A FEW HUNDRED FEET FROM THE TANK FARMS, UM, IS BEING BUILT.

THE CONSTRUCTION ON THE TANKS IS MOVING PRETTY QUICKLY, SO IN THE MATTER OF NINE MONTHS, UM, SINCE THE CITY COUNCIL LET THEM MOVE FORWARD, THEY HAVE BUILT TWO JET FARM FUEL TANKS.

UM, THERE HAS ALSO BEEN NO NOTICEABLE CHANGES TO OUR QUALITY OF LIFE AND INCLUDING WILDLIFE, WHICH, UM, I'VE SEEN RUN INTO MY YARD.

UH, THE RUNWAYS, UH, NEAR OUR NEIGHBORHOOD, UM, THE NOISE HAS INCREASED SINCE THEY'VE PUT THE TANKS UP.

UM, THE, THE NOISE IS DISTURB OUR SLEEP, ESPECIALLY THOSE WHO WORK SEVEN DAYS OF THE WEEK.

UM, AS I MENTIONED BEFORE IN SEVERAL MEETINGS, THERE HAS BEEN AN INCREASE IN EVIDENCE OF HOW MUCH THIS PROJECT IS AFFECTING PEOPLE OF COLOR WITHIN A MINOR MINORITY GROUP.

UH, WITHIN THE NINE MONTHS, THE RISK OF OUR SAFETY IS THAT THREAT FOR OUR CHILDREN BECAUSE OF TRAFFIC THAT HAS INCREASED WITHIN THESE PAST NINE MONTHS.

WE HAVE, UH, COMMERCIAL TRUCKS GOING THROUGH OUR NEIGHBORHOODS.

WE HAVE OTHER VEHICLES THAT ARE, UH, TRYING TO GET DOWN TO 180 3 AND USE OUR STREETS AS A SHORTCUT, UM, PUTTING OUR CHILDREN, UM, AT RISK, UM, WITH THESE HUGE TRUCKS THAT ARE COMING THROUGH OUR NEIGHBORHOOD.

WE HAVE TWO SIGNS AT THE BEGINNING AND AT THE END, UH, SHOWING THAT IT IS A NO TRUCK.

UM, BUT WHILE CONSTRUCTION ON THE FARM IS HAPPENING QUICKLY, AND THE NEW EXPANSION PRO PRO, UM, EXCUSE ME, PROJECTS ARE HAPPENING QUICKLY, THE PROMISE THAT THE AIRPORT MADE TO OUR COMMUNITY ARE NOT HAPPENING AT ALL.

ONE MAJOR PROBLEM IN THE DECISION TO PUT THE TANK FARM WHERE IT IS, IS THAT THERE HAS BEEN ZERO COMMUNITY ENGAGEMENT.

THE AIRPORT SAID THEY DID NOT LEGALLY NEED TO COMMUNICATE WITH THE COMMUNITY.

GIVEN AUSTIN'S HISTORY, THE, THE, UM, WITH LOCATING PAINT FARMS NEAR POOR NEIGHBORHOODS IN EAST AUSTIN, THIS SHOULD HAVE BEEN A NO-BRAINER.

BUT TO AVOID CITY COUNCIL TO, UM, BUT TO A, EXCUSE ME, BUT TO AVOID HAVING CITY COUNCIL TELL THEM TO FIND AN ALTERNATIVE SITE, THE TANK FARM FOR THE TANK FARM, THE AIRPORT MADE PROMISES THAT THEY WOULD DO BETTER MOVING FORWARD AND NOT MAKE THE SAME MISTAKES AGAIN.

THEY SAID THEY WOULD CREATE A GREEN TEAM TO ENSURE THE COMMUNITY'S ENGAGEMENT HAPPENS.

THEY DON'T MAKE THE MISTAKES.

AGAIN, WITHIN THE NINE MONTHS, THE AIRPORT HAS A FANCY NEW MARKETING CAMPAIGN CALLED JOURNEY WITH A U S BUT NOT A GREEN TEAM.

UH, AMANDA, UH, I WILL TELL YOU, THE GREEN TEAM IS, I'M SORRY, AMANDA, EXCUSE ME.

UH, YOU'RE AT YOUR THREE MINUTES.

I'M GONNA GIVE YOU ONE MORE MINUTE, BUT WE NEED TO WRAP UP IN, WE'RE ONLY SUPPOSED TO ALLOW THREE MINUTES.

