UM, WHERE THE MOST, WHAT MANY WOULD CONSIDER THE MOST DESIRABLE, CERTAINLY THE MOST EXPENSIVE REAL ESTATE IN THE WORLD IS THAT'S RESIDENTIAL.

UM, TWO SPECIFIC ITEMS. ONE, UH, THE DEVELOPER INCLUDED A, A VERY LONG LIST OF CONDITIONAL OVERLAYS THAT WERE INTRODUCED EARLIER, UM, LAST YEAR.

THEY'RE BASICALLY JUST AUTO ORIENTED OVERLAYS AND ZAP HAS MADE A HABIT OF ADDING CONDITIONAL OVERLAYS LIKE THIS ON OUR TRANSIT CORRIDORS.

AND I, UM, AM BRINGING THIS TO YOUR ATTENTION 'CAUSE I WANTED TO APPLAUD THE DEVELOPER FOR DOING THIS WORK AND ENCOURAGE THIS BODY TO, UH, ENCOURAGE OTHER DEVELOPERS TO CONSIDER THAT ON TRANSIT CORRIDORS.

UM, ANOTHER REASON WHY I'M HERE TODAY IS BECAUSE THE DEVELOPMENT TEAM WAS REALLY OPEN TO THE RECOMMENDATION TO CREATE PEDESTRIAN CONNECTIVITY BETWEEN BATTLE BAND, NEIGHBORHOOD AND SOUTH CONGRESS AVENUE.

AND I MEAN, MY PERSONAL PREFERENCE IS TO USE LIVERPOOL DRIVE BECAUSE OF ACCESS TO THE PARKLAND AND ITS ESSENTIAL CONNECTION, UM, TO THE COMMUNITY THAT'S THERE.

AND ALSO THE CONNECTION DIRECTLY TO HIGH FREQUENCY TRANSIT.

AND THEY'VE AGREED TO STUDY THIS FURTHER WITH THE CONNECTION ALONG WILLIAMSON CREEK.

NOW, THE REASON THIS IS IMPORTANT ISN'T JUST BECAUSE I LIVE IN THIS AREA AND I, I, THESE ARE THINGS THAT I WOULD LIKE.

UM, IT ISN'T JUST IMPORTANT BECAUSE THEY SAID YES.

THIS IS GREAT.

I LOVE IT.

UM, THE REASON I THINK THIS IS IMPORTANT IS BECAUSE WE DON'T CURRENTLY HAVE POLICY TO ENCOURAGE MOBILITY EASEMENTS AROUND MULTIFAMILY DEVELOPMENT.

AND SO WE HAVE NO GUARANTEE THAT AS WE BUILD OUT DISTRICTS LIKE ST.

ELMO, UH, THAT THEY'LL BE WALKABLE.

UH, MOST OF THESE BUILDINGS ARE BUILT WITH FENCES AROUND THEM AND NO WAY TO WALK OR BIKE AROUND THEM.

SO THEY WIND UP BEING LARGE FENCES, KEEPING PEOPLE IN SINGLE FAMILY NEIGHBORHOODS AWAY FROM THE CORRIDORS THAT THEY'RE SUPPOSED TO BE ABLE TO ACCESS.

SO, UM, WHILE I WANNA APPLAUD THIS DEVELOPER FOR BEING OPEN TO THIS, I WANNA HIGHLIGHT THIS NEED FOR THE PLANNING COMMISSION TO CONSIDER HOW MOBILITY EASEMENTS CAN BE BROUGHT TO MORE MULTI-FAMILY DEVELOPMENTS LIKE THIS ONE.

SO WITH THAT IN MIND, I CERTAINLY ENCOURAGE YOU TO SUPPORT THIS APPLICANT'S REQUEST.

SO, UM, OTHERWISE THAT WOULD BE THE ONLY TWEAK.

