UH, BOTH CAROL PHILLIPSON AND I HAVE BEEN TRAINED BY THE FIREWISE ALLIANCE TO HELP MITIGATE WILDFIRE RISKS AFFECTING 950 HOMES IN JESTER ESTATES.

ACCORDING TO, UH, SCOTT STOOKEY FROM THE AUSTIN FIRE MARSHAL'S OFFICE, THIS IS THE FIRST PROPOSAL TO BUILD A CELL TOWER JUST FEET AWAY FROM A FEDERALLY PROTECTED ENDANGERED SPECIES HABITAT.

THE SITE PLAN FAILS TO ILLUSTRATE THE SEVERITY OF THE NEW WILDFIRE THREAT, WHICH IS EVIDENT IN THE ACCOMPANYING PICTURES AND VIDEO.

THE FIRST TWO PICTURES DEPICT THE LOCATION OF THE BACKUP BATTERIES, UH, AND DIESEL FUEL STORAGE JUST 33 FEET FROM THE BCP FENCE.

UM, THE FOLLOWING TWO IMAGES SHOW THE 100 FOOT MONOPOLE POSITIONED 46 AND 65 FEET FROM THE RESPECTIVE FENCES ON THE BCP PROPERTY.

THE NEXT PICTURE REPRESENTS A CO COLLAGE ILLUSTRATING THE CONSEQUENCES OF A MONOPOLE COLLAPSE OR FIRE.

UH, THE FI THE FINAL TWO PICTURES OFFER AN OVERHEAD VIEW OF THE AREA AND A PLAT MAP AROUND JESTER CLUB HIGHLIGHTING THE BASKETBALL COURT WHERE THE LOWER TOWER WILL BE, WOULD BE INSTALLED, AND THE WOODEN ENCLOSURE FOR THE BATTERIES AND DIESEL.

THE OVER OVERHEAD VIEW ALSO SHOWS THEIR PROXIMITY TO THE SURROUNDING WOODLAND FUEL.

HOWEVER, PICTURES ALONE CANNOT CONVEY THE EXTREME WILDFIRE HAZARD POSED BY THIS 100 FOOT MONOPOLE.

THE THREAT ENDANGERS NOT ONLY THE PROTECTED SPECIES IN THEIR HABITAT, BUT ALSO THE 950 HOMES IN GE ESTATE, WHICH HAVE ONLY TWO EVACUATION ROUTES.

NOTE THAT THE TOWER WILL ALSO INCLUDE A LIGHT FIXTURE TO ELIMINATE THE BASKETBALL COURT, WHICH IS AN ADDITIONAL FIRE HAZARD, UH, BEYOND THAT POSED BY THE FIRE TOWER ITSELF.

UH, IF WE COULD SHOW THE VIDEO PLEASE.

SO THIS SHOWS YOU WHERE THE TOWER VENTURES PLANS TO PUT A HUNDRED FOOT MONOPOLE BEHIND THE BASKETBALL COURT, AND THEY'RE GONNA HAVE A LIGHT THAT'S GONNA SHINE FOR THE BASKETBALL COURT BEHIND THIS HOOP.

AND IF I TURN AROUND THIS WAY, YOU WILL SEE THAT 46 FEET FROM THIS AREA IS THE BALCONES CANYON LAND ENDANGERED SPECIES HABITAT.

AND IF I GO THIS WAY, IT'S 65 FEET.

IT'S TOTALLY GROWN IN FIVE THREE.

SO YOU CAN HARDLY SEE THE FENCE LINE BACK THERE, BUT IT IS BACK THERE.

I MAY SEE A POOL THERE.

ADDITION TO THE MONOPOLE AND THE STORAGE FACILITY, THEY'RE GOING TO HAVE 150 FEET OF WIRING THAT GOES FROM THE BASKETBALL HOOP ALL THE WAY OVER TO, AND YOU'LL SHOW YOU ALL THIS, UH, ALL THE WAY OVER TO THE STORAGE FACILITY, WHICH IS OVER HERE THAT'S GONNA STORE THE BATTERIES AND THE DIESEL FIELD.

THIS IS BCP PROPERTY AND FROM THIS POINT TO THE STORAGE FACILITY IS 33 FEET.

SO AS YOU CAN SEE, THIS IS EXTREME FIRE HAZARD AND THERE SHOULD BE NEW CODE TO PREVENT THIS.

AND CAROL WILL NOW PRO PROVIDE MORE DETAILS ABOUT THE PROPOSED 100 FOOT MONOPOLE FACILITY.