SO, SO WE'RE ASKING FOR THE GREEN TEAM.

WE ARE ASKING, YOU KNOW, THAT THERE IS SOME, UH, COMMUNITY ENGAGEMENT, WHICH, YOU KNOW, WE ALSO WANT BETTER TRANSPARENCY OVER THE SITE AND THE BUILDING OF THE TANK FARM, UH, BY THE PRIVATE AIRLINES.

UM, WE'RE, WE'RE ASKING, YOU KNOW, THERE WAS SOME, SOME MUD WATERS AND WE IN SEPTEMBER, AND WE WEREN'T EVEN NOTIFIED UNTIL TWO WEEKS AGO OF THIS HAPPENING, WHICH CAN, YOU KNOW, CAN ALSO, UH, CAUSE FLOODING AND, AND WE'RE, WE'RE AT RISK FOR FLOOD ZONE AS WELL, YOU KNOW, WHICH CAN GO INTO OUR YARD.

SO WE WANT SOMETHING DONE.

WE NEED SOMETHING DONE RIGHT NOW, YOU KNOW, WE WANT AIR QUALITY EQUIPMENT

UM, I'M AN ENVIRONMENTAL ATTORNEY.

I'M HERE ON MY, UM, INDIVIDUAL CAPACITY, THOUGH AS A, A RESIDENT OF DISTRICT ONE.

AND AS AMANDA SAID, YOU KNOW, ABOUT A YEAR AGO, IF YOU'LL REMEMBER, FOLKS NEAR THE AIRPORT FIRST LEARNED ABOUT THE TANK FARM THAT WAS BEING BUILT.

UM, ONE OF MYSELF AND ONE OF MY LAW PARTNERS KIND OF VOLUNTARILY JOINED IN THE OPPOSITION WITH THE COMMUNITY, GIVEN JUST HOW WRONG THAT FELT.

AND WE SUBMITTED TWO PUBLIC INFORMATION ACT REQUESTS TO THE CITY IN MARCH AND APRIL OF LAST YEAR THAT ASKED FOR, I PROBABLY DON'T HAVE TIME TO GO INTO IT HERE, BUT A VARIETY OF INFORMATION, UM, RELATED TO THE TANK FARM, RELATED TO THE ENVIRONMENTAL ASSESSMENT THAT WAS DONE.

UM, TO SUMMARIZE THAT INCLUDED, YOU KNOW, INFORMATION RELATED TO, UH, OTHER FEDERAL, STATE, AND LOCAL PERMITS, CONTRACTS, AND INVOICES AND COMMUNICATIONS WITH THE FIRM THAT PREPARED THE ENVIRONMENTAL ASSESSMENT, UM, AND THE FIRM THAT DID THE EMISSIONS MODELING, UM, THE FUEL FARM MASTER PLAN ITSELF, UM, AND A VARIETY OF OTHER COMMUNICATIONS AND DOCUMENTS BETWEEN THE PRIVATE AIRLINE CONSORTIUM AND THE CITY STAFF.

THE SHORT STORY IS, IS THAT THE CITY HAS REPEATEDLY VIOLATED THE TEXAS PUBLIC INFORMATION ACT OVER THE COURSE OF THE LAST NINE MONTHS, AND REFUSE TO PROVIDE US WITH ANY OF THIS INFORMATION, DESPITE THE FACT THAT WE HAVE PAID NEARLY $450 FOR THAT INFORMATION.

AND DESPITE THE FACT THAT THE ATTORNEY GENERAL'S OFFICE HAS DIRECTED THE CITY TO PROVIDE AT LEAST SOME OF THAT INFORMATION.

AND SO, I AM HERE TODAY TO ASK THIS COMMISSION.

UM, GIVEN THAT I THINK PUBLIC TRANSPARENCY AND ACCOUNTABILITY IS ONE OF YOUR OBJECTIVES TO PUT THIS ITEM ON A FUTURE AGENDA SO THAT WE CAN TALK ABOUT THIS, SOME OF THIS INFORMATION THAT'S MISSING AND HOW IMPORTANT IT IS NOT JUST TO THE DECI, HOW IT WOULD'VE BEEN IMPORTANT TO THE DECISION THAT WAS MADE ABOUT THE TANK FARM, BUT IT'S ALSO IMPORTANT TO THE DECISIONS ABOUT THE EXPANSION PROJECTS MOVING FORWARD.

