IT, I HAD MADE AN ANNOUNCEMENT VIA EMAIL AND SOCIAL MEDIA, UH, LAST WEEK, BUT I WANTED TO COME HERE AND IN-PERSON BOTH VIRTUALLY ANNOUNCE IT AND THEN TURN IT OVER TO KATIE.
THANK YOU SO MUCH DIRECTOR MIRALIS I, UM, YOU KNOW, IT'S A LITTLE BITTERSWEET NEWS, UH, NOT BEING A COMMISSIONER ANYMORE, BUT, UH, IT CERTAINLY MADE EASIER KNOWING THAT I GET TO CONTINUE TO WORK WITH ALL OF YOU.
OH, HOT MORE, UH, IN THE COMING YEARS.
SO I COULDN'T BE MORE EXCITED.

UH, BUT I DID JUST WANT TO TAKE A CHANCE TO SAY HOW MUCH I APPRECIATED WORKING WITH EACH OF YOU, THE GOOD DIALOGUE WE'VE HAD OVER THE YEARS, THE TOUGH DISCUSSIONS WE'VE HAD, UH, AND JUST THE HUMAN CONNECTION WE'VE HAD WITH ONE ANOTHER AROUND KIND OF THESE CORE VALUES ABOUT, YOU KNOW, UH, REALLY JUST WANTING TO SEE, UH, ENVIRONMENTAL GOALS, UH, IN AUSTIN, CARRY OUT IN A WAY THAT, THAT MAKES US A BETTER CITY FOR EVERYONE TO LIVE IN AND A BETTER CITY FOR, UH, ALL ENVIRONMENTAL SYSTEMS. UM, SO I'VE APPRECIATED THAT SO MUCH.
UM, AND I DID JUST WANT TO ALSO SAY, UH, COMMISSIONER, UM, GUERRERO, MADAM CHAIR, UH, YOU'VE BEEN A HUGE MENTOR TO ME OVER THE LAST FEW YEARS, AND I HAVE TO THANK YOU WHOLE HEARTEDLY FOR ALL THE SUPPORT YOU'VE GIVEN ME.

I'M JUST GOING TO SEE YOU IN A LITTLE BIT OF A DIFFERENT CAPACITY.
SO, UH, COULDN'T BE MORE EXCITED AND THANKS FOR GIVING ME SOME SPACE TO SAY THIS.
WE'RE EXCITED TO WORK WITH YOU TOO.
THANK YOU SO MUCH FOR LETTING US KNOW, HAVE A GOOD EVENING.
UM, THIS IS THE REGULAR MEETING OF THE ENVIRONMENTAL COMMISSION, NOVEMBER 3RD, 2021 AT 6:00 PM.
AUSTIN CITY HALL, CITY COUNCIL CHAMBERS ROOM 1 0 1, 3 0 1 WEST SECOND STREET, AUSTIN, TEXAS 7 8, 7 0 2.
UH, THIS IS GOING TO BE ROLL CALL.
COMMISSIONER SCOTT HERE, COMMISSIONER AXLER YOU'RE ON THE SCREEN COMMISSION OF BRISTOL HERE.
UH, WE'VE CALLED THE MEETING TO ORDER ORDER.
[CITIZEN COMMUNICATION: GENERAL]
IS CITIZENS COMMUNICATION, GENERAL SPEAKERS WHO HAVE SIGNED UP TO SPEAK PRIOR TO THE MEETING ARE BEING CALLED TO ORDER YOUR SEAT THREE MINUTES ALLOTMENT TO DISCUSS TOPICS, NOT POSTED ON THE AGENDA.AND AS WE KNOW, WE DO NOT DO ANY BACK AND FORTH.
WE SEEM TO HAVE A LOT OF STUDENTS TODAY FROM THE UNIVERSITY OF TEXAS WITH US, AND WE'RE CURIOUS ABOUT WHAT THEY WILL SPEAK ON.
AND WE'D LIKE TO KNOW WHAT CLASS THIS IS THAT YOU ARE COMING FROM.
IF YOU DON'T MIND LETTING US KNOW WHEN YOU DO COME UP HERE TO MAKE YOUR THREE MINUTES.
SO FIRST OFF WE'VE GOT REESE, UH, SING.
[00:05:04]
IF YOU WOULDN'T MIND, JUST STATE YOUR NAME, UH, WHEN YOU GET TO THE MIC.IS THAT CLEAR? UM, SO Y'ALL START OFF.
WE ARE IN A CLASS, UH, URBAN STUDIES, INTERNSHIP AND SERVICE LEARNING WITH GREG ANDERSON.
AND WE WERE TASKED WITH COMING TO A, UM, COMMISSION OR BOARD SOMEWHERE IN THE CITY AND DOING PUBLIC SPEAKING TO KIND OF PRACTICE FOR WHAT IT MAY BE LIKE IN REAL LIFE.
UM, SO MY NAME IS
I THANK YOU FOR TAKING TIME TO LISTEN TO ME.
MY NAME IS REESE LOOSENING, AND I'M A SENIOR AT THE UNIVERSITY OF TEXAS STUDYING URBAN STUDIES THROUGHOUT THIS SEMESTER.
WE'VE BEEN CHALLENGED TO IDENTIFY ISSUES IN OUR COMMUNITY.
AND ALTHOUGH I GREW UP IN DALLAS, AUSTIN IS THE CITY THAT I HAVE GROWN TO LOVE AND PLAN TO LIVE IN FOR THE REST OF MY LIFE.
MY TIME IN NORTH CAMPUS HAS BEEN VERY EYE-OPENING.
I GREW UP IN AN AREA IN DALLAS THAT PROVIDED MANY GREEN SPACES AND PARKS TO GO TO.
THUS THESE PLACES HAVE BECOME A BIG PART OF MY LIFE BECAUSE OF THIS.
I HAVE GROWN SPEND A LOT OF TIME AT ADAM'S HEMP HILL NEIGHBORHOOD PARK, NEAR MY HOUSE IN AUSTIN.
THIS IS A VERY GOOD SIZED PARK FOR MY DOG AND MYSELF.
THE ONE THING I WOULD LIKE TO BRING TO THE ATTENTION OF THIS COUNCIL IS THE EQUIPMENT THERE.
THE BASEBALL BACKSTOP IS OLD RUSTED AND NOT SAFE TO PLAY AROUND FOR KIDS OR ANIMALS.
THE BRIDGE AS WELL COMING FROM THE EAST SIDE IS NOT STABLE AND VERY WOBBLY.
I'M HERE TODAY TO ASK YOU THIS COUNCIL CAN START TO THINK ABOUT CLEANING UP SOME OF THESE SMALLER NUISANCES.
THESE ARE THINGS THAT HELP OUR COMMUNITY STAY ACTIVE, HAPPY, AND HEALTHY.
I BELIEVE THAT THIS WOULD BE VERY, VERY BENEFICIAL TO EVERYONE IN THE AREA, HUMANS AND DOGS INCLUDED.
THANK YOU VERY MUCH FOR TAKING TIME TO LISTEN TO ME.
AND I HOPE YOU ALL HAVE A GREAT REST OF YOUR WEEK.
UM, NEXT UP, WE'VE GOT FRANK FLETCHER.
HI, MY NAME IS FRANK FLETCHER AND I AM IN THE SAME CLASS.
IT'S AROUND 360 WITH, UH, GREG ANDERSON AS A PROFESSOR.
HELLO, ENVIRONMENTAL COMMISSION OF THE CITY OF AUSTIN.
OUR NATIONAL ENVIRONMENT IS HURTING MORE AND MORE EACH DAY, AND IT DOESN'T SEEM TO BE A FEASIBLE SOLUTION INSIDE.
THAT IS WHY I AM HERE TO SPEAK ON WHY IT'S SO IMPORTANT FOR US TO EDUCATE THE YOUTH, THE YOUTH OF AUSTIN, TEXAS, ABOUT THE IMPORTANCE OF PROTECTING OUR ENVIRONMENT AND LEADING AS GREEN OF A LIFE AS WE POSSIBLY CAN.
CLIMATE CHANGE HAS REACHED LEVELS OF UNCERTAINTY ABOUT OUR FUTURE, AND THERE NEEDS TO BE A CHANGE IN A CHANGE.
IF WE PLAN TO DO ANYTHING ABOUT IT, WE ALSO HAVE TO THINK ABOUT OUR CHILDREN IN THE FUTURE GENERATIONS THAT WE WILL INEVITABLY PASS ON THIS PLANET TO THE POPULATION OF PEOPLE BETWEEN THE AGES OF 10 AND 24 IS ABOUT 1.8 BILLION PEOPLE.
THAT IS THE LARGEST GENERATION OF YOUTH IN HISTORY.
I BELIEVE IF WE START TO PROPERLY EDUCATE OUR YOUTH, STARTING AT A YOUNG AGE ABOUT THE EFFECTS OF CLIMATE CHANGE ON OUR ENVIRONMENT, THAT WE CAN TURN AROUND THIS PATTERN FOR A BETTER WORLD.
IN THE CITY OF AUSTIN, WE CAN HELP LEAD THE CHARGE ON EDUCATING THE USE ON THE IMPORTANCE OF CLIMATE CHANGE.
AND AS WE'VE SEEN IN MORE RECENT YEARS IS THAT THE YOUTH ARE NOT ONLY THE VICTIMS OF CLIMATE CHANGE, BUT ARE ALSO THE LOUDEST AND MOST VALUABLE CONTRIBUTORS TO CLIMATE CHANGE GIVEN THEIR EXTENDED PERIOD OF TIME ON THIS EARTH COMPARED TO OLDER GENERATIONS, ONE WAY I THINK WE CAN START TO GIVE YOUNG PEOPLE A STAGE FOR THEIR VOICE TO BE HEARD IS TO PROVIDE OPPORTUNITIES FOR THEM TO WORK WITH LEADERS IN OUR COMMUNITIES ON WAYS THEY THINK THAT THEY CAN COMBAT CLIMATE CHANGE AND TO PROVIDE THEM WITH INFORMATION ON SIMPLE THINGS THEY CAN DO TO DECREASE THEIR CARBON FOOTPRINT.
IF WE DO THIS, I BELIEVE THAT WE WILL NOT ONLY SEE A DECREASE IN OUR CITY'S CARBON FOOTPRINT, BUT WE WILL FUEL OUR YOUNGER GENERATIONS PASSION FOR FIGHTING CLIMATE CHANGE EVEN MORE BY PROVIDING THEM A VOICE ON THE ISSUE.
THANK YOU ALL, REALLY FOR GIVING US A PLATFORM HERE TO SPEAK.
UM, I'M ALSO IN THAT HERB 360 CLASS TAUGHT BY A PROFESSOR, GREG ANDERSON.
UM, YOU GUESSED IT CLIMATE CHANGE OF IT'S A REALLY BIG TOPIC AND THERE'S A LOT OF BIG POLLUTERS AND I LOVE HEARING ABOUT ALL OF THEM AND HOW WE CAN KIND OF CURB THAT.
BUT, UM, I KIND OF WANTED TO PUT AN EMPHASIS ON SMALLER THINGS THAT EVERYDAY PEOPLE LIKE THIS EARLY BALDING GENTLEMAN HERE, UM, CAN PARTAKE IN.
AND, UM, COMPOSTING SEEMS TO BE A REALLY EASY WAY TO DO THAT.
I MEAN, FUN FACT THAT I LEARNED TODAY WAS THAT IT TAKES 25 YEARS FOR A PIECE OF LETTUCE TO BIODEGRADE.
[00:10:01]
SO THAT'S JUST ON A LARGE SCALE.IT'S A LOT OF PIECES OF LETTUCE, BUT I'M BASICALLY JUST KIND OF ASKING THE COMMISSION TO MAYBE PUT TOGETHER SOME SORT OF PACKAGE TO INFORM PEOPLE ON HOW EASY IT IS TO JUST PUT YOUR OTHER EXTRA FOOD IN A LITTLE AREA AND KIND OF DO YOUR LITTLE PART BECAUSE I MEAN, I ALWAYS, WE ALL SEE ABOUT THE HUGE POLLUTERS IN THIS EARTH, BUT WE KIND OF DON'T REALIZE WHAT WE DO TO IT.
YOU KNOW, IT'S ALWAYS THE OTHER GUYS.
SO, UM, YEAH, THAT'S ABOUT IT.
JUST SOME SORT OF PROGRAMMING, INFORMED PEOPLE, COLLEGE STUDENTS WHO JUST THROW THEIR FOOD ON THE GROUND.
UM, AND YEAH, THANK YOU FOR YOUR TIME.
AND WE'VE NEXT UP IS WILLIAM DELLINGER.
MY NAME IS WILLIAM DILLINGER AND I'M ALSO CURRENTLY AN URBAN STUDIES MAJOR AT THE UNIVERSITY OF TEXAS.
