THE COMMISSION MAY GO INTO EXECUTIVE SESSION TO DISCUSS AGENDA ITEMS TWO AND THREE RELATED TO A COMPLAINT FILED BY JULIE OLIVER AGAINST RICHARD SMITH, WHICH COMPLAINT ALLEGES VIOLATION OF CITY CODE SECTION TWO DASH TWO DASH 14.

UM, SO THIS IS REGARDING AN ORIGINAL COMPLAINT THAT WAS FILED ON SEPTEMBER 29TH, 2022.

THE ISSUE AT THIS PRELIMINARY HEARING IS WHETHER REASONABLE GROUNDS EXIST TO BELIEVE THAT A VIOLATION OF CITY CO OF A CITY CODE PROVISION WITHIN OUR JURISDICTION HAS OCCURRED.

SO OUR REGULAR PRACTICE IS TO GIVE EACH OF THE PARTIES 10 MINUTES TO PRESENT THEIR POSITIONS AT A PRELIMINARY HEARING ON A COMPLAINT.

UM, WHILE THE STATEMENTS ARE UNDER OATH, THERE'S NO CROSS EXAMINATION ALLOWED.

AND IT JUST DIDN'T HAVE THE DISCLOSURE THAT SAID, THE CAMPAIGN HAS AGREED NOT TO COMPLY WITH THE CONTRIBUTION EXPENDITURE LIMITS OF THE AUSTIN FAIR CAMPAIGN, UH, CHAPTER.

AND SO I SUBMITTED THAT, LIKE I SAID, JUST, JUST UNDER A MONTH AGO OR SO.

AND, UM, AT THAT TIME, HIS CAMPAIGN MATERIALS DID NOT HAVE THAT REQUIRED DISCLOSURE.

UH, FAILURE TO INCLUDE FAILURE OF A NON-INCUMBENT TO USE THE WORD FOR, AND A CAMPAIGN COMMUNICATION THAT IS NOT OTHERWISE MISLEADING AND FAILURE TO INCLUDE THE RIGHT OF WAY NOTICE ON POLITICAL ADVERTISING.

SO BASICALLY THE THREE THINGS THAT A, ANY CANDIDATE