AND SO THIS IS REALLY IMPORTANT INFORMATION THAT THE PUBLIC HAS A RIGHT TO SEE, BUT ALSO THAT I THINK THE COMMUNITY THAT'S CONCERNED ABOUT THE EXPANSION, UM, NEEDS TO SEE.

SO MY UNDERSTANDING IS THAT IT TAKES TWO OF Y'ALL TO ASK FOR A, UH, FUTURE AGENDA ITEM ON THIS.

AND SO I, I'M HERE TO JUST MAKE THAT REQUEST THAT, THAT THIS BECOME AN ISSUE OF PUBLIC, UH, DISCUSSION.

UM, ITEM NINE IS LISTED AS POSSIBLE ACTION TO EXECUTE A CONTRACT TO PROVIDE COMMUNICATIONS, COMMUNITY ENGAGEMENT, AND MARKETING SUPPORT WITH A FIRM CALLED THE EISS DESIGN INCORPORATED, UM, FOR AMOUNT AT 2.5 MILLION OVER THE NEXT FIVE YEARS.

I WANNA FOCUS ON THE TERM COMMUNITY ENGAGEMENT.

AS YOU HEARD MS. CARILLO SPEAK TO EARLIER.

UM, WHAT I SEE HERE IN THIS PACKAGE IS NOT COMMUNITY ENGAGEMENT.

UH, I LOOKED AT THE FIRM'S WEB WEBSITE, NOTHING AGAINST THIS FIRM, BUT IT'S JUST THEY DON'T SEEM TO DO COMMUNITY ENGAGEMENT.

THEY SEEM TO DO BRANDING AND MARKETING.

SO MAYBE IT'S COMMUNITY ENGAGEMENT THE WAY THE AIRPORT DEFINES IT, BUT THAT'S NOT REALLY THE, WHAT THE, THE KIND OF COMMUNITY ENGAGEMENT THAT AMANDA AND HER NEIGHBORS WERE PROMISED.

UM, THE JOURNEY WITH A U S CAMPAIGN DOES NOT SEEM TO BE COMMUNITY ENGAGEMENT.

IT SEEMS TO BE MARKETING AND BRANDING AS FAR AS I CAN TELL.

AND THIS IS MORE THAN JUST SEMANTICS.

AS YOU HEARD AMANDA SAY, THIS IS VERY IMPORTANT TO THE AFFECTED COMMUNITY.

AND THE BIGGEST PROBLEM WITH THE TANK FARM FIGHT WAS THAT THE COMMUNITY WAS NOT ENGAGED AND THE COMMUNITY WAS TOLD THAT THEY DIDN'T HAVE TO BE ENGAGED.

AND THE CONSULTANT THAT WAS HIRED TO PREPARE THAT ENVIRONMENTAL ASSESSMENT SPECIFICALLY SAID THEY DIDN'T DO ANY COMMUNITY ENGAGEMENT BECAUSE THEY DIDN'T HAVE TO DO ANY COMMUNITY ENGAGEMENT.

AND SO THE FEAR IS BY CONTINUING TO USE THIS TERM, UM, IN A, IN THE WRONG MANNER, YOU COULD BE HIRING A FIRM THAT'S TELLING THE AIRPORT HOW TO NOT DO COMMUNITY ENGAGEMENT, HOW TO AVOID COMMUNITY ENGAGEMENT.

AND SO I THINK WE NEED A FUNDAMENTAL, UH, REDEFINING

OF WHAT COMMUNITY ENGAGEMENT MEANS WITH THE AIRPORT.

UM, AND I THINK THAT IF WE HAVE A CONTRACT BEFORE US THAT HAS TO DO WITH COMMUNITY ENGAGEMENT, THE COMMUNITY SHOULD BE INVOLVED.

AND AS YOU HEARD AMANDA SAY, THAT COMMUNITY HAS NOT BEEN REACHED OUT TO ONCE SINCE THIS DECISION ON THE TANK FARMS WAS MADE MORE THAN NINE MONTHS AGO.

AND SINCE THE COMMUNITY WAS PROMISED MORE COMMUNITY ENGAGEMENT.

AND SO I THINK THAT YOU SHOULD, AND I'M HERE TO ASK YOU TO POSTPONE TAKING ACTION ON THIS ITEM SINCE IT'S NOT CLEAR THAT THE SUBJECT REALLY IS COMMUNITY ENGAGEMENT.

