IT HAS BEEN BUILT UPON THE HEADWATERS A LITTLE WALNUT CREEK, UH, TO BUILD THAT STADIUM AND PUT SO MUCH IMPERVIOUS COVER. THEY HAD TO PUT A FLOOD WATER, A STORM WATER DETENTION POND. NOW THE PROBLEM WITH THE POND IS THAT IT DOESN'T DRAIN AS OPPOSED TO TRAIN FOR HOURS, BUT IT DOESN'T EVER DRAIN. AND A WATERSHED IS WORKING ON THIS WITH THE STADIUM BECAUSE IT'S A, IT'S A REGIONAL POD HAS GOT TO WORK. RIGHT. BUT THERE IS AN ISSUE THAT I JUST WANT TO BRING POINT OUT TO YOU THAT THE POND, BECAUSE IT'S, IT HAS TO BE PRETTY BIG. IT'S BUILT BELOW GRADE AND THERE IS A PUMP THAT PUMPS THROUGH THE BOTTOM AND PUMPS DOWN LITTLE WALNUT CREEK. AND RIGHT NOW THE, THE, THE PUMP IS, UM, THERE THERE'S SOME BLOCKAGE IN THE, UH, THE OUTFLOW AND THEY'RE, THEY'RE PLANNING ON FIXING THAT AND IT'S LOOKS LIKE WE'RE HAVING A DRY SUMMER. THEREFORE, THE APPLICANT HAS REQUESTED TO VARY FROM THE CUT REQUIREMENTS TO BE ALLOWED TO CUT OVER FOUR FEET DOWN TO 16 FEET. NEXT SLIDE, PLEASE. HERE IS THE GRADING EXHIBIT. ALL OF THE COLORS, THERE ARE GRADING A CUT MORE THAN FOUR FEET. SO THE GRAY GOES UP TO FOUR FEET AND OVER FOUR FEET, THERE'S ALL THOSE PRETTY COLORS. YOU CAN SEE THE PURPLE IS UP THERE WHERE THE WORST OF THE STEEPEST OF THE, UM, OF THE FILL WAS. AND NEXT SLIDE PLEASE. SO STAFF FIGURES THAT'S THE, UH, OR JUDGES THAT THE REMOVAL OF THE FILL AND DEVELOPMENT OF THE SITE WILL REDUCE THE POTENTIAL FOR FUTURE EROSION ON THESE STEEP ARTIFICIALLY CONSTRUCTED SLOPES. THEREFORE WE RECOMMEND THE VARIANCE WITH THE FOLLOWING CONDITIONS THAT ALL GRADING OVER EIGHT FEET WILL BE CONTAINED WITH TERRACING OR ENGINEERED WALLS THAT AROUND THE PERIMETER OF THE LIMITS OF CONSTRUCTION AND IN AREAS WHERE MORE THAN THREE FEET OF VERTICAL RISE IS PROPOSED ALL THREE TO ONE SLOPES FOR GREATER WE'LL HAVE EROSION CONTROL MATTING APPLIED IMMEDIATELY AFTER FINAL GRADE IS ACHIEVED TO REDUCE EROSION. AND THE THIRD CONDITION IS THAT DISTURBANCE IN THE WATER IRRIGATION FIELDS WILL BE MINIMIZED BY RESTRICTING THE LOC OR LIMITS OF CONSTRUCTION AND ROUTING THE IRRIGATION LINES IN SUCH A WAY AS TO PRESERVE [00:15:01] THE EXISTING TREES TO THE GREATEST EXTENT POSSIBLE. THIS IS A SOMEWHAT UNIQUE, UH, SITUATION CIRCUMSTANCE IN THAT THE CODE DOESN'T REALLY ADDRESS HOW TO DEAL WITH CUT AND FILL WHEN YOU HAVE AREAS THAT WERE PREVIOUSLY DISTURBED BEFORE THEY FELL UNDER THAT, YOU KNOW, UNDER THAT JURISDICTION. AND SO, UM, YOU KNOW, WE WENT BACK AND FORTH WITH STAFF ON, ON A VARIETY OF OPTIONS AND SCENARIOS. AND AT THE END OF THE DAY, FELT LIKE IT WAS JUST BEST TO CLEAN IT UP AND GO THROUGH THE VARIANCE PROCESS. AND SO THAT'S, THAT'S REALLY THE PURPOSE OF US BEING HERE. UM, UH, BUT LIKE PAMELA SAID, UH, THE PHIL'S BEEN THERE SINCE THE EARLY EIGHTIES, IT WAS PLACED IN AN UNCONTROLLED MANNER. UH, AND, AND IT'S ONE THAT STAFF, UH, FELT LIKE THEY COULD SUPPORT THE VARIANTS FOR. SO, UH, IT'S A, IT'S A GRADING PLAN THAT MINIMIZES THE DISTURBANCE AS MUCH AS POSSIBLE WHILE ALLOWING US TO FULLY BE ABLE TO UTILIZE, UH, THE