UH, WE UNDERSTAND THAT THE CITY OF AUSTIN HAS ALREADY BUILT VERY WALKABLE.
HOWEVER, I WOULD JUST ASK THAT THIS COUNCIL FURTHER ENCOURAGES AND EDUCATES THE CITY OF CITIZENS OF AUSTIN TO TRANSITION TO THIS LIFESTYLE THROUGH THE USE OF THIS TRANSITION.
WE CAN MINIMIZE OUR AIR POLLUTION AND NOISE POLLUTION WHILE AT THE SAME TIME TO CREATE, DECREASE OUR GREENHOUSE GAS EMISSIONS BY PUTTING LESS CARS ON THE ROAD, FURTHERMORE, BECOMING A MORE WALKABLE CITY WOULD IMPROVE THE HEALTH AND OVERALL WELLBEING OF OUR CITIZENS.
AND THANK YOU GUYS FOR TAKING THE TIME TO HEAR MY THOUGHTS AND FOR YOUR CONSIDERATION.
UM, AND I DON'T KNOW IF GABRIELLA, UM, MON SOUTH IS SPEAKING ON A TOPIC OR JUST IN GENERAL? UM, YEAH, I JUST DIDN'T KNOW BECAUSE IT SAID TO SPEAK ON A TOPIC THAT'S ON THE AGENDA, BUT I DON'T, IT'S NOT ON THE AGENDA.
THEN JUST RIGHT NOW IS YOUR TIME YOU'RE IN THE RIGHT TOWN.
UM, MY NAME'S GABRIELLE AMMAN SALVA.
I'M ALSO IN THAT COURSE, UM, WITH GREG ANDERSON, UH, BUT I'M ALSO TAKING A COURSE THIS SEMESTER TITLED HUMAN HEALTH AND THE ENVIRONMENT.
AND I JUST KIND OF WANTED TO SPEAK ABOUT A DOCUMENTARY THAT I RECENTLY WATCHED, UH, CALLED PLASTIC WARS, UM, THE FILM CENTERS AROUND PLASTIC POLLUTION AND HOW THE INDUSTRY SET IN PLACE RECYCLING PROGRAMS IN ORDER TO INCREASE CONSUMER PLASTIC SUPPORT AND KEEP PLASTICS IN THE MARKETPLACE.
GLOBAL PLASTIC PRODUCTION IS EXPECTED TO TRIPLE BY THE YEAR 2050, WHILE THE SMITH OF RECYCLING BEING A SOLUTION, THAT'LL SAVE US ALL, WORKED IN SHIFTING THE BLAME TOWARDS CONSUMERS IN THE EIGHTIES AND NINETIES, THE DOCUMENTARY STATES, HOW THIS PROBLEM CAN NO LONGER BE DELAYED FOR ANOTHER 20 OR 30 YEARS.
PLASTIC BEGAN TO BE USED WIDELY IN AMERICA'S POST-WAR BOOM, DUE TO ITS EFFICIENT QUALITIES LIKE ITS LIGHTWEIGHT VARIABILITY, JURY DURABILITY.
AND THE FACT THAT MORE CAN BE DONE WITH LITTLE MATERIAL IN THE 1970S, AMERICAN CITIZENS HAD THE ENVIRONMENTAL AWAKENING.
THE ENACTMENT OF EARTH DAY SHOWED THAT PEOPLE WERE WAKING UP TO THE FACT THAT THE EARTH IS FINITE.
THIS LED TO THE PLASTIC INDUSTRY, SHIFTING THE BLAME ON CONSUMER'S ROLE IN THE PROBLEM BY INVESTING LARGE AMOUNTS OF MONEY INTO ADVERTISEMENTS, PUSHING FOR RECYCLING.
HOWEVER, THE FILM SHOWS THAT THERE WAS NEVER ANY GENUINE BELIEF ON THE END.
TREE'S PART THAT RECYCLING WOULD WORK IN, UM, IN ANY SIGNIFICANT WAY.
UH, AND IT WAS JUST USED AS A MARKETING TACTIC TO IMPROVE THE IMAGE OF PLASTIC MATERIALS.
THEY WERE SELLING THE DOCUMENTARY SHARES THIS STATISTIC THAT NO MORE THAN AN ESTIMATED 10% OF PLASTIC HAVE, HAS EVER BEEN RECYCLED.
UH, IT IS ESTIMATED THAT 60% OF PLASTIC WASTE IN THE OCEANS COME FROM ASIA.
HOWEVER, IN THE DOCUMENTARY, MOST OF THE PLASTIC WASTE FROM THESE DUMPING GROUNDS COME FROM THE UNITED STATES WHILE THERE'S A GROWING EFFORT TOWARD FINDING A SOLUTION THROUGH THE INCREASING INCREASING PLASTIC BANDS AND PLASTIC FEES BEING IMPLEMENTED AROUND THE WORLD.
ENVIRONMENTAL IMPACT, THE PRODUCTION OF PLASTIC HAS, IS STILL NOT BEING ADDRESSED NOR ACTED AGAINST WITH THE OIL AND GAS INDUSTRIES.
INCREASINGLY GETTING BACK INTO THE CORNER BY ENVIRONMENTAL BACKLASH, THEY HAVE RESORTED TO PLASTIC PRODUCTION AS THEIR BACKUP PLAN.
THIS PROBLEM IS ROOTED IN INDUSTRIES THAT CONTINUE SHIFTING THE PUBLIC EYE INTO THE CONSUMER'S ROLE.
WE ARE RUNNING OUT OF TIME TO CONTINUE THIS BLAME SHIFTING GAME.
SO I JUST ASKED THE COUNCIL TO PERHAPS, UM, SHED MORE LIGHT ON THIS PLASTIC PROBLEM.
AND I BELIEVE THAT'S ALL THE GENERAL CITIZEN COMMUNICATIONS,
[1. APPROVAL OF MINUTES AND ACTION]
THE OCTOBER 20TH, 21 AND VARO MENTAL COMMISSIONERS, REGULAR MEETING.DO WE HAVE AN APPROVAL OF THE MINUTES? IS THERE A MOTION TO APPROVE SECOND
[00:15:01]
MOTION TO APPROVE SECOND BY THANK YOU SO MUCH.UH, COMMISSIONER SCOTT, UH, ANY OTHER FURTHER DISCUSSION EDITS CHANGES ALL IN FAVOR, SAY AYE.
[2.a. Name: Park 183 Buildings 6 & 7, SP-2021-0072C Applicant: Nick Brown, P.E., LDC Location: 4201 W Parmer Lane, Suite C – 100, Austin, Texas, 78727 Council District: District 2 Staff: Tunde Daramola, Environmental Review Specialist Senior, Development Services Department 2 Watershed: Onion Creek Watershed, Suburban, Desired Development Zone Request: Variance request is as follows: 1. Request to vary from 25-8-342 to allow fill over 4 feet up to 17 feet. Staff Recommendation: Staff recommends this variance with conditions. (30 minutes)]
TO A PUBLIC HEARING.WE HAVE PARK 1 8, 3 BUILDING SIX AND SEVEN S P DASH 2021 DASH OH OH 72.
MR. BROWN LOCATION IS AT 42 0 1 WEST PALMER LANE, SUITE C DASH 100 AUSTIN, TEXAS 7 8 7 2 7.
DISTRICTS TO STAFF IS HERE TO PRESENT.
YES, MA'AM UH, GOOD EVENING COMMISSIONERS.
I'M AN ENVIRONMENTAL REVIEW SPECIALIST WITH THE DEVELOPMENT SERVICES DEPARTMENT.
AND, UM, TODAY I WILL BE PRESENTING AN APPLICATION FOR A VARIANCE FROM THE LAND DEVELOPMENT CODE 25 83 42 FEAR REQUIREMENTS, UH, WHICH RECAPITULATES FEEL ON A TRACT OF LAND THAT MAY NOT EXCEED FOUR FEET OF DEPTH ON CERTAIN DEVELOPMENT.
SO I'M HERE PRETTY MUCH TO PRESENT AN APPLICATION FOR A VARIANCE FROM THE LAND DEVELOPMENT CODE 25 8 3 42 FUEL REQUIREMENTS, WHICH RECAPITULATES FIELD ON A TRACT OF LAND THAT MAY NOT EXCEED FOUR FEET OF DEPTH ON CERTAIN DEVELOPMENTS AND WATERSHEDS.
UH, THIS PROPOSED CONSTRUCTION THAT I'M GOING TO TALK ABOUT TODAY, UPLANDS TO FALL UNDER THE PURVIEW OF FUEL EXITING FOUR FEET OF DEPTH.
UH, AND WITH THAT BEING SAID, I PRESENT TO YOU PARK QUANTITY THREE, BUILDING SIX AND SEVEN, UH, LOOK AND SAID AT 4,800 DISTRIBUTION DRIVE AND 79 ON GRID INDUSTRY WAY, UH, WITH SITE PLAN NUMBER S P 2 0 2 1 0 0 7 2 C.
I'M GOING TO TALK ABOUT THE PROPERTY DATA.
I'M GOING TO GIVE US A LITTLE BIT OF, UH, OF THIS, OF THE BACKGROUND, UH, THE EXISTING CONDITIONS, UH, THE TYPOGRAPHY, THE VARIANCE REQUEST ITSELF, THE PROPOSED SITE PLAN AND GRADING CONDITIONS, WHICH SUMMARIZES THE, UH, CAUGHT ON FUEL EXHIBIT, THE RETAINING STRUCTURES AND THE VARIANCE RECOMMENDATION.
THIS SITE IS LOCATED WITHIN THE ONION CREEK WATERSHED CLASSIFIED AS SUBURBAN, UH, IT'S IN THE DESERT DEVELOPMENT ZONE.
UH, IT'S UH, IT'S IN THE CITY OF AUSTIN, FULL PURPOSE JURISDICTION.
IT IS NOT LOCATED ABOUT THE EDWARDS AQUIFER RECHARGE ZONE, UH, NITA, IS IT OVER THE COUNTRY, UH, BEATEN ZONE, UH, IT FALLS ON THE COUNCIL DISTRICT TWO AND THERE ARE NO CRITICAL ENVIRONMENTAL FEATURES HERE.
THIS IMAGE, UH, WOULD, UH, GIVE US A BETTER UNDERSTANDING OF WHERE THIS SITE IS SITUATED.
UH, IT'S OFF OF 35, JUST CLOSE TO THE, UH, AIRPORT.
UH, I WOULD SAY, UH, SOUTHWEST, UH, LIKE I SAID BEFORE, IT'S IN THE FULL PURPOSE AND IT'S OUTSIDE OF THE RECHARGE ZONE AND THE CONTRIBUTING ZONE.
UH, THE SITE, THIS SITE IS 19.1, THREE ACRE SITE DEVELOPMENT THAT PROPOSES TO WHERE I'LL SEND AND BUILD IN FACILITIES, APPROXIMATELY 300,000 SQUARE FEET WITH ASSOCIATED LOADING DOCKS, SOFTWARES PARKING, AND UTILITY CONNECTIONS.
UH, THE PROPERTY LIES WITHIN AN INDUSTRIAL ZONE DESIGNATED FOR COMMERCIAL SERVICE USE AND LIMITED MANUFACTURING WITH SIMILAR WAREHOUSE BUILDINGS RANGING BETWEEN 115,000 SQUARE FEET TO 160,000 SQUARE FEET.
UH, THIS SITE ALSO OFFERS A REASONABLE LOCATION FOR LARGE INDUSTRIAL MANUFACTURING WAREHOUSES, AS IT IS LOCATED IN THE DESERT DEVELOPMENT ZONE.
UH, NO CRITICAL ENVIRONMENTAL FEATURES ON NO CRITICAL WATER QUALITY ZONE HERE, NO WATER QUALITY, WATER QUALITY TRANSITION ZONE, UH, AND NO, UH, STEEP SLOPE IDENTIFIED,
[00:20:02]
UH, IN ORDER TO FACILITATE THIS TYPE OF DEVELOPMENT, SIGNIFICANT LEVELING IS REQUIRED TO AN US MANEUVERABILITY INTO THE LOADING DOCKS, ALIGNED TRUCKS TO OPERATE SAFELY ACCESSIBILITY TO PORTIONS OF THE BUILDING WOULD NOT BE ACHIEVABLE WITHOUT THIS VARIANCE.SO THIS SHOWS THE EXISTING CONDITIONS.
UM, THIS IS WHAT THE SITE LOOKS LIKE PRESENTLY.
UH, IT HAS TALL GRASSES, WEED STREET, CARVER, UH, MOSTLY HUCKBERRY MESQUITE AND CHINABERRY ALL LESS THAN, UM, 19 INCHES.