AND TO PROVIDE MORE INFORMATION TO THE COMMUNITY SO WE KNOW WHAT THIS CONTRACT IS REALLY FOR.

WE'VE GOT STAFF BREEDING BRIEFINGS.

THE FIRST IS FROM RAJIV.

RAJIV.

YEAH.

GOOD AFTERNOON.

UH, RAJIV THOMAS, DEPUTY CHIEF OF FINANCE.

UH, THE NOVEMBER RESULTS AS, UH, AS SHOWN IN THE WRITTEN BRIEFING, UH, WAS VERY GOOD.

THE OPERATING REVENUES WERE ABOUT 3.3 MILLION OVER NOVEMBER OF 2021.

UM, THE OPERATING REVENUES CAME IN AT 22.6 MILLION VERSUS 19.3 MILLION IN THE PRIOR YEAR.

UM, ONE OF THE CONCERNS I THINK YOU HAD CHAIR WAS ON THE OPERATING EXPENSES, HOW IT WAS ON, AND THAT OPERATING EXPENSES FOR THE MONTH OF NOVEMBER WAS 27.8% HIGHER THAN I WASN'T WISHING THAT THEY WOULD INCREASE.

I JUST EXPECT THAT THEY WOULD.

YEAH, THEY ARE.

AND YEAR TO DATE, UM, YOU KNOW, LAST YEAR, IF YOU LOOK AT IT ON A YEAR TO DATE BASIS, IT ONLY SHOWS ABOUT A 6.6% INCREASE.

BUT THAT IS BECAUSE LAST YEAR, OCTOBER, 2021 HAD A THREE PAY PERIOD MONTH.

RIGHT.

SO IF YOU TAKE THAT INTO ACCOUNT, ACTUALLY YEAR TO DATE, IT HAS GONE UP ALMOST 20, 19%.

SO, OTHER THAN THAT, ON THE REVENUE SIDE, UM, YOU KNOW, IT, IT WAS A VERY GOOD MONTH.

NOTHING UNUSUAL TO SPEAK OF IN TERMS OF WHAT WE EXPECTED IN TERMS OF THE RESULTS.

UH, IT WAS WHERE WE THOUGHT IT WOULD COME IN.

AND, UH, UH, A VERY GOOD MONTH, THAT 22.6 MILLION COMMISSIONERS.

QUESTIONS FOR RAJIV? UM, I'VE GOT A COUPLE, WELL, REALLY NOTATIONS, I JUST WANNA CALL OUT THAT SINCE NOVEMBER, 2019, WE HAVE 68 MORE DAILY DEPARTURES.

UM, AND THANK YOU FOR MAKING NOTE OF THAT.

UM, AND THEN I, I WANTED TO ASK RAJIV IF, SO, WE'RE AT 44% AIRLINE REVENUES, 55% NON-A AIRLINE.

WHAT HAS THAT BEEN HISTORICALLY IN 2019? IT WAS ROUGHLY THE SAME.

THAT MIX WAS ROUGHLY THE SAME.

YEAH.

AND, UH, BUKI DO, DO YOU THINK WE'RE, I KNOW THAT, THAT WE'RE UNDER CAPACITY FOR CONCESSIONS PER PASSENGER TRAFFIC RIGHT

YOU THINK THAT'S AT RISK OF UPSETTING NON-A AIRLINE REVENUES? WELL, THE CONCESSIONS REVENUE THAT IS GENERATED IN INSIDE OF THE TERMINAL, SO IN TERMINAL CONCESSIONS IS, IS GROSSLY UNDER, UNDER WHAT WE SHOULD BE SERVING BASED ON THE PASSENGER LOADS.

UM, DO I BELIEVE THAT THERE'S LEAKAGE, MEANING THAT CUSTOMERS ARE JUST NOT PURCHASING? UM, YES, BUT WE, WE, WE'VE MADE SOME EFFORTS WITH PRODUCT AND FOOD DELIVERY AND STORAGE ON THE PROPERTY INSIDE OF THE TERMINAL BUILDING SO THAT THE CONCESSIONAIRES CAN REPLENISH AND SERVE.

AND THEN AS THEY'VE BEEN RAMPING UP, UH, WITH THE, WITH THE LABOR CRISIS AND THEY'RE STABILIZING NOW WITH WORKFORCE, WE'RE SEEING THAT, UM, THEY ARE ABLE TO SERVE.