SITE, UM, IN THE MANNER THAT WE'RE PROPOSING. UH, THIS PORTION OF THE PROJECT IS, UH, COMPLYING WITH SOS. UM, AND I GUESS, YOU KNOW, ACCOMMODATE THEIR WISHES OR KIND OF HOW IS, HOW IS THAT GONNA HOW'S THE RUBBER HIT THE ROAD ON THAT CONDITION? YEAH, SO THE, THE, THE PLANS, UM, ON THE EROSION SEDIMENTATION CONTROL PLAN, WE DELINEATED THE LOC. SO THAT'S APPROXIMATELY 10 FEET WIDE, UH, ALONG WHERE THE IRRIGATION LINES WILL BE LOCATED. AND THEN, UM, WHAT FRANK, HISTORICALLY WHAT FRANK, UM, REQUIRES WHEN HE INSPECTS THESE AREAS. HE, HE DOESN'T, HE DOESN'T REQUIRE US TO LITERALLY CLEAR TREES, BUT HE DOES SOMETIMES REQUIRE US TO PRUNE THE TREES SO THAT THE CANOPY IS LIFTED UP TO ALLOW THE IRRIGATION TO, TO SPREAD OUT MORE AND, UH, YOU KNOW, GET BETTER ABSORPTION INTO THE, INTO THE SOIL. IT'S BLUE THAT ACTUALLY HAS FLOOD PLAIN, AND IT IS THE, UM, CRITICAL WATER QUALITY ZONE THAT AFFECTS THE SITE. THE AREA IN QUESTION, THERE IS COMPLETELY 100% IMPERVIOUS COVER. SO THIS IS AN AERIAL VIEW OF THE EXISTING CONDITIONS AT THE SITE WITH THE CITY OF AUSTIN FULLY DEVELOPED 100 YEAR FLOOD, PLAIN AND CRITICAL WATER QUALITY ZONE SHOWING THE PROPOSED BRIDGE CROSSING. THERE WAS UNPERMITTED DEVELOPMENT, INCLUDING THE CONSTRUCTION OF A PAVED PARKING LOT IN THE FLOOD, PLAIN AND CRITICAL WATER QUALITY ZONE. AS YOU CAN SEE HERE, AND IN ORDER TO CONSTRUCT THE BRIDGE AND DEVELOP THE NORTHERN PORTION OF THE SITE, GRADING IS NECESSARY IN THE FLOODPLAIN AND CRITICAL WATER QUALITY ZONE. NEXT SLIDE, PLEASE. THE AREA SHADED IN GRAY IS THE AREA OF GRADING OR PROPOSED PLANT FLOODPLAIN MODIFICATION. THE FLOOD PLAIN ASSESSED AS THE CITY OF AUSTIN FULLY DEVELOPED 100 YEAR FLOOD PLAIN IN THIS IMAGE, THE RED HATCHING IS THE APPROXIMATE BOUNDARIES OF GRADING AND THE CONSULTANT USED APPROPRIATE METHODOLOGY TO CONDUCT THE FH AND THE SAMPLE PLOTS. READ IT THE FLOOD PLAIN IN FAIR CONDITION, THE SCORES HAVE FOUR RATINGS RANGING FROM EXCELLENT TO GOOD, TO FAIR, TO POOR. NEXT SLIDE, PLEASE FOR FLOODPLAIN MODIFICATION, EITHER FLOODPLAIN RESTORATION ONSITE OR OFFSITE MITIGATION IS REQUIRED. THE OFFSITE MITIGATION IS BASED ON RATIOS AND ECM 1.7 0.6 AND THE TOTAL FLOODPLAIN MODIFICATION AREA FOR THIS SITE IS 2.69 ACRES. THE AREA OF FLOODPLAIN MODIFICATION IN ZONE ONE, WHICH IS THE FLOODPLAIN OUTSIDE. THE CRITICAL WATER QUALITY ZONE IS OUTLINED IN YELLOW AND EQUATES TO LESS THAN A 10TH OF AN ACRE. THE ZONE ONE AREA WAS SCORED AS FAIR, WHICH EQUATES TO THE MITIGATION RATIO OF THREE TO ONE USING THE MITIGATION RATIO TABLE AND ECM 1.7 0.6 AND THE THREE TO ONE RATIO RESULTS IN 0.19 ACRES, 1 9 2 ACRES OF MITIGATED AREA. THE AREA OF FLOOD PLAIN MODIFICATION AND ZONE TWO. THE FLOODPLAIN WITHIN THE CRITICAL WATER QUALITY ZONE IS OUTLINED IN RED AND EQUATES TO 2.626 ACRES. THE ZONE TWO AREA WAS ALSO SCORED AS FAIR, WHICH CORRESPONDS TO A SIX TO ONE RATIO IN THE MITIGATION RATIO TABLE AND RESULTING IN 15.75, SIX ACRES OF MITIGATION AREA REQUIRED COMBINING THE CALCULATED ZONE ONE AREA AND ZONE TWO AREA. THE TOTAL