UH, THE TOPOGRAPHY, THE SITES MOSTLY SLOPES FROM SOUTH TO NORTH RANGING BETWEEN 525 FEET TO 5 0 3 FEET SLOPES VARY, BUT DO NOT EXCEED 15% IN ANY DIRECTION EXCEPT FOR MANMADE DRAINAGE SWELL ON THE NORTH SIDE OF THE PROPERTY.
THE VARIOUS REQUEST TODAY USED TO ALLOW FIELD IN EXCESS OF FOUR FEET AND UP TO 17 FEET WITHIN THE DESIRED DEVELOPMENT ZONE.
THIS IS THE PROPOSED SITE PLAN AND GRADING.
AND THIS ALSO SHOWS THE CUT AND FEEL EXHIBIT AND THE AREAS SHADED IN LIGHT BROWN, RED AND GREEN, OUTSIDE OF THE BUILDING FOOTPRINT OR THE AREAS CONTINUING TO FILL UP TO 17 FEET.
AND THIS AREA HAS BEEN STRUCTURALLY CONTAINED USING RETAINING BOWLS.
ACCESS TO PERSONS OF THE BUILDING HERE WOULD NOT BE ACHIEVABLE WITHOUT THIS FIELD.
AND FROM THE MEASURES THAT HAVE BEEN IMPLEMENTED HERE OR PROPOSED TO BE IMPLEMENTED, UH, THIS DOES NOT CREATE ANY SIGNIFICANT PROBABILITY OF HARMFUL ENVIRONMENTAL CONSEQUENCES, JUST BECAUSE THIS, THE RETAINING WALLS HAVE BEEN PROPOSED TO BE ERECTED.
SO THE RETAINING WALLS ARE THERE AND THERE, AS WE CAN SEE IN THE IMAGE ON THE RIGHT, UH, THE RETAINING WALLS ARE BEEN THERE, UH, PROPOSED TO BE ERECTED, TO STRUCTURE ALL THE CONTAINED FEEL AND MINIMIZE THE AMOUNT OF GRADING.
THEY WOULD ALSO RESIST LATERAL PRESSURE OF THE SOIL PREVENT MOVEMENT OF SALT DOWNWARD SINCE THE AREA SLOPES FROM SOUTH SOUTH TO NORTH.
UH, SO IT'S GOING TO PREVENT MOVEMENT OF THE OFFSITE DOWNWARD AND ALSO AN UNSTABILITY, UH, STAFF RECOMMENDS THE VARIANCE OVEN, THE TIMING THAT THE REQUIRED FINDINGS OF FACT I'VE BEEN MET STAFF ALSO RECOMMEND AND SUPPORT THE FOLLOWING CONDITION OF PROVIDING STRUCTURAL CONTAINMENT OF FIELD WITH A RETAINING WALLS.
SHALL WE HEAR FROM THE APPLICANT AND THEN DO Q AND A, IS THE APPLICANT WANTING TO SPEAK THIS EVENING? HI, MY NAME IS NICK BROWN.
I'M WITH LDC I'M THE CIVIL ENGINEER FOR THE PROJECT.
UM, I'LL JUST SAY, THIS IS, THIS IS A VERY SITE IS TODAY, UH, MENTIONED, AND IT'S, YOU KNOW, WE'D HAVE OVER 20 FEET OF SLOPE FROM THE SOUTH TO THE NORTH.
AND, UH, WITH THE TYPE OF PROJECT THAT WE'RE TRYING TO DEVELOP, WHICH IS CONSISTENT WITH THE OTHER, UH, BUILDINGS THAT ARE IN THIS AREA, ALONG WITH THE ZONING, UH, WE FELT THAT THIS WAS THE BEST OPPORTUNITY TO, TO GET THIS PROJECT APPROVED, UH, WITH THE RETAINING WALLS THAT WE'RE PROVIDING AROUND THE SITE.
WE ALSO FELT THAT THAT WAS THE BEST DESIGN OPPORTUNITY, UH, AS OPPOSED TO EARTH EARTH SLOPES, UH, WHICH WOULD, WOULD NOT BE AS CONTAINED AS, AS THE CURRENT DESIGN HAS PROPOSED THAT.
WE'RE GOING TO START OUR Q AND A, UH, FIRST UP, DO YOU MIND IF WE START OFF WITH COMMISSIONER BARRICK BIXLER, DO YOU HAVE ANY QUESTIONS AT THIS TIME? NO QUESTIONS.
MY NAME IS MIKE MACDOUGAL, ENVIRONMENTAL REVIEW DEVELOPMENT SERVICES DEPARTMENT.
I JUST WANTED TO POINT OUT THERE WAS AN ERROR WITH THE ADDRESS.
I APOLOGIZE FOR THAT ON YOUR MEMO PACKET, I BELIEVE IT SAID THE ADDRESS OF THE PROPERTY WAS 42 0 1 WEST
[00:25:01]
PARMER.AND THE, THE CORRECT ADDRESS IS WHAT SHOWN IN THE PRESENTATION, WHICH IS 4,800 DISTRIBUTION DRIVE AND 7,900 INDUSTRY WAY.
I JUST WANTED TO READ THAT INTO THE RECORD AND MAKE EVERYBODY AWARE OF THE, THE ADDRESS DISCREPANCY ON THE PRINTED MATERIAL, BUT THE ADDRESS IS INDEED ON DISTRIBUTION DRIVE AND INDUSTRY WAY.
THE CORRECT ADDRESS IS 4 8 0 0 DISTRIBUTION DRIVE, AND 7 9 0 0 INDUSTRY WAY.
THE ADDRESS IN THE PACKET WAS 4 2 0 1 WEST PARMER LANE, AND THAT IS THE INCORRECT ADDRESS.
AND THAT'S ALSO WHAT'S APPEARING ON THE SCREEN AS WELL.
SO I APOLOGIZE FOR THAT, UH, THAT AIR IN THE, UH, WE USE TEMPLATES A LOT OF TIMES.
SO I THINK THE OLD ADDRESS FROM A PRIOR TEMPLATE MIGHT'VE SNUCK THROUGH.
THANK YOU FOR THAT CORRECTION.
DO YOU HAVE ANY Q AND A NO, I DO NOT.
I I'LL GO OVER HERE NOW TO COMMISSIONER BEDFORD.
I WAS KIND OF CURIOUS THAT THERE WAS A, UM, A TREE SURVEY DONE TO KIND OF LIKE ASSESS LIKE HOW MANY TREES WOULD BE REMOVED OR, UM, HOW MANY TREES, HOW MANY TOTAL TREES? UH, WE DID HAVE A TREE SURVEY DONE.
I, I DON'T KNOW THE EXACT COUNT.
UM, AND ALL THE TREES THAT HAVE BEEN REMOVED ARE BEING MITIGATED FOR AS IN ACCORDANCE WITH CITY RULES AND REGS.
SO I, I HAVE TO, UM, BEYOND THE RETAINING WALLS, IS THERE, ARE THERE RETENTION AREAS, UH, FOR WATER RUNOFF ON THOSE AS WELL? ARE THEY ON THE DOWN SLOPE? ARE THEY UP HIGH, A LITTLE BIT UP HIGHER? UH, ARE YOU ASKING, ARE THERE MORE RETAINING WALLS ON THE SITE OR IS IT JUST THE ONES AROUND THE BUILDINGS I'M THINKING OF? WHERE, WHERE DOES THE WATER GO? IS IT PAST THE RETAINING WALLS OR IS IT IN A DIFFERENT? YEAH, SO THE RETAINING WALLS ARE PLACED APPROXIMATELY 15 FEET FROM THE BUILDING, UM, IN ORDER TO CONTAIN THAT, THAT FILL.
AND THEN WE JUST HAVE SHEET RUNOFF THAT GOES TO AREA DRAINS AND CURB INLETS.
UH, AND THEN THAT IS DIRECTED TO A STORMWATER ON THAT IS OFF SITE THAT IS, UH, THAT ADDRESSES REGIONAL DETENTION AND WATER QUALITY.
'CAUSE I DIDN'T THINK I SAW ONE ON THE PLANET.
UM, THANK YOU FOR THE, UM, UH, PRESENTATION.
UM, WHAT HAPPENS TO THE SWALE THAT HAS BEEN THERE? WILL THERE STILL BE, UH, A SWALE? YES, THEY'RE REPLACING THE SWELL, THEY'RE FILLING IT UP AND, UM, THE ONE TO MAKE CUSTOM DRAIN, SO THEY'RE FILLING IT UP TO, UH, MAKE A DON'T DRINK.
AND SO, SO THAT, THAT DRAINAGE SWALE THAT'S ON THE NORTH SIDE OF THE PROPERTY, IT WAS PART OF THE CONSTRUCTION AND THE DEVELOPMENT OF PREVIOUS PHASES IN ADDITION TO THE RIGHT OF WAY CONSTRUCTION FOR DISTRIBUTION AND INDUSTRY WAY.
UM, AND SO PART OF OUR DEVELOPMENT, WE DO HAVE A CONNECTION TO THE NORTH PROPERTY, UH, WITH A DRIVEWAY.
AND INSTEAD OF, UM, YOU KNOW, USING THAT DRAINAGE DITCH, WE DECIDED IT WAS BEST TO EXTEND THE STORM SEWER PIPE ACROSS THAT, UH, THAT DRIVEWAY AND, AND FILL THAT DRAINAGE DITCH IN.
SO WHAT WOULD THAT, UM, END UP THEN GOING TO A, UH, DIXON BRANCH? I'M SORRY, THEIR EYES, UH, IF I'M LOOKING AT THE ADDRESS AS YOU HAVE GIVEN IT, TO ME, IT LOOKS LIKE THERE'S, UH, UM, UH, WELL MAYBE IT'S A CREEK, UH, DIXON BRANCH DOES THE, WHERE DOES THE STORMWATER DRAIN THE STORM WATER DRAINS TO THE EAST? SO, UM, WE'RE ABLE TO PULL SOMETHING UP.
I DON'T KNOW IF YOU GUYS CAN SEE IT.
UM, BUT THE DRAINAGE POND IS THE, THE DETENTION POND IS OFF TO THE EAST ADJACENT TO A 180 3 ON THE WEST SIDE.
SO IT DOESN'T, IT DOES SHOW UP ON ANY OF THESE EXHIBITS EXCEPT FOR MAYBE ONE OF THE AREAS THAT THAT MAY HAVE BEEN IN THERE.
UM, MY QUESTION IS IT IS, I DON'T FOR EITHER ONE OF YOU, BUT, UM, IT DOES SEEM A BIT EXCESSIVE.
[00:30:01]
WE'RE GOING FROM FOUR TO 17 FEET.UM, ARE YOU GOING TO HIT IT IN THE MIDDLE OR YOU'RE JUST Y Y THIS, RIGHT? YEAH.
SO WE, WE LOOKED AT MULTIPLE DIFFERENT DIFFERENT OPTIONS, UM, WITH THE, THE EXISTING TOPOGRAPHY WITH THE ADJACENT ROADWAYS, THE SOUTHERN SIDE OF THE PROPERTY IS THE HIGH SIDE, AND THEN THE NORTHEAST CORNER IS THE LOW SIDE.
SO WE'RE WORKING ON MAKING DRIVEWAY CONNECTIONS TO BOTH BOTH OF THOSE ROADWAYS, SO THAT WE HAVE ACCESS TO THE PROPERTY.
AND WITH THE, YOU KNOW, THE REQUIREMENTS THAT WE HAVE AS FAR AS THE DEVELOPMENT GOES, IT'S REALLY DIFFICULT TO GET ACCESS INTO IT AT A REASONABLE SLOPE, ESPECIALLY KNOWING THAT THESE ARE GOING TO BE LARGE, LARGE VEHICLES THAT ARE ENTERING THE SITE MANEUVERING.
SO BEING ABLE TO MAINTAIN ACCESSIBILITY, BEING ABLE TO MAINTAIN PROPER ACCESS, UH, WAS CRITICAL AS FAR AS THOSE SLOPES GO TO GET IN.
AND THEN WE HAVE THESE LARGE, LONG, LONG BUILDINGS, UH, WHICH REQUIRE, YOU KNOW, ONE SINGLE FINISHED FLOOR AS OPPOSED TO A RELATIVELY FLAT TRUCK LOADING DOCK.
SO AS YOU GET FURTHER NORTH, THAT DELTA BEGINS TO INCREASE, WHICH IS REALLY WHY WE HAVE THAT, YOU KNOW, UP TO 17 FEET.
SO THAT NORTHERN CORNER IS REALLY THE MOST RESTRICTIVE.
IF YOU LOOKED ON THE EXHIBIT, THE GREEN AREA IS PROBABLY WHERE WE'RE, WE'RE STARTING TO APPROACH THAT 17 FEET.
AND, UH, ALL OF THAT AGAIN IS CONTAINED WITHIN THOSE RETAINING WALLS.
MA'AM ANY OTHER FURTHER QUESTIONS? COULD, UH, COULD WE DO THE EXHIBIT AGAIN? OKAY.