UM, AND THEN COMING UP IN, UM, UH, IN THE BEGINNING OF THE SECOND QUARTER AND THE SECOND QUARTER, YOU'LL ALSO SEE US COME BACK TO COUNCIL, UM, FOR ADDITIONAL FUNDS TO THE BAGGAGE PROJECT.

WE CALL IT BAGGAGE INFILL.

WE'VE EXPANDED THAT SCOPE TO THE BAGGAGE PROJECT TO INCLUDE THE INFILL AND A BUMP OUT TO THE BUILDING, TO THE NORTH, AS WELL AS MEZZANINE.

THIS WILL ALLOW US TO INCREASE THE CAPACITY OF THE SECURITY CHECKPOINTS, WHICH WE DESPERATELY NEED.

AND IT BRINGS TOGETHER ALL OF THE ACRONYMS AND ALPHABET SOUP THAT I KNOW THAT THIS GROUP IS PARTICULARLY FOND OF SOMETIMES.

UM, BUT WE'RE TRYING TO BRING IT ALL TOGETHER UNDER ONE COHESIVE AND TRANSPARENT COMMUNICATIONS CAMPAIGN FOR THE PUBLIC TO EASILY UNDERSTAND AND ENGAGE WITH.

SO WE DEVELOPED A CAMPAIGN MISSION STATEMENT AND A VISION STATEMENT.

AND WE WORKED ON THIS OVER THE SUMMER OF LAST YEAR.

AND THIS WAS CREATED WITH FEEDBACK AND SUPPORT FROM THE AIRPORT LEADERSHIP TEAM, THE CITY HALL PIO TEAM, UH, AND THE CITY MANAGER'S OFFICE.

AND SO REALLY THE MISSION IS TO ALIGN COMMUNICATIONS ACROSS ALL THE DIFFERENT PROJECTS.

ALL THOSE PROJECTS THAT LYNN AND SUMMER JUST PRESENTED.

UM, WE'RE WORKING TO MAKE SURE THAT THOSE ARE COMMUNICATED BACK OUT TO THE PUBLIC UNDER ONE UNIFIED VOICE THAT'S UNDERSTANDABLE AND ACCESSIBLE.

AND THE VISION FOR THIS CAMPAIGN IS TO ELEVATE THE PASSENGER JOURNEY WITH AN AUTHENTIC AUSTIN EXPERIENCE.

AND WE ASKED THEM, WHAT ARE SOME OF THE IMPEDIMENTS OF DOING BUSINESS WITH THE CITY OF AUSTIN, ESPECIALLY WHEN IT COMES TO CONSTRUCTION AND CIVIL CONSTRUCTION.

SO THIS LED TO THE IDENTIFICATION OF EIGHT KEY ISSUES AND OVER 30 ACTION ITEMS THAT THE CITY COULD TAKE TO BENEFIT OUR MINORITY AND WOMEN-OWNED BUSINESSES.

AND AGAIN, UH, TRYING TO SEE WHAT WE CAN DO TO MODEL A SIMILAR PLAN, UH, FOR THE ALLS EXPANSION.

KNOWING THAT WE'RE GONNA, THIS IS, THIS IS PROBABLY THE LARGEST C UH, CAPITAL IMPROVEMENT PROJECT IN THE CITY'S HISTORY.

UH, WE WANNA MAKE SURE WE HAVE AS MUCH PARTICIPATION FROM OUR MINORITY WOMEN AND DISADVANTAGED BUSINESS COMMUNITY AS POSSIBLE.

SO WE'VE DONE SEVERAL STAKEHOLDER UPDATES, UH, SIX TO DATE.

THE LAST ONE WAS, UH, THIS PAST DECEMBER.

UH, WE'VE DONE A LOT OF GOOD WORK, UM, THAT MY, I I'M NOT GONNA TAKE ANY CREDIT.

THIS IS ALL MY STAFF THAT HAS BEEN WORKING ON THIS FOR THE PAST SEVERAL YEARS.

UH, BUT WE DO, UH, CORRIDOR CONSTRUCTION NOTIFICATIONS TWO WEEKS PRIOR TO ANY, UH, NOTIFICATION HITTING THE STREET.