MITIGATED MITIGATION ACREAGE REQUIRED EQUATES TO 15.948 ACRES. AND THIS TOTAL ACREAGE IS USED TO CALCULATE THE FEE TO PAY INTO THE RIGHT PERIOD ZONE MITIGATION FUND. NEXT SLIDE, PLEASE. THE APPLICANT IS ALSO PROVIDING ENHANCED POND OUTFALL STRATEGIES TO REDUCE EROSIVE CONVEYANCE THAT COULD DEGRADE THE WETLANDS CF AND CF SETBACKS. THE DETENTION POND OUTFALLS CIRCLED IN GREEN AT THE SOUTH HAS BEEN MODIFIED TO BE A STILLING BASIN WITH FOUR ROWS OF STAGGERED NATIVE BUNCHGRASSES AROUND THE ENTIRE PERIMETER OF THE STILLING BASIN. THIS PROVIDES ADDITIONAL INFILTRATION AND DISBURSES SHEET FLOW MORE EQUITABLY. THE WATER QUALITY POND OUTFALL HAS BEEN MODIFIED TO INCLUDE A PERIMETER OF FOUR ROWS OF SWITCHGRASS AND EASTERN GAMMA GRASS ON TWO FOOT CENTERS AS WELL. AND THE PEERS FROM THE PROPOSED BRIDGE DESIGN HAVE BEEN STRATEGICALLY PLACED OUT OUTSIDE OF THE ACTIVE CHANNEL AND POSITIONED TO REDUCED IMPACTS TO THE WETLAND CF BOUNDARIES, THE BRIDGE PIERS SPAN OF MAJORITY OF THE WETLAND CF BOUNDARIES ONLY IMPACTING THE EDGE OF ONE OFF-SITE WETLAND. AS YOU CAN SEE IN THIS EXHIBIT, NEXT SLIDE. SIMILAR VARIANCES HAVE BEEN GRANTED FOR PROJECTS WITH SIMILAR CODE REQUIREMENTS AND SIMILAR RESTRICTIVE CIRCUMSTANCES TO ALLOW NECESSARY ACCESS TO THE SITE. THE VARIANCE IS NECESSITATED BY TOPOGRAPHIC TEACHERS, NOT DESIGN CHOICE GRADING OF THE FLOODPLAIN TO OFFSET THE VOLUME DISPLACED BY THE BRIDGE IS NECESSARY TO DEVELOP THE SITE. THE BRIDGE IS ALSO NECESSARY TO ACCESS THE SITE ACROSS THE FLOOD. PLAIN. THE VARIANCE IS ALSO THE MINIMUM DEVIATION FROM CODE. THE FLOODPLAIN MODIFICATION IS THE MINIMUM NECESSARY TO BUILD THE BRIDGE WITH CODE COMPLIANCE, SAFE ACCESS AND LOW CORD. AND THE LOW CORD OF THE BRIDGE IS TWO FEET ABOVE THE WATER SURFACE ELEVATION OF THE A HUNDRED YEAR FLOOD. PLAIN. THE VARIANCE IS UNLIKELY TO RESULT IN HARMFUL ENVIRONMENTAL CONSEQUENCES. A FLOOD STUDY REVIEWED REVIEWED BY THE CITY SHOWS NO ADVERSE IMPACTS TO OTHER PROPERTIES. BRIDGE PEERS HAVE BEEN PLACED TO MINIMIZE IMPACTS TO EXISTING WETLANDS. CES WETLAND MITIGATION AND FLOODPLAIN MITIGATION HAS BEEN APPROVED BY CITY STAFF. WATER QUALITY WILL BE EQUAL TO OR BETTER THAN THE WATER QUALITY WITHOUT THE VARIANCE EXISTING UNTREATED IMPERVIOUS COVER IN THE FLOOD PLAIN WILL BE REMOVED ALL NEWLY PROPOSED IMPERVIOUS COVER WILL RECEIVE FULL CODE COMPLIANT, WATER QUALITY TREATMENT. HOWEVER, UM, IN THIS CASE WE DO HAVE TO CONSTRUCT IT SO THAT IT IS A SAFE ACCESS POINT AND ABOVE THE A HUNDRED YEAR FLOOD PLAIN, UM, AS MENTIONED THE LOW COURT OF THE BRIDGE, THE BOTTOM OF THE STRUCTURE IS REQUIRED TO BE TWO FEET ABOVE THE HUNDRED YEAR SURFACE ELEVATION. SO, UM, IT WILL ALWAYS BE A SAFE ACCESS POINT FOR THE USERS OF THE SITE. UM, AND SO TO CONSTRUCT THAT BRIDGE, WE NEED THE TWO VARIANCES, ONE FOR THE FILL TO CONSTRUCT THE ABUTMENTS AND THEN THE OTHER TO OFFSET THE GRADING THAT WE, THE VOLUME WE'RE DISPLACING IN THE FLOOD PLAIN ELSEWHERE, SO THAT WE HAVE NO ASP ADVERSE IMPACT ON SURROUNDING PROPERTIES WITH THE TENDER.