CAN Y'ALL PULL UP THAT EXHIBIT, YOU WOULD JUST REFER THE ONE THAT WERE JUST REFERRING TO, I BELIEVE IT'S SLIDE 10 OF 13 IN THE POWERPOINT.
THIS, THIS IS, UH, YOUR, YOUR IDEA OF WHAT IT WOULD LOOK LIKE WHEN IT'S FINISHED.
AND DO YOU HAVE A MAP THAT SHOWS WHAT IT LOOKS LIKE NOW? UH, I DON'T KNOW IF THERE'S, I MEAN, YOU CAN KIND OF SEE THE EXISTING CONTOURS RUNNING THROUGH THAT SITE ON THAT PLAN.
I THINK PAGE THREE SHOWS A KIND OF ZOOMED OUT A LITTLE BIT MORE ARE YOU GUYS ABLE TO PULL UP THE COLOR EXHIBIT AGAIN? I THINK THAT DOES SHOW YOU'RE LOOKING FOR EXISTING SOMEWHAT.
SO YOU CAN KIND OF SEE IN THERE, THE THERE'S A REALLY LIGHT, LIGHT LINES THAT ARE KIND OF ARGUING THROUGH BOTH OF THOSE BUILDINGS AND THERE'S SOME SMALL LABELS ON THEM, WHICH YOU REALLY CAN'T SEE, BUT YOU CAN SEE HOW THE CONTOURS START TO, TO RUN FROM THE SOUTH TO THE NORTH, AND THEN ALSO FROM KIND OF THE CENTER OF THE PROPERTY TO THE EAST TOWARDS THE RIGHT OF WAY.
SO AS YOU START RUNNING THROUGH THE EASTERN BUILDING, THOSE CONTOURS START TO TAKE OFF.
WHY DO YOU, WHAT, WHAT, WHAT IS RED AND WHAT IS BLUE? WHAT, WHAT ARE THOSE, WHAT DOES THAT REPRESENT? I, I, I JUST DON'T UNDERSTAND THIS.
UM, SO BLUE IS BLUE IS A CUT THAT HAS BETWEEN FOUR AND EIGHT FEET.
UH, AND THEN THE WHITE IS BASICALLY ANYTHING BETWEEN ZERO OR NEGATIVE FOUR AND FOUR FEET.
SO THAT'S ALL WITHIN THE REQUIREMENTS.
ORANGE IS FOUR TO EIGHT FEET OF FILL.
RED IS EIGHT TO 12, AND THEN GREEN IS 12 AND, UH, NOT QUITE 17 FEET, BUT IT'S 16 AND SOME CHANGE THAT'S JUST SHOWING, UM, THE, THE, UH, LEVELING TO CHOOSE THE CORRECT.
IT'S BASICALLY SHOWING OUR HEAT MAP OF HOW MUCH FILL WE HAVE.
AND YOU CAN SEE THAT, YOU KNOW, OUR CRITICAL AREAS ARE THE RED AND THE GREEN, WHICH IS AN EXCESS OF EIGHT FEET.
AND, UM, AND, AND, UH, CITY STAFF IS I'M SATISFIED THAT THERE WILL BE, UH, ADEQUATE DRAINAGE FOR, UM, UH, GIVEN THAT WE CAN EXPECT MORE THAN MORE WATER IN THE FUTURE THEN, THAN WE SEE CURRENTLY, UH, AT, AT TIMES AT TH AT THIS TIME, CORRECT? YES, WE'VE, WE'VE WORKED WITH OUR DRAINAGE REVIEWERS AND WITH THE EXISTING REGIONAL POND THAT ADDRESSES WATER QUALITY IN DETENTION.
UH, WE HAVE NOT HAD ANY ADDITIONAL DRAINAGE COMMENTS, UH, THAT WE NEED TO ADDRESS AT THIS POINT.
DOES ANYONE ELSE HAVE ANOTHER QUESTION? OKAY.
UH, CAN I GET A MOTION TO CLOSE THE PUBLIC HEARING, THEN WE'VE DONE A MOTION TO CLOSE THE PUBLIC HEARING.
IS THERE ANY FURTHER DISCUSSION?
[00:35:03]
ALL RIGHT.DO WE HAVE A MOTION? THAT'S MY SOUND.
UM, ITEM TWO, A, UM, PARK 180 3, BUILDING SIX AND SEVEN SP 2021 DASH 0 0 7 2 C.

FIRST, A SERVICE EXTENSION REQUEST OR SCR IS AN APPLICATION FOR CITY WATER OR WASTEWATER SERVICE FROM A PROPERTY OWNER OR DEVELOPER.
SCRS ARE REQUIRED WHEN A PROPERTY IS LOCATED MORE THAN 100 FEET FROM AN ACCESSIBLE WATER OR WASTEWATER SYSTEM, OR WHEN EXISTING INFRASTRUCTURE IS AN ADEQUATE FOR PROPOSED PROJECT DEMANDS, SERVICE MAY INVOLVE CONSTRUCTION OF A NEW LINE OR AN ASSOCIATED FACILITY OR UPGRADES TO EXISTING LINES OR FACILITIES.
THE APPLICANT PAYS FOR THE ASSOCIATED INFRASTRUCTURE AS OUTLINED IN THE SCR PER THE LAND DEVELOPMENT CODE SCRS REQUIRE COUNCIL APPROVAL.
IF THE PROPERTY IS LOCATED IN THE DRINK OF WATER PROTECTION ZONE AND OUTSIDE OF THE CITY'S FULL PURPOSE JURISDICTION, THE ENVIRONMENTAL COMMISSION AND THE WATER AND WASTEWATER COMMISSION REVIEW AND MAKE RECOMMENDATIONS ON SCRS THAT REQUIRE COUNCIL APPROVAL.
SO FOR THE WATER ACCESS REQUEST IN FRONT OF YOU TONIGHT, THIS IS A REQUEST FOR A WATER SERVICE FOR ONE LI L U E.
UM, THIS, THE PROPOSED STRS FOR AN EIGHT POINT 10 ACRE PROPERTY LOCATED AT THE CITY'S LIMITED PURPOSE JURISDICTION.
AND IN COUNCIL DISTRICT 10, THE PROPERTY IS WITHIN THE DRINKING WATER PROTECTION ZONE.
THE COLDWATER CREEK WATERSHED, AND IS CLASSIFIED AS WATER SUPPLY.
THE APPLICANT IS PROPOSING TO DEVELOP ONE SINGLE FAMILY HOME WITH ONE LIVING UNIT EQUIVALENT OR ELIQUIS.
THIS IS THE LOCATION OF THE SITE IN THE CONTEXT OF THE CITY'S FULL, FULL JURISDICTION.
SORRY, DID THAT A LITTLE BIT TOO QUICKLY? AND THIS IS THE LOCATION IN THE CONTEXT OF IMAGINE AUSTIN'S GROWTH CONCEPT MAP.
IT IS NOT LOCATED NEAR ONE OF THE CENTERS OR CORRIDORS WHERE THE COMPREHENSIVE PLAN SEEKS TO DIRECT NEW DEVELOPMENT.
THIS IS A MAP SHOWING THE PROPERTY IN THE LIMITED PURPOSE, LIMITED PURPOSE JURISDICTION.
EMMA LONG METROPOLITAN PARK IS JUST TO THE NORTH OF THIS PROPERTY.
AND THIS IS A MAP SHOWING THE PROPOSED EXTENSION.
THE APPLICANT IS PROPOSING TO CONSTRUCT 350 FEET OF EIGHT INCH WATER MAIN FROM EXISTING EIGHT INCH WATER MAIN IN-CITY PARK ROAD AND EXTEND ALONG CITY PARK ROAD TO THE SUBJECT TRACT.
THE APPLICANT IS PROPOSING TO UTILIZE AN ONSITE SEPTICS FACILITY FOR WASTEWATER SERVICE AND WILL BE SUBJECT TO CITY TO I'M SORRY, TO TRAVIS COUNTY CODE AND RULES
[00:40:01]
FOR ON-SITE SEWAGE FACILITIES.THIS IS A MAP SHOWING THE AERIAL VIEW OF THE PROPERTY.
IT IS MOSTLY VACANT LAND WITH A FEW JOINT ACCESS DRIVES TWO ADJACENT PARCELS.
UH, SO THIS IS THE FINAL PLAT OF THE SUBDIVISION, WHICH SHOWS WHERE THE CRITICAL ENVIRONMENTAL FEATURES ARE LOCATED ON THE PROPERTY.
IF YOU LOOK AT THE CIRCLES WITH THE LITTLE S AND THEN IT ALL, THOSE ARE THE, UM, WITH THE SEATS.
SO THERE ARE THREE CRITICAL ENVIRONMENTAL FEATURES ON THE PROPERTY AND THEN BUFFERS FOR FOUR ADDITIONAL CES LOCATED ON THE ADJACENT PROPERTY TO THE SOUTH.
UM, THERE ARE NO CRITICAL WATER QUALITY ZONE OR WATER QUALITY TRANSITION ZONE ON THE SITE.
AND IF YOU LOOK AT THE AREA THAT'S HATCHED IN GRAY, THAT IS THE CONSERVATION EASEMENT FOR THE PROPERTY.
SO THE MAJORITY OF THE PROPERTIES YOU CAN SEE IS IN THE COMP WITHIN THE CONSERVATION EASEMENT AGREEMENT, THAT'S 7.26 ACRES.
SO ONLY 8.84 ACRES OF THE PROPERTY IS ACTUALLY DEVELOPED DEVELOPABLE OKAY.
SO, UM, S STAFF REVIEW DETERMINED THAT DUE TO THE PROTECTIONS PLACED ON THE CONSERVATION EASEMENT, THERE ARE NO SIGNIFICANT ENVIRONMENTAL RISKS TO EXTEND SERVICE TO THE SITE.
THEREFORE, THE WATERSHED PROTECTION DEPARTMENT STAFF RECOMMENDS SUPPORT OF WATER SERVICE EXTENSION REQUEST TO 5, 2, 1.
AND I'M HAPPY TO ANSWER ANY QUESTIONS YOU HAVE AT THIS TIME.
HI, JUST BEING NEW, UM, TO THIS, UM, CAN YOU EXPLAIN TO ME WHY THESE ARE, UH, CRITICAL, CRITICAL ENVIRONMENTAL AREAS AND WHAT, WHAT, UH, WHAT CONSTITUTES A CRITICAL ENVIRONMENTAL AREA? SO IT CAN BE A SPRING OR A SEAT ON THE PROPERTY.
IT COULD ALSO BE, UM, A CANYON RIM ROCK OR SOMETHING LIKE THAT IN THIS CASE, THEY'RE PRIMARILY SPRINGS AND SEEPS.
AND, UM, THE, THE WATER SERVICE, UM, THAT'S PUT IN WILL NOT GO THROUGH THAT, THAT ANY OF THOSE FEATURES WILL BE PLACED SOMEWHERE ELSE.
UM, COULD YOU, WOULD YOU MIND PUTTING MY, UH, PRESENTATION BACK UP ON THE SCREEN, I'M GOING TO SHOW YOU, UM, THE MAPS, SO YOU, SO YOU CAN SEE WHERE THE EXTENSION IS PROPOSED.
BE EASIER FOR ME TO UNDERSTAND IF I, OKAY.
DO YOU SEE THAT LITTLE RED LINE RIGHT THERE? THAT IS THE PROPOSED EXTENSION.
SO IT'LL JUST BE ALONG CITY PARK ROAD THERE.
AND THEN, UM, WE EXPECT THAT THE DEVELOPMENT WOULD BE JUST, UH, UP AT THE FRONT OF THE PROPERTY BECAUSE OF THE CONSERVATION EASEMENT.
SO, UM, THEY WOULD JUST BE CONNECTING THERE FROM SYDNEY PARK ROAD.
UH, ANY OTHER QUESTIONS BEFORE WE ASKED THE APPLICANT, IF HE WOULD LIKE TO SPEAK? OKAY.
DID I HAVE A QUESTION? OH, I'M SORRY.
THANK YOU FOR YOUR PRESENTATION, KAYLA.
UM, THIS IS, UH, THIS IS, UH, A LEARNING QUESTION.
DO YOU MIND EXPLAINING THE DIFFERENCE IN HOW THE CITY'S ABLE TO MANAGE SOMETHING THAT'S BEING DEVELOPED WITHIN THE LIMITED PURPOSE CITY LIMIT VERSUS THE FULL PURPOSE CITY LIMIT? I KNOW THIS COMES UP QUITE A BIT, AND I JUST APPRECIATE YOU.
I'M GOING TO DEFER TO OUR DEPUTY ENVIRONMENTAL OFFICER FOR THIS ONE, WHO IS OUR DEVELOPMENT EXPERT.