WE TRY TO MAKE SURE THAT OUR CERTIFIED MINORITY VENDORS, UH, THAT HAVE THE SCOPES OF WORK THAT WE'RE GONNA NEED TO CONSTRUCT THESE CORRIDORS, GET FIRST NOTIFICATION BEFORE ANYONE EARLY NOTIFICATION IS IMPORTANT SO THEY CAN, UH, GEAR UP, GET THEIR RESOURCES READY TO GO IF THEY CHOOSE TO BID ON A PARTICULAR PROJECT.

THAT ORDINANCE EXTENSION WAS SENT TO COUNCIL.

THEY APPROVED IT.

AND THAT WAS IN, UH, DECEMBER OF 2018.

WE ALSO INITIATED A RAPID RENEWAL, UH, FOR RE-CERTIFICATION, AS WELL AS A RAPID RENEWAL FOR NEW FIRMS THAT WANT TO GET INTO THE, THE CITY CERTIFICATION PROGRAM THAT WORK IN THE TRADES AND THE SCOPES THAT WE NEED TO BUILD OUT THESE NINE QUARTERS.

THAT'S ALSO BEEN VERY SUCCESSFUL.

AND I BELIEVE, IF I REMEMBER CORRECTLY, FROM LAST NIGHT'S MEETING, IT TAKES US ABOUT EIGHT DAYS TO CERTIFY A VENDOR THAT HAS THE CODES THAT WE NEED TO CONSTRUCT THESE NINE CORRIDORS.

WHAT PERCENTAGE OF THOSE THAT EXIST ARE, ARE CERTIFIED AND QUALIFIED.

AND I, I THINK THAT'S AN OPPORTUNITY TO MAKE THIS AN EVEN MORE ROBUST PROGRAM.

UH, WE DON'T DISAGREE WITH YOU, UH, AT ALL.

AND WE HAVE SEVERAL IRONS IN THE FIRE AND PEOPLE FLY IS DEFINITELY ON OUR LIST.

WE'VE BEEN AROUND FOR ABOUT 10 YEARS.

WORKERS DEFENSE PROJECT HAS BEEN AROUND FOR ABOUT 20 YEARS NOW.

UM, AND WE'VE WORKED WITH DOZENS OF EMPLOYERS THROUGH THE BETTER BUILDER, UH, PROGRAM, DOZENS OF DEVELOPERS AND CONTRACTORS, UM, TO ENSURE GOOD SAFE JOBS IN TEXAS.

UM, OUR GOAL IS TO RAISE STANDARDS IN THE CONSTRUCTION INDUSTRY BY ENSURING A SAFE, UM, AND FAIRLY COMPENSATED WORKFORCE.

AND I IMAGINE THAT IT'S ALSO A VALUE THAT MANY OF YOU SHARE.

UM, AS Y'ALL PROBABLY KNOW, IN 2019, THE CITY OF AUSTIN RESOLVED TO REQUIRE CONSTRUCTION WORKER PROTECTION STANDARDS THAT GO ABOVE AND BEYOND WHAT THE LAW REQUIRES, UH, ON THIRD PARTY DEVELOPMENT AGREEMENTS THAT ARE OVER $1 MILLION IN VALUE.

UM, SO FOR SEVERAL MONTHS, THE WORKER'S DEFENSE PROJECT MYSELF, UM, I'VE BEEN WORKING WITH, UH, STAFF MAINLY SUMMER AND, AND HER TEAM AMONG OTHERS, UM, TO GET THE BUILDER PROGRAM BETTER BUILDER PROGRAM IMPLEMENTED AT THE AIRPORT.

UM, AND WE REALIZED THAT THIS HAS REQUIRED MANY PROCEDURAL SHIFTS, UH, IN HOW SEVERAL DEPARTMENTS DO THEIR WORK AND THAT IT'S TAKEN TIME TO IMPLEMENT AND TO ADJUST TO.

UM, WE'VE MADE PROGRESS IN SEVERAL AREAS.

WE'VE MET ON A MONTHLY BASIS SINCE OCTOBER, WE'VE SEEN A REVISION IN THEIR TENANT, UH, PROJECT INTAKE PROCESS.

AND WE NOW KNOW THAT, UM, A U S SENT A LETTER LAST MONTH TO ALL TENANTS, UH, INFORMING THEM OF THE NEW REQUIREMENTS ON CONSTRUCTION WORKER STANDARDS.

UM, HOWEVER, WE DO ALSO KNOW THAT SEVERAL PROJECTS THAT SHOULD BE A PART OF THIS PROGRAM, UM, HAVE BEEN ALLOWED TO PROCEED WITHOUT HAVING TO COMPLY WITH ANY NEW STANDARDS, UM, INCLUDING SOME OF THE PROJECTS, UM, THAT WE HEARD ABOUT.

UM, THIS MEANS THAT THERE ARE WORKERS RIGHT NOW, NOW AT THE AIRPORT WHO UNDER THIS ORDINANCE SHOULD BE EARNING A LIVING WAGE, SHOULD HAVE HAD OSHA SAFETY TRAINING, AND SHOULD HAVE WORKERS' COMPENSATION COVERAGE.

UM, BUT CURRENTLY TO OUR KNOWLEDGE, THEY'RE NOT RECEIVING THOSE PROTECTIONS.

SO THE TEAM AT AOS HAS LET US KNOW THAT THEY WOULD NOT LET ANY MORE OF THESE PROJECTS PROCEED UNTIL THEY AGREE TO THESE STANDARDS.

AND WE HOPE THAT THIS COMMITMENT IS HELD TO, UM, A FEW THINGS NEED TO BE IN PLACE BEFORE THIS HAPPENS.

FIRST, WE'D LIKE TO, UH, KNOW WORKERS' DEFENSE PROJECT WOULD LIKE TO KNOW, UM, THESE START DATES OF UPCOMING PROJECTS AS STAFF GETS INFORMED OF THEM.

SECOND, WE WOULD LIKE THE ASSISTANCE OF STAFF TO SET UP MEETINGS WITH TENANTS WHO ARE PREPARING TO ENTER INTO THE CONSTRUCTION PHASE TO TELL THEM MORE ABOUT THE PROGRAM AND THE SPECIFIC REQUIREMENTS.

UM, I ACTUALLY DID GET AN INVITE TODAY, UM, TO OUR FIRST MEETING WITH THE TENANT.

SO, UM, THAT'S A GREAT SIGN THAT THE BALL IS ROLLING.

UM, AND THEN THIRD, WE WANNA BE SURE THAT PROJECTS DON'T PROCEED WITH CONSTRUCTION BEFORE COMMITTING TO THE STANDARDS SET FORTH IN THE RESOLUTION THROUGH ASSIGNED BETTER BUILDER PLEDGE.

UM, QUICKLY, I ALSO WANNA NOTE THAT EVEN THOUGH I'M AWARE THAT AOS CAN'T FORCE TENANTS TO CHOOSE ANY PARTICULAR INDEPENDENT MONITOR, I DO WANNA MAKE IT KNOWN THAT, UH, WORKERS DEFENSE PROJECTS, UH, STRONGLY PREFERS THAT CERTIFICATION ASSOCIATES, UM, BE THE ACCREDITED MONITORING ENTITY.

THEY'RE A TRUSTED, UM, AND EXPERIENCED MONITORING GROUP WHO HAS WORKED WITH BETTER BUILDER FOR MANY YEARS.

UM, SO ALTHOUGH I KNOW THAT CAN'T BE REQUIRED, I DO WANNA MAKE IT KNOWN THAT THAT IS WHAT WE WOULD LIKE TO SEE.

SINCE THEN, WE'VE COLLABORATED AND WE'VE REFINED AND UPDATED THE TENANT PROJECT FORM SINCE THE REQUEST THAT THEY PUT IN WITH THE PROPERTIES TEAM WHEN THEY, THEY WANT A PROJECT THAT IS THE FIRST TIME BESIDES THIS LETTER THAT THEY ARE.

THEY GO THROUGH THE PLANNING PROCESS, DESIGN PROCESS WITH THEM IN PRE-CONSTRUCTION AT ALL OF THESE MEETINGS THAT THEY HAVE AT THE KICKOFF AND IN DESIGN AND IN THE PRE-CONSTRUCTION.

THEY ARE THEN REMINDED AND GIVEN THIS INFORMATION, AGAIN, MY TEAM IS FULLY EMPOWERED TO NOT GIVE THEM A NOTICE TO PROCEED UNTIL THEY CAN PROVE THAT THEY DO HAVE A CERTIFIED, UM, AUDITOR, THIRD PARTY AUDITOR IN PLACE.

UM, IF WE FIND THAT THEY ARE NOT DOING THESE AUDIT AUDITS OR IN COMPLIANCE, MY TEAM IS NOW FULLY EMPOWERED TO STOP CONSTRUCTION AS WELL.

