OKAY, GOOD AFTERNOON.

[I. Call to Order]

AND I WANT TO THANK EVERYONE FOR JOINING US FOR THE DECEMBER MEETING OF THE CAP METRO BOARD OF DIRECTORS.

TODAY IS MONDAY, DECEMBER 18TH.

WE ARE HERE AT THE CAP METRO BOARDROOM, UH, THE ROSA PARKS BOARDROOM.

UH, AND THE TIME IS 1232.

SO I'LL CALL THIS MEETING IN ORDER.

UH, AND THE FIRST ITEM

[II. Safety Briefing]

ON OUR AGENDA TODAY WILL BE OUR MONTHLY SAFETY BRIEFING.

I UNDERSTAND THAT WE HAVE A SPECIAL GUEST PRESENTER, AND AS I TURN TO MY LEFT, MS. WATKINS, CAN I, CAN I CALL ON YOU FOR THAT TODAY? I'VE ACTUALLY APPROPRIATELY DE DELEGATED THAT SOMEONE MUCH MORE QUALIFIED THAN I AM, DARRYL JAMELL, WHO'S OUR, UH, DIRECTOR OF PUBLIC SAFETY AND EMERGENCY MANAGEMENT, WILL TAKE CARE OF THE SAFETY BRIEFING TODAY.

THAT IS, UH, AN EXCELLENT USE OF EXECUTIVE AUTHORITY .

SO, PRESIDENT, GO AHEAD, .

GOOD AFTERNOON, CHAIR ILIAN, MEMBERS OF THE BOARD PRESIDENT AND CEO WATKINS.

I'M DARRYL JAMELL.

I SERVE AS THE SENIOR DIRECTOR OF PUBLIC SAFETY AND EMERGENCY MANAGEMENT.

OUR SAFETY BRIEFING TODAY IS THAT WE ARE LOCATED AT 29 10 EAST FIFTH STREET IN THE ROSA PARKS BOARDROOM.

IF WE DO HAVE TO EVACUATE THIS FACILITY, WE CAN USE EITHER THE EXIT ON OUR RIGHT OR LEFT.

AND IF WE DO USE THE ONE ON THE EX THAT GOES DIRECTLY TO THE EXTERIOR WITH THE, UH, EXIT SIGN OVER IT.

UH, IF YOU HAVE, UH, MOBILITY CHALLENGES, PLEASE WAIT AT THE TOP OF THE STEPS FOR ASSISTANCE FROM OUR STAFF.

OUR EVACUATION ASSEMBLY AREA IS DIRECTLY ACROSS THE STREET, UH, TO THE LEFT BY BROOK ELEMENTARY.

UH, THERE'S A FIELD ON THE WEST SIDE OF THE ELEMENTARY SCHOOL WHERE WE WILL ASSEMBLE IF WE'D HAVE TO EVACUATE THE BUILDING.

THERE'S AN AUTOMATIC EXTERNAL DEFIBRILLATOR OR A ED LOCATED NEXT TO THE ELEVATOR PAST THE LOBBY.

AS YOU ENTER THE BUILDING, IF WE DO NEED A A ED, THANK YOU.

SO WE CAN PROCEED SAFELY FROM THIS POINT? YES, SIR.

ALL RIGHT.

ALL RIGHT.

JUST MAKING SURE.

UH, THANK YOU VERY MUCH, UH, FOR THE BRIEFING.

UH, I THINK THAT IT'S, IT'S REALLY IMPORTANT AS WE ARE IN A NEW SPACE, UH, TO MAKE SURE THAT WE ARE FAMILIAR WITH THE NEW PROTOCOLS, UH, WHERE WE EXPECT TO FIND EACH OTHER IF WE HAVE TO LEAVE THE BUILDING.

UH, SO I AM HAPPY THAT THE SAFETY TEAM AND THE CEO HAVE, I'VE ALL STEPPED UP TO MAKE SURE, UH, THAT WE KNOW EXACTLY WHAT WE'RE SUPPOSED TO DO IN CASE OF AN EMERGENCY.

SO, UM, WE'RE

[III. Public Comment]

MOVING TO THE PUBLIC COMMENT SEGMENT AND I UNDERSTAND THAT WE HAVE SEVERAL SPEAKERS THAT HAVE SIGNED UP IN ADVANCE.

SO, UH, WHEN I CALL YOUR NAME, IF YOU COULD PLEASE COME TO THE PODIUM.

UH, EACH SPEAKER WILL HAVE THREE MINUTES, UNLESS THEY'RE SPEAKING ON TWO AGENDA ITEMS OR THEY'RE REPRESENTING A GROUP, UH, THAT IS REPRESENTED WITH MORE THAN ONE PERSON IN THE ROOM.

IN THAT CASE, I'LL HAVE FIVE MINUTES.

ALRIGHT, SO OUR FIRST SPEAKER IS GONNA JOIN US REMOTELY.

IT WILL BE MS. ZIA JOSEPH.

UH, MS. JOSEPH HAS ASKED TO SPEAK ON SEVERAL ITEMS. MS. JOSEPH, ARE YOU AVAILABLE, MR. CHAIR? I DON'T SEE MS. JOSEPH WITH US.

UH, AS YOU KNOW, SHE WAS WITH US DURING THE PUBLIC HEARING, BUT I HAVE NOT SEEN HER JOIN THIS MEETING YET.

OKAY.

SO IF SHE DOES CALL IN, WE WILL ACKNOWLEDGE IT AT THAT POINT.

UH, BUT UNTIL THEN, UH, WE WILL MOVE TO PERSON NUMBER TWO, WHO'S ALSO SPEAKING REMOTELY, AND THAT WILL BE KAREN BLIZZARD.

OKAY.

UM, AND YOU WILL HAVE THREE MINUTES, SO PLEASE PROCEED.

GOOD AFTERNOON, CHAIR BILION AND MEMBERS OF THE BOARD.

MY NAME IS KAREN BLIZZARD.

I'M AN AUSTIN RESIDENT IN DISTRICT FIVE AND FREQUENTLY RIDE THE NUMBER THREE BUS ALONG THE MENCHACA AND SOUTH LAMAR CORRIDOR.

I'M HERE TODAY TO SPEAK ABOUT THE NIGHT OWL TRANSPORTATION OPTIONS ON NEW YEAR'S EVE, WHICH FALLS ON A SUNDAY WHEN REGULAR BUS HOURS END AT 10:00 PM FIRST OF ALL, I'D LIKE TO COMMEND CAP METRO IN THE CITY FOR PLANNING AN EXCITING EVENING AT AUDITORIUM SHORES WITH NIGHT OWL BUS SERVICE UNTIL 2:00 AM WE HAVE ATTENDED THE AUDITORIUM SHORES PARTIES IN THE PAST AND ALWAYS HAD A FANTASTIC TIME AT THOSE.

UM, I WOULD LIKE THIS YEAR TO ASK THAT YOU CONSIDER EXPANDING THE NIGHT OWL BUS PROGRAM TO SERVE OTHER AREAS OF THE CITY ON NEW YEAR'S EVE AS WELL.

THIS IS AN AFFORDABLE, EQUITABLE WAY TO GET PEOPLE SAFELY WHERE THEY NEED TO GO WITHOUT PAYING THE ELEVATED COST OF RIDE SHARE DURING THOSE PEAK TIMES.

THIS YEAR, WE'RE CONSIDERING GOING TO THE NEW YEAR'S EVE SHOW AT THE FAR OUT LOUNGE, WHICH IS LOCATED NEAR SLAUGHTER AND SOUTH CONGRESS.

AT THE END OF THE NUMBER THREE LINE, WE WOULD LOVE TO BE ABLE TO TAKE THE BUS THERE WITH OUR FRIENDS AND BACK, UM, ESPECIALLY SINCE THERE IS LIMITED PARKING IN THAT AREA.

[00:05:01]

AND CARS PARKED ALONG THE STREETS HAVE BEEN VANDALIZED RECENTLY BY IRRITATED NEIGHBORS.

BUT SINCE THE BUS SERVICE FOR NUMBER THREE ENDS AT 10:00 PM THAT EVENING IN THAT AREA, WE DON'T HAVE A GOOD OPTION FOR GETTING BACK HOME.

I DID SUBMIT A REQUEST FOR EXTENDED NIGHT OWL HOURS TO A CAP METRO CUSTOMER SERVICE REPRESENTATIVE.

UM, THAT WAS THIS MORNING.

SO OF COURSE THAT'LL TAKE SEVERAL DAYS.

UM, AND I DON'T SEE OUR EXAMPLE AS AN ISOLATED NEED.

I'M SURE THERE ARE MANY TRYING TO FIGURE OUT HOW TO GET AROUND TOWN EFFICIENTLY AND AFFORDABLY THAT NIGHT.

SO PLEASE CONSIDER HAVING NIGHTOWL HOURS FOR THE ENTIRE NUMBER THREE ROUTE AND ADDITIONAL ROUTES ACROSS TOWN ON NEW YEAR'S EVE AND PERHAPS ON OTHER OCCASIONS AS WELL.

UM, THIS IS GREAT FOR PUBLIC SAFETY AND GREAT FOR AUSTIN.

THANK YOU.

ALRIGHT, UH, THANK YOU MS. BLIZZARD, UM, FOR, UH, PRESENTING, UH, YOUR IDEAS TO THE BOARD.

UM, NEXT PERSON ON THE LIST IS, UH, PEDRO HERNANDEZ.

MR. HERNANDEZ, ARE YOU OKAY? ALRIGHT.

THOUGHT YOU WERE GONNA BE REMOTE HERE.

YOU ARE ALL LIBERAL MEMBERS.

UH, MY NAME IS PEDRO HERNANDEZ JR.

AND I'M WITH PO HERNANDEZ.

HOLD ON BACK HERE.

I CAN'T SEE YOU.

HELLO, BOARD MEMBERS.

MY NAME IS PEDRO HERNANDEZ JR.

AND I'M WITH PODER, AN ENVIRONMENTAL AND SOCIAL JUSTICE ORGANIZATION.

I'M A COMMUNITY ORGANIZER AND FAIR FARES CAMPAIGN COORDINATOR.

I'M ALSO A RESIDENT OF THE MONTAO NEIGHBORHOOD, WHICH IS THE NEIGHBORHOOD THAT WILL BE GREATLY IMPACTED BY CAP METRO'S LIGHT RAIL.

I'M HERE TO SPEAK ABOUT THE FAIR FAIRS MOVEMENT IN REFERENCE TO PROJECT CONNECT, AUSTIN TRANSIT PARTNERSHIP AND CAP METRO'S LIGHT RAIL FAIRS.

UM, I HAVE GIVEN YOU GUYS, UM, A COPY OF THE PETITION THAT WE HAVE ONLINE AND WE HAVE ALMOST A THOUSAND PETITIONS ONLINE IN REFERENCE TO THEM BEING THE SAME PRICE.

OKAY.

UM, CAP METRO IS SPENDING OVER $7 BILLION TO CREATE A RAIL THAT WILL BRIDGE VARIOUS AREAS OF AUSTIN, INCLUDING EAST AUSTIN, AN AREA WITH REMAINING WORKING CLASS COMMUNITIES OF COLOR.

HOWEVER, THE COST OF A DAY PASS RAIL RAIL RIDE IS $7.

THIS IS EXTREMELY UNAFFORDABLE, ESPECIALLY IN COMPARISON TO THE DAY PASS OF TWO 50 FOR THE DAY FOR THE LOCAL BUS.

YOU HAVE STATED IN THE PAST THAT YOU, THAT YOUR PLAN IS FOR THE PRICE OF THE LIGHT RAIL TO BE THE SAME AS THE REGULAR LOCAL FAIRS, BUT WE HAVE NOT, BUT WE HAVE YET TO SEE THIS IN WRITING.

WE ARE ASKING TO HAVE THIS IN WRITING SO THAT WHEN THE LIGHT RAIL IS FINALLY READY FOR FOR RIDERS, THEY WILL KNOW THAT IT WILL BE THE SAME PRICE WHEN TRANSFERRING FROM THE LOCAL BUS TO THE LIGHT RAIL.

THUS ENSURE AN EQUITY IN THE, IN OUR PUBLIC TRANSPORTATION SYSTEM.

BUS FARE SHOULD EQUAL RAIL FAIRS.

EQUITY ENSURES ACCESSIBLE AND AFFORDABLE TRANSPORTATION FOR EVERYONE IN THE COMMUNITY.

AUSTINITES DESERVE FAIR DISTRIBUTION OF TRANSPORTATION RESOURCES, BENEFITS, COST, PROGRAMS AND SERVICES.

IF THE LIGHT RAIL FAIR PRICE IS NOT EQUIVALENT TO THE LOCAL BUS FAIR PRICE, THEN CAP METRO WILL CONTINUE TO PERPETUATE INEQUITY AND DISCRIMINATE AGAINST LOW INCOME AND COMMUNITIES OF COLOR.

AND A SIDE NOTE, WHEN PEOPLE CAN RELY ON THE BUS OR TRAIN TO GET WHERE THEY NEED TO BE, THEY CAN BETTER ACCESS JOBS, EDUCATION, MEDICAL CARE, CULTURE, GOODS AND SERVICES AND THE DAILY LIFE OF THEIR COMMUNITIES.

THANK YOU.

THANK YOU VERY MUCH FOR YOUR COMMENTS AND TAKING THE TIME TO, UH, GIVE THEM TO US.

I SEE THAT YOU'RE WITH, UH, SUSANNA ALMANZA, WHO HAS BEEN A, UH, A LONG TERM, LONG TIME ACTIVIST IN THE COMMUNITY.

SO, UH, GOOD TO SEE YOU.

GOOD TO YOU.

ALWAYS.

ALRIGHT, UH, AND UH, ED, YOU WERE TELLING ME THAT MS. JOSEPH IS NOW ON THE PHONE.

I BELIEVE SO.

MS. JOSEPH, ARE YOU WITH US? MS. JOSEPH, CAN YOU HEAR US? YES, MR. EASTON.

ALRIGHT.

UM, LET'S SEE.

WE WILL RECOGNIZE, UH, MS. JOSEPH FOR FIVE MINUTES.

UH, I THINK SHE WILL BE TALKING ABOUT TWO ITEMS. UH, UH, PLEASE GO AHEAD MR. JOSEPH.

FIVE MINUTES.

THANK YOU MR. CHAIR MEMBERS.

I'M XENOBI JOSEPH.