UM, YES, THIS IS LIZ JOHNSTON.
UM, ZONING DOES HAVE ZONING, UM, AND, UM, AND WE DO HAVE OUR ENVIRONMENTAL REGULATIONS.
UM, HOWEVER, UH, WE ARE NOT OBLIGATED TO PROVIDE SERVICES TO THE LIMITED PURPOSE, UH, ZONING JURISDICTION.
SO THERE ARE CERTAIN THINGS, SO IT COULD BE LIKE A HEALTH AND SAFETY OR, OR SOME OTHER REASON TO CALL IT THE LIMITED PURPOSE.
SO THERE IS ZONING AND, UM, OTHER REGULATIONS, BUT IT IS NOT IN THE ETJ AND IT'S NOT IN FULL PURPOSE.
SO IT'S KIND OF IN BETWEEN, I DON'T KNOW IF THAT REALLY HELPED A LOT, BUT, UM, IT'S, UH, THE CITY OF AUSTIN IS ONE OF THE FEW PLACES THAT HAS LIMITED PURPOSE IN TEXAS.
UM, WHAT, WHAT DO YOU MEAN BY ETJ?
[00:45:01]
UM, THE EXTRA TERRITORIAL JURISDICTION.AND SO THESE ARE, SO THE FULL PURPOSE IS ENTIRELY WITHIN THE CITY LIMITS.
IT HAS ALL OF THE ZONING, ALL THE PERMIT REQUIREMENTS, UM, AND THE TWO MILE AND THE FIVE MILE ETJ.
THESE WERE AREAS, UM, SURROUNDING AUSTIN THAT, UM, WE HAVE PLANNED, WE HAVE SAID IT'S IN OUR ATG BECAUSE WE PLAN TO ANNEX IT AT SOME POINT, NOT WITHSTANDING STATE REGULATIONS THAT PROHIBIT THAT, BUT, AND SO IT IS LIMITED PURPOSE HAS CERTAIN ASPECTS KIND OF IN BETWEEN.
UM, THEY DON'T PAY TAXES FOR EXAMPLE, BUT THEY DO HAVE ZONING AND PERMITTING REQUIREMENTS SIMILAR TO THE FULL PURPOSE.
THANK YOU BOTH FURTHER EXPLANATION AND PRESENTATION AND PRESENT.
UH, DID THE APPLICANT ONE OF SPEAK, IS THE APPLICANT HERE? I DON'T BELIEVE THE APPLICANT IS HERE, CHAIR.
SO, UH, ANY OTHER QUESTIONS? DO WE HAVE A MOTION TO CLOSE THE PUBLIC HEARING? STILL MOVE MOTION BY COMMISSIONER SCOTT.
SO DO WE HAVE, DO WE HAVE A MOTION AT THIS TIME? OKAY.
SORRY ON AGENDA ITEM TWO B UH, 43, 15 CITY PARK ROAD, WATER SERVICE EXTENSION REQUEST 52 16.
WHEREAS THE ENVIRONMENTAL COMMISSION RECOGNIZES THE WATER SURFACE EXTENSION REQUEST IS LOCATED IN THE COLD CREEK COLDWATER CREEK WATERSHED WATER SUPPLY ROLE AND DRINKING WATER PROTECTION ZONE.
WHEREAS THE ENVIRONMENT COMMISSION RECOGNIZES THAT THE WATERSHED PROTECTION DEPARTMENT STAFF HAVE COMPLETED REVIEW AND RECOMMEND APPROVAL OF THE REQUEST.
THEREFORE, THE ENVIRONMENTAL COMMISSION RECOMMENDS APPROVAL OF THE ABOVE NOTED WATER SERVICE EXTENSION REQUEST MOTION BY COMMISSIONER RAMBERT.
SECOND, SECOND BY COMMISSIONER BEDFORD.
ANY OTHER FURTHER DISCUSSION? ALL IN FAVOR, SAY AYE.
[2.c. Name: 8921 US Hwy 290 West Wastewater Service Extension Request #4796 Applicant: Joe Longaro, P.E., LJA Engineering, Inc. Location: 8921 US 290 Hwy West, Austin, Texas 78737 Council District: Austin 2-mile Extraterritorial Jurisdiction Staff: Kaela Champlin, Environmental Program Coordinator, Watershed Protection Department Watershed: Slaughter Creek Watershed, Barton Springs Zone, Edwards Aquifer Contributing Zone, Drinking Water Protection Zone Request: Wastewater Service Extension Staff Recommendation: Staff recommends approval of the wastewater service extension. (30 minutes)]
RIGHT.WE ARE NOW ON TO C UH, EIGHT TO, I MEAN, SORRY.
8, 9 2 1 US HIGHWAY TWO 90 WEST WASTEWATER SERVICE EXTENSION REQUEST NUMBER 4 7 9 6.
THIS IS AT 89, 21 U S TWO 90 HIGHWAY WEST AUSTIN, TEXAS 7 8 7 3 7 DISTRICT IS AUSTIN TO MALL EXTRA TERRESTRIAL AND HE WAS GOING TO DO THAT ACTION TERRITORIAL JURISDICTION.
THAT'S I I'D LIKE TO SEE, AND WE HAVE A WASTEWATER EXTENSION REQUEST.
WE HAVE STAFF PRESENTING AGAIN.
MY NAME IS KAYLA CHAMPLIN AND WITH THE WATERSHED PROTECTION DEPARTMENT, UM, TONIGHT WE'RE REQUESTING THAT THE ENVIRONMENTAL COMMISSION MAKE A RECOMMENDATION ON 89 21, US HIGHWAY TWO 90 WEST.
THIS IS A WASTEWATER EXTENSION REQUEST.
UM, IT IS ALSO SCHEDULED TO BE CONSIDERED AT THE WATER AND WASTEWATER COMMISSION ON DECEMBER 1ST, AND THEN WILL SUBSEQUENTLY GO TO COUNCIL FOR APPROVAL CAUSE LIKE MY CLICKER ISN'T WORKING ANYMORE.
COULD YOU GO TO THE NEXT SLIDE PLEASE? THANK YOU.
SO FOR THIS PROJECT, THE APPLICANT IS REQUESTING A WASTEWATER SERVICE EXTENSION REQUEST WHO ARE ATTRACTIVE APPROXIMATELY 69.12 ACRES.
THE SITE IS IN THE SLAUGHTER CREEK WATERSHED, THE BARTON SPRINGS ZONE, THE DRINKING WATER PROTECTION ZONE AND THE EDWARDS AQUIFER CONTRIBUTING ZONE.
THIS PROJECT HAS AN APPROVED SITE PLAN FOR THE JUNCTION ATHLETIC COMPLEX.
I PROPOSE SPORTS COMPLEX THAT HAS NOT BEEN CONSTRUCTED.
THE APPLICANT SUBMITTED A PROPOSAL TO REVISE THE PREVIOUSLY APPROVED SITE PLAN FOR THE ATHLETIC COMPLEX TO DIP INTO INSTEAD DEVELOP A 280 UNIT MULTIFAMILY DEVELOPMENT PROJECT IN THE SAME DEVELOPMENT FOOTPRINT WITH 140 LAND USE EQUIVALENTS OR L U E S.
THE PROPOSED REVISED SITE PLAN WAS SUBMITTED FOR COMPLETENESS CHECK TO THE CITY OF AUSTIN ON SEPTEMBER 10TH OF THIS YEAR AND IS CURRENTLY IN REVIEW.
THIS IS THE LOCATION OF THE SITE IN THE CONTEXT
[00:50:01]
OF THE CITY'S FOLGERS DICTION.THIS IS A SITE IN THE CONTEXT OF IMAGINE AUSTIN'S GROWTH CONCEPT MAP.
IT IS NOT LOCATED NEAR ONE OF THE CENTERS OR CORRIDORS WHERE THE COMPREHENSIVE PLAN SEEKS TO DIRECT NEW DEVELOPMENT.
THE PROPERTY IS SHOWN HERE AND YOU CAN SEE IT'S IN THE CITY TWO MILE, EXTRA TERRESTRIAL JURISDICTION.
THE PROPERTY IS ADJACENT TO 90 21 WEST US HIGHWAY TWO 90.
THIS PROPERTY HAS AN APPROVED SCR CALLED THE LEDGE STONE MULTI-FAMILY WASTEWATER S HE R NUMBER 4 6 2 2.
THIS SDR WAS APPROVED BY CITY COUNCIL ON JUNE 11TH, 2020.
AND BEFORE THAT HAD COME THROUGH THE ENVIRONMENTAL COMMISSION IN WEST REMIT RECOMMENDED BY THE COMMISSION, UM, THE LINES ASSOCIATED WITH ALLEGED STONE MULTIFAMILY SCR HAVE NOT BEEN CONSTRUCTED.
SO THE, FOR THE ENVIRONMENTAL IMPACTS, THE EASTERN PORTION OF THE SITE CONTAINS DEVILS PENN CREEK AND ASSOCIATED CRITICAL WATER QUALITY ZONE AND WATER QUALITY TRANSITION ZONE.
THERE ARE SEVEN WETLAND CES OR CRITICAL WATER, I'M SORRY, CRITICAL ENVIRONMENTAL SPEAK FEATURES.
AND ONE CAEP CRITICAL ENVIRONMENTAL FEATURE ON THE SITE.
THIS PROPERTY DOES NOT DRAIN TO SALAMANDER HABITAT, UM, AND DUE TO VESTING RIGHTS, GRANTED PER CHAPTER 245 OF THE STATE OF TEXAS LOCAL GOVERNMENT CODE ALL SITE DEVELOPMENT IS SUBJECT TO REGULATIONS IN EFFECT IN 1995.
SO THAT INCLUDES CREEK BUFFERS, STRUCTURAL WATER QUALITY TREATMENT, AND REQUIRE I'M SORRY, A STRUCTURAL WATER QUALITY TREATMENT REQUIREMENTS, CRITICAL ENVIRONMENTAL FEATURE PRODUCTIONS AND OTHER ENVIRONMENTAL PROTECTIONS, BUT IT IS NOT SUBJECT TO THE SAVE OUR SPRINGS ORDINANCE.
SO HERE'S A MAP SHOWING THE CRITICAL ENVIRONMENTAL FEATURES, THE CRITICAL WATER QUALITY ZONE AND THE WATER QUALITY TRANSITION ZONE ON THE SITE.
SO DUE TO THE APPROVED LEDGE STONE MULTIFAMILY SCR ON THE ADJACENT PROPERTY, THERE ARE TWO POSSIBLE SCENARIOS FOR DEVELOPMENT OF A LIFT STATION AND THE FORCE MAIN FOR THESE PROPERTIES.
AND THE FIRST FIRST SCENARIO, UM, BOTH DEVELOPERS WILL WORK TOGETHER TO BUILD ONE LIFT STATION AND FORCED ME TO SERVE BOTH PROPERTIES.
IN THE SECOND SCENARIO, THE DEVELOPER FOR THE SCR UNDER CONSIDERATION TONIGHT BUILDS THE LIFT STATION ENFORCEMENT FOR THIS PROPERTY ONLY.
UM, IN THAT CASE, THE ALLEGED STONE PROPERTY WILL BE RESPONSIBLE TO EITHER UPGRADE THE EXISTING LIFT STATION OF FORCE MAIN OR BUILD THEIR OWN LIFT STATION ENFORCEMENT ON THE ADJACENT PROPERTY DUE TO THE COST AND LIMITED ALLOWABLE SPACE IN THE RIGHT OF WAY.
THE MOST LIKELY SCENARIO IS THAT THEY, THE TWO DEVELOPERS WILL COORDINATE AND BUILD ONE CONSOLIDATED LIFT STATION.
HOWEVER, CITY STAFF CANNOT GUARANTEE THAT THE SECOND SCENARIO WOULD NOT OCCUR IF BOTH PARTIES CAN'T COME TO AN AGREEMENT ON THIS.
SO, UH, THE, THE PROPERTY IS NOT REQUESTING WATER SERVICE FOR THE SITE BECAUSE THEY'RE IN THIS BECAUSE THEY'RE IN THE SERVICE AREA FOR THE WEST TRAVIS COUNTY PUBLIC UTILITY AGENCY.
SO HERE IS A MAP OF THE PROPOSED WASTEWATER EXTENSION BEFORE YOU THIS EVENING.
UM, THE LOCATION OF THE PROPOSED LIFT STATION IS A CONCEPTUAL LAYOUT PROVIDED BY AUSTIN WATER.
UM, THIS IS IMPORTANT TO KNOW BECAUSE THE ACTUAL LOCATION OF LIFT STATION WILL BE REVIEWED WHEN THE PROJECT COMES IN, UM, WHEN IT'S SUBMITTED FOR A SITE PLAN REVIEW.
AND AT THAT POINT, IT MUST COMPLY WITH CITY PUB CODE.