WE'RE FULLY COMMITTED TO THIS, UM, TO THIS ORDINANCE AS WE FOLLOW IT AS UM, TWO, SO ON DECEMBER 8TH, LETTER TO ALL THE TENANTS TO REINFORCE THE COMMITMENT AND COMPLIANCE WAS SENT OUT.

WE HAVE NOTIFIED WE AT THIS TIME DURING THIS PROCESS, WE IDENTIFIED FOUR PROJECTS THAT WERE NOT, THAT WERE IN CONSTRUCTION AND OVER A MILLION DOLLARS THAT WERE NOT IN COMPLIANCE OF FOLLOWING THE AUDITING PROCESS.

I DO NOT KNOW IF THEY WERE IN NOT IN COMPLIANCE FOR NOT MEETING THIS.

THEY WERE NOT PERFORMING THE AUDITS.

WE'VE ALSO, UM, IDENTIFIED THOSE.

THEY HAVE BEEN SENT A LETTER TO LET THEM KNOW THAT THEY WERE NOW HAVE TO BE IN COMPLIANCE.

UM, WE HAVE, UM, TWO PROJECT, TWO OF THOSE PROJECTS, UM, WITH ONE TENANT ARE NOW COMPLETING IN THE NEXT MONTH.

ONE A VERY LARGE PROJECT, UM, HAD A KICKOFF MEETING, UM, LAST WEEK AND IS FULLY ON BOARD AND IS COMMITTED TO THIS AND WILL NOT RECEIVE THEIR NOTICE TO PROCEED UNTIL THEY, UH, SUBMIT THEIR AUDIT PLAN.

AND THE LAST ONE IS TEXT DOT.

THEY FOLLOW STATE PROCEDURES OF A VERY SIMILAR PROGRAM.

UM, SO WE'LL BE UPDATING, UM, THE BETTER BUILDER TEAM, THE OR DEFENSE PROGRAM ON THEIR COMPLIANCE.

SO WE ARE COMMITTED MONTHLY TO WORK WITH THEM AND MEET WITH THEM TO, SO OVER ALL OF OUR TENANT PROJECTS, IN WHAT PHASE OF THE PROCESS THEY'RE IN, THE INCOMING INTAKE, THE DESIGN, AND WHEN THEY PLAN TO START CONSTRUCTION.

UM, WE ALSO HAVE INVITED, UH, THE, THE POINT OF CONTACT FOR CERTIFICATION AND ASSOCIATIONS TO ASSOCIATES TO ATTEND SO THAT THEY COULD PLAN ACCORDINGLY AS WELL FOR STAFFING.

UM, I WANTED TO BRING UP THAT THE FUEL TANK IS A TENANT PROJECT.

UH, THIS TENANT IS A US FUEL THAT IS AN AIRLINE CONSORTIUM.

WHEN I WAS, WHEN I FIRST GOT HERE, WE HAD THE INTENT WAS FOR A U S TO BE THAT THIRD PARTY AUDITOR FOR ALL TENANT PROJECTS.

WE QUICKLY FOUND THAT WE, UM, ARE NOT RESOURCED TO DO THAT.

AND SO THAT IS WHY WE PUT A STOP TO THAT IN OCTOBER AND HAVE STARTED TO IMPLEMENT THIS PROGRAM AT THE END OF LAST YEAR WITH THIS PROGRAM, BECAUSE THEY'RE A MID CONSTRUCTION, UM, WE ARE STILL THE, THE THIRD PARTY, BUT WITH CCO, WITH THE CONTRACTING OFFICE OFFICE, UM, OVER, THEY'RE OVER THE JET FUEL FARM.

THEY ARE PERFORMING THOSE AUDITS.

WE'RE NOW GETTING THAT INFORMATION TO ANDREA, UM, ON A MONTHLY BASIS, UM, TO MAKE SURE THEY ARE COMPLETING THAT.

AND IF ANY TIME WE CANNOT KEEP UP WITH THAT RESOURCES, WE WILL THEN ENSURE THAT THEY TAKE ON A THIRD PARTY THAT WE, THAT WE CAN'T DO IT.

BUT RIGHT NOW IN PARTNER A US WITH C O IS PERFORMING THOSE AUDITS AND THE WANTED TO BE CLEAR ABOUT THAT.
