[00:00:02]
UM, TODAY IS TUESDAY, DECEMBER 5TH.
I'M CALLING TO ORDER THE ZONING AND PLANNING COMMISSION.
MICROPHONE, MICROPHONE, PLEASE.
IT WAS ON AND I TURNED IT OFF.
I'M GONNA CALL TO ORDER THE ZONING AND PLATING COMMISSION.
TODAY IS TUESDAY, DECEMBER 5TH.
WE ARE IN CITY HALL AND THE COUNCIL CHAMBERS.
WE WILL START WITH ROLL CALL COMMISSIONER BOONE.
RE, VICE CHAIR GREENBERG HERE.
PARLIAMENTARIAN JOHNSON IS NOT HERE.
WE HAVE 1, 2, 3, 4, 5, 6, 7, 8 PRESENT.
UH, ONE VACANCY AND ONE ABSENT.
DO WE HAVE ANY PUBLIC COMMUNICATION CHAIR? THERE IS NO PUBLIC COMMUNICATION TODAY.
[Consent Agenda]
THE CONSENT AGENDA UP.UH, WE'RE GONNA HAVE THE APPROVAL OF THE MINUTES FROM OCTOBER 17TH AND NOVEMBER 21ST.
DOES ANYBODY HAVE ANY ISSUES WITH THOSE MINUTES BEFORE I MOVE FORWARD? OKAY.
I'M GONNA CALL ITEM TWO, REZONING C FOURTEEN TWENTY TWENTY THREE DASH 0 0 0 5 CHAMPIONS COMMERCIAL TRACK FOUR IN DISTRICT 10.
THIS IS AT 60 25 NORTH CAPITAL OF TEXAS HIGHWAY, AND THIS IS STAFF RECOMMENDED WITH, UM, RECOMMENDATIONS FROM THE ENVIRONMENTAL COMMISSION, AS WELL AS STAFF RECOMMENDATIONS ARE INCLUDED AS ITEM TWO.
SO THOSE ARE INCLUDED IN THE BACKUP.
SO THIS IS MOTION TO APPROVE WITH THOSE ITEMS. WE DO HAVE ONE SPEAKER.
UM, AND IF I CAN HAVE MR. DEWEY PETIT.
UH, THANK Y'ALL FOR, UH, UH, HEARING ME THIS EVENING.
I WISH, UH, PERHAPS I BEEN INVOLVED IN THIS PROCESS A LITTLE BIT EARLIER.
I, UH, DO UNDERSTAND THAT, UH, A LOT OF FOLKS HAVE PUT IN A LOT OF WORK, UH, DEVELOPING RESTRICTIVE COVENANTS TO ADDRESS CONCERNS OF NEIGHBORHOOD GROUPS.
UM, I, UH, AT ONE POINT INQUIRED ABOUT WHO ARE THESE NEIGHBORHOOD GROUPS WHO I COULD TALK TO THEM.
I, I NEVER GOT, UH, THAT SATISFACTION, BUT, UM, LET ME BACK UP.
MY NAME'S DE ATE AND MY WIFE AND I HAVE LIVED AT 63 0 6 SPRUCE WOOD COVE FOR 30 YEARS.
UH, I FIRST CAME TO AUSTIN IN 69.
UH, WE ENJOY OUR BACKYARD A GREAT DEAL.
WE HAVE, UH, FOUGHT HARD TO TRY TO KEEP THE NOISE AND LIGHT LEVELS DOWN TO WHERE, YOU KNOW, IT'S MAKING IT A MORE LIVABLE PLACE IN THE CITY.
UM, WHEN THEY RAISED THE BRIDGE THERE AT LOOP, UH, ACROSS, UM, BULL CREEK, WHICH IS BASICALLY OUR BACKYARD, UH, THEY RAISED THAT BY 20 FEET AND SUDDENLY THEY, WE HAD A GREAT INCREASE IN ROAD NOISE.
WE WORKED WITH THE, I THINK IT WAS THE HIGHWAY DEPARTMENT AND CITY YEAR COUNTY TO HAVE THE SURFACE THERE.
NOT A GROOVED NOISY PAVEMENT, BUT A QUIET PAVEMENT.
AND TO HAVE THE LIGHTS SHIELDED WHERE THEY DIDN'T SHINE INTO OUR BACKYARD.