CAN YOU GO BACK ONE? THERE WE GO.
SO FOR REFERENCE, I WANTED TO SHOW YOU WHAT WAS APPROVED FOR THE LEDGE STONE SCR, UM, AS WITH THE SCR UNDER CONSIDERATION, THE LOCATION OF THE LIFT STATION HERE, IT'S SHOWN AT THE BOTTOM OF THE PROPERTY.
UM, BUT THIS IS JUST A CONCEPTUAL LAYOUT.
THE ACTUAL LOCATION WILL BE DETERMINED ONCE WE KNOW IF THE DEVELOPER IS GOING TO COME TO AGREEMENT ABOUT THE LIFT STATION OR IF THE, WHEN THE APPLICANTS ADMITS THEIR PROJECT FOR SITE PLAN REVIEW.
UM, AND, AND JUST TO CLARIFY, NO DEVELOPMENT APPLICATION HAS BEEN SUBMITTED FOR THIS PROPERTY YET.
SO THIS, I THINK JUST COVERS WHAT WE JUST DISCUSSED, BUT AGAIN, JUST TO EMPHASIZE CONSTRUCTION OF THE WASTEWATER MAIN AND LIFT STATION ARE REQUIRED TO COMPLY WITH CODE AND THEY'RE REQUIRED BY, BY CITY CODE TO BE LOCATED OUTSIDE OF THE WATER QUALITY TRANSITION ZONE AND WATER.
UH, AND, UH, DID I SAY WATER QUALITY TRANSITION ZONE AND CRITICAL WATER QUALITY? SO THANK YOU.
[00:55:02]
OKAY.SO IN THE CASE THAT THE SDR WAS NOT APPROVED, UM, THE SITE IS ALLOWED 25% NET SIDE AREA IN PURVIEWS COVER.
IF SERVICE WERE NOT EXTENDED AND WASTEWATER DISPOSAL IS REQUIRED, THE APPLICANT WAS LIKELY TO APPLY FOR A SUB SURFACE AREA.
DRIP DISPERSAL SYSTEM ISSUED BY THE TEXAS COMMISSION ON ENVIRONMENTAL QUALITY.
AND WE'RE ESTIMATING THAT 8.3 ACRES WOULD BE DEDUCTED FROM THE NET SIDE AREA CALCULATIONS FOR IMPERVIOUS COVER LIMITS FOR THAT SUBSURFACE DISPERSAL FIELD ONSITE STORAGE AND ONSITE TREATMENT AND AN ON-STREET TREATMENT PLANT.
UM, THIS SCENARIO WOULD DISTURB OVER EIGHT ACRES OF UPLANDS.
SO THIS IS NOT, UH, THE PREFERRED OPTION FOR WATERSHED STAFF.
UH, I THINK WE MIGHT HAVE GONE BACKWARDS NEXT SLIDE.
OH, I THINK WE'RE GOING BACKWARDS.
SO WHILE SENSITIVE ENVIRONMENTAL FEATURES DO EXIST WITHIN THE PARCEL, AND THERE IS A CONCERN THAT LEAKING PIPES COULD CAUSE ENVIRONMENTAL HARM TO THE CREEK WATERSHED PROTECTION DEPARTMENT STAFF RECOMMEND APPROVAL OF SERVICE EXTENSION REQUEST NUMBER 4 7, 9, 6.
AND THE REASON THAT WE'RE RECOMMENDING THIS IS BECAUSE THE APPROVED LEADSTONE SCR ADJACENT TO THIS SITE WILL EVENTUALLY ALLOW FOR THE CONSTRUCTION OF NEW PUBLIC WASTEWATER INFRASTRUCTURE AND THE PROPOSED INFRASTRUCTURE FOR THIS PROJECT IS SIMILAR TO THAT WHICH HAS PRE BEEN PREVIOUSLY APPROVED FOR THE OTHER SITE.
ALSO THE EXISTING PARCEL ALREADY HAS AN APPROVED SITE PLAN FOR THE ATHLETIC COMPLEX AND THE LEVEL OF DEVELOPMENT THAT'S ASSOCIATED WITH THE PROPOSED APARTMENT BUILDINGS WILL BE SIMILAR TO THE AMOUNT OF DEVELOPMENT ALREADY ALLOWED WITH THE APPROVED ATHLETIC COMPLEX, DUE TO THE SITE DEVELOPMENT REGULATIONS.
AND ALSO, AS I MENTIONED BEFORE, THE AREA THAT WOULD BE REQUIRED FOR SUBSURFACE IRRIGATION UNDER THE ALTERNATIVE WASTEWATER SCENARIO WOULD DISTURB OVER EIGHT ACRES OF UPLANDS.
SO WE'RE NOT RECOMMENDING THAT OPTION AND I'M HAPPY TO ANSWER ANY QUESTIONS.
WE ALSO HAVE STAFF FROM AUSTIN WATER HERE, IF YOU HAVE ANY QUESTIONS FOR THEM.
AND I BELIEVE WE ALSO HAVE SEVERAL MEMBERS FROM THE COMMUNITY WHO ARE HERE TO SPEAK ON THIS ITEM.
WHY DON'T WE, UH, FIRST SEE IF THE APPLICANT WANTS TO SPEAK AND THEN WE'LL GO TO THE, UH, COMMUNICATION FROM THE NEIGHBORS.
HOW ARE YOU ALL MICHAEL WHALEN ON BEHALF OF THE APPLICANT? UM, JUST WANTED TO POINT OUT A COUPLE OF THINGS REAL QUICKLY.
UM, THIS IS THE SITE PLAN THAT HAS NOW BEEN SUBMITTED.
SO WE HAVE IN FACT COMPLIED WITH THE RECOMMENDATION TO MOVE IT AWAY FROM THE NEIGHBORS.
THE NEIGHBORS ARE TO THE RIGHT, THERE'S A CANINE CAMP IN BETWEEN.
I'M GOING TO SHOW YOU ANOTHER IMAGE IN A MOMENT THAT SHOWS THAT THERE'S ACTUALLY A LITTLE ROAD THAT BETWEEN OUR PROPERTY AND THAT OTHER SCR, THEY KEPT REFERENCING THE LEDGE STONE LINE.
I ALSO WANT TO POINT OUT THE CREEK IS, UH, TO THE TOP OF THIS IMAGE.
YOU CAN SEE WHERE THE CREEK IS, WHERE WE PULLED IT AWAY TO THE FURTHEST POINT AWAY FROM THE CREEK THAT WE COULD ON OUR PROPERTY.
UM, SO I JUST, I WANTED TO MAKE THAT, UH, CLEAR IN THAT AND, AND WE'VE SHARED THIS AND WE'VE HAD SEVERAL CONVERSATIONS WITH THE NEIGHBORS.
THIS IS THE SITE PLAN THAT WE NOW HAVE SUBMITTED.
SO WE ARE COMMITTING TO THIS, UH, THIS LOCATION, UH, THIS, WHEN YOU HEARD, UH, UH, UH, MS. CHAMPLIN TALK ABOUT THE, UH, SAD, WHAT A GREAT ACRONYM, SUBSURFACE AREA, DRIP DISPERSAL SYSTEM, AND HOW IT WOULD DISTURB UP TO EIGHT ACRES OF UPLANDS.
THIS IS THE EIGHT ACRES THAT WE WOULD HAVE TO DISTURB, BUT WE WOULD HAVE TO FIND EIGHT ACRES AMONG THIS AREA IN ORDER TO, UH, IMPLEMENT THE SAD.
I'M GOING TO SAY THAT AT LEAST TWO MORE TIMES.
UH, AND SO THIS IS WHAT WE'RE TALKING ABOUT.
YOU CAN SEE WE MOVED, OUR DEVELOPMENT IS ACTUALLY IN THE AREA.
THAT'S OPEN TRYING TO MINIMIZE DISTURBANCE, THE AREA THAT IS WIDE OPEN THAT YOU SEE THE RED LINE KIND OF WORKS AROUND.
THAT IS THE KENNEL BOBBY, UH, UH, WHAT'S HER NAME, EXCUSE ME.
YEAH, BOBBY COLORADO'S, UH, PROPERTY.
AND THAT'S WHY WE CAN'T DO IT THERE WHERE THERE'S NO DISTURBANCE, THAT'S SOMEBODY ELSE'S PROPERTY.
[01:00:01]
YOU CAN ACTUALLY SEE THAT RIGHT HERE.THAT'S HER PROPERTY, THE BLUE, SHE HAS A ROAD THAT TAKES IT DOWN TO THAT AREA.
BUT THE AREA THAT WE WOULD HAVE TO DISTURB IS OUTLINED IN RED.
AND MOST OF IT IS COVERED IN TREES, WHICH I THINK IS ONE REASON WHY STAFF DIDN'T WANT TO HAVE US IMPLEMENT SAD.
UM, AND THEN AS I POINTED OUT, JUST SO THAT THERE'S CLARITY, OUR LIFT STATIONS, WHERE THAT, UH, OUR PROPOSAL OF STATION MORE THAN PROPOSED, WE'VE NOW COMMITTED BY SPENDING MONEY AND FILING A MEANINGFUL SITE PLAN IS WHERE THAT PURPLE SQUARE IS RIGHT NEXT TO THE BUILDING ALL THE WAY TO THE LEFT OF WHERE THE CREEK IS.
THE CREEK'S RUNNING ON THIS, UH, UH, TOP ON THIS IMAGE RUNNING NORTH SOUTH, BUT IT'S NOT NORTH SOUTH ANYWAY, BUT TO THE LEFT ON THIS IMAGES, THAT OTHER SCR THAT WAS APPROVED WAY BACK WHEN FOR LEDGE STONE.
SO, UH, WE DON'T CONTROL WHERE THEY WILL ULTIMATELY PUT THEIR LIFT STATION.
HOPEFULLY THEY WILL MOVE IT FROM THE PROPOSED LOCATION THAT WAS ON THE SCR, UH, WHEN THEY GET THE CHANCE TO DO SO WHEN THEY SUBMIT A SITE PLAN, BUT IT IS A TOTALLY DIFFERENT CASE.
UM, I JUST WANTED TO MAKE THAT CLEAR THAT WE'VE RESPONDED TO THE NEIGHBORS WE'VE MOVED OURS, AND WE HOPE THAT YOU'LL, UH, UH, BE MOVED TO SUPPORT OUR SCR, UM, AND, UH, NOT HAVE US DISTURB A CONSIDERABLE AMOUNT OF LAND, EIGHT ACRES OF UPLANDS.
YEAH, SCOTT, LET'S GO AHEAD AND GO TO SYSTEM COMMUNICATION.
SO THE FIRST PERSON UP IS STEPHANIE HAMMON AND WE HAVE THREE MINUTES.
YOU HAVE THREE MINUTES MA'AM IF YOU WOULDN'T MIND, JUST STATE YOUR NAME.
MY NAME IS STEPHANIE HARMON AND I'M ONE OF THE NEIGHBORS AND OUR PROPERTY IS RIGHT, UH, CHASTENED.
AND IT WOULD BE VERY CLOSE TO, UM, THE SCR 4 6 2 2, WHICH IS, I GUESS, HOPEFULLY NOW OUT OF THE RACE, BUT IT WOULD BE A BIG CONCERN FOR US AS NEIGHBORS, SINCE IT WOULD BE VERY CLOSE TO OUR PROPERTY, IT WOULD PROBABLY DEVALUE OUR PROPERTY VALUE.
AND IT WOULD ALSO DISTURB A LOT OF THE, UM, THE WILDLIFE THERE BECAUSE IT'S, UM, YOU KNOW, IT WOULD, IT'S SO FAR AWAY FROM WHERE IT WILL, SHOULD BE.
SO I HOPE THE, THE S E R 4 7 9 6 GOES THROUGH.
UM, NEXT STEP, WE HAVE KATE MCKINSEY.
UH, I LIVE ON TERRA LANE AND ASHLEY OAKS SUBDIVISION, HALF OF THE HOMES IN OUR NEIGHBORHOOD RUN ALONG THAT CREEK DEVILS PIN CREEK.
I AM IN FAVOR OF THIS SE R AS LONG AS IT IS IN THE LOCATION PREFERRED BY, UM, ARDIT PROPERTIES WHERE IT WAS ORIGINALLY PROPOSED RIGHT ON THE CREEK WOULD CREATE GREAT POTENTIAL FOR, UH, POLLUTION TO THE CREEK, BECAUSE IT'S NOT A QUESTION OF IF THOSE WILL EVER FAIL OR MALFUNCTION OR LAKE IT'S A QUESTION OF WHEN THEY WILL MALFUNCTION AND LEAK.
SO AS LONG AS IT IS UP ON THE PROPERTY, WELL, AWAY FROM THE CREEK, WE'RE IN FAVOR OF IT.
