SIX, DISCUSSION OF THE MAY 13TH, 2024 BOARD OF ADJUSTMENT ACTIVITY REPORT.

UH, Y'ALL ARE AWESOME.

I'M GOING TO USE THESE, OR I AM USING THESE FOR THE ANNUAL REPORT THAT I HAVE TO TURN IN IN JULY FOR THE BOARD MEMBERS.

YOU WILL GET TO SEE A COPY OF THAT REPORT AT THE NEXT MEETING.

UH, THERE WON'T BE ANY DISCUSSION ON IT.

I'LL JUST HAVE IT THERE SO YOU CAN LOOK AT, BUT THAT'LL BE GETTING SUBMITTED TO THE CLERK'S OFFICE ON TIME THIS YEAR.

UM, FOR ITEM SEVEN AND EAT.

SO FOR ITEM SEVEN, LET'S GO IN AND, UM, WE'LL JUST PUSH THIS, WE'LL POSTPONE THIS TILL THE NEXT MEETING WHEN WE HAVE A FULL, UH, BODY HERE.

IF WE DO NOT HAVE A SUPER MAJORITY, THESE FOLKS, THESE APPLICANTS WHO HAVE PAID THOUSANDS OF DOLLARS FOR US TO HEAR THEIR CASE CANNOT BUILD, THEY CANNOT MOVE FORWARD.

IF THEY HAVE A RED TAG, THERE ARE FINES ACCRUING, AND THERE IS A REALLY CRANKY CO COMPLIANCE OFFICER CALLING THESE FOLKS ON A PRETTY REGULAR BASIS.

SO WE HAVE TO TRY TO MAKE SURE THAT WE GET TO AT LEAST NINE, PREFERABLY 10.

AND I WILL CONTINUE WORKING ON GETTING ANOTHER ALTERNATE FROM THE MAYOR'S OFFICE.

ARE THERE ANY FOR FUTURE AGENDA ITEMS OR ANNOUNCEMENTS? I CHAIR, UH, BOARD MEMBER OF VINYL.

I'VE BEEN GONE FOR QUITE A WHILE, BUT, UM, TRYING TO REMEMBER IF THE, THE NECESSITY FOR SUPER MAJORITY, THAT'S STATE STATUTE OR I DON'T KNOW IF, UH, IF LEGAL IS THERE, IS THAT STATE STATUTE OR IS THAT ORDINANCE, IS THAT CITY ORDINANCE? IT'S CITY.

IT'S CITY ORDINANCE.

IT'S, IT'S IN THE CODE AND IT'S IN OUR BYLAWS.

BUT IS IT ALSO STATE, BUT IT'S ALSO STATE, SO IT'S KIND OF EVERYWHERE, BUT THE CITY MAJORITY IS EVERYWHERE.

SO I GUESS OKAY, BECAUSE I, I REMEMBER YEARS AGO AND 12 YEARS AGO, IT USED TO BE JUST A MAJORITY.

I DIDN'T, I GUESS THAT'S PROBABLY BACK WHEN THINGS WERE A LOT MORE LOOSEY GREASY THAN THEY WERE NOT.

THEY ARE NOW.

SO I JUST DIDN'T KNOW IF THERE'S A MECHANISM WHERE WE AS A BOARD CAN EITHER SUBMIT FOR A CHANGE OF BYLAWS OR RULES AND PROCEDURES TO ALLOW A MAJORITY OR A QUORUM, EVEN THOUGH IT'S NOT A SUPER MAJORITY TO, UH, YOU KNOW, AMEND THE NUMBER OF PEOPLE THAT ARE PARTICIPATING SO THAT WHEN WE DO VOTE, IT'S A SUPER MAJORITY OF THOSE THAT ARE PRESENT SO THAT AC ACTION CAN BE TAKEN.

I I, IF I REMEMBER CORRECTLY, UH, TEXAS CODE SAYS THAT LIKE THE TWO MOST PROMINENT THINGS THAT I THINK AFFECT US ARE THAT THERE HAS TO BE AT LEAST FIVE BOARD MEMBERS MEET ONCE A QUARTER AND THAT IT HAS TO BE TWO THIRDS FOR ANY ZONING VARIANCE, UH, SPECIAL EXCEPTIONS, UH, SIGNED CASES.

THOSE ARE JUST MAJORITY.

OKAY.

WELL, IT'S WORTH HAVING LEGAL LOOK INTO THE POSSIBILITY BECAUSE FOR EXAMPLE, HERE TONIGHT WE HAVE QUITE A FEW PEOPLE WHERE, UH, WE STILL HAVE A QUORUM, BUT WE CAN'T TAKE ANY ACTION.

AND I AGREE WITH YOUR COMMENT THAT, UH, A LOT OF PEOPLE ARE PAYING A LOT OF MONEY AND THEN EACH MONTH THAT THEIR PROJECTS ARE HELD UP AS A FORMER CONTRACTOR AND AND DEVELOPER, I CAN TELL YOU IT COSTS A LOT OF MONEY FOR THESE PEOPLE TO WAIT ANOTHER 30 DAYS.

SO I DON'T KNOW IF THERE'S SOMETHING THAT LEGAL MIGHT BE ABLE TO LOOK INTO TO SEE IF THERE COULD BE AN AMENDMENT WITHOUT HAVING TO GO TO LEGISLATURE OR ANYTHING OF THAT NATURE SO THAT WE CAN CONDUCT BUSINESS.