UH, THE MEMBERS ONLY CHESTER CLUB HAS CONTRACT WITH TYRA VENTURES TO BUILD A HUNDRED FOOT CELL TOWER FOR AT AND T WITH 12 BATTERIES, 50 GALLONS DIESEL FUEL AND STRINGING WIRES 150 FEET FROM THE STORAGE BUILDING TO THE TOWER.

ONLY A FEW FEET FROM THE BALCONES CANYON LANDS PRESERVE AN ENDANGERED SPECIES HABITAT.

THEN PLANS TO ADD TWO MORE CARRIERS, INCREASING THE NUMBER OF BATTERIES IN DIESEL FUEL ACCORDINGLY, CREATING AN EVEN MORE SERIOUS FIRE RISK TO THE PRESERVE.

THE REASON FOR THIS 104 FOOT CELL TOWER SITE IS TO IMPROVE AT AND T SERVICE FOR A FEW JESTER CLUB MEMBERS, NOT EVEN THE NEIGHBORHOOD CODE 25 DASH TWO DASH 8 39 SECTION F LINE D RES.

THE PROPOSED TOWER LOCATION WILL NOT NEGATIVELY AFFECT A RESIDENTIAL NEIGHBORHOOD.

THIS WILL DEFINITELY AFFECT NEGATIVELY AFFECT GE ESTATES AND LAKEWOOD.

IN ADJOINING NEIGHBORHOOD WITH INCREASED WILDFIRE, MONOPOLES CAN BE 100 TO 400 FEET HIGH.

SO UPDATED CODE MUST ESTABLISH AND MANDATE A SAFE DISTANCE FROM AN ENDANGERED SPECIES HABITAT.

LUCKILY, THIS WILDFIRE THREAT CAN BE EASILY MITIGATED.

MUNI CODE 25 DASH TWO DASH 2 89 E, WHICH REGULATES THE DISTANCE OF TOWERS, JUST NEEDS TO BE UPDATED WITH ONE ADDITIONAL RESTRICTION.

THE TOWER MAY NOT BE LOCATED ON OR WITHIN 600 FEET OF A FEDERALLY PROTECTED ENDANGERED SPECIES HABITAT.

WWE AND IFC ONLY REQUIRE 10 FOOT CLEARANCE, WHICH I'M ALSO WORKING TO UPDATE AS WELL AS INTERNATIONAL CODE.

UPDATED CODE WILL MITIGATE THIS NEW WILDFIRE ADDRESSED BY GOVERNOR ABBOTT AND MERRITT'S DECLARATION OF EMERGENCY FOR 143 COUNTIES IN RESPONSE TO INCREASING WILDFIRE DANGER.

NO ONE PLANS AN ACCIDENT, SO SHOULD A BATTERY OR FUEL FIRE IGNITE AND OR THE 104 MONOPOLE FALL TO THE PRESERVE, A WILDFIRE WOULD QUICKLY SPREAD THREATENING THE ALREADY ENDANGERED SPECIES, THEIR FRAGILE ENVIRONMENT.

PLUS, IN THIS CASE A NEIGHBORHOOD OF 950 HOMES WITH ONLY TWO EVACUATION ROUTES.

THE NEW WILDFIRE RISK WILL IMPACT BCPS 33,000 ACRES LOCATED WITHIN MANY OF ALL YOUR DISTRICTS THROUGHOUT AUSTIN.

WHAT, WHAT WOULD YOU DO IF THIS WAS YOUR NEIGHBORHOOD? VICKY GOODWIN ALSO AGREES THAT THIS NEW WILDFIRE THREAT MUST BE ADDRESSED AND SUBMITTED.

SO A LEGISLATIVE BILL WAS, WAS WRITTEN AND AND MANDATED, I'M SORRY, WAS SUBMITTED LAST WEEK TO MANDATE A SAFE DISTANCE FOR CELL TOWERS FROM FEDERAL PROTECTED ENDANGERED SPECIES HABITATS.

I HAVE ALSO DISCUSSED THIS MATTER WITH ALISON ALTER, LLOYD DOGGETT, DONNA HOWARD, SARAH ECKHART, AND NEWLY ELECTED MARK UCHIN, ALL WHO HAVE CONCERNS FOR INCREASED RISK OF WILDFIRE AS POLICYMAKERS.

IT IS YOUR RESPONSIBILITY TO UPDATE MUNI CODE AS SOON AS POSSIBLE TO PREVENT AN UNNECESSARY CATASTROPHIC WILDFIRE.

THIS PROPOSED A HUNDRED FOOT CELL TOWER FACILITY IS UNDER REVIEW AS WE SPEAK.

UM, THESE HAVE COME CONSISTENTLY IN THE LAST COUPLE OF MONTHS BECAUSE MANY OF OUR LOCAL ISDS HAVE DONE BOND PROJECTS, WHICH REQUIRES THEM TO, OR ENCOURAGES THEM TO UPDATE THEIR INTER-LOCAL AGREEMENTS.

UM, I THINK I WOULD JUST LIKE TO SPEAK TO THE FACT THAT WE NEED TO CONTINUE TO DO THESE INTER-LOCAL AGREEMENTS AND WE'D LIKE TO SEE THEM PERHAPS BEFORE WE SEE BOND REQUESTS.

UM, OBVIOUSLY WE'RE SEEING THIS IN PAIRS TONIGHT, BUT, UM, JUST TO REALLY EMPHASIZE TO OUR LOCAL ISDS AS WELL AS TO OUR ZONING STAFF AND EVERYONE ELSE, THAT IT'S GREAT FOR US TO UPDATE OUR REGULATIONS WITH OUR LOCAL ISDS BEFORE WE ACTUALLY MOVE FORWARD WITH BOND PROJECTS.

THIS IS A REQUEST FOR RESIGNING FROM CSMU MP AND CS ONE MP TO CH PDA MP.

AFTER DISCUSSION OF THIS CASE, AT THE PLANNING COMMISSION MEETING LAST WEEK, WHICH WAS ON NOVEMBER THE 12TH, THE APPLICANT AMENDED THEIR APPLICATION BACK TO THEIR ORIGINAL PDA REQUEST TO PROPOSE A MAXIMUM HEIGHT OF 250 FEET AND A MINIMUM LOT SIZE OF FIVE HUNDRED AND FIFTY SEVEN SEVEN FIFTY SQUARE FEET.

BASED ON THE PROPOSED PDA OVERLAY CONDITIONS, THE STAFF IS NOW RECOMMENDING DENIAL OF THE REQUESTED C-H-P-D-A MP ZONING.

WHILE THE PROPERTY IN QUESTION MEETS THE INTENT OF THE CH BASE DISTRICT, BECAUSE IT IS LOCATED ON US HIGHWAY 180 3, THE APPLICANT'S PROPOSAL FOR A PDA OVERLAY WILL INCREASE THE ENTITLEMENTS AND DENSITY THROUGH RELAXED SITE DEVELOPMENT STANDARDS ON THIS PROPERTY, THE PROPOSED PDA OVERLAY IN THIS REZONING APPLICATION WILL INCREASE THE PERMITTED HEIGHT BY FOUR TIMES FROM 60 FEET TO 250 FEET, INCREASE THE MAXIMUM FAR FROM TWO TO ONE TO EIGHT TO ONE, REMOVE THE MINIMUM SETBACKS AND ADD PERMITTED USES ON THE PROPERTY WITHOUT THE BENEFITS THAT COULD BE ACCOMPLISHED THROUGH THE PRO.

THAT CAN BE ACCOMPLISHED THROUGH THE PROPOSED ZONING.

THE STAFF UNDERSTANDS THAT THE APPLICANT HAS AGREED TO A LIST OF COMMUNITY BENEFITS WITH THE NEIGHBORHOOD.

HOWEVER, BY CODE THESE ITEMS CANNOT BE INCLUDED IN THE PDA OVERLAY THROUGH THE ZONING ORDINANCE.

THE STAFF WOULD SUPPORT THIS LEVEL OF HEIGHT AND DENSITY ON THIS TRACT OF LAND.

IF THIS WAS A REZONING REQUEST FOR A PLANNED UNIT DEVELOPMENT OR PDA UNDER CURRENT CODE REGULATIONS ONLY, THE PDA DISTRICT, PUD, I'M SORRY, PUD DISTRICT DESIGNATION PROVIDES GUIDELINES AND TIER LEVEL REQUIREMENTS FOR THE STAFF TO REVIEW THE BENEFITS THAT ARE PROPOSED FOR THIS TYPE OF DEVELOPMENT AND INCLUDE THEM IN A CITY APPROVED DOCUMENT THAT WILL BE ENFORCED DURING THE DEVELOPMENT PROCESS.

SO WE UNDERSTAND THE APPLICANT'S REQUEST FOR INCREASED HEIGHT AND, UH, FAR ON THIS PROPERTY AS WELL AS PROPOSED MORE PROPOSED USES ON THIS SITE, UM, THROUGH

IT DOES NOT MEET ALL THE DIFFERENT REQUIREMENTS AND THINGS THAT THE NEIGHBORHOOD WANTED.