IT ISN'T REALLY THE PREFERRED SITE FOR THE APARTMENT COMPLEX BUILDERS.
IT COULD POSSIBLY BE CHANGED BY THE WASTEWATER COMMISSION OR THE ENVIRONMENTAL COMMISSION, YOU GUYS.
SO IT'S REALLY IMPORTANT THAT WE STAY IN A SAFE LOCATION TO PROTECT THE CREEK AND TO PROTECT A NEIGHBORHOOD THAT HAS BEEN THERE SINCE THE EARLY 1980S, 32 HOMES, 32 HOMEOWNERS WHOSE PROPERTY VALUES WOULD BE IMPACTED.
ALSO BACK IN 1985, THERE WAS A LAWSUIT STARTED BY MY NEIGHBORHOOD AGAINST A COMPANY THAT WANTED TO PUT IN AN ASPHALT PLANT.
WE WON, WE STOPPED THE ASPHALT PLANT THAT, UH, LAWSUIT, UH, THE FINAL JUDGMENT IS NUMBER 3 7 5 2 5 8.
AND AT THAT TIME WE HAD CONSIDERABLE DEVELOPMENTAL RESTRICTIONS PLACED ON THAT PROPERTY, WHICH ARE STILL IN EFFECT TODAY AND
[01:05:01]
SHOULD BE ABIDED BY IF WE BLINK.IF WE CLOSE OUR EYES, IF WE'RE NOT ACTIVE, THOSE CAN BE OVERLOOKED.
UM, AND NOT FULLY IMPLEMENTED.
WE WERE AN ACTIVE COMMUNITY IN 1985.
WE ARE STILL AN ACTIVE COMMUNITY, AND WE'LL BE WATCHING THE DEVELOPMENT OF THIS PROPERTY AND PROTECTING OUR, UH, CREEK AND OUR NEIGHBORHOOD.
NEXT UP IS TERRY HENDRICK, BUT IT'S NOT VERY LONG.
UH, FIRST OF ALL, THANKS FOR LETTING ME SPEAK TONIGHT.
MY NAME IS TERRY HENDRICK AND I LIVE AT 9,400 FLINT ROCK CIRCLE.
UH, MY HOUSE IS RIGHT BEHIND THE CONCEPTIONAL, UH, PROP, UH, RIGHT BEHIND THE EXCEPTIONAL LIST STATION.
SO THAT'S WHY I'M HERE TONIGHT TO SPEAK.
I'M ASKING THAT THE ENVIRONMENTAL COMMISSION, UM, TO I'M ENCOURAGING YOU TO, UH, TO ENCOURAGE THE WASTEWATER COMMISSION AND THE CITY COUNCIL TO INFLUENCE THE DEVELOPERS OF ROSENTHAL AND LEADSTONE TO JOIN TOGETHER, TO BUILD A SHARED LIFT STATION IN ORDER TO ELIMINATE THE ENVIRONMENTAL CONSEQUENCES OF DISTURBING THE LAND UNNECESSARILY BY BUILDING TWO LIFT STATIONS IN SUCH CLOSE PROXIMITY TO EACH OTHER, AND THE POTENTIAL OF NEGATIVE IMPACT TO THE RESIDENTIAL PROPERTIES ALONG FLINTLOCK CIRCLE.
IF THE SECOND LIFT STATION IS BUILT ANYWHERE NEAR THE LOCATION SHOWED ON THE SCR 46, 22 MAP, THESE POTENTIAL NEGATIVE IMPACTS, UM, BEING THE SALE OF OUR PROPERTIES AND THE FAILURE OF LIFT STATION AT SOME POINT.
SO, AND ALSO THEY'RE NOT HERE ANYMORE, BUT I DID WANT TO APPLAUD THE STUDENTS THAT CAME AND TALKED ABOUT RECYCLING.
LAST UP, WE'VE GOT MICHAEL WHALEN WHO SIGNED UP TO SPEAK AS A REPRESENTING THE APPLICANT AS WELL, JUST TO SAY SAD, LIKE ONE MORE TIME.
CAN HE DO THAT? I DIDN'T KNOW WHETHER I HAD TO SIGN UP.
SO, UH, AND ONLY HERE, IF THERE'S ANY QUESTIONS AND, YOU KNOW, UH, WE ARE HOPEFUL AS I INDICATED THAT ON THE SCR 4 6, 2, 2, THAT THERE'LL BE A SITE PLAN THAT MOVES IT, UH, TO INAPPROPRIATE LOCATION.
THAT'S THAT'S ONE THAT'S ALREADY PASSED.
WE WE'VE BEEN AROUND THE CORNER HERE.
OH, WE HAVE ANOTHER COMMENT COMING.
KAYLA CHAMPLIN, WATERSHED PROTECTION.
I JUST WANTED TO OFFER A QUICK CLARIFICATION.
UM, A FEW OF THE COMMUNITY MEMBERS REFER TO THE WONG TRAP.
THAT IS THE LEDGE STONE PROPERTY, JUST IN CASE YOU WEREN'T CLEAR ON THAT.
YEAH, SHE'S GOT HER HAND UP TOO.
UM, THIS QUESTION IS FOR MS. CHAMPLIN ART AND STAFF.
UM, SO IT WAS MY UNDERSTANDING THAT THE REQUESTS TO THE ENVIRONMENTAL COMMISSION TO ME IS TO CONSIDER REVIEWING THIS WASTEWATER SERVICE EXTENSION.
UM, BUT WHEN I WAS, YOU KNOW, LISTENING TO THE, UM, THE REMARKS BY THE COMMUNITY AT TWO TO TWO ITEMS CAME UP, UM, ABOUT, SORRY, THAT'S MY SIX-YEAR-OLD SON WHO DOES OPEN THE DOOR.
SO ONE WAS ABOUT THE, UM, PER LIKE THE PREFERRED LOCATION, UM, YOU KNOW, THE PREFERRED SITE AND THE OTHER ONE WAS ABOUT HAVING A SHARED LIFT STATION.
AND SO IS THAT A PART, ARE THOSE TWO ITEMS ALSO A PART OF CONSIDERATION BY OUR COMMISSION TONIGHT? UM, HOW DO WE CONSIDER THAT WITH RESPECT TO WHETHER OR NOT TO APPROVE THE EXTENSION? RIGHT.
SO I THINK ONE IMPORTANT CLARIFICATION TO MAKE IS THAT THE LOCATION OF THE PROPOSED LIFT STATION AND, UM, AND THE FORCE MAIN ARE NOT, UM, CONFIRMED.
THEY'RE JUST CONCEPTUAL AT THIS POINT UNTIL THEY COME THROUGH WITH A SITE PLAN.
SO, UH, IT, AS THE DEVELOPER HAS SAID, UM, THEY'RE WORKING WITH THE COMMUNITY ABOUT THE LOCATION, BUT, UM, AT THIS POINT IT'S JUST CONCEPTUAL.
SO WHAT YOU'RE APPROVING ESSENTIALLY IS, UM, THE PROPOSED IMPROVEMENTS THAT ARE ON THE MAP, UM, FOR THE GRAVITY WASTEWATER MAIN, THE, UM,
[01:10:01]
A LIFT STATION AND THE FORCE MAIN ASSOCIATED WITH THE PROPERTY.UM, THE PREFERRED LOCATION IS AT THIS POINT, NOT SOMETHING THAT WE CAN DETERMINE OR TIE TO THE SCR.
UM, THE SHARED LIFT STATION IS SOMETHING THAT WE'VE LEARNED THROUGH THE CONVERSATIONS WITH THE DEVELOPERS THAT, UM, AND CERTAINLY STAFF'S PREFERENCE WOULD BE FOR A SHARED LIFT STATION.
UM, BUT AT THIS POINT WE CAN'T GUARANTEE THAT IT'S GOING TO HAPPEN.
SO WE TRIED TO OFFER YOU SOME ALTERNATIVES.
IF THE, UM, IF OUR PREFERRED SCENARIO OF A SHARED, SHARED LIFT STATION IS NOT APPROVED, UH, OR THE, OR THE DEVELOPERS CAN'T COME TO AN AGREEMENT TO, TO SHARE THAT LIFT STATION, THEN THE ALTERNATIVE WOULD BE, UH, THIS PROPERTY WOULD GO AHEAD AND DEVELOP THEIR LIFT STATION.
AND THEN WHEN THE LEDGE STONE PROPERTY IS READY TO DEVELOP, THEY WOULD EITHER UPGRADE THE EXISTING LIFT STATION ON THIS PROPERTY, OR THEY WOULD BUILD THEIR OWN LIFT STATION.
BUT TONIGHT WE CAN'T REALLY TALK ABOUT THAT ONE IT'S ALREADY BEEN APPROVED, BUT WE WON'T KNOW THE LOCATION OF THAT PROPOSED LIFT STATION IN THAT SCENARIO UNTIL THEY COME THROUGH WITH A SITE PLAN.
DOES, DID I EXPLAIN THAT CLEARLY ENOUGH? DOES THAT MAKE SENSE? OKAY.
DO YOU WANT TO ADD TO IT? UM, ALSO, UH, THANK YOU KAYLA.
UM, ONE OTHER POINT OF CLARIFICATION THAT WE NEED TO REMEMBER, UM, DUE TO STATE LAW, OUR LEGAL STAFF HAVE, UM, ADVISED US THAT WE ARE UNABLE TO APPLY ANY CONDITIONS ON APPROVAL FOR SERVICE EXTENSION REQUESTS.
AND SO, UM, WE, WE CAN DO OUR BEST.
WE CERTAINLY CAN SAY WHAT WE WANT, BUT WE CANNOT, UM, WE CAN'T HAVE ANY CONDITIONS, UNFORTUNATELY, NO FURTHER QUESTIONS.
I'LL START DOWN HERE FIRST WITH YOU.
OVER HERE TO MR. PERMISSION OF BRIMER.
SO, UH, KAYLA, IF I UNDERSTAND CORRECTLY, THERE'S ALREADY A LIFT STATION APPROVED ON THE LEDGE STONE PROPERTY.
UM, IT HASN'T BEGUN CONSTRUCTION.
THEY DON'T HAVE A DEVELOPMENT PERMIT IN YET, BUT, UH, THE SCR IT HAS BEEN APPROVED.
SO THEY'RE UNDER NO OBLIGATION TO DO ANYTHING WITH REGARD TO THIS NEW TOOL THAT WE'RE LOOKING.
NOW, WE CAN ONLY, YOU KNOW, ENCOURAGE THEM TO NEGOTIATE WITH THE CURRENT DEVELOPER HERE THAT WE'RE LOOKING AT TONIGHT TO BE FRIENDS.
LIFT STATIONS AND ALL THAT OTHER SORT OF THING.
I THINK I SAW COMMISSIONER SCOTT HAD A QUESTION.
WHAT WAS YOUR ANSWERS NOW? COMMISSIONER KERSCHER OKAY.
UM, I HAD, UH, I HAD A COUPLE OF QUESTIONS, FIRST OF ALL, YOU KNOW, I WOULD JUST LIKE TO SAY THAT, UH, YOU KNOW, I GREW UP IN THE CEDAR VALLEY BELTERRA AREA.
SO, YOU KNOW, THIS AREA IS VERY CLOSE TO MY HEART.
SO I DEFINITELY FEEL FOR ALL THE COMMUNITY MEMBERS OR WORRIED THAT, YOU KNOW, THEIR QUALITY OF LIFE MIGHT BE IMPACTED.
UH, YOU KNOW, AS THIS QUICKLY DEVELOPING AREA OF AUSTIN BECOMES, YOU KNOW, MORE TREELESS AND, UH, MORE HOMEFUL I GUESS.
UM, ONE OF MY QUESTIONS WAS, UM, SO IF THERE'S A LIFT STATION APPROVED AT, UH, WAS IT LEADSTONE I THINK THE NEIGHBORING PROPERTY, UM, AND WE'RE TALKING ABOUT POSSIBLY HAVING LIKE A SHARED LIFT STATION, I GUESS, WOULD THAT BE AT THE LEDGE STONE PROPERTY? WOULD THAT BE ON THIS PROPERTY? UH, YOU KNOW, IF THIS, IF THE PROPOSED LIFT STATION THAT'S IN FRONT OF YOU TONIGHT IS APPROVED, THEN IT COULD POTENTIALLY BE ON EITHER PROPERTY.
BUT I BELIEVE IN I'LL LET THE DEVELOPER CONFIRM THIS, BUT I BELIEVE THE NEGOTIATION IS THAT IT WOULD BE ON THE PROPOSED PROPERTY THAT HAS, IS PROPOSING AN STR HERE TONIGHT.
UM, MR. WAYLON, DID YOU WANT TO SPEAK TO THAT? OKAY.
MICHAEL WHALEN ON BEHALF OF THE APPLICANT, I'M GLAD YOU SAID TREELESS.