UM, WE ARE SITUATED, UM, I KNOW THERE'S SOME OTHER PROPERTIES UP IN THE COURTYARD ABOVE THIS PARTICULAR PROPERTY THAT, UH, ARE JUST AS CLOSE, PERHAPS MEASURED BY THE DISTANCE, BUT THEY ARE ALSO FAR ABOVE IT.
MUCH LESS A PROBLEM FOR THEM WITH, IF ALL THE LIGHTS ARE POINTED DOWN, BOY, THEY GET NO PROBLEM WHATSOEVER.
LIGHTS POINTED DOWN AT US ARE STILL PERHAPS SHINING RIGHT ACROSS STATUS.
UM, THE NOISE NOT GONNA BE A PROBLEM FOR THEM.
THEY'RE WAY UP ABOVE IT FOR US.
WE ARE, OUR PROPERTY IS THE INTERSECTION OF LAKEWOOD DRIVE AND 2222, OUR BACKYARD.
UH, THERE IS THE ONLY THING BETWEEN US AND THIS NEW HOTEL WILL BE A A FEW THIN, UM, CEDAR TREES, WHICH DON'T BLOCK MUCH NOISE OR LIGHT.
WE'VE BEEN FIGHTING ROAD NOISE THERE FOR A LONG TIME.
UM, BUT, UH, WHAT I WOULD, I WISH I'D HAVE BEEN ABLE TO GET MY INPUT WITH THE NEIGHBORHOOD GROUPS WHO HAD BEEN WORKING ON THIS A LONG TIME.
I LIVE CLOSEST TO IT THAN ANYBODY MORE.
YOU KNOW, THE, UH, MY WIFE AND I, UM, REALLY WANTS TO, UH, AVOID THE POSSIBILITY IF POSSIBLE, THROUGH THIS PROCESS OF HAVING, UM, SIGNIFICANT INCREASES IN THE NOISE AND LIGHT POLLUTION INTO OUR BACKYARD.
PARTICULARLY, UH, NOW I DO NOTICE THAT THE, THE RESTRICTIVE
[00:05:01]
COVENANTS HAVE BEEN PROPOSED BY THE NEIGHBORHOOD GROUPS AND AGREED TO INCLUDE A 75 DECIBEL LIMIT ON NOISE AT THE PROPERTY LINE.NOW, OH, THAT'S, NOISE AT THEIR PROPERTY LINE IS PRETTY MUCH NOISE AT OUR PROPERTY LINE, BECAUSE WE'RE JUST ACROSS, DIAGONALLY ACROSS THE INTER THE, THE CREEK THERE FROM THEM.
UM, SO IF IT'S 75 DECIBELS THERE, IT'S 75 DECIBELS IN OUR BACKYARD.
UH, THEY, THEY HAVE PROPOSED A POOL I SEE FOR THE DRAWINGS OVER ON THE, UH, SIDE TOWARDS OUR PROPERTY.
UH, I, I JUST GOOGLED UP AND THE, THE, THE NOISE OF CHILDREN PLAYING ABOUT 80 DECIBELS.
WE, BOTH MY WIFE AND I DO, BUT, UH, I WOULD PREFER NOT TO HAVE THE, THE NOISE OF A BUNCH OF KIDS IN A POOL.
UH, DRAKE, EVEN IF THEY SHUT IT OFF AT 10 O'CLOCK, WE'RE IN BED BY 10 O'CLOCK.
WE'RE OUT THERE ENJOYING IT AT FIVE O'CLOCK AND SIX O'CLOCK, YOU KNOW, AT FOUR O'CLOCK.
IF YOU CAN GO AHEAD AND WRAP UP THAT, THAT WAS A THREE MINUTE BUZZER IS WHAT THAT WAS.
WELL, NO PROBLEM IF I, I, UH, APPRECIATE YOUR INDULGENCE.
THE, SO WHAT, THE TWO THINGS THAT I THINK THAT WOULD REALLY, UH, HELP US AND OUR NEIGHBORS WOULD BE A COMMITMENT TO A SOUND WALL AROUND ANY OUTDOOR POOL SOUND BARRIERS BETWEEN US AND THE NEIGHBORS.
AND, UH, NO OUTDOOR SPEAKERS, NO OUTDOOR MUSIC, NO OUTDOOR AMPLIFIED MUSIC.
APPRECIATE YOUR, YOUR CONSIDERATION.
IF YOU HAVE ANY QUESTIONS FOR ME, YOU'D BE GLAD TO ANSWER 'EM.
UM, I'M GONNA GO AHEAD AND READ THE REST OF THE CONSENT AGENDA AND THEN I'LL HAVE SOMETHING TO SAY ON WHAT WE WERE JUST TALKING ABOUT.
UM, ITEM THREE IS, UH, RE ZONING CASE C 14 20 23 DASH 0 1 1 12 SA.
THE RIDGE APARTMENTS 86 0 180 6 0 9 86 13 FM 9 69.
IT IS A ZONING CHANGE FROM DR.
ITEM FOUR IS A CONDITIONAL USE PERMITS.
GOODNIGHT RANCH, SELF STORAGE AT 67 26 STOCKMAN DRIVE.
UH, IT IS A, AGAIN, A CONDITIONAL USE PERMIT FOR A CONVENIENCE STORAGE FACILITY IN THE NEIGHBORHOOD AND MIXED USE AREA OF THE GOODNIGHT RANCH.
P ITEM FIVE IS AN ENVIRONMENTAL VARIANCE.
UH, SP 2021 DASH 0 3 8 4 C DO SH NORTH WIND APARTMENTS.
IT IS A VARIANCE FROM 25 8 3 41 TO ALLOW CUT UP TO 12 FEET 25 8 3 42 TO ALLOW PHILLIP TO 17 FEET 25 8 2 61 TO ALLOW DRIVEWAY IN A CRITICAL WATER QUALITY ZONE.
IT ALSO HAS STAFF CONDITIONS AND ENVIRONMENTAL CONDITIONS, AND WE'RE ACCEPTING ALL OF THOSE.
SO ALL OF THOSE ARE PART OF THE MOTION TO APPROVE THIS ITEM.
THE OTHER ITEM ON THE CONSENT AGENDA IS ITEM SIX, DISCUSSION OF POSSIBLE ACTION, ADOPTING A RULE, ALLOWING REGISTERED SPEAKER DONATION OF TIME.
I THINK WE HAVE THAT ALL READY TO GO.
AND SO WE ARE APPROVING THAT ONE ON ITEM TWO IF STAFF CAN WORK WITH THE PERSON WHO SPOKE.
UM, THIS IS NOT THE FINAL JUDGMENT, THIS IS JUST OUR RECOMMENDATION AND IT GOES TO CITY COUNCIL.
SO THERE'S AN OPPORTUNITY BETWEEN NOW AND CITY COUNCIL TO TRY TO WORK SOME THINGS OUT.
I THINK THIS DEVELOPER'S BEEN VERY AMENABLE TO WORK WITH THE NEIGHBORHOOD, SO I THINK THAT'S SOMETHING WE CAN ADDRESS BETWEEN NOW AND CITY COUNCIL.
IF THAT, IF THAT WORKS, WE CAN, WE CAN PROCEED ALONG THAT WAY.
UM, DO I HEAR A MOTION TO APPROVE THE CONSENT AGENDA? A MOTION? DO WE HEAR? SECOND, SECOND, SECOND.
I WAS ALSO GONNA SAY, I THINK WE CAN PUT YOU IN TOUCH WITH, UM, SOMEONE WHO WORKS WITH THE NEIGHBORHOOD.
WE, WE CAN, WE CAN PUT YOU IN TOUCH WITH THE NEIGHBORHOOD AND YOU CAN VISIT WITH THE NEIGHBORHOOD ASSOCIATION AS WELL, AS WELL AS STAFF BETWEEN NOW AND CITY COUNCIL.
UH, WE HAVE A MOTION AND A SECOND.
UM, CHAIR, COULD YOU, UH, COULD YOU SHARE WHO, UH, PROPOSED AND SECONDED? YES.
UM, COMMISSIONER GREENBERG APPROVED.
SORRY, I'VE GOTTA LOOK AT NOTES.
UH, FUTURE AGENDA ITEMS. DO WE HAVE ANY FUTURE AGENDA ITEMS? COMMITTEE REPORTS, CLOSE
[COMMITTEE REPORTS]
AND ORDINANCES.WE HAVE A MEETING NEXT WEEK ON THE 13TH.
CONTRARY PLAN JOINT COMMITTEE.
I DON'T THINK WE HAVE ANY MEETINGS UNTIL THE FIRST OF THE YEAR FOR THE COMPETENCY PLAN.
JOINT COMMITTEE AND SMALL AREA PLANNING JOINT COMMITTEE.
WE HAVE A MEETING NEXT WEEK, MEETING NEXT WEEK.
[00:10:06]
I GOT, I.