MY COMMENTS ARE SPECIFICALLY RELATED TO TITLE SIX OF THE CIVIL RIGHTS ACT OF 1964, WHICH PROHIBIT IS DISCRIMINATION BASED ON RACE, COLOR, AND NATIONAL ORIGIN.

LET ME JUST START WITH THE SAFETY ITEM THAT'S ON YOUR AGENDA.

I DO RECOGNIZE THAT YOU ARE REQUIRED BY THE FEDERAL TRANSIT ADMINISTRATION TO SUBMIT THE SAFETY PLAN.

HOWEVER, AS YOU'VE HEARD ME SAY MANY TIMES, IT DOESN'T COST CAPITAL METRO ANY MONEY TO ACTUALLY MOVE 5 8 5 7, THE CHINATOWN MID BLOCK STOP TO CVS PHARMACY.

YET IN THE BOARD PACKET, I AM LOOKING AT THE

[00:10:01]

PUBLIC TRANSPORTATION AGENCY SAFETY PLAN, LANGUAGE FOR STRATEGIC OBJECTIVES.

AND IT SAYS SAFE AND RELIABLE SERVICE WHEN PEOPLE CROSSED MIDBLOCK.

AS YOU ARE AWARE FROM THE 2009 TEXAS TRANSPORTATION INSTITUTE STUDY, THAT IS WHERE THEY ARE MOST LIKELY TO BE KILLED.

DAVID JOHN MEDRANO WAS KILLED MIDBLOCK OVER AT FAIRFIELD STATION AND THEN AFTER HIS DEATH, THAT IS WHEN THE CITY ACTUALLY PUT A PEDESTRIAN HARVARD BEACON.

I'M LOOKING AT THE STRATEGIC OBJECTIVES AND IT ALSO SAYS HIGH QUALITY CUSTOMER EXPERIENCE.

I WANT MEMBER STRATTON TO RECOGNIZE SPECIFICALLY THAT IF YOU WANT TO EMPOWER LOW INCOME WRITERS AS THE PREVIOUS SPEAKER MENTIONED, THEN YOU WOULD CONNECT THEM TO SAMSUNG, TO APPLE, TO THE THREE HES THAT ARE ON PARMA LANE TO JOBS.

EVEN WITH THE FREE BUS PASS, IT'S WAS STILL A THREE MILE WALK FROM 3 92 STOP.

ID 5 3, 2, 3 TO GET THE SAMSUNG.

YOU HAVE AN EXISTING FLEET.

YOU CAN USE THE LITTLE PICKUP BUSES, THE LITTLE CUTAWAY VEHICLES RATHER, AND CREATE FOR THE WHITE PEOPLE IN LEANDER ALL THE WAY TO MAINOR SOME TYPE OF ACCESS EAST WEST CONNECTIVITY.

AND I WILL JUST ADD THAT WHILE THE MAYOR WENT AND SPOKE BEFORE CONGRESS, HE DIDN'T MENTION THE PROJECT CONNECT LAWSUIT AND HE DIDN'T RECOGNIZE THAT EVEN IF WE WERE TO GET AMTRAK, HOW WOULD PEOPLE GET TO SAMSUNG AND APPLE INTO THESE ROBUST JOBS ON PARMER LANE? YOU CAN DO BETTER.

I WANT YOU TO RECOGNIZE AS IT RELATES TO ITEM SIX, THAT'S THE 11 CANDIDATES TO SERVE AS MEMBERS OF THE PROJECT CONNECT COMMUNITY ADVISORY COMMITTEE.

THAT IS AN OPAQUE PROCESS.

I RECOGNIZE THAT MY COMMENTS BEFORE YOU TODAY EQUATE TO A MERE EXERCISE INTO UTILITY.

SO WHAT I AM GOING TO DO IS WRITE TO THE IRS INSTEAD.

AND I AM FIRST GOING TO START WITH FOREMAN CITY BECAUSE JAY BLAKE BLAZE CROSSLEY ACTUALLY TESTIFIED AGAINST HOUSE BILL 3 8 9 9.

AS DID OTHER MEMBERS THAT ARE LISTED FOR YOU TO ACTUALLY APPOINT TODAY.

I WANT YOU TO RECOGNIZE THAT ON JUNE 8TH, 2023, THAT WAS ACTUALLY A CAC MEETING, THE PROJECT CONNECT MEETING AND THE MEMBERS, MR. GORSE, G-O-R-S-E, WHO IS THE BLIND GENTLEMAN ON THE BOARD, HE DIDN'T EVEN KNOW WHAT THE PROCESS WAS TO GET APPOINTED.

I WANT YOU TO RECOGNIZE THAT WHAT YOU HAVE DONE IS RECYCLED INDIVIDUALS WHO HAVE ALREADY SERVED ON OTHER COMMITTEES AND IT APPEARS THAT YOU HAVE SIMPLY CHOSEN TO PUT THOSE MEMBERS BACK ON.

AND THERE IS ONLY ONE BLACK MALE.

SO THIS IS TOKENISM AND AS BEST I CAN TELL, THERE ARE ONLY REALLY THREE NEW PEOPLE.

AND THAT'S FOR SUSAN SUMMERS, WHO ACTUALLY LEADS THE URBAN TRANSPORTATION COMMISSION AS CHAIR.

I WANT YOU TO RECOGNIZE SHE KEEPS TALKING ABOUT THIS PURPLE WINE OR PURPLE WINE, PLURAL, THAT'S SAMSUNG TO APPLE, WHICH IS NOT EVEN IN THE PLAN THAT WAS ADOPTED JUNE 6TH, 2023.

THERE IS NO ONE THAT YOU ARE NOMINATING THAT ACTUALLY REPRESENTS THE TRANSIT DEPENDENT MINORITIES THAT ARE NORTHEAST OF US, 180 3.

AND I WOULD ASK YOU TO TABLE THIS ITEM AND RECOGNIZE THAT YOU'RE NOT DOING US ANY TYPE OF SERVICE.

THIS IS A DISSERVICE.

AND I WOULD LASTLY JUST SAY AS IT RELATED TO THE NUMBER ONE, WHICH WAS THE TRANSIT PASSES AGAIN TO MEMBER STRATTON IN PARTICULAR, UM, MORE CAN BE DONE MEMBER STRATTON.

AND I'M CALLING YOU OUT JUST BECAUSE YOU MENTIONED YOU WANTED TO EMPOWER THE PEOPLE WHO ARE LOW INCOME AND RESPECTFULLY, IF YOU WANTED TO EMPOWER THEM, THEN YOU WOULD CONNECT US BACK TO THE ARBORETUM ONE SEAT RIDE AS OPPOSED TO GAMING THE SYSTEM AND INCLUDING KELMAR TRANSIT CENTER AND THE EQUITABLE TRANSIT-ORIENTED DEVELOPMENT ITEMS, UH, AS THEY GO BEFORE THE FEDERAL TRANSIT ADMINISTRATION.

DOTIE WATKINS HAS HEARD ME SAY THIS MANY TIMES, AND I WOULD JUST ASK HER TO RECOGNIZE THAT IF THE SYSTEM THAT WE MINORITIES HAVE TO ACTUALLY ENDURE IS NOT GOOD ENOUGH FOR HER DAUGHTER, THEN IT SHOULD NOT BE THE WAY THAT IT IS TODAY.

AND I WOULD ASK YOU TO DO MORE THAN JUST GO THROUGH THE MOTIONS OF PASSING SAFETY ITEMS WHEN PEOPLE ARE DYING.

AND SO THOSE ARE MY COMMENTS MR. CHAIR.

I KNOW YOU'VE HEARD ME ASK YOU TO RESIGN BEFORE OR RESPECTFULLY MOORE CAN BE DONE FOR NORTHEAST AUSTIN.

AND I'VE SAID THIS AD NAUSEUM AND YOU GUYS HAVE SIMPLY CIRCUMVENTED TITLE SIX OF THE CIVIL RIGHTS ACT OF 1964 BECAUSE YOU SAY ONE THING, DO ANOTHER DOCUMENT WHAT IT SAID, THE FOOL THE FED.

ALL RIGHT.

THAT WOULD BE END OF YOUR FIVE MINUTES.

MS. JOSEPH, THANK YOU FOR COMING AND ADDRESSING THE BOARD.

UM, AND THANK YOU.

I HOPE YOU WILL ACT ON MY, UH, RECOMMENDATION.

HAVE A BLESSED DAY.

UM, BLESS YOUR HEART.

ALL RIGHT.

UM, LET'S SEE.

UH, THE NEXT PERSON WHO IS, UH, SIGNED UP TO SPEAK IS DAVID KEYS.

HELLO.

[00:15:03]

CAN WE, YOU DON'T, YOU DON'T HAVE TO HAND IT OUT.

JUST APPRECIATE IT.

YOUR PLEASE.

UH, I'M, I'M REQUESTING FIVE MINUTES, SIR.

'CAUSE IT'S TWO DIFFERENT SUBJECTS.

UH, GO AHEAD.

THANK YOU.

YOU'LL HAVE FIVE MINUTES.

UH, FIRST I WANT TO THANK ED FOR BRINGING ME IN AND LETTING ME SEE THE BEING IN INFORMING ME FOR THE FIRST TIME.

AND NINA AS WELL, WHO I TAKE DANCE CLASSES WITH AT THE YMCA .

UH, SO HELLO CAPITAL METRO BOARD.

THANK YOU FOR HAVING ME.

MY NAME IS DAVID KEYS.

I'M HERE TO PRESENT A LOGICAL, MORAL AND CORRECT PLAN TO CHANGE A PART OF ROUTE 3 24 AND ROUTE 1 42.

PLEASE TURN TO PAGE ONE.

I'M A RESIDENT OF AUSTIN, SPECIFICALLY NACA SHORT FOR NACA AUSTIN CIVIC ASSOCIATION, WHICH IS THE NEIGHBORHOOD THAT THAT LIES NORTH OF 180 3 EAST OF METRIC, SOUTH OF KRAMER AND WEST OF NORTH LAMAR, AND IS A PART OF DISTRICT FOUR.

IN FACT, OUR AUSTIN DISTRICT FOUR CITY COUNCIL MEMBER IS HERE WITH US.

HELLO CHEETO.

UH, THERE IS MUCH HISTORY IN NACA.

UH, IT STARTED IN THE 18 HUNDREDS AT FISKVILLE AND WAS CENTERED AROUND THE LITTLE WALNUT CREEK, WHICH IS A SPRING FED CREEK.

THE SPRING FED CREEK STARTS, UH, AT THE EDGE OF Q2 STADIUM AND WINDS ITS WAY THROUGH NORTH AUSTIN, ALL THE WAY THROUGH TO THE COLORADO.

THE CREEK IS AUSTIN'S WILDLIFE'S BEST SET KEPT SECRET OR WAS THIS PLANT PROTECTS THE NEIGHBORHOOD, PROPERTY VALUES AND WELLBEING.

IT PROTECTS THE AMAZING LITTLE WALNUT CREEK AND ALSO PROVIDES EVEN MORE ACCESS TO THE PEOPLE WHO NEED IT IN MANCA NEIGHBORHOOD.

I LIVE RIGHT OFF OF ME'S MEADOW.

I'M SURE OUR COUNCIL MEMBER CAN RECALL THE FLOODING THAT OCCURRED THERE.

UH, PLEASE TURN TO PAGE TWO, TWICE A DAY, I WALK ME'S MEADOW WITH MY DOG, SNARKY AND THE MORNING, AND AT NIGHT I RESCUE SNARKY OFF THE FREEWAY, STOPPING TRAFFIC AND BRINGING HER IN FOR AN EMERGENCY SURGERY.

SHE'S NOW 13 AND MEANS THE WORLD TO ME.

PLEASE TURN TO PAGE THREE.

MES MEOW FOLLOWS ALONG LITTLE WALNUT CREEK BECAUSE LITTLE WALNUT CREEK HAS A YEAR AROUND SPRING FED WATER.

IT IS A LITERAL OASIS.

THE WATER DOESN'T ALWAYS FLOW FAR, BUT IT, IT STICKS WITHIN A MILE OF THE SPRING'S MOUTH.

IT SUPPORTS A FULL TOP TO BOTTOM ECOSYSTEM WITH ALGAES AND MOSSES TO FISH ALL THE WAY UP TO THE PREDATORS, PLEASE TURN TO PAGE FOUR.

SNARKY LOVES TO WALK DOWN THE CREEK'S EDGE.

AND SO, UH, SO DO I.

SHE EVEN TAKES A DIP.

WE SEE, WE'VE SEEN FOXES, WHITE TAIL HAWKS, SPOTTED TAIL HAWKS, SCREECH TOWELS BARRED OWLS, WOODPECKERS, BLUE HERONS, GREAT WHITE HERONS, WHIPPING CRANES, MALLARD DUCKS, PLAIN BELIED WATER, SNAKES, SOFT SHELL TURTLES, RED SLIDER TURTLES, SNAPPING TURTLES, CRAWFISH, AND MANY NATIVE TEXAS FISH, UH, A NEIGHBOR HAS HAD, HAS PHOTOS OF DEER.

UH, MY WALKS WITH MY DOGS SNARKY ARE ALWAYS A, A BREATHER WHERE I GET TO ENJOY THE BEAUTY OF CENTRAL TEXAS AND BEAUTIFUL LITTLE WALNUT CREEK.

NOT ANYMORE.

PLEASE TURN TO PAGE FIVE.

NOW MY WATTS CONSISTS OF PICKING UP BEER CANS AND CONVENIENCE STORE TRASH, USUALLY CONSOLIDATED NEAR THE BUS STOPS THAT WERE INSTALLED INTO OUR SINGLE FAMILY RESIDENTIAL CAR OWNING NEIGHBORHOOD.

THE PROBLEM GETS WORSE AND WORSE AS MORE AND MORE EYES OF THE OF THE PUBLIC TRANSPORTATION GET BROUGHT INTO OUR NEIGHBORHOOD THAT DOESN'T NEED PUBLIC TRANSPORTATION.

OUR MAILBOXES ARE GETTING ROBBED.

CARS RANSACKED AND TRASH IS NOW EVERYWHERE.

THE BATTLE HAS JUST BEGUN ON THE HOMELESS TRYING TO TAKE OVER THE BEAUTIFUL CREEK, UH, THAT THEY RIDE BY EVERY DAY.

ON THE BUSES, I HAVE FOUND TURTLES DEAD WITH THEIR SHELLS CRUSHED NEXT TO THEIR ENCAMPMENTS.