CAUSE THAT'S WHAT THE SAD, YOU KNOW, THE DRIP SYSTEM WOULD REQUIRE US FOR THAT EIGHT ACRES, BUT THE PREFERRED OPTION, FOR SURE.
NO, IT'S NOT THE, UH, BUT TO YOUR POINT TO YOUR POINT, COMMISSIONER, I THINK MANY PEOPLE ARE WONDERING THE SHARED LIFT STATION FINANCIALLY MAKES THE MOST SENSE, CAUSE YOU'RE IT'S HALF THE COST FOR EACH.
AND, UH, SO THAT IS SOMETHING THAT WE'VE ACTIVELY HAD A DISCUSSION WITH FOLKS.
WE, WE ALSO HAVE REMEMBER, UH, THE, THE ROAD CUTTING BETWEEN US.
SO WE WOULD NEED SOME COMPROMISE WITH THAT PARTICULAR LANDOWNER AS WELL.
UH, THE LEDGE STONE, WHOEVER IS GOING TO BUY THE LEDGE STONE AND DO ANYTHING, YOU KNOW, RIGHT NOW IT'S ONE PARTICULAR DEVELOPER, YOU KNOW, THEY'RE NOT OBLIGATED TO DO THIS, BUT WE THINK IT'S IN THEIR INTEREST TO DO IT, WHICH IS WHY WE'VE BEGUN THAT DISCUSSION.
[01:15:01]
A SITE PLAN LIKE OURS IS REAL.WE'VE ALREADY INVESTED IN MEANINGFUL ENGINEERING.
WE HAVE OUR ENGINEER HERE AND IF SPENT HUNDREDS OF THOUSANDS OF DOLLARS TO GET A SITE PLAN IN MOST LIKELY YAS LIFT STATION WILL BE BUILT FIRST.
THAT'S WELL, DEFINITELY BE BUILT FIRST BECAUSE WE ALREADY HAVE A SITE PLAN IN.
WE, OURS WAS MOST LIKELY TO BE FIRST, WHICH IS AN A PREFERRED LOCATION.
I THINK YOU HEARD THAT FROM THE NEIGHBORS BECAUSE WE'RE FURTHER AWAY FROM THE NEIGHBORHOOD AND WE'RE AWAY FROM THE CREEK.
SO, UM, I'M HOPEFUL THAT WE DO COME TO SOME AGREEMENT, BUT WE REALLY CAN'T REACH THAT AGREEMENT UNLESS WE HAVE AN SCR THAT GIVES US THE RIGHT TO HAVE THE LIFT STATION.
I'M GOING TO GO BACK OVER HERE.
I BOUGHT YOU COMMISSION A POSTAL.
UM, YEAH, MY QUESTION IS, UM, YOU MENTIONED THAT, UM, THAT THIS HAS A S A SPECIAL CLAUSE THAT THE PROPERTY WOULD ONLY HAVE TO ABIDE BY 1995 RULES IS THAT ALSO APPLIES TO THEIR LIFT STATION.
AND DOES IT ALSO APPLY TO, UM, THE, THE MAIN THAT'S COMING IN AND HOW DOES THAT IMPACT IT? THE, THE VESTING RIGHTS ONLY APPLIED TO THE PARCEL, UM, THAT, THAT HAS THE, UM, THE LIFT STATION, THE APARTMENT COMPLEX, THE, THE, THE MAIN, AND ALL THE, UM, THE NECESSARY INFRASTRUCTURE THAT WOULD BE CONSTRUCTED TO SERVE THE SITE WOULD FOLLOW, UH, CITY FULL CODE COMPLIANCE, CURRENT CODE.
AND JUST TO EMPHASIZE ANY CONSTRUCTION OF WOULD BE NOT ALLOWED AT THE LIFT STATION AND FORCED MAIN WOULD NOT BE ALLOWED IN THE CRITICAL WATER QUALITY ZONE WITH A WATER QUALITY TRANSITION ZONE.
ANY OTHER QUESTIONS AS I'M FINISHED? I NEED TO GO NOW TO COMMISSIONER SCOTT.
I CAN COME BACK AROUND TO YOU AFTER WE FINISH.
HI, I AM NOT THAT FAMILIAR WITH LIFT STATIONS, BUT I, I GATHERED THAT'S, UH, UM, UH, UH, ASSU UH, SEWAGE, UM, UM, MAIN, WHICH BRINGS, UH, THE THINGS TO THE POINT WHERE YOU CAN GET, GET, GET THEM FLOWING DOWNHILL.
AND, UH, UM, MY QUESTION IS JUST ONE OF, UM, THE RESILIENCE OF, OF SUCH A LIFT STATION, UM, AND WHAT CAN BE DONE TO, UM, TO KEEP IT FROM FAILING IN THE EVENT OF A, UH, TORRENTIAL RAINS, UH, YOU KNOW, THE KINDS OF THINGS THAT, UM, SOMETIMES HAPPEN IN THIS AREA.
UH, JUST, I JUST DON'T REALLY KNOW WHAT, I DON'T KNOW WHAT HAPPENS WITH THAT SORT OF THINGS.
AND, UM, I JUST WANT TO MAKE SURE THAT WE'RE LOOKING AHEAD, UH, AND, AND, UM, MAKING SURE THAT WE HAVE RESILIENT, UM, UM, THAT WE HAVE, UH, A RESILIENT PLAN SO THAT, UM, WE DON'T HAVE, OH, YEAH, IT WAS FINE UNTIL THIS HAPPENED, BUT THEN, THEN EVERYTHING WENT SIDEWAYS.
UM, AND, AND I DON'T KNOW THAT THAT'S THE CASE OR THAT IT WOULD, I JUST, I'M, I'M ASKING FOR INFORMATION.
I'M A CIVIL ENGINEER AND I'M THE CIVIL ENGINEER WITH THE RDM PROPERTY.
LOOKING AT THIS DEAL WHEN THE LIFT STATION IS DESIGNED FOR THE CITY OF AUSTIN CODE, UM, ONE OF THE THINGS THEY ACTUALLY HAVE TO DO IS YOU GOT TO LOOK AT ALL THE OLD ELECTRIC RECORDS AND FIND OUT WHAT WAS THE LONGEST TIME YOU'VE BEEN OUT OF SERVICE.
AND YOU GOT TO TAKE THAT INFORMATION AND DESIGN YOUR PA YOUR, YOUR, UH, LIFT STATION TO HANDLE THAT WITH NO ELECTRICITY, IT'S GOING TO HAVE TO FILL UP.
IT'S GOING TO HAVE TO HANDLE THAT.
WHAT'S, WHAT'S SOME SAFETY FACTORS YOU ADD TO THAT, THE FACT THAT ONE PUMP COULD PUMP EVERYTHING, BUT THERE'S TWO AND THEY ALTERNATE.
SO THERE'S ALWAYS SOMETHING GOING ON.
SO, YOU KNOW, SO YOU HAVE TWO PUMPS, THEN YOU GOT THE GENERATOR, THEN YOU GOT A GENERATOR THAT WILL KICK IN, IN CASE THE ELECTRICITY GOES OUT FOR TOO LONG.
SO YOU HAVE ALL THESE, THESE BACKUP INFORMATION, ALL THIS BACKUP STUFF TO, YOU KNOW, TO PREVENT ANY ACCIDENTS.
SO THAT'S THAT, YOU KNOW, SO THERE'S A LOT OF, YOU KNOW, UH, REDUNDANCY IN THE SYSTEM AND NEVERMIND THE COMMUNICATION REQUIRED WITH THE SCADA SYSTEM.
THAT BASICALLY, I THINK THE CITY CAN OPERATE THESE LIFT STATIONS REMOTELY AND KNOW EXACTLY WHAT'S GOING ON FROM, YOU KNOW, FROM A FAR AWAY.
[01:20:02]
MR. WAYLON, I KNOW YOU'VE BEEN IN AGREEMENTS WITH OTHER NEIGHBORHOODS.YOU'VE WORKED OUT SOME VERY DIFFICULT SITUATIONS, UM, AND I'M GLAD TO SEE THAT YOU'RE MOVING IT INTO A PREFERRED AREA.
THE ONE THING THAT MAKES ME FEEL GOOD IS THAT THE NEIGHBORS KNOW HOW TO SUE, YOU KNOW, AND, UM, I'M REALLY PLEASED TO NOW YOU'RE, THEY'RE ACTIVE.
HOPEFULLY THEY WON'T GET TO THAT POINT AND THAT THEY, YOU COULD COME AND, UM, UNFORTUNATE THE OTHER PERSON THAT OWNS THE OTHER PROPERTY.
ISN'T ALREADY ON BOARD WITH YOU PRIOR TO THAT, HOW SOON ARE YOU PLANNING TO DEVELOP OUT, DO YOU THINK? WELL, I THINK BY GETTING THIS SCR, THAT'LL GIVE US SOME MOMENTUM, UH, FRANKLY, UM, I DID WANT TO GIVE SOME ASSURANCE.
WE ARE, I CONFIRMED AT 25% NET SITE AREA.
I KNOW THAT'S KIND OF WHERE YOU WERE HEADING.
I WANTED TO ASSURE YOU OF THAT AS WELL, BUT I, I, I'M HOPEFUL, I THINK MORE HOPE EXISTS THAN, UH, THEN DOES IT IN THIS PARTICULAR CIRCUMSTANCE BECAUSE IT JUST MAKES ECONOMIC SENSE TO DO IT THAT WAY.
SO ANY OTHER QUESTIONS PRIOR TO CLOSING THE PUBLIC HEARING? DID YOU HAVE SOMETHING COMMISSIONER FARMER, WELL, JUST KIND OF FURTHERING THAT, THE STATEMENT YOU JUST MADE THE DISCUSSION ABOUT LEADSTONE LEDGE STONE WAS KIND OF AMORPHOUS.
I MEAN, THEY'RE SPOKEN OF AS SOMETHING THAT IS KIND OF THERE, BUT DOESN'T REALLY EXIST, BUT YOU SEEM TO BE HOPEFUL THAT AN AGREEMENT CAN BE REACHED WITH THEM.
I MEAN, IT SEEMS TO MAKE ECONOMIC SENSE TO DO THIS TYPE OF THING.
IS THERE ANY REASON WHY THEY WOULDN'T WANT TO DO THIS, UM, MICHAEL WHALEN ON BEHALF OF THE APPLICANT, THEY MAY NOT BUY IT, RIGHT.
WE'RE TALKING TO ITS OWN WHEN IT WAS REFERRED TO AS THE LONG TRACK.
I THINK MR. WONG OWNS IT AND IS SELLING IT TO SOMEBODY AND THAT'S WHO WE'VE BEEN TALKING TO IS THE POTENTIAL BUYER.
SO IT IT'LL ULTIMATELY OCCUR WHEN THERE ISN'T A REAL BUYER WHO HAS CLOSED ON THE PROPERTY AND IS READY TO, UH, MOVE FORWARD WITH THE SITE PLAN.
BUT THE FACT THAT WE WILL HAVE OUR SITE PLANS ALREADY IN IS I ALREADY HAVE SAID NUMEROUS TIMES.
I MEAN, THE FACT THAT WE'RE THAT FAR ALONG, UH, IS GOING TO CREATE, UH, UH, A LOT OF PRESSURE, YOU KNOW, UH, WITH THAT OPPORTUNITY, FRANKLY.
I HOPE WE CERTAINLY DO ENCOURAGE YOU TO CONTINUE YOUR DISCUSSIONS WITH THE NEIGHBORHOODS.
WE ARE VERY CONCERNED ABOUT, ABOUT WHAT THEY HAVE BROUGHT FORWARD TO US TONIGHT.
SO I THINK EVERYONE'S ON BOARD, PLEASE.
IS THERE A MOTION TO CLOSE THE PUBLIC HEARING? IF THERE'S NO FURTHER DISCUSSION? I MOVE TO CLOSE RAMBERT SECOND BY SCOTT ON FAVOR, SAY AYE.
MA'AM ON AGENDA ITEM TO SEE THE SUBJECT BEING, UH, 82 21 WEST HIGHWAY TWO 90, SORRY, US TWO 90 WEST WASTEWATER SERVICE EXTENSION REQUEST 4 7, 9, 6.

ALMOST FORGOT MYSELF WHAT IT IS, BUT, UH, IT, IT, I'M NOT SURE THAT IT WILL ACTUALLY AFFECT THE BATS PER SE, BUT THAT IS THE, UH, THE INTENT AND I WILL SPEAK ABOUT IT, UM, WHEN I'M ALLOWED TO TAKE YOU.
AND, UH, EMAILS ARE GREAT TO FORWARD THOSE TO US.
WE REALLY APPRECIATE YOUR EFFORTS.
AND FOR TAKING ON THIS INITIATIVE MUCH APPRECIATED, MUCH APPRECIATED, NOT A PROBLEM.