DBE TODD, AS YOU KNOW, IN THE ORDINANCE ALREADY HAS EXPLICIT LANGUAGE, WHICH OVERRIDES ANY CONDITIONAL OVERLAY, BUT AS YOU ALL ALSO KNOW, IT ALSO REQUIRES RESIDENTIAL AND AFFORDABLE HOUSING.

UNDER DISCUSSION, UM, OVER THE PAST SEVERAL MONTHS, WE'VE WORKED WITH THE AGENT FOR THE APPLICANT, UH, TO NEGOTIATE AN AGREEMENT THAT IS MUTUALLY BENEFICIAL FOR THE APPLICANT AND THE COMMUNITY OF WHICH THESE TRACKS ARE APART.

WE ARE GRATEFUL TO STAFF, VERY GRATEFUL FOR THEIR CONSIDERED EFFORTS IN REVIEWING THESE CASES AND STRONGLY CONCUR WITH THEIR RECOMMENDATION OF GR WITH CONDITIONAL OVERLAY FOR TRACKS ONE, TWO, B THREE AND FOUR AND, UH, AND CONTINUED CS WITH CONDITIONAL OVERLAY ON TRACKS TWO A.

KIRKSEY IS OUR ARCHITECT AND LAND USE SOLUTIONS.

UH, THAT'S MY COMPANY'S ZONING AND ENTITLEMENTS.

THESE ARE EXAMPLES OF STONE LAKE'S DEVELOPMENTS THAT, UM, WE'VE REVIEWED WITH DURING OUR COMMUNITY ENGAGEMENT PROCESS.

THE FLATIRON AND THE BOWEN ARE IN DOMAIN SOUTH END OF BERNARD AND BREAKER AND TRAILHEAD EAST IS IN EAST AUSTIN AT BAL ROAD AND SHADY LANE.

THE PROPERTY LOCATION IS AT COLLIER AND THE MAR HERE'S A CLOSEUP VERSION.

IT'S CURRENTLY AN UNDERUTILIZED SITE THAT IS DEVELOPED WITH ONE STORY COMMERCIAL USES AND IS OWN CSV WITH A MAXIMUM HEIGHT OF 60 FEET.

UM, MS. BOUDREAUX WENT OVER THE, THE ZONING REQUEST, SO I WON'T, UM, SPEND TOO MUCH TIME ON THAT.

SO OUR COMMUNITY ENGAGEMENT PROCESS, OUR ORIGINAL PROPOSAL WHEN WE FILED WAS DCSV DB 90 FOR THE ENTIRE TRACT, WHICH IS 5.2 ACRES FOR THE MAXIMUM OF 90 FEET IN HEIGHT.

DURING OUR COMMUNITY ENGAGEMENT PROCESS, WE HEARD FROM NEIGHBORS AND WE AMENDED OUR PROPOSAL IN MAY FOR TRACT ONE AS DB 90 AND TRACK TWO.

UH, WE REMOVED THE DB 90 AND KEPT IT AT 60 FEET IN HEIGHT AND INCLUDED A CONDITIONAL OVERLAY THAT HAS A 75 FOOT BUILDING SETBACK AREA, WHICH WE BASICALLY FROM THE WESTERN PROPERTY LINE PULLED THE ENTIRE BUILDING OUT OF THE COMPATIBILITY SETBACK.

IT COULD HAVE BEEN 25 FEET FROM THE PROPERTY LINE, BUT WE PULLED IT OUT OF THAT AREA AND ALSO INCLUDED PROHIBITED USES.

SO THE STAFF RECOMMENDATION THE APPLICANT DOES AGREE WITH, AND AS MS. BOUDREAUX DISCUSSED, TRACK ONE IS THE FRONT PORTION ON LAMAR AT THE INTERSECTION AND TRACK TWO IS THE WESTERN PORTION OF THE SITE, THE 75 FOOT BUILDING SETBACK IN YOUR BACK.

IT IS CONSISTENT AND COMPATIBLE WITH SURROUNDING ZONING AND LAND