THE SITE IS LOCATED IN WEST AUSTIN.

IT'S LOCATED WITHIN THE DRINKING WATER PROTECTION ZONE, FULL AND LIMITED PURPOSE JURISDICTIONS AS WELL AS COUNCIL DISTRICT 10.
THERE ARE NO CREEKS OR CREEK BUFFERS ON THE SITE.
HOWEVER, THERE ARE TWO WETLAND CRITICAL ENVIRONMENTAL FEATURES OR CEFS AND A LAKE AUSTIN BUFFER ON THE SITE.
THE VARIANCE REQUEST FOR THIS CASE IS TO REQUEST TO VARY FROM L D C 25 8 360 8 E TO ALLOW MORE THAN 25 CUBIC YARDS OF DREDGE IN LAKE AUSTIN.
UH, THE PROJECT IS PROPOSING TO MODIFY AN EXISTING MARINA BUILT PRIOR TO 1965.
THE EXISTING 21 SLIP MARINA IS SHOWN, HIGHLIGHTED IN BLUE ON THIS SLIDE AND IN THE PROPOSED 16 SLIP MARINA IS SHOWN IN YELLOW ON THIS SLIDE.
THE CLIPPED PLAN SET IMAGE IN THE CENTER SHOWCASES THE OVERLAY OF BOTH THE EXISTING AND PROPOSED MARINA OVERLAP AND THE EXISTING FOOTPRINT IS OUTLINED IN LAVENDER.

AND EACH SITE PLAN TYPICALLY CONTAINS ONE TO TWO SLIPS.
UM, THE PROJECT IS PROPOSING 6.1 CUBIC YARDS OF DREDGE PER BOAT SLIP FOR A TOTAL OF 97.4 CUBIC YARDS OF DREDGE.
IF THIS PROJECT CAME IN AS 16 SEPARATE SITE PLANS FOR 16 SEPARATE BOAT SLIPS AND PROPOSED 25 CUBIC YARDS OF DREDGE PER BOAT SLIP, THEN THAT WOULD BE A TOTAL OF 400 CUBIC YARDS OF DREDGE AND THE QUANTITY OF DREDGE PER BOAT SLIP AND OVERALL TOTAL IS MUCH LESS THAN ALLOWED PER CODE IF THIS WAS FILED AS 16 SEPARATE BOAT SLIPS, OR SORRY, 16 SEPARATE SITE PLANS.
UH, THE VARIANCE IS REQUIRED TO ALLOW A QUANTITY OF DREDGING THAT IS DICTATED BY THE NUMBER OF BOAT SLIPS AND IS LESS PER BOAT SLIP, APPROXIMATELY 6.1 CUBIC YARDS AND THE QUANTITY OF DREDGING ALLOWED BY CODE FOR A SINGLE BOAT SLIP 25 CUBIC YARDS.
SIMILAR VARIANCES HAVE BEEN GRANTED FOR PROJECTS WITH SIMILAR CODE REQUIREMENTS.

IF THE BOAT DOCK WAS PERMITTED ON A SLIP BY SLIP BASIS, THE VARIANCE IS UNLIKELY TO RESULT IN ENVIRONMENTAL CONSEQUENCES, UH, AND HARMFUL ENVIRONMENTAL CONSEQUENCES.
THE SEDIMENT BOOM WOULD BE INSTALLED PRIOR TO CONSTRUCTION AND MAINTAINED FOR THE DURATION OF THE PROJECT TO MINIMIZE DISCHARGES TO THE LAKE.
DENYING DREDGE TO A NAVIGABLE DEPTH POTENTIALLY HARMS THE WATER QUALITY OF THE LAKE DUE TO TURNING OF THE LAKE BED.
BY BOATS LEAVING SEDIMENT LADEN WATER IN THEIR LAKE WATER QUALITY WOULD BE EQUAL TO OR BETTER THAN THE WATER QUALITY WITHOUT THE VARIANCE.
DREDGING IS NECESSARY TO ELIMINATE THE TURNING OF THE LAKE BED BY BOAT TRAFFIC LEADING TO SEDIMENT LAY LADEN LAKE WATER.
THERE WILL BE A REPLACEMENT OF THE BULKHEAD THAT IS CURRENTLY ALLOWING SEDIMENT TO ENTER LAKE AUSTIN WETLAND MITIGATION, BULKHEAD MITIGATION TREE PROTECTION AND THE INSTALLATION OF TEMPORARY ORANGE CONSTRUCTION.
FENCING AROUND THE WETLAND C E F WILL POSITIVELY IMPACT WATER QUALITY AND ADDITIONAL WETLAND PLANTINGS AND PROTECTING THE WETLAND C E F WILL ALSO POSITIVELY IMPACT WATER QUALITY.
STAFF RECOMMENDS THIS VARIANCE WITH THE FOLLOWING CONDITIONS.
ONE, INSTALL THE SEDIMENT BOOM TO MINIMIZE SEDIMENT DISTURBANCE.
INSTALL TEMPORARY CONSTRUCTION TEMPORARY ORANGE CONSTRUCTION FENCING AROUND THE WETLAND C E F, UM, NOT INCLUDING THE L O C TO PREVENT ENCROACHMENT WITHIN THE WETLAND.

THE PROJECT SITE CONTAINS AN ABANDONED RESTAURANT PAVED DANCE FLOOR STAGE PARKING LOT BULKHEAD EXISTING 18 SLIP MARINA, THE NORTH DOCK, AND A SEPARATE THREE SLIP MARINA THAT PREVIOUSLY HAD A GAS PUMP, THE SOUTH DOCK.
THE DEVELOPMENT PROCESS FOR THE REST OF THE SITE HASN'T YET BEGUN, BUT THE CONDITION OF BOTH BOAT DOCKS IS TOO DANGEROUS TO LEAVE UNADDRESSED.
THE DOCKS WERE RED TAGGED IN OCTOBER, 2019, AND A SITE PLAN IS REQUIRED TO RECONSTRUCT THE DOCKS.
THE PROPOSED PROJECT WILL RECONSTRUCT THE DOCKS AND THE BULKHEAD.
BY TODAY'S PERMITTING REGULATIONS, THE OLD STRUCTURES WERE A 21 SLIP MARINA.
THE PROPOSED PROJECT WILL HAVE 16 SLIPS BE CODE COMPLIANT WITHIN THE EXISTING FOOTPRINTS AND FIX A FAILING BULKHEAD.
THE CURRENT WATER DEPTH IS TOO SHALLOW TO ACCOMMODATE MODERN BOATS AND BOAT LIFTS.
CODE PROVIDES FOR DREDGE UP TO 25 CUBIC YARDS TO BE APPROVED ADMINISTRATIVELY, HOWEVER, CODE DOESN'T DISTINGUISH BETWEEN WHETHER ONE SLIP OR 16 SLIPS IN THIS CASE ARE BEING PERMITTED.
THE PROPOSED DREDGE PER SLIP FOR THIS VARIANCE APPLICATION IS ONLY SIX CUBIC YARDS PER SLIP.
OR 25% OF THE DREDGE ALLOW FOR THE SLIP IN A ONE SLIP BOAT DOCK WHILE THE DOCK CAN BE RECONSTRUCTED WITHOUT THE VARIANCE, THE OWNER'S PROJECT TEAM AND CITY STAFF AGREE THAT IT WOULD BE BETTER TO REMOVE ACCUMULATED SILT AND INCREASE THE WATER DEPTH WITH EROSION CONTROLS IN PLACE WITHOUT THE VARIANCE.