PLEASE TURN TO PAGE SIX.

THE FIRST BUS THAT NEEDS TO BE REROUTED IS BUS 1 42, WHICH COMES DIRECTLY FROM DOWNTOWN AND STAYS ON MAIN THOROUGHFARES UNTIL HITTING OUR SINGLE FAMILY RESIDENTIAL CAR OWNING NEIGHBORHOOD.

PLEASE TURN TO PAGE SEVEN.

THE NEXT BUS LINE THAT NEEDS ADJUSTMENT IS BUS 3, 2, 4.

THIS BUS IS THE DEATH SENTENCE FOR OUR NEIGHBORHOOD.

EVERY 30 MINUTES, PEOPLE FROM LAMAR AND RUNDBERG, WHICH IS THREE STOPS AWAY, ARE INJECTED INDOOR SINGLE FAMILY, RESIDENTIAL, CAR OWNING NEIGHBORHOOD.

THE PSYCHOLOGICAL TOLL OF THE TRASH THEFT, LOITERING AND DEFECATING ON OUR STREETS IS LIKE SOMEONE STOLE OUR HOMES FROM US.

IF YOU LOOK ON OUR NOTES, THE PART OF THE ROUTE HIGHLIGHTED IN PURPLE IS MENTIONED AS A LONG-TERM DETOUR.

I CALLED HERE AND THE ROOT HAS NO DETOURS.

CURRENTLY THOUGH, UH, ONE IS ABOUT TO START THIS HORRIBLE THREAT OF OUR NEIGHBORHOOD'S WELLBEING ISN'T EVEN SUPPOSED TO BE THERE.

PLEASE TURN TO PAGE EIGHT.

HERE'S NCA'S NEIGHBORHOOD DIVIDED BY LAND USE.

PLEASE NOTE THE YELLOW AND ORANGE AREAS.

YELLOW IS SINGLE FAMILY HOMES, WHICH ARE MUCH LESS NEEDING OF PUBLIC TRANSPORTATION.

WE ALL HAVE CARS.

THE HIGH DENSITY APARTMENTS ARE THE AREAS IN ORANGE.

TAKE NOTE OF THE PURPLE STAR, WHICH IS COOK ELEMENTARY.

PLEASE TURN TO PAGE NINE HERE.

HERE'S AN OVERLAY OF THE SPRING FED LITTLE WALNUT CREEK, WHICH STARTS AT THE EDGE OF Q2 STADIUM.

PLEASE TURN TO PAGE 10.

HERE'S AN OVERLAY OF THE BUS ROUTES, 3, 2, 4, AND 1 4 2 COMING THROUGH NACA.

PLEASE NOTICE HOW MUCH THE BUS ROUTES ARE GOING THROUGH THE YELLOW SINGLE FAMILY RESIDENTIAL CAR OWNING AREAS OF OUR NEIGHBORHOOD.

PRETTY MUCH THE ONLY PEOPLE HANGING AROUND THESE BUS STOPS ARE LOITERS, DOING DRUGS, DRINKING, AND SOMETIMES TAKING THE OCCASIONAL CRAP.

FUNNY ENOUGH, CAPITOL METRO PUT TRASH CANS BECAUSE OF THE COMPLAINTS, BUT THE PEOPLE WHO ARE GOING TO BE DRINKING AND LOITERING AT A BUS STOP DON'T CARE ABOUT TRASH CANS.

SO NOW WE JUST HAVE SYMBOLS OF THE FILTH THAT IS IN, IN OUR NEIGHBORHOOD.

UH, PLEASE PRAY.

TURN TO PAGE 11.

I I HAVE HAD PLENTY OF TIME AND NEIGHBORHOOD EXPERIENCE

[00:20:01]

TO REROUTE THESE BUS LINES TO PROTECT OUR NEIGHBORHOODS AND EVEN ADD ACCESS TO PLACES THAT NEED IT.

NOTICE HOW THE NEW 3, 2, 4 BUS ROUTE TOUCHES ALL ORANGE MULTIFAMILY AREAS AND STREAMLINES PAST THE YELLOW SINGLE FAMILY CAR OWNING HOMES.

ALSO, BUS ROUTE 1 42 AS THE EXACT SAME ABILITY TO PROVIDE TRANSPORTATION TO THE NEIGHBORHOOD WITH, WITH WITHIN COMING INTO OUR RESIDENTIAL AREAS AND ONLY BRINGS IN WHO SHOULD BE IN THESE NEW BUS ROUTES.

KEEP THE BUSES ON MAIN THOROUGHFARES LIKE ALMOST EVERY OTHER BUS ROUTE.

BUS ROUTE IN AUSTIN.

THE GREEN NUMBER ONE IS THE OLD BUS STOP AT COOK ELEMENTARY.

THE GREEN NUMBER TWO WOULD BE THE NEW BUS STOP CLOSEST TO COOK.

THE NEW BUS ROUTE ALSO PROVIDES MULTIFAMILY AREAS.

UH, WHAT, SORRY.

PROVIDES MULTIFAMILY AREAS.

BUS ACCESS AT THE GREEN.

NUMBER THREE, BOTH OF THOSE DISTANCES ARE THE SAME AS WELL.

OUR POOR RESIDENTIAL ROAD IS NOT GRADED FOR CONSTANT USE.

PLEASE CLEAR.

TURN TO PAGE 12.

UH, MR. KEYS, I UNDERSTAND IT'S, IT'S ONE 30 SECONDS LEFT.

PAGE 14.

THIS PROJECT FELL THROUGH AND SAT FOR YEARS.

PAGE 15.

IT WAS SUPPOSED TO BE DONE A YEAR AGO, ENDING IN 2022.

THE CONSTRUCTION IS JUST KEPT GOING.

NOW IT'S ENDING IN 2026.

ALL OF ME'S MEADOW IS GONNA BE DETOURED AND HAVE CONSTRUCTION FOR THE NEXT THREE YEARS.

SO THAT BUS LINES ARE GONNA BE GETTING DETOURED ANYWAYS, PUTTING, THROWN ONTO NEW RESIDENTIAL HOMES, CAUSING MORE DESTRUCTION AND THEY SHOULD BE REROUTED TO MAIN THROW AFFAIRS LIKE THE MAJORITY OF THE BUS LINES IN AUSTIN.

THANK YOU FOR YOUR TIME.

UM, MR. KEYS? YES.

UH, NUMBER ONE, THANK YOU FOR COMING.

YEAH.

AND, AND PRESENTING YOUR IDEAS.

YEAH.

WE'RE GONNA SEND THIS TO APPROPRIATE STAFF SO WE CAN SIT DOWN AND TAKE OUR TIME AND GO THROUGH IT AND UNDERSTAND.

YEAH.

AND SEE WHAT YOU SEE.

SURE.

SO, I APPRECIATE YOU COMING HERE.

UH, WE'LL TAKE SERIOUSLY WHAT YOU'VE PRESENTED US AND, UH, AND TAKE OUR TIME AND, AND MAKE SURE THAT WE, UH, DO ALL THE APPROPRIATE THINGS.

THANK YOU.

THANK YOU BOARD.

ALRIGHT.

CHEAT OUT.

COUNT ON YOU, MAN.

ALRIGHT.

UM, I, I'LL JUST ADD, THANK YOU.

THAT WAS VERY THOROUGH IN THE AMOUNT OF TIME THAT YOU HAD, WHICH IS NOT VERY, NOT A LOT OF TIME TO GO THROUGH ALL THAT.

AND THANK YOU VERY MUCH FOR BRINGING IT TO OUR ATTENTION.

ALRIGHT.

AND, UH, THANK MS. MILLER IS GOING TO, UM, ADDRESS THIS ONE MORE TIME.

GOOD MORNING.

I'M DEBORAH MILLER.

UM, THIS LAST YEAR I'VE BEEN ABLE TO USE MY WHEELCHAIR.

I GOT A NEW WHEELCHAIR FINALLY.

SO I'VE BEEN ABLE TO GO TO OUTLYING COMMUNITIES, UM, FOR 10 HOURS, FIVE HOURS EACH WAY.

I CAN GO TO ROUND ROCK NOW FROM WHERE I LIVE, WHICH I, I MEAN, I JUST LIKE TO EXPLORE, RIGHT? BUT IN CEDAR PARK, I WANTED TO MAKE A RECOMMENDATION TO YOU.

THEY HAVE WHAT'S CALLED A, I CALL IT A ROLLING CURB.

AND WHEN WE LOOK AT NOW, MOST OF THE BUS STOPS IN AUSTIN ARE ADJACENT TO A BIKE LANE.

IF THOSE CURBS WERE NOT HARD CURBS, IF THEY WERE ROLLING CURBS, PEOPLE LIKE ME WHO ARE PROVISIONAL RIDERS, WE WOULD NO LONGER BE BLOCKED FROM GETTING TO A LOT OF THE BUS STOPS.

WHICH IS ONE OF THE REASONS WHY I MIGHT CHOOSE TO USE THE A DA SERVICE AS OPPOSED TO GO MYSELF, IS THAT I CAN'T GET ON THE BUS STOP ITSELF.

'CAUSE A LOT OF 'EM HAVE A HARD CURB ON 'EM.

SO I'D ENCOURAGE YOU TO LOOK TO CEDAR PARK FOR THE WAY THEY'RE DOING THAT.

ALSO IN, UH, ROUND ROCK, THEY HAVE 88 WHEELCHAIR ACCESSIBLE TO PORTA-POTTIES.

AND IF YOU'VE EVER TRIED TO CHANGE A DIAPER AT A BUS STOP, YOU WOULD APPRECIATE THAT.

LIKE I DO THAT, YOU MIGHT WANNA LOOK INTO THAT AT SOME POINT IN THE FUTURE.

AND THEN THE OTHER THING I WANTED TO BRING TO YOUR ATTENTION, I WAS ON A 700 SERIES BUS THE OTHER DAY AND I WAS HORRIFIED TO SEE THE VIEW FROM THE DRIVER'S SEAT, WHICH I DON'T THINK Y'ALL ARE AWARE OF.

BUT WE ARE PURCHASING SO MUCH NEW TECHNOLOGY THAT WE'RE PUTTING ON THE DASH.

AND IN THE WINDSHIELD I COUNTED FOUR MOTOR VEHICLE CODE VIOLATIONS OF THINGS THAT WERE HANGING FROM THE MIRROR.

UM, YOU CAN'T EVEN PUT AN AIR FRESHER ON THE CAR AND DRIVE AROUND THAT WAY.

UM, THERE'S A NEW SCREEN ON THE, ON THE DASH.

I'M NOT SURE WHAT IT'S FOR, BUT IT BLOCKS THE REAR VIEW THE SIDE MIRROR.

SO RIGHT NOW THE DRIVER, THERE'S A HANDLE ON THIS SIDE AND A SCREEN ON THIS SIDE.

SO THE DRIVER CAN BARELY SEE WHAT'S IN FRONT OF HIM WITH ALL THIS GREAT NEW TECHNOLOGY TO HELP US.

AND THEN THE OTHER THING, I GUESS IS THE BLACK BOX OR SOMETHING THAT'S BEEN PUT ON THE FLOOR AND BEEN COVERED UP WITH A FABRIC THAT MATCHES THE FLOOR.

SO IT'S HARD TO SEE AND IT'S JUST, I CAN'T SEE HOW DRIVER'S NOT JUST GONNA TRIP AND TRIP AND TRIP AND GET HURT OVER IT.

SO I, I REALLY WISH THAT, UM, IN ADDING THIS NEW TECHNOLOGY THAT YOU WOULD TAKE A CHANCE AND STOP AND LOOK FROM THE DRIVER'S VIEW.

I CAN'T SEE THE ROAD.

GUYS.

HELP US OUT.

THANK YOU.

THANK YOU VERY MUCH FOR, FOR YOUR TIME AND, AND UH, THE INFORMATION THAT YOU GIVE TO THE BOARD.

RIGHT.

UH, BEFORE WE MOVE ON, LET ME MAKE SURE THAT THERE'S NOT ANYONE ELSE WHO, UH, WANTS TO ADDRESS THE BOARD.

IS THERE ANYONE ELSE IN THE AUDIENCE THAT WOULD LIKE TO ADDRESS THE BOARD THIRD TIME FOR POSTERITY? ANYONE ELSE THAT WOULD LIKE TO ADDRESS THE BOARD? OKAY.

UH, HEARING NONE, UH, I'LL SAY THANK YOU TO EVERYONE, UH, WHO PRESENTED AND, UH, SHARED THEIR POINT OF VIEW.

ALRIGHT.

UH, WE'RE GONNA HAVE OUR BOARD

[IV. Advisory Committee Updates]

ADVISORY COMMITTEE UPDATES, UH, MS. BARRA, UH, AND I GUESS WE WILL START WITH THE CUSTOMER

[00:25:01]

I'M HERE TO PROVIDE DECEMBER'S COMMITTEE UPDATES AND I THINK I, I'M JUST GONNA LUMP THEM TOGETHER IF THAT'S OKAY, JUDGE.

OKAY.

ALRIGHT.

UH, IF THERE'S, IF THERE'S NO OBJECTION.

ALRIGHT, PLEASE GO AHEAD.

SO, FOR DECEMBER, ACCESS AND CSAC MET ON DECEMBER 6TH AND 13TH.

UM, THEY BOTH RECEIVED AN UPDATE ON, UM, ETOD BY ANNA LAN, UH, PENAL PENELOPE LING AND MATTHEW MEJIA, UM, CSAC SPECIFIC.

SHE MEYER.

UM, THE LAST MEMBER UPDATE, UM, FOR PSAC, WE ARE WORKING WITH, UH, BOARD MEMBER STRATTON AND ALSO BOARD MEMBER ELLIS ON APPOINTING OUR LAST TWO, UM, PSAC MEMBERS.

UM, SO WE'LL CONTINUE TO WORK WITH MR. EASTON ON APPOINTING THOSE MEMBERS.

AND, UM, I WORK WITH YOU IN THE EARLY NEW YEAR.

UM, AND THAT'S THE, THAT'S ALL THE UPDATES ON THE ADVISORY COMMITTEES.

IF YOU HAVE ANY QUESTIONS, LET ME KNOW.

OKAY.

BOARD MEMBERS, ANY QUESTIONS, DON'T SEE ANY, BUT I'LL ASK TWO MORE TIMES.

BOARD MEMBERS, ANY QUESTIONS? BOARD MEMBERS? ANY QUESTIONS? HEARING NONE.

