S RESTAURANT. I DON'T KNOW IF IT'S STILL OPEN THAT THEY SEAFOOD RESTAURANT ON RIVERSIDE, JUST WEST OF AND HEADING WEST ALONG RIVERSIDE, ALL THE WAY TO CONGRESS AVENUE AND FROM THERE, AND A LITTLE BIT BEHIND THERE TO RIVER OR THE LAKE PLUS ONE TEXAS CENTER. AND THE CITY IS IDENTIFIED THIS AS A PLACE THAT CAN BE REDEVELOPED, THAT IF IT'S A PLAN TO DEVELOPMENT, THAT WE CAN GET MORE COORDINATION, MORE BENEFIT OUT OF IT THAN IF DEVELOPERS JUST GO IN ONE BY ONE WITH A BUNCH OF INDIVIDUAL PROJECTS. THERE'S AN EXPECTATION THAT IT'LL BE STATE-OF-THE-ART EVERYTHING THAT IT'LL HAVE THE LATEST AND STORM DRAINAGE BOLDEN CREEK RUNS THROUGH THE AREA AND DOES FLOOD SOME OF THE APARTMENTS IN THE AREA. SO THERE'S A NEED FOR BETTER DRAINAGE, BUT IT COULD BE TRAINEES NOT WHERE WE JUST PUT THE CREEK IN A CULVERT AND TONGUE COVERED WITH CONCRETE, BUT WE LEAVE IT EXPOSED. SO YOU CAN SEE THE CREEK AND WE HAVE MORE VEGETATION TO ABSORB THE STORMWATER, UM, LOTS OF OPEN SPACE, LOTS OF PUBLIC USE AREAS AND 20% AFFORDABLE HOUSING. AND I, I, I HEAR PROVISIONS LAYING OUT SOME OF THE OTHER STATE OF THE ART COMPONENTS, BUT THE HOUSING IS SOMETHING THAT, UM, IN THE TIME I'VE BEEN ON THIS BOARD STRUGGLED WITH, BECAUSE IT ALWAYS SEEMS LIKE IT'S JUST AROUND, LIKE THE NEXT MEETING, WE'RE GOING TO GET THE PLAN. THAT'S GOING TO MAKE SURE WE GET THAT 20% OR ANY PERCENT OF AFFORDABLE HOUSING. BEFORE I JOINED THE DECISION WAS MADE TO EXPAND TO THE AREA FROM THE SOUTH CENTRAL WATERFRONT TO GO ALL THE WAY TO BEN WHITE. AND THERE'S A LOT OF NICE AREAS AND, UH, 7, 8, 704 THAT I THINK A LOT OF PEOPLE WOULD BE HAPPY LIVING, BUT THERE'S A BIG DIFFERENCE BETWEEN LIVING ACROSS FROM BEN WHITE AND LIVING ACROSS FROM LAKE LADYBIRD. SO I SEE IT AS A CHALLENGE TO GET AS MUCH OF THAT HOUSING, THAT COMMITMENT INTO THE SOUTH CENTRAL WATERFRONT AREA, AS WE CAN. UM, PART OF THE, PART OF THE KEY TO THAT IS CONVERTING THE PARKING LOT IN FRONT OF ONE TEXAS CENTER INTO, UM, MULTIFAMILY COMPLEX AND IT'S INTENDED AS FAMILY-ORIENTED HOUSING. UM, SO THAT WOULD COVER A CONSIDERABLE AMOUNT OF THE COMMITMENT TO AFFORDABLE HOUSING, BUT THE REST OF IT NEEDS TO COME OUT OF THE PROPERTY. THAT'S ALL ALONG THROUGH THERE. AND SOME OF IT'S ALREADY GOT COMMITMENTS THAT ARE VERY LOW, LIKE FOUR AND A HALF PERCENT OF THE UNITS ARE SUPPOSED TO BE AFFORDABLE. SO IT'S A, IT'S A REALLY TOUGH CHALLENGE. THERE'S A FORMULA THAT CONSULTANTS THAT DID THE CODE NEXT, OR LAND DEVELOPMENT CODE FORMULAS FOR HOW MUCH THE PERCENTAGES OF AFFORDABLE HOUSING WOULD BE. ALSO DID PROJECTIONS ON THE SET ASIDES THE PERCENTS OF UNITS FROM EACH DEVELOPMENT THAT WOULD NEED TO COME OUT. AND UNLIKE WHERE WE WERE ABLE THE PUBLIC WAS ABLE TO ACCESS THOSE FORMULAS FOR THE LAND CODE PROCESS, THESE FORMULAS ARE NOT AVAILABLE TO THE PUBLIC AND OUR CHAIR CAN TESTIFY TO THE AMOUNT OF TIME. I SPENT UNDERSTANDING THE LAND DEVELOPMENT CODE FORMULAS. I HAVE PAPER AND WE WENT TO COFFEE ONE MORNING AND I UNROLLED IT AND SHOWED HIM WHERE THE, HOW THE FORMULA WAS WORKED. BUT I HAVEN'T BEEN ABLE TO GET HOLD OF THOSE FORMULAS TO SEE IF THERE'S ANYTHING IN THERE ABOUT THAT WOULD HELP US MAKE SURE WE GET THAT AFFORDABLE HOUSING. SO IT IS IMPORTANT THAT WE FIGURED OUT THE AFFORDABLE HOUSING PIECE SOON. YES. UH HUH. MR. DELGADO? SO THERE ARE NEGOTIATIONS GOING ON OVER ZONING REZONING TO FIT WHAT THAT DEVELOPER WANTS TO DO WITH THE PROPERTY. AND, AND IT WOULD HELP IF THIS PLAN HAD BEEN MORE IN PLACE BEFORE THAT DEVELOPER CAME ALONG. BUT YEAH, THERE'S A LOT OF TIMING ISSUES GOING BOTH WAYS. THE OTHER PROPERTIES ARE, ARE OWNED BY, UH, PEOPLE WHO'VE HELD THEM FOR A LONG TIME. SOME OF THE STATE OFFICE BUILDINGS ARE ON PROPERTIES THAT HAVE JUST BEEN HELD FOR A LONG TIME FOR AN ASSESSMENT.