I THANK YOU MS. POWER FOR ALWAYS A THOROUGH AND COMPLETE REPORT.

UH, THANK YOU FOR, UH, THANK YOU BRINGING EVERYTHING TO OUR ATTENTION.

ALRIGHT.

UH, NEXT IS GOING TO BE OUR REGULAR BOARD COMMITTEE UPDATES.

UH, BUT BEFORE WE START THAT, UH, I JUST WANT TO RECOGNIZE, CONGRATULATE AND THANK BOARD MEMBER STRATTON FOR, UH, THE FIFTH ANNIVERSARY OF HIS SERVICE ON THE CAP METRO BOARD.

CAN WE RECOGNIZE HIM? PLEASE? NOW WE HAVE NOT KEPT INDIVIDUAL CALCULATIONS, BUT I'M FAIRLY CERTAIN THAT HE HAS ASKED MORE QUESTIONS THAN ANY BOARD MEMBER IN THE HISTORY OF THE BOARD .

SO, UH, IF, IF THERE'S ANYONE THAT ELSE THAT WOULD LIKE TO ROAST HIM, , UH, WE PROBABLY WON'T DO THAT TODAY, BUT WE'LL PLAN TO DO SOMETHING SOMETIMES SOON.

UH, BOARD MEMBER STRATTON, WOULD YOU LIKE TO SAY A WORD PLEASE? WORD .

NOW THAT USED TO BE A SONG IN THE NINETIES NOW, SO WE'LL TALK ABOUT THAT AFTER.

THANK, THANK YOU MR. CHAIRMAN.

I, I REALLY APPRECIATE THAT.

I I HADN'T EVEN GIVEN IT A, A THOUGHT LATELY THAT OH, FIVE YEARS.

YES.

GOOD FIGURE.

SO, UM, THANK YOU.

IT'S, IT'S A BEEN AN HONOR AND A PRIVILEGE AND I, I, I THANK THE, THE FOLKS IN THE, UH, AT THE, UH, COMMISSIONER'S COURT IN WILLIAMSON COUNTY WHO'VE CONTINUED TO, TO PLACE THEIR FAITH IN ME TO COME BACK HERE.

AND THE FACT THAT, UH, THAT, THAT, UH, YOU GUYS HAVEN'T RUN ME OFF JUST YET.

SO, .

OKAY.

OKAY.

UM, BEFORE I ASK YOU TO TAKE UP THE CAMPO UPDATE, UH, LET ME JUST, UM, REMIND MY COLLEAGUES THAT WE WILL BE LOOKING AT THE CONSENT AGENDA AFTER, UH, TWO MORE COMMITTEE REPORTS.

SO IF YOU WILL, UH, BRIEFLY SCAN IT TO DETERMINE WHETHER THERE'S ANYTHING THAT YOU WANT TO TAKE OFF OF THE CONSENT AGENDA AND MOVE TO THE ACTION ITEMS. UH, AS, AS WE OPEN UP NUMBER SIX FOR CONSENT, THAT WILL BE THE TIME AND I'LL GIVE YOU AN OPPORTUNITY TO DO SO.

SO IF YOU'D, IF YOU'D PERUSE THOSE, THAT WOULD BE GOOD.

AND, UH, BOARD MEMBER HARRIS, IF YOU COULD TAKE US THROUGH THE CAMPO UPDATE.

THIS SHOULD BE BRIEF.

THE CAMPO TRANSPORTATION POLICY BOARD DID NOT MEET LAST MONTH, SO .

OH, OKAY.

WELL, UM, WELL THAT WAS A RECORD TIME FOR THE CAMPO UPDATE.

UH, I WILL PROVIDE THE AUSTIN TRANSIT PARTNERSHIP UPDATE, WHICH WILL BE A LITTLE MORE ROBUST.

UH, WE MET ON, UH, DECEMBER 15TH.

UH, AND, UH, ON 2023, UH, THE TRANSIT PARTNERSHIP, UH, TALKED ABOUT NOT ONLY THE, UH, RECURRING MONTHLY UPDATE, BUT WE APPROVED THE MINUTES AND DISCUSSED FIVE ACTION ITEMS. THEY WERE THE APPROVAL OF CONTRACTS RELATED TO PUBLIC RELATIONS AND MARKETING.

UH, THE NEXT MEETING OF THE A TP BOARD WILL OCCUR IN JANUARY OF 2024.

UH, THAT IS THE, UH, REPORT OF THE, UH, AUSTIN TRANSIT PARTNERSHIP.

ALRIGHT.

UM, ANY, ANY QUESTIONS, ANY FURTHER DISCUSSION QUESTIONS, FURTHER DISCUSSION, HEARING, NO QUESTIONS, OR FURTHER DISCUSSION.

UH, WE'RE NOW GONNA MOVE

[VI. Consent Items]

TO OUR CONSENT ITEM AGENDA.

UH, WE'RE POISED OR POSTED FOR ACTION ON 10 ITEMS TODAY.

10 ITEMS ARE ON OUR CONSENT AGENDA.

UH, WANNA MAKE SURE THAT IF ANYONE WANTS TO PULL AND DISCUSS ANY OF THOSE ITEMS, NOW IS THE TIME TO DO SO.

AND, UH, AND, UH, IF YOU DO SO, BE CONSIDERED FOR REGULAR ACTION.

IF THERE, UH, UH, DO WE HAVE ANYONE THAT WOULD LIKE TO PULL ANY ITEM? I'LL JUST MAKE THE MOTION TO APPROVE THE CONSENT.

OKAY.

UH, CHAIR WILL ENTERTAIN A MOTION.

SECOND.

OKAY.

UH, BOARD MEMBER POOL MAKES THE MOTION AND IT'S, UH, SECONDED BY BOARD MEMBER STRATTON.

IS THERE ANY FURTHER DISCUSSION ABOUT THE CONSENT AGENDA? ANY FURTHER DISCUSSION ABOUT THE CONSENT AGENDA? ANY FURTHER DISCUSSION? HEARING NONE.

ALL IN FAVOR, LET IT BE KNOWN BY SAYING AYE.

UH, OPPOSED? SAME SIGN.

HEARING NONE, THE CHAIR WILL MAKE IT UNANIMOUS.

THE CONSENT AGENDA HAS BEEN APPROVED.

RIGHT.

SO WE WILL

[VII.1. Approval of a resolution adopting amendments to CapMetro’s Fare Policy and Fare Structure to provide a no-cost, two-year transit pass for eligible unhoused or housing insecure customers for use on CapMetro local and Rapid bus, Pickup by CapMetro, and CapMetro Access services, approving the related Title VI Fare Equity Analysis, and authorizing the President & CEO, or her designee, to implement the fare change.]

NOW MOVE INTO, UH, THE, UH, REGULAR ACTION ITEMS AND, UM, WE HAVE SIX ITEMS POSTED FOR TODAY, STARTING WITH THE APPROVAL OF AMENDMENTS, UH, TO THE CAP METRO FAIR STRUCTURE, AND, UH, AND WHICH WAS ALSO THE TOPIC OF OUR FUR, OF OUR EARLIER DISCUSSION.

UH, MS. WALKER, UH, CAN YOU START US OFF ON THIS DISCUSSION? YES.

GOOD AFTERNOON.

AGAIN.

LET ME, LET ME READ IT IN, LET ME READ IT INTO THE RECORD.

I, I WAS, I WAS MOVING SLOWLY, BUT, UH, LET ME READ ACTION ITEM NUMBER ONE, APPROVAL OF A RESOLUTION ADOPTING AMENDMENTS TO CAP METRO'S FAIR POLICY AND FAIR STRUCTURE TO PROVIDE A NO COST TWO YEAR TRANSIT PASS FOR ELIGIBLE UNHOUSED OR HOUSING INSECURE CUSTOMERS FOR USE ON CAP METRO LOCAL AND MET, UH, RAPID BUS, UH, PICKUP BY CAP METRO AND CAP METRO ACCESS SERVICES APPROVING THE RELATED TITLE SIX FAIR EQUITY ANALYSIS AND

[00:35:01]

AUTHORIZING THE PRESIDENT AND CEO OR HER DESIGNEE TO IMPLEMENT THE FAIR CHANGE.

PLEASE GO AHEAD, MS. WELL, ALL RIGHT.

GOOD AFTERNOON AGAIN.

UH, CHAIR TAVIAN, MEMBERS OF THE BOARD AND PRESIDENT AND CEO WATKINS.

AGAIN, MY NAME IS CATHERINE WALKER AND I SERVE AS CAPTAIN METRO'S, EVP, CHIEF FINANCIAL AND RISK OFFICER.

UM, YOU SAW MY PRESENTATION EARLIER AT THE PUBLIC HEARING, I'M HAPPY TO ANSWER ANY QUESTIONS WITH THAT AS WELL AS EDNA PARRA HERE TO MY LEFT.

UM, AGAIN, WE WOULD LIKE TO MAKE A FORMAL CHANGE, UH, TO OUR FAIR POLICY TO INCORPORATE THIS NEW TRANSIT PASS.

OKAY.

UH, BOARD MEMBERS, DO WE HAVE ANY QUESTIONS? ANY QUESTIONS? ANY QUESTIONS? JUST MAKING SURE.

ALRIGHT.

UH, THEN, UH, CHAIR WILL ENTERTAIN A MOTION TO ACCEPT, UH, ACTION ITEM NUMBER ONE.

OKAY.

UH, BOARD MEMBER.

SO MOVED.

STRATTON MAKES THE MOTION BOARD MEMBER, VELA MAKES THE SECOND.

IS THERE ANY FURTHER DISCUSSION? ANY FURTHER DISCUSSION? ANY FURTHER DISCUSSION? HEARING NONE.

ALL IN FAVOR? LET IT BE KNOWN BY SAYING AYE.

AYE.

OPPOSED? SAME SIGN.

HEARING NONE.

THE CHAIR WILL MAKE IT UNANIMOUS.

RIGHT.

IT'S ACTION ITEM NUMBER ONE.

THANK YOU VERY MUCH.

AND NOW WE'RE LOOKING FOR, UH,

[VII.2. Approval of a resolution authorizing the President & CEO, or her designee, to finalize and execute a temporary Master License Agreement with the City of Austin for the use of certain portions of CapMetro’s Rail right of way and real property located at 2910 E 5th Street, Austin, Texas 78702, for the purpose of constructing, operating, and maintaining the MoKan Trail.]

ACTION ITEM NUMBER TWO.

LET ME READ IT INTO THE RECORD.

APPROVAL OF A RESOLUTION AUTHORIZING THE PRESIDENT AND CEO OR HER DESIGNEE, UH, TO FINALIZE AND EXECUTE A TEMPORARY MASTER LICENSE AGREEMENT WITH THE CITY OF AUSTIN FOR THE USE OF CERTAIN PORTIONS OF CAP METRO'S, UH, RAIL RIGHT OF WAY AND REAL PROPERTY.

LOCATED AT 29 10 EAST FIFTH STREET, AUSTIN, TEXAS 7 8 7 0 2 FOR THE PURPOSE OF CONSTRUCTING, OPERATING AND MAINTAINING THE MOAN TRAIL.

AND, UH, WE'VE GOT OUR, UH, OUR CHIEF OF STAFF, UM, CHEYENNE KRAUS HERE.

WOULD YOU PLEASE MAKE YOUR PRESENTATION? THANK YOU.

CHAIR BOARD OF DIRECTORS.

I'M CHEYENNE KRAUSE.

I'M THE CHIEF OF STAFF FOR CAP METRO.

I'M GOING TO QUICKLY PRESENT THIS ITEM TO FOR YOU ALL.

UM, THAT IS AN ITEM TO CONSIDER A MASTER, A TEMPORARY MASTER LICENSE AGREEMENT FOR US TO COLLABORATE WITH THE CITY AS THEY WORK TO DELIVER THE MOAN TRAIL IN EAST AUSTIN.

UM, THIS IS A LITTLE BIT ABOUT THE TRAIL.

UM, SO, UM, IT'S CONNECTING ESSENTIALLY EXISTING TRAILS AND FILLING IN A GAP IN THE URBAN TRAIL NETWORK.

UM, THE CITY IS ADVANCING THIS WORK USING A COMBINATION OF BOND FUNDINGS.

THEY'VE AL ALSO RECEIVED AN EARMARK FROM CONGRESSMAN DOGGETT TO ADVANCE THIS WORK.

UM, THE SECTION THAT WE ARE TALKING ABOUT TODAY THAT WOULD BE KIND OF GOVERNED, IF YOU WILL BY THIS UH, TEMPORARY MASTER LICENSE AGREEMENT IS THE SECTION BETWEEN SPRINGDALE ROAD, GENERALLY APPROXIMATELY IN THE EAST, UM, AND APPROXIMATELY PLEASANT VALLEY, UM, ROAD AND PETAL STREET.

ON THE WEST SIDE OF THIS ALIGNMENT, YOU CAN SEE, UM, 29 10, WHERE WE ARE TODAY IS PART OF THIS ALIGNMENT.

AND YOU CAN SEE ALSO THAT THE ALIGNMENT FOLLOWS GENERALLY WHAT WILL BE THE FUTURE GREEN LINE.

SO OUR, OUR CAT METRO RAIL RIGHT OF WAY.

UM, THIS TRAIL IS ALREADY UNDER CONSTRUCTION, SO UH, THE CITY IS BUILDING ONE SECTION OF IT ALREADY.

UM, RIGHT HERE WHERE WE'RE AT, AND I'M GONNA USE THE CLICKER, I THINK MAYBE, UH, MAYBE NOT.

OKAY, I'M GOING TO HIGHLIGHT ON THE BOTTOM OF THE SCREEN.

UM, IS 2019 IS OUR BUS YARD.

UM, THIS SECTION OF THE TRAIL WILL HAVE TWO ALIGNMENTS.

SO PHASE ONE AND PHASE TWO IS DEPICTED ON THE SCREEN, ARE ALREADY UNDER CONSTRUCTION.

UM, THAT WILL PROVIDE TRAIL CONNECTIVITY TO THE LIBRARY AND TO THE HEB UM, UNDER SEVENTH STREET.

THERE WILL ALSO BE A, UH, STRAIGHT ALIGNMENT, IF YOU WILL, ALONG THE SOUTH SIDE OF THE RAIL RIGHT OF WAY THAT WILL, UM, USE BOTH RAIL RIGHT OF WAY PRIVATE PROPERTY AS WELL AS CAP METRO OWNED PROPERTY.

SO THE AGREEMENT GOVERNS THE ENTIRE TRAIL LIMITS, WHETHER THE TRAIL IS IN THE PUBLIC RIGHT OF WAY, PRIVATE PROP, UM, UM, UM, SORRY, PUBLIC RIGHT OF WAY BEING CAP METRO RAIL RIGHT OF WAY OR OUR PROPERTY ALONG 29 10, UM, ON 29 10.

UM, SO THIS IS A SCHEMATIC.

UM, THE TRAIL WILL USE A PORTION OF OUR EXISTING CONCRETE FOOTPRINT ON THE SOUTH SIDE OF THE RAIL RIGHT OF WAY ON THE LEFT HAND SIDE OF YOUR SCREEN, YOU SEE PLEASANT VALLEY ROAD, UM, GOING EAST, THE TRAIL, UM, COMES INTO OUR PROPERTY.

IT WILL RUN ALONG BASICALLY THE BACK FENCE OF THIS PROPERTY WHERE WE'RE AT TODAY.

UM, IT HAS NO IMPACT, UM, ON OUR ABILITY TO ACCESS THE MAINTENANCE BAYS, UM, OR DO ANY OF OUR OPERATIONS, UM, ON A DAY-TO-DAY BASIS.

IT DOES HOWEVER, UM, ON THIS SIDE, UM, CONTINUING EAST IMPACT SOME OF OUR EMPLOYEE PARKING SPACES.

AND SO WE WILL BE REWORKING SOME OF THAT SPACE.

UM, AND A BIG SHOUT OUT TO OUR OPERATIONS TEAM AND OUR CAPITAL PROJECTS TEAM FOR MAKING THIS WORK.

UM, AND THINK, FIGURING OUT HOW WE CAN MAKE SURE THAT WE'RE BOTH MEETING THE NEEDS OF THE TRAIL AS WELL AS OUR EMPLOYEES, UM, ON THEIR DAY-TO-DAY SERVICES.

GOING, UH, FOR TODAY, THIS IS A TEMPORARY MASTER LICENSE AGREEMENT WITH THE CITY BEFORE THE TRAIL AS I DESCRIBED.

UM,

[00:40:01]

IT BOTH IMPACTS 29 10, BUT IT IS A LONG-TERM AGREEMENT THAT GOVERNS THE ENTIRE TRAIL.

SO AS THE CITY IS ADVANCING DESIGN, UM, ONCE WE HAVE MORE DETAIL ABOUT HOW IT IMPACTS OUR RAIL RIGHT OF WAY, WHERE IT GOES INTO THE PUBLIC RIGHT OF WAY, THAT TYPE OF THING, WE WILL BE ABLE TO ADD THOSE PIECES.

SO IT'LL BE KIND OF ONE DOCUMENT TO, TO RULE THEM ALL, IF YOU WILL.

UM, WE NEED IT NOW TO FACILITATE THE TRAIL CONSTRUCTION AT 2019, WHICH THE CITY HOPES TO BEGIN AFTER THE FIRST OF THE YEAR.

UM, AS I MENTIONED, WE'LL ADD TO IT AS THE PROJECT IS ENGINEERED AND DESIGNED.

UM, IT ALSO DEFINES ROLES AND RESPONSIBILITIES RELATED TO CONSTRUCTION MAINTENANCE, UM, AND OPERATIONS FOR THE TRAIL AND IT WAIVES THE USE.

THIS ITEM ALSO WAIVES THE USAGE FEES FOR THE AGREEMENT DUE TO TRA DUE TO THE TRANSIT SUPPORTIVE NATURE OF THE TRAIL AND THE BENEFIT TO BOTH CAP METRO, UM, STAFF AND OUR CUSTOMERS.

UM, ONE THING I WANNA MAKE SURE THAT, UM, ESPECIALLY OUR FAA MEMBERS ARE AWARE OF, WHEN I PRESENTED THIS ITEM ORIGINALLY, WE WERE, UM, PROPOSING A 10 YEAR LICENSE AGREEMENT THAT WE WOULD RENEW ON A 10 YEAR BASIS.

THE CITY REQUESTED DURING OUR DISCUSSION ON WHETHER OR NOT IT COULD JUST BE AN AGREEMENT THAT WE REVISIT AS NEEDED AS OUR NEEDS CHANGE AS A TRANSIT AGENCY.

AND SO THE AGREEMENT THAT IS ATTACHED AS A DRAFT IS A TEMPORARY MASTER AGREEMENT, KIND OF WITH NO EXPIRATION DATE.

IT DOES PROVIDE FOR CAP METRO TO MAINTAIN AS WE ARE REQUIRED OUR TRANSIT PRIOR PRIORITY.

AND IF WE NEED THE, UM, TRAIL RIGHT OF WAY, UH, ON OUR PROPERTY OR IN OUR RAIL RIGHT OF WAY FOR TRANSIT PURPOSE, WE WOULD BE REQUIRED TO NOTIFY THE CITY.

WE WOULD HAVE AT LEAST 180 DAYS TO HAVE THAT CONVERSATION, UM, AND, AND REVIEW IT AT, UM, AT THAT POINT.

SO THE CITY IS AWARE THAT, UM, THERE'RE GOING TO BE EVOLVING NEEDS IN THIS AREA, ESPECIALLY RELATED TO THE GREEN LINE.

AND IF WE EVER, UM, DECIDE TO MOVE FORWARD WITH SOME OTHER PLANS FOR THIS FACILITY, UM, AND AS ALWAYS, OUR TRANSIT NEEDS AS AN AGENCY ARE PROTECTED.

ALRIGHT, THAT'S IT.

ALRIGHT, BOARD MEMBERS, DO WE HAVE ANY QUESTIONS? UH, YES.

BOARD MEMBER, ALEX, NO QUESTIONS.

I JUST WANNA SAY THIS IS HUGELY EXCITING AND I'M ALWAYS APPRECIATIVE OF THE CITY OF AUSTIN STAFF AND CAP METRO BEING ABLE TO WORK TOGETHER.

THERE'S A NUMBER OF DIFFERENT RAILS IN TOWN NOW, BUT INCLUDING THE BERGSTROM SPUR THAT THE CITY'S BUILDING, THE RED LINE, UM, ALL THE TRAILS THAT GO ALONG THE RED LINE AND THEN NOW HAVING THIS MOAN CORRIDOR.

I KNOW, UM, UH, CONGRESSMAN DOGGETT HAS BEEN HELPFUL IN THIS EFFORT AS WELL.

AND SO I KNOW THERE'S A LOT OF OTHER ADVOCATES IN THIS SPACE THAT JUST REALLY APPRECIATE THE PARTNERSHIP.

SO I DIDN'T WANT IT TO GO BY WITHOUT, UM, SAYING A LITTLE BIT OF THANKS TO EVERYBODY.

AND THANK YOU FOR PROMPTING ME TO ALSO SAY THANKS TO OUR COLLEAGUES AT THE CITY.

UM, WE ARE MEETING WITH THEM VERY FREQUENTLY ON TRAILS, BOTH THIS AND THE REDLINE TRAIL STUDY AND ALL OF THE OTHER THINGS THAT ARE KIND OF UNDER OUR BELTS.

AND WE APPRECIATE THEM UNDERSTANDING THAT WE HAVE A RESPONSIBILITY AS A TRANSIT AGENCY AND WE HOPE TO MEET THEM, UM, WHERE THEY ARE, WHICH IS RESPONSIBLE FOR MORE THAN JUST TRANSIT FOR ALL THE DIFFERENT TYPES OF MODES.

SO, UM, WE HAVE A GOOD RELATIONSHIP RIGHT NOW AND WE'RE APPRECIATE APPRECIATIVE TO THEIR ADVOCACY FOR THEIR PROJECT.

SHOULD THE CHAIR LOOK AT YOUR STATEMENT AS A MOTION FOR APPROVAL OF ITEM NUMBER TWO? SO MOVED.

ALRIGHT.

UH, OKAY, THERE'S A SECOND FROM BOARD MEMBER BANGAL.

AND, UH, NOW LET ME CONTINUE TO MAKE SURE THAT THERE ARE NO ADDITIONAL QUESTIONS.

ANY QUESTIONS, COMMENTS FROM THIS SIDE? ANY QUESTIONS, COMMENTS? ANY QUESTIONS OR COMMENTS? HEARING NONE, UH, LET IT BE KNOWN BY, UH, THIS, UH, THE BY I IF YOU APPROVE ITEM NUMBER TWO.

AYE.

OPPOSED? SAME SIGN.

UH, HEARING NONE, THE CHAIR WILL MAKE IT UNANIMOUS.

ALRIGHT, THANK YOU.

AND NOW WE ARE LOOKING FOR,

[VII.3. Approval of a resolution authorizing the President & CEO, or her designee, to finalize and execute a Commercial Contract - Improved Property for the purchase of a 11.46-acre tract of land located at 5315 E. Ben White Blvd., Austin, Texas 78741, together with two (2) one-story buildings measuring 10,090 square foot in size, associated parking areas, all other improvements, and any easements and rights appurtenant thereto, from River City Partners, Ltd. for a new CapMetro Operation and Maintenance facility (Demand Response South Base), in an amount not to exceed $___________ plus closing costs.]

UH, MR. CARTWRIGHT FOR, UH, ITEM NUMBER THREE, WHICH I'LL READ INTO THE RECORD.

APPROVAL OF A RESOLUTION AUTHORIZING THE PRESIDENT AND CEO OR HER DESIGNEE TO FINALIZE AND EXECUTE A COMMERCIAL CONTRACT AND, UH, IMPROVED PROPERTY FOR THE PURCHASE OF A 11.46 ACRE TRACK TRACT OF LAND.

LOCATED AT 53 15 EAST BEND WHITE BOULEVARD, AUSTIN, TEXAS 7 8 7 4 1.

TOGETHER WITH A, WITH TWO ONE STORY BUILDINGS MEASURING, UH, 10,090 SQUARE FOOT IN SIZE ASSOCIATED PARKING AREAS, ALL OTHER IMPROVEMENTS, ANY EASEMENTS AND RIGHTS ARE PERTINENT THERETO FROM RIVER CITY PARTNERS LIMITED FOR A NEW CAP METRO OPERATION AND MAINTENANCE FACILITY, A DEMAND RESPONSE SOUTH BASE IN AN AMOUNT NOT TO EXCEED $13,500,000 PLUS CO CLOSING COSTS.

MR. CAR.

THANK YOU CHAIR ILIAN.

BOARD MEMBERS PRESIDENT, CEO WATKINS.

I'M KEN CARRA, VICE PRESIDENT OF CONSTRUCTION OF FACILITIES, AND AS YOU UH, MENTIONED IN THAT RESOLUTION, I HAVE A

[00:45:01]

FEW SLIDES TO SHARE WITH YOU REGARDING THE ACQUISITION OF A PROPOSED, UH, PROPERTY TO SUPPORT OUR, UH, DEMAND RESPONSE SERVICE.

BUT FIRST I'D LIKE TO GIVE YOU A LITTLE BIT OF BACKGROUND ON OUR DEMAND RESPONSE OPERATIONS AND HOW WE CURRENTLY SUPPORT THOSE.

THIS PARTICULAR MAP ON THE RIGHT SIDE OF THE SLIDE INDICATES THE VARIOUS LOCATIONS THAT CURRENTLY SUPPORT OUR DEMAND RESPONSE OPERATIONS.

DEMAND RESPONSE INCLUDES OUR, OUR, UH, METRO ACCESS SERVICE, AS WELL AS OUR PICKUP SERVICE.

AND MORE RECENTLY THE, UH, METRO BIKE PROGRAM HAS BEEN ADDED TO THEIR, UH, AREA OF RESPONSIBILITY.

SO OUR PRIMARY OPERATING FACILITY CURRENTLY IS LOCATED AT FINO 5 0 9 THOMPSON LANE, WHICH IS IN THE LOWER RIGHT HAND QUARTER, UH, JUST EAST OF 180 3 IN THE DIRECTION OF THE AIRPORT.

UM, THAT'S A LONG-TERM FACILITY THAT WE'VE HAD AND CONTINUE TO OPERATE.

UM, UNTIL RECENTLY WE HAD A, WE LEASED A, UH, PROPERTY ACROSS THE STREET FROM THAT, UH, HOUSE SUPPORT ADDITIONAL VEHICLES THAT LEASES SINCE EXPIRED.

AND SO WE ARE A LITTLE SHORT ON SPACE.

WE'LL POINT OUT THOUGH, UM, WE DO, UH, OPERATE OUT OF A LOCATION, UH, AT 8 8 1 7 WEST HOWARD LANE THERE ON THE UPPER RIGHT, UH, CORNER IN THE NORTHEAST, UH, AREA OF OUR SERVICE AREA.

AND WE ACTUALLY, UH, UTILIZE OUR TECH RIDGE PARK AND RIDE IN ORDER TO SUPPORT THAT FACILITY.

SO THE 8 1 7 WEST HOWARD LANE FACILITY IS ACTUALLY, UM, LEASED BY OUR CURRENT DEMAND RESPONSE OPERATOR, MTM.

AND SO WE, UM, ARE ALLOWED TO CONTINUE TO OPERATE THAT FACILITY AS LONG AS THE MTM CONTRACT, UM, CONTINUES, WHICH IS, UH, SET TO EXPIRE THE END OF, UH, NEXT CALENDAR YEAR.

SO THEN AT THE VERY BOTTOM, UH, THERE, 48 11 EAST SEVENTH STREET, WE RECENTLY LEASED A FACILITY NEARBY HERE IN ORDER TO SUPPORT OUR ADDITIONAL VEHICLES.

SO AS YOU CAN SEE, WE'VE GOT MULTIPLE FACILITIES SUPPORTING DEMAND RESPONSE AT THIS POINT IN TIME.

THE, THE FUTURE.

HOWEVER, THROUGH OUR FACILITIES MASTER PLAN, WE'VE IDENTIFIED THAT WE PRIMARILY WANT TO OPERATE TWO DEMAND RESPONSE, UH, FACILITIES, ONE IN THE NORTHERN SECTOR AND ONE IN THE SOUTHERN, UH, SECTOR IN ORDER TO MOST EFFICIENTLY OPERATE THE SERVICES.

UH, THE BOARD PREVIOUSLY AUTHORIZED THE, UH, ACQUISITION OF OUR PROPERTY ON CAMERON LANE NORTH OF 180 3, UH, 25 ACRES, WHICH WE'RE IN CURRENTLY IN DESIGN, UH, FOR DEVELOPING THAT FACILITY AS OUR NORTH DEMAND RESPONSE BASE.

AND THAT WILL SUPPORT 220 VEHICLES.

TODAY, WE'RE BRINGING TO YOU THIS PROPOSED LOCATION AT 53 15 EAST BEND WHITE, UM, TO SERVE AS OUR, POTENTIALLY AS OUR SOUTH LOCATION.

AND IF WE'RE SUCCESSFUL IN DEVELOPING BOTH OF THESE FACILITIES, THEN WE WOULD REPURPOSE OUR 5 0 9 THOMPSON LANE FACILITY FOR OTHER, UH, AGENCY USES.

THIS PARTICULAR PROPERTY, AS YOU MENTIONED, IS 11.466 ACRES, UH, INCLUDES TWO, UH, ONE STORY BUILDINGS, UH, WITH A TOTAL OF 10,090 SQUARE FEET BETWEEN THE TWO BUILDINGS.

THE OWNER, AS YOU MENTIONED, IS RIVER CITY PARTNERS, THEY'RE CURRENTLY OPERATING.

YOU CAN SEE ON THE MAP HERE IS LEAF JOHNSON SUPERSTORE, A USED CAR DEALERSHIP WITH AN OIL CHANGE SERVICE.

SO WE'VE BEEN WORKING WITH THIS, UH, PARTICULAR, UH, PROPERTY OWNER.

WE'VE DONE SOME PRELIMINARY ASSESSMENT.

WE DID AN ENVIRONMENTAL ASSESSMENT, WHICH, UH, DEMONSTRATED NO PARTICULAR ADVERSE IMPACTS RELATED TO THE CURRENT USE OR PROPOSED USE.

AND BASED ON THAT, WE'VE WORKED WITH THE FEDERAL TRANSIT ADMINISTRATION THROUGH THEIR PROTECTIVE BUY PROGRAM IN ORDER TO INITIATE THE POTENTIAL ACQUISITION OF THIS SITE.

AND JUST A LITTLE BIT OF BACKGROUND, PROTECTIVE BY MEANS THAT THERE ARE OTHER PARTIES INTERESTED IN THIS PROPERTY.

AND IN ORDER TO FACILITATE A, UH, SPEEDY NEGOTIATION WITH THIS PARTICULAR, UH, PROPERTY OWNER, THE, UH, FDA MINIMIZES THE UPFRONT REQUIREMENTS, BUT THEN REQUIRES THAT WE COMPLETE THE ENVIRONMENTAL DUE DILIGENCE AND OTHER, UH, TITLE SIX WORK AS PART OF THE ACQUISITION PROCESS.

UH, THIS IS, UH, ANOTHER AERIAL OF SIDE SHOWING JUST A VERY EARLY LAYOUT THAT WE DID TO SEE HOW WE WOULD HOUSE THE, UH, DEMAND RESPONSE VEHICLES.

WE WOULD PROPOSE TO HOUSE 165 DEMAND RESPONSE VEHICLES, PLUS OTHER EMPLOYEE PARKING AT THIS LOCATION.

UM, YOU SEE IT, IT LOOKS LIKE IT EXPANDS BEYOND THE SITE, BUT THAT IS TO DISPLAY A TWO OR THREE STORY, UH, FACILITY POTENTIALLY.

UM, I WILL POINT OUT THAT THERE IS A NATURAL GAS PIPELINE THAT BISECTS THE PROPERTY.

WE, UH, UNDERSTAND THAT WE CAN PAVE ON TOP OF THAT, BUT NOT NECESSARILY BUILD ANY STRUCTURES ON TOP OF THAT.

BUT WE WILL FURTHER ASSESS THAT DURING THE FEASIBILITY, UH, UH, PROCESS IF WE ARE SUCCESSFUL IN, UM, SIGNING A PURCHASE AND SALE AGREEMENT WITH THIS, UH, PARTICULAR PROPERTY OWNER.

ANOTHER VIEW OF JUST ANOTHER POTENTIAL LAYOUT HERE, BUT AGAIN, WE WOULD HOUSE, UH, POTENTIALLY 165

[00:50:01]

DEMAND RESPONSE VEHICLES UP TO, UH, 263 EMPLOYEE PARKING SPACES.

UH, WE, UH, WOULD PLAN FOR 22 MAINTENANCE, UH, BAYS AS PART OF THAT.

UH, WE DO HAVE SOME CONFIRMATION INCLUDING STORM WATER AND, AND THE BUILDING LIMIT LINES AND THINGS LIKE THAT THAT WILL FOR FURTHER EVALUATE DURING THE, UH, FEASIBILITY PERIOD.

AND WE ALSO WILL EVALUATE ADJACENT SITES AS WELL DURING THAT PROCESS.

UM, AS YOU MENTIONED, UH, THIS WOULD BE A PURCHASE AND SALE AGREEMENT, UH, UH, REQUESTING AUTHORIZATION FOR A PURCHASE PRICE OF $13,500,000 PLUS CLOSING, UH, CLOSING COSTS.

WE DID, UH, TWO INDEPENDENT APPRAISALS AND ESTABLISHED A MARKET VALUE.

THIS PRICE IS BELOW THAT ESTABLISHED MARKET VALUE.

AND IF WE'RE SUCCESSFUL IN ENTERING INTO THE PURCHASE AND SALE AGREEMENT, THAT WOULD INITIATE A 90 DAY FEASIBILITY, UH, PERIOD WHERE WE WOULD FURTHER REFINE TEST FITS FOR THE SIDE, VERIFY TITLE, UH, EVALUATE STORM WATER, ONSITE, STORM WATER, NATIONAL GAS, UH, NATURAL GAS PIPELINE, ET CETERA, IN ORDER TO CONFIRM THAT THIS SITE IS IN FACT VIABLE FOR THE PLANNED USES FOR THE DEMAND RESPONSE FACILITY.

AND THAT'S, UH, A LOT OF INFORMATION, BUT I'D PAUSE AT THIS POINT TO ANSWER ANY QUESTIONS YOU MIGHT HAVE REGARDING THIS BOARD MEMBERS.

ANY, UH, ANY QUESTIONS? ANY QUESTIONS? HEARING NONE.

ANY QUESTIONS? HEARING NONE.

OKAY.

UM, CHAIR WILL ENTERTAIN A MOTION TO APPROVE ITEM NUMBER THREE.

OKAY.

UM, OKAY.

BOARD MEMBER POOLE WITH THE MOTION.

UM, OKAY.

BOARD MEMBER HARRIS WILL SHARE THE WEALTH, UH, MAKE SURE EVERYBODY HAS AN OPPORTUNITY, UM, WITH THE SECOND ANY.

UM, LET'S SEE.

UM, SO, UH, HEARING ANY FURTHER DISCUSSION, HEARING NO FURTHER DISCUSSION, NO FURTHER DISCUSSION.

UH, LET IT BE KNOWN, UM, BY SAYING I IF IN SUPPORT OF PROPOSITION THREE.

AYE.

UM, OPPOSED? SAME SIGN.

HEARING NONE.

THE CHAIR WILL MAKE IT UNANIMOUS.

THANK YOU.

SO ACT ACTION ITEM THREE HAS BEEN COVERED.

[VII.4. Approval of a resolution authorizing the President & CEO, or her designee, to finalize and execute a contract with Jay-Reese Contractors, Inc. for the construction of the Railroad Pedestrian Crossing at the intersection of East 4th Street and Sabine Street for $1,291,000 and 15% contingency of $193,650 for a total not to exceed amount of $1,484,650.]

UH, IT LOOKS LIKE YOU'RE UP FOR ACTION ITEM NUMBER FOUR, LET ME READ IT INTO THE RECORD.

ALRIGHT, UH, THANK YOU.

UH, WE'RE GONNA LOSE VICE CHAIR, UH, POOL FROM THE MEETING, BUT LOOKS LIKE WE STILL GOT A QUORUM, SO WE SHALL CONTINUE TO, TO, UH, MOVE FORWARD.

ACTION ITEM FOUR READS APPROVAL OF A RESOLUTION AUTHORIZING THE PRESIDENT AND CEO OR HER DESIGNEE TO FINALIZE AND EXECUTE A CONTRACT WITH JAY REESE CONTRACTORS, INC.

FOR THE CONSTRUCTION OF THE RAILROAD PEDESTRIAN CROSSING AT THE INTERSECTION OF EAST FOURTH STREET AND SABINE STREET FOR 1,291,000, UH, DOLLARS AND A 15% CONTINGENCY OF, UH, $193,650 FOR A TOTAL NOT TO EXCEED AMOUNT OF, UH, 1,484,000, UH, $650.

PLEASE, UH, TAKE IT AWAY.

MR. CARTWRIGHT.

THANK YOU AGAIN, CHAIR ILIAN.

UM, THIS PARTICULAR ITEM, I'LL, UH, JUST MENTION, UH, I HAVE SOME SLIDES TO SHARE WITH YOU REGARDING BACKGROUND, BUT THE FUNDS FOR THIS PROPOSED CONTRACT ARE INCLUDED IN THE FISCAL YEAR 24 BUDGET.

UM, THERE WAS A 14% DBE GOAL ESTABLISHED FOR THIS CONTRACT, WHICH THE PROPOSED CON CONTRACTOR, UH, WILL, UH, PLAN TO MEET.

AND, UM, THAT, UH, UH, THE, THE PROPOSED CONTRACTOR WAS, UH, DETERMINED TO BE THE BEST VALUE, UM, AFTER RECEIVING, UH, UH, PROPOSALS FOR THIS PARTICULAR CONTRACT.

BUT AS, UH, YOU MENTIONED, THIS IS REGARDING A PEDESTRIAN CROSSING PROTECTED CROSSING AT THE, UH, FOURTH AND SABINE INTERSECTION.

THIS IS AN ILLUSTRATION, AN AERIAL ILLUSTRATION OF THE DOWNTOWN RAIL STATION.

UH, YOU CAN SEE THE RAIL STATION IS BETWEEN, UH, TRINITY STREET ON THE LEFT OR THE WEST AND OR RED, UH, AND RED RIVER, EXCUSE ME, ON THE EAST.

AND THEN YOU SEE FURTHER TO THE EAST IS SABINE STREET WITH THE, UH, RED CIRCLE THERE.

AND THEN AT THE VERY FAR, UH, EAST OR TO THE RIGHT IS INTERSTATE 35.

SO AS PART OF THE DOWNTOWN RAIL STATION, UH, WHICH WAS COMPLETED IN 2020, UM, THERE WAS THIS PEDESTRIAN AND, AND, UH, CROSSING ESTABLISHED AGAIN, UH, ACROSS SABINE STREET.

AND IT WAS DETERMINED TO BE A PRIMARY CONNECTION ALONG THE BIKE AND PEDESTRIAN CROSSING, UH, ALONG SABINE STREET, BUT ALSO A, AN IMPORTANT CONNECTION TO THE, UH, WALLER CREEK, UH, TRAIL THAT IS, UH, JUST BELOW STREET LEVEL IN THIS LOCATION.

THIS IS A STREET VIEW OF THAT INTERSECTION LOOKING SOUTH STANDING ON SABINE STREET.

YOU CAN SEE CURRENTLY THAT PEDESTRIAN CROSSING WE HAVE TEMPORARILY BLOCKED WITH FENCING AND WE'RE PROPOSING TO ADD A, UH, PERMANENT, UH, PROTECTED CROSSING FOR BIKE AND PEDESTRIAN AT THIS, UH, PARTICULAR TIME.

AND THAT WAS BASED ON A SAFETY ASSESSMENT, A RECOMMENDATION TO

[00:55:01]

ADD A PROTECTED CROSSING AT THIS LOCATION.

AGAIN, THE DOWNTOWN STATION WAS OPEN IN 2020 AND THE SAFETY ASSESSMENT, UH, RECOMMENDED A, UH, SIGNALED CROSSING FOR PEDESTRIANS AND BICYCLES.

UM, AND THEN WE HAVE BEEN COORDINATING SINCE THAT TIME WITH THE CITY OF AUSTIN, THE FEDERAL RAILROAD ADMINISTRATION TO DESIGN AND ESTABLISH THAT, UH, IMPORTANT CONNECTION TO THE WALLER CREEK, UH, UH, GREEN BELT.

THE, UH, RECOMMENDED CONTRACTOR, JAY REESE CONTRACTORS ACTUALLY WAS THE CONTRACTOR FOR THE DOWNTOWN STATION PROJECT.

IT'S CURRENTLY WORKING ON OUR MCAL STATION PROJECT.

WE'RE VERY FAMILIAR WITH THE FIRM AND THE EXCELLENT WORK THAT THEY DO.

YOU MENTIONED THAT THIS IS A, UH, CONTRACT, A BASE CONTRACT FOR $1,291,000 PLUS CONTINGENCY FOR A TOTAL AMOUNT NOT TO EXCEED $1,484,658.

WE'RE CURRENTLY IN THE PERMITTING PROCESS WITH THE CITY ON THIS PROJECT, AND IF THIS CONTRACT IS AWARDED, WE WOULD EXPECT TO BEGIN CONSTRUCTION IN THE EARLY SPRING TIMEFRAME AND COMPLETE IT WITHIN, UH, ONE YEAR'S TIMEFRAME.

BUT WITH THAT, I'LL BE HAPPY TO ANSWER ANY QUESTIONS YOU HAVE REGARDING THIS PROPOSED CONTRACT.

QUESTIONS, QUESTIONS? HEARING NONE.

UM, LET, ALRIGHT, LET'S REMOVE THE PROPERLY SECONDED APPROVE ACTION ITEM NUMBER FOUR.

ANY FURTHER DISCUSSION? FURTHER DISCUSSION, FURTHER DISCUSSION.

UH, HEARING NONE FURTHER I SUPPORT OF THE PROPOSITION.

AYE.

OPPOSED HEARING OPPOSITION.

THE CHAIR WILL MAKE YOU MAD.

THANK YOU, MR. THE COURT.

ALRIGHT, LET'S SEE.

LOOKS LIKE ACTUALLY ITEM NUMBER FOUR PRESENTED BY, OH, EXCUSE ME.

UH, ALL RIGHT.

I DIDN'T

[VII.5. Approval of a resolution approving the CapMetro Public Transportation Agency Safety Plan (“the Plan”), authorizing the President & CEO, or her designee, to finalize and execute the Plan, and setting a program to provide relevant and useful information to the Board of Directors. (part 1 of 2)]

HAVE MY MIC ON.

AND, UH, ALL RIGHT.

AND IT LOOKS LIKE, UH, THE, UM, ACTION ITEM NUMBER FIVE WILL BE PRESENTED BY, UH, GARDNER TABBAN.

AND LET ME READ IT INTO THE RECORD.

APPROVAL OF A RESOLUTION APPROVING THE CAP METRO PUBLIC TRANSIT AGENCY SAFETY PLAN, AUTHORIZING THE PRESIDENT AND CEO OR DESIGNEE TO FINALIZE AND EXECUTE THE PLAN AND SETTING A PROGRAM TO PROVIDE RELEVANT AND USEFUL INFORMATION TO THE BOARD OF DIRECTORS.

MR. TABBAN.

UH, GOOD AFTERNOON, CHAIR ILIAN, BOARD MEMBERS AND PRESIDENT, CEO WATKINS.

UH, MY NAME IS GARDNER TAVON AND I SERVE AS CAPITAL METROS EXECUTIVE VICE PRESIDENT SYSTEM-WIDE ACCESSIBILITY AND CHIEF SAFETY OFFICER.

I'M HERE TO PRESENT AN ITEM RELATED TO PUBLIC TRANSPORTATION AGENCY SAFETY PLAN, ALSO KNOWN AS THE PT A S.

FURTHER ONE, MAKE CLEAR THAT THE PT A IS NOT JUST A REGULATORY REQUIREMENT, BUT A FUNDAMENTAL ASPECT OF OUR COMMITMENT TO ENSURING THE SAFETY OF OUR PASSENGERS AND TRANSIT COMMUNITY.

THE PROPOSED REVISION STEM FROM OUR ANNUAL REVIEW PROCESS, WHICH ALSO INCLUDES, UH, UNION MEMBERS IMPERATIVE FOR, UH, COMPLIANCE WITH FEDERAL LAW.

UH, THESE CHANGES PRIMARILY INVOLVE, UH, ADMINISTRATIVE ADJUSTMENTS, UH, RELATED TO THE PROCESSES AND, UH, PROCEDURES ALONG WITH AMENDMENTS TO PERFORMANCE TARGETS, ALIGNING WITH INDUSTRY STANDARDS.

IN YOUR PACKET, YOU'LL FIND A COMPREHENSIVE MEMO DETAILING THE BACKGROUND AND OVERVIEW OF THE P TASK ALONG WITH THE PROPOSED REVISIONS.

I'M AVAILABLE TO ADDRESS ANY QUESTIONS OR COMMENTS THAT YOU MAY HAVE.

UH, THAT LEAVES US

[VII.6. Approval of a resolution appointing 11 candidates to serve as members of the Project Connect Community Advisory Committee, as recommended by the Nominating Committee, to serve either two- or four-year initial terms as determined via lottery.]

WITH ACTION ITEM NUMBER SIX.

UH, AND LET ME READ IT INTO THE RECORD.

APPROVAL OF A RESOLUTION APPOINTING 11 CANDIDATES TO SERVE AS MEMBERS OF THE PROJECT CONNECT COMMUNITY ADVISORY COMMITTEE AS RECOMMENDED BY THE NOMINATING COMMITTEE TO SERVE EITHER TWO OR FOUR YEAR INITIAL TERMS AS DETERMINED VIA LOTTERY.

UM, BOARD MEMBER STRATTON.

LOOKS LIKE YOU HAVE DRAWN THE SHORT STRAW AND SHOULD MAKE THE, THE PRESENTATION.

YES.

THANK YOU, MR. CHAIRMAN.

I APPRECIATE IT.

AS YOU KNOW, WE ALL RECENTLY AMENDED THE PROJECT CONNECT COMMUNITY ADVISORY COMMITTEE BYLAWS, AND KICKED OFF THE PROCESS IDENTIFIED BY CAC MEMBERS FOR, UH, TO IDENTIFY CAC MEMBERS FOR THE NEW TERM UPCOMING, STARTING IN JANUARY, I PARTICIPATED IN THIS PROCESS, UH, IS OFFICIALLY AS CAP MEMBER AS CAP METRO'S BOARD MEMBER, UH, REPRESENTED ON THE NOMINATING COMMITTEE.

THERE'S A MEMBER REPRESENTING CAP METRO, THAT'S ME.

UH, THERE WAS A MEMBER REPRESENTING THE CITY OF AUSTIN, AND THAT ACTUALLY WAS, UH, MY COLLEAGUE, UH, BOARD MEMBER PAIGE ELLIS.

AND THEN WE ALSO HAD, UM, A MEMBER REPRESENTING THE, UH, COMMUNITY ADVISORY COMMITTEE AS WELL.

UM, AND, UH, I WILL AM PLEASED TO NOW RECOMMEND 11 CANDIDATES FOR APPOINTMENT TO THE, UH, COMMUNITY ADVISORY COMMITTEE FOR PROJECT CONNECT.

THE PROCESS YIELDED MORE THAN 50 APPLICANTS OF VERY WELL QUALIFIED COMMUNITY CHAMPIONS, AND THE 11 INDIVIDUALS RECOMMENDED IN THIS RESOLUTION WERE AGREED TO BY THE COMMITTEE, UH, FOR WITH FOUR NOMINATING, UH, COMMITTEE MEMBERS.

AND I SHOULD NOTE ALSO THAT OUR COLLEAGUE, UH, MR. JUAN GARZA WAS ALSO, UH, ON THAT AS WELL.

SO WE HAD A MEMBER FROM THE CAC AND THEN ALSO, UH, FROM A TP CAP METRO AND FROM THE CITY OF, UH, AUSTIN AS WELL FROM, UH, CITY COUNCIL.

UH, SO FOLLOWING THE RECOMMENDATION FROM THE NOMINATING COMMITTEE, THE 11 MEMBERS HAVE SINCE BEEN APPROVED BY BOTH AUSTIN CITY COUNCIL AND THE A TP BOARD OF DIRECTORS AT THE MOST RECENT MEETINGS OF THOSE BODIES.

AND SO NOW THAT IT FALLS TO US, I JUST WANT TO THANK ALL THE STAFF FOR BASICALLY HERDING THE CATS, TRYING TO GET ALL OF US TOGETHER IN ORDER TO CONSIDER THESE.

AND, AND I, I CAN'T EMPHASIZE THIS ENOUGH, WE HAD SOME AMAZING, AMAZING APPLICANTS FOR THIS, UH, FOR, FOR, FOR THESE, UH, FOR, FOR THIS COMMITTEE.

AND, UM, IN OUR, UH, SUPPLEMENTAL MATERIALS THAT, THAT YOU FIND IN OUR BOARD PACKETS, YOU'LL SEE THE INFORMATION ABOUT THE CANDIDATES.

UH, THEY REPRESENTED A GREAT DIVERSITY OF, UH, RACE, ETHNICITY, UH, DEMOGRAPHIC GROUP TRANSIT USERS, INDIVIDUALS FROM ACROSS THE COMMUNITY, NOT JUST THE CITY OF AUSTIN, BUT ALSO, UH, CAP METRO SERVICE TERRITORY, WHO STEPPED FORWARD AND WERE INTERESTED IN CONTINUING TO SEE PROJECT CONNECT, SUCCEED AND SEE THIS GROW AND REPRESENT THE COMMUNITY AS A WHOLE FOR WHAT OUR, UH, PLANS ARE FOR THE FUTURE AS WE MOVE FORWARD.

SO, UM, SPECIFICALLY I WANNA REACH OUT AND, UH, RECOGNIZE, UH, CHEYENNE KRAUS AND THEN ALSO, UM, UH, COURTNEY CHAVEZ AT A TP, WHO SERVED AS THE PRIMARY STAFF LIAISONS TO THIS, UH, TO THE CAC AND FOR OUR NOMINATING COMMITTEE.

I'M CONFIDENT TOGETHER WITH THE MEMBERS OF THE CAC, UH, THAT PROJECT CONNECT PROGRAM.

AND PARTNERS WILL CONTINUE TO SEE GREAT SUCCESS MOVING FORWARD IN OUR COLLABORATIVE PROCESS AS WE WORK TO, UH, TO BUILD OUT THE SYSTEM, OUR TRANSIT SYSTEM, TO CONTINUE TO MAKE AUSTIN A GREAT PLACE TO LIVE, WORK, AND PLAY.

AND SO, THANK YOU EVERYBODY.

AND WITH THAT, I LOOK FORWARD TO TAKING ANY QUESTIONS FOR MEMBERS BEFORE WE, UH, HOPEFULLY, UH, CAN, CAN BE THE FINAL PIECE OF THE PUZZLE TO PASS THIS AND GET TO SEE THESE NEW MEMBERS SEATED SOON.

SO, UH, BEFORE, UH, BEFORE I ASK FOR ANY QUESTIONS, I WOULD LIKE TO JOIN MY COLLEAGUE BY THANKING A, A VERY HARDWORKING, INCOMPETENT STAFF.

UH, YOU KNOW, THESE TYPES OF THINGS ARE, ARE NEARLY IMPOSSIBLE WITHOUT A SIGNIFICANT AMOUNT OF STAFF WORK, UH, BECAUSE EVERYBODY HERE IS WORKING, AND EVERYBODY HERE IS, IS RESPONSIBLE FOR A NUMBER OF THINGS.

AND STAFF OFTEN TAKES IT UPON THEMSELVES, UH, TO PUT A PROCESS TOGETHER THAT THE, THAT THE TEAM CAN RELY ON AND HAS CONFIDENCE IN.

AND THEN, UH, THEY WORK IT THROUGH EX THEY EXECUTE THE PROCESS.

SO, UH, I WOULD LIKE TO THANK OUR CEO, UH, WHO PROVIDES LEADERSHIP IN SO MANY AREAS, UH, BUT ALSO ONE OF THOSE AREAS IS PICKING A VERY DEDICATED AND COMPETENT STAFF TO DO THE WORK OF, OF THE, UH, OF THE AGENCY.

SO I, I JUST WANT TO JOIN MY COLLEAGUE IN COMMENDING.

YOU THERE? UH, ARE THERE ANY, ARE THERE ANY QUESTIONS? ANY FURTHER QUESTIONS? ANY QUESTIONS? UH, UH, LET'S SEE.

THE CHAIR WILL THEN ENTERTAIN A MOTION TO APPROVE ITEM NUMBER SIX, BOARD MEMBER BENGAL, WITH THE MOTION THERE A SECOND.

OKAY.

ALRIGHT.

UH, OKAY.

A, A NEW ENTER IN BOARD MEMBER ROSS.

OKAY.

UH, ALRIGHT.

[01:05:01]

UH, IT'S BEEN MOVED AND PROPERLY SECONDED THAT WE APPROVE.

ACTION ITEM NUMBER SIX.

IS THERE ANY FURTHER DISCUSSION? ANY FURTHER DISCUSSION? ANY FURTHER DISCUSSION? HEARING NONE, UH, LET IT BE KNOWN BY SAYING I IF YOU SUPPORT THIS ITEM.

AYE, I'LL LET IT BE KNOWN BY THE SAME SIGN IF YOU OPPOSE THIS ITEM.

OKAY.

UH, HEARING NO OPPOSITION, THE BOARD CHAIR WILL MAKE IT UNANIMOUS.

I WANT TO THANK EVERYONE FOR, UM, FOR, UH, WORKING THROUGH THE, UH, THE CONSENT ITEMS AND THE ACTION ITEMS. THIS CONCLUDES OUR ACTION ITEMS FOR TODAY.

AND WE DO HAVE ONE

[VIII.1. President & CEO Monthly Update]

FINAL ITEM, WHICH IS OUR MONTHLY, UH, REPORT FROM OUR PRESIDENT AND CEO, UH, MS. WATKINS.

UM, CEO.

TAKE IT AWAY.

EXCELLENT.

THANK YOU SO MUCH.

UM, WE'VE, UM, EN ENGAGED IN A NUMBER OF EXCITING EVENTS OVER THE LAST MONTH AND JUST WANNA HIGHLIGHT A FEW OF THEM.

UM, FIRST OFF WAS THE, UM, 2023 TEXAS VISION ZERO SUMMIT, WHICH WAS HELD AT THE AUSTIN CENTRAL LIBRARY.

UM, AND CAP METRO LEADERSHIP TOOK CENTRAL CENTER STAGE IN HELPING HIGHLIGHT THE IMPORTANCE OF BRINGING TOGETHER ELECTED OFFICIALS, TRANSPORTATION EXPERTS, AND ADVOCATES ALTOGETHER IN ORDER TO ACHIEVE ZERO TRAFFIC DEATHS, UM, STATEWIDE.

UM, WE WERE PLEASED TO TO HAVE OUR OWN DEPUTY CEO, UM, CARRIE BUTCHER AND OUR OWN BOARD MEMBER MAYOR PRO TE PAGE ELLIS, UM, WHO WERE ENGAGED IN A PANEL DISCUSSION TITLED WHAT TEXAS WOMEN ARE DOING TO END TRAFFIC DEATHS.

AND ALSO, UM, THE PICTURE ON THE LEFT THERE YOU'LL SEE OUR, UM, EVP AND, UM, CHIEF PLANNING AND DEVELOPMENT OFFICER SHARMILA MUJI, WHO CONTRIBUTED TO A PANEL FOCUSED ON EQUITABLE TRANSIT ORIENTED DEVELOPMENT.

UM, THIS MONTH WE HAVE HAD A FANTASTIC TIME CELEBRATING THE WINTER HOLIDAYS WITH OUR POLAR EVENTS.

WE KICKED IT OFF ACTUALLY THE VERY LAST DAY OF NOVEMBER, UM, WITH A LIVE SEGMENT ON KU WHERE MYSELF AND FROSTY THE SNOWMAN, UM, JOINED THE KVU TEAM AND OUR POLAR EVENTS BUS.

UM, TO KICK OFF, UM, THE EVENT OUR ELVES HAVE BEEN OUT ON, UM, THE MOVE THEY'VE BEEN ON OUR BUSES AND TRAINS HANDING OUT, UM, HOLIDAY SWAG.

WE'VE HAD A NUMBER OF EVENTS WHERE WE'RE PROVIDING BREAKFAST TACOS, COFFEE, AND FREE LIVE MUSIC TO ADD TO THE HOLIDAY SPIRIT.

UM, AND A BIG THANK YOU TO LEANER MAYOR CHRISTINE DELLY, UM, FOR JOINING US AT THE LEANDER STATION EVENT AND CONTRIBUTING TO THE OVERALL FESTIVE ATMOSPHERE.

WAS SHE AN ELF? SHE WAS NOT THE ELF.

SHE WAS NOT THE ELF, AT LEAST IN COSTUME THAT DAY.

UM, THE, THE, THE NAMES AND IDENTITIES OF THE ELVES AND FROSTY WILL BE KEPT CONFIDENTIAL.

UM, OUR POLAR EVENTS HAVE BEEN A GREAT SUCCESS AND THEY'RE NOT QUITE DONE.

WE STILL HAVE A FEW MORE EVENTS TO ROUND OUT, UM, THIS MONTH, BUT IT'S BEEN A GREAT WAY TO REALLY JUST SAY THANK YOU TO OUR COMMUNITY AND MORE IMPORTANTLY, THANK YOU TO OUR CUSTOMERS FOR ANOTHER GREAT YEAR.

UM, EACH YEAR ON DECEMBER 1ST, UM, WE CELEBRATE ROSA PARKS DAY HONORING, UM, THIS KEY LEADER IN THE CIVIL RIGHTS MOVEMENT WHO OBVIOUSLY HAS A SPECIAL PLACE IN OUR HEARTS AS TRANSIT PROFESSIONALS.

UM, OUR TEAM RECOGNIZED THE SIGNIFICANT MOVEMENT, UM, AND HER CONTRIBUTIONS TO CIVIL RIGHTS AND TRANSIT EQUITY WITH A BUS TOUR WITH THE ORGANIZATION, BLACK AUSTIN TOURS, UM, LEARNING MORE ABOUT THE HISTORY OF, UM, AFRICAN AMERICANS IN AUSTIN, TEXAS.

UM, IT'S A FANTASTIC EVENT.

IF YOU'RE INTERESTED IN ATTENDING ONE, UM, LET ME KNOW.

I DO BELIEVE WE'LL BE BACK OUT DOING ANOTHER ONE ON HER BIRTHDAY COMING UP IN FEBRUARY.

AND JUST TO POINT OUT TO THE COMMUNITY, SHE WAS A MEMBER OF ALPHA KAPPA ALPHA SORORITY AND SHE WAS A SECRETARY OF HER LOCAL NAACP.

THERE YOU GO.

AS WELL AS THE SEAMSTRESS.

SO, AND THEN ADDITIONALLY ON THAT VERY SAME DAY, UM, A A NUMBER OF OUR EXECUTIVES HAD THE OPPORTUNITY OF MEET MEETING WITH TAMIKA MONVILLE FROM THE U-S-D-O-T.

UM, SHE'S FROM THE FEDERAL RAILROAD ADMINISTRATION, SOUTH CENTRAL REGION.

WE ARE ABLE TO GIVE HER AN OVERVIEW OF WHAT WE DO CURRENTLY IN TERMS OF FREIGHT AND COMMUTER RAIL AND WHAT WE'RE HOPING TO DO FOR COMMUTER RAIL IS ALSO, AND ALSO TALK THROUGH SOME OF THE AMBITIOUS PLANS OF THIS REGION WHEN IT COMES TO PASSENGER RAIL.

UM, SO WE WERE VERY GRATEFUL, UM, TO HAVE HER COME TO AUSTIN TO MEET WITH US AND GET A CHANCE TO RIDE OUR BEAUTIFUL RED LINE SERVICE.

ONE OF THE THINGS THAT, UM, I WANTED TO TO TAKE, UM, A MOMENT OF, OF PRESIDENTIAL PRIVILEGE AND THANK OUR THREE COUNCIL MEMBER BOARD MEMBERS, UM, COUNCIL MEMBER POOLE, COUNCIL MEMBER VELA AND MAYOR PRO TEM ELLIS, WHO WERE ALL, UM, KEY IN LEADING THE DIALOGUE ON THE HOME INITIATIVE.

THE HOME INITIATIVE, WHICH RECENTLY PASSED COUNCIL, UM, MAKES IT EASIER FOR PEOPLE TO HAVE SECONDARY DWELLINGS ON THEIR, ON THEIR PROPERTY, AS WELL AS TO INCREASE THE, UM, NUMBER OF

[01:10:01]

UNRELATED ADULTS LIVING IN A SPACE SO THAT MORE ROOMMATES MIGHT BE ABLE TO AFFORD TO LIVE IN THE CENTRAL CITY.

THESE SORTS OF INITIATIVES, UM, HELP OUR CITY GROW SMARTER AND IN A WAY THAT IS MORE CONDUCIVE TO SUPPORTING TRANSIT.

SO, UM, WE JUST WANT TO SAY THANK YOU VERY MUCH FOR YOUR WORK.

UM, AND WE ARE EXCITED TO CONTINUE SUPPORTING THAT WORK, UM, OVER, UM, THE NEXT YEAR OR SO, AS WE CONTINUE TO TRY AND, UM, MOVE OUR LAND DEVELOPMENT CODE PROCESSES TOWARD THE MOST TRANSIT SUPPORTIVE WE CAN POSSIBLY GET THEM.

IT IS THE END OF THE YEAR, SO OF COURSE THERE'S AN AWARDS BANQUET OR TWO TO ATTEND.

UM, IT WAS MY PLEASURE TO ATTEND AND SPEAK AT THE AUSTIN NAACP'S 58TH DEWITTE OVERTON FREEDOM FUND BANQUET, UM, WITH MANY OF MY COLLEAGUES, UH, A GREAT THANK YOU TO, UM, COUNCIL MEMBER VELA WHO JOINED US AT OUR TABLE.

UM, CHAIR TAVION WAS ALSO IN ATTENDANCE, ALTHOUGH, UM, UNABLE TO MAKE IT OVER AND SAY HI.

I GAVE HIM A HARD TIME ABOUT THAT ALREADY.

I WAS WITH MY MOTHER-IN-LAW.

HE DID TELL ME HE HAD MORE IMPORTANT, I LOVE, LOVE Y'ALL, BUT MORE IMPORTANT RESPONSIBILITIES.

AND I UNDERSTAND THAT THE THEME OF THE EVENT IS UNFINISHED BUSINESS, UM, INEQUITIES IN AUSTIN.

AND IT BROUGHT TOGETHER A NUMBER OF COMMUNITY LEADERS TO THINK ABOUT ALL THAT WE HAVE ACCOMPLISHED, BUT ALL THE WORK WE STILL HAVE LEFT TO DO.

UM, AND IT WAS OUR PRIVILEGE TO BE ABLE TO BE IN ATTENDANCE, I SHOULD SAY, MY MOTHER IN LOVE.

THAT THAT'S, THAT'S HOW WE REFER, REFER TO THAT, UH, THAT WE MOTHER IN LOVE.

EXCELLENT.

THAT'S AND LOVE.

WE WILL, WE WILL LET MRS. TVI KNOW THAT HER MOTHER WAS APPROPRIATELY SHOWERED WITH APPRECIATION.

ALRIGHT, THIS MONTH WE HOSTED THE, UM, AFTA, THE AMERICAN PUBLIC TRANSPORTATION ASSOCIATION SAFETY AND RISK MANAGEMENT SEMINAR THAT'S BROUGHT TOGETHER A FEW HUNDRED SAFETY AND RISK MANAGEMENT PROFESSIONALS FROM THROUGHOUT THE COUNTRY, UM, TO TO SHARE IT INFORMATION WITH ONE ANOTHER, TO TALK ABOUT UPCOMING CHANGES IN FEDERAL LAW LAW.

IT'S REALLY A PROACTIVE WAY FOR THESE SAFETY PROFESSIONALS TO STAY INFORMED.

UM, WE WERE EXCITED AS PART OF THAT EFFORT TO BE ABLE TO HOST, UM, TRAVIS COUNTY, JUDGE ANDY BROWN, WHO WAS THE KEYNOTE SPEAKER AT THEIR OPENING DAY LUNCHEON.

HE PROVIDED INSIGHTS ON REGIONAL CHALLENGES AND OPPORTUNITIES, EMPHASIZED, UM, OUR AMBITIOUS GOALS FOR PASSENGER RAIL AS WELL AS DISRE DISCUSSED ACCESS TO CRITICAL RESOURCES AND EXPECT EXPRESSED HIS JUST OVERALL RESPECT FOR TRANSPORTATION PROFESSIONALS DEDICATED TO SERVING THEIR COMMUNITY.

SO IT WAS GREAT, UM, TO HEAR FROM JUDGE BROWN AND BE ABLE TO SHARE HIS WORDS WITH THE REST OF OUR INDUSTRY.

AND LASTLY, WE HAD TWO CAP METRO CARES EVENTS THIS MONTH.

CAP METRO CARES IS A PROGRAM THAT ALLOWS CAPITAL METRO TO, UM, EXTEND OUR REACH.

WE ARE ALL ABOUT SERVING COMMUNITY, THAT IS WHO WE ARE, BUT WE KNOW THAT THERE'S ONLY SO MUCH WE CAN DO THROUGH PUBLIC TRANSIT.

AND SO WE MAKE AVAILABLE THROUGH OUR CAP METRO CARES PROGRAM, OTHERWISE UNUTILIZED ADVERTISING SPACE ON OUR BUSES, UM, TO PARTNER WITH NONPROFITS THAT SHARE OUR VALUES THAT ARE, ARE WORKING TOWARDS SOME OF THE SAME, UM, OUTCOMES THAT WE ARE.

AND THIS MONTH WE WERE THRILLED, UM, TO HOST THE AFRICAN AMERICAN YOUTHS HARVEST FOUNDATION AND UNVEILING, UM, THEIR BUS WRAP.

THOSE ARE, UM, CONFUSINGLY THE PICTURES ON THE TOP LEFT AND THE BOTTOM RIGHT .

WE KINDA SWITCHED THEM AROUND A LITTLE.

UM, THE AFRICAN AMERICAN YOUTH HARVEST FOUNDATION, IF YOU HAVE NOT HEARD OF THEM, YOU NEED TO GO GOOGLE THEM RIGHT AWAY.

THEY'RE AN AMAZING ORGANIZATION, UM, THAT, UM, HIGHLIGHT THAT THAT PROVIDES A NUMBER OF SERVICES FOR AFRICAN AMERICAN YOUTH, BUT ALSO JUST OPENED THE YOUTH HARVEST TRAUMA RECOVERY CENTER, UM, TO PROVIDE TRAUMA SUPPORT TO PEOPLE IN OUR COMMUNITY.

UM, WE WERE, UM, THRILLED AT THIS EVENT TO, UM, HEAR REMARKS FROM COUNCILWOMAN VANESSA FUENTES, UM, WHO HA WHO WAS VERY INTEGRAL IN HELPING SUPPORT THE OPENING OF THAT TRAUMA RECOVERY CENTER.

UM, WE ALSO CELEBRATED WITH CONTIGO WELLNESS IN UNVEILING THEIR CAT MITRO CARES WRAP, WHICH FEATURED LOCAL ARTWORK AND CONTIGO WELLNESS'S MENTAL EQUITY SERVICES.

UM, THEIR PARTNERSHIP IS DEDICATED TO EMPOWERING THE COMMUNITY THROUGH MENTAL HEALTH AWARENESS, UM, AND THE EVENT FEATURED A LOCAL D DJ, UM, PANDUCE AND A PHOTO SHOOT FOR THE ORGANIZATION.

SO, UH, MANY THANKS TO THESE TWO GREAT ORGANIZATIONS THAT ARE PROVIDING, UM, A LOT OF, UM, FANTASTIC SERVICES FOR OUR COMMUNITY.

AND IT'S OUR HONOR TO SUPPORT THEM, UM, THROUGH ADVOCACY AND EDUCATION BY HAVING THESE BUS REPS ON OUT ON THE STREETS.

AND THEN THE LAST THING IS I JUST WANT TO, UM, WISH EACH OF YOU A VERY HAPPY HOLIDAY SEASON.

I KNOW IT IS A BUSY TIME OF YEAR AND SOME FOLKS ARE TRAVELING AND SOME FOLKS ARE SAYING, PUT THE BEAUTIFUL POINSETTIAS IN OUR BOARDROOM TODAY ARE NOT JUST OUR HOLIDAY DECORATION, BUT

[01:15:01]

A SMALL TOKEN OF OUR APPRECIATION TO YOU.

WE WOULD BE HONORED IF YOU WOULD TAKE THAT ONE HOME SO THAT YOU CAN THINK FONDLY OF US OVER THE COMING WEEKS.

UM, AND WE WILL SEE YOU BACK IN JANUARY.

WELL, THANK YOU FOR THAT REPORT.

UH, IT IS, IT IS ALWAYS, UH, IT'S ALWAYS GOOD TO HEAR HOW WE'RE WORKING IN THE COMMUNITY AND HOW STAFF IS, IS WORKING IN THE COMMUNITY.

AND, UM, AND IT MAKES US KNOW AS A BOARD THAT WE, WE MADE AN EXCELLENT SELECTION IN OUR CEO, UM, BECAUSE SHE DOES, UM, ALL THAT WE EXPECT OF HER AND A AND A LOT MORE AS WELL.

SO I THANK YOU FOR WHAT YOU'VE DONE.

UM, NOW I

[VII.5. (part 2 of 2)]

AM TOLD BY OUR MEDIA TEAM THAT MY MIC WAS OFF ON ITEM NUMBER FIVE.

SO WHAT I'D LIKE TO DO IS POINT OUT THAT ITEM NUMBER FIVE, I'LL READ IT INTO THE RECORD AGAIN.

UH, APPROVAL OF A RESOLUTION APPROVING THE CAP METRO PUBLIC TRANSPORTATION AGENCY SAFETY PLAN, AUTHORIZING THE PRESIDENT AND CEO OR HER DESIGNEE TO FINALIZE AND EXECUTE THE PLAN, UH, AND SETTING A PROGRAM TO PROVIDE RELEVANT AND USEFUL INFORMATION TO THE BOARD OF DIRECTORS.

UH, THE MOTION WAS MADE BY BOARD MEMBER ELLIS, UH, THE BOARD.

THE, THE MOTION WAS SECONDED BY BOARD MEMBER HARRIS.

AND, UH, AND THE ITEM WAS UNANIMOUSLY APPROVED BY THE BOARD.

SO NOW DO I, DO I NEED TO CALL IT OR DO I JUST NEED TO DESCRIBE IT? OKAY.

IT'S BEEN DESCRIBED, UM, AND EFFECTIVELY READ INTO THE RECORD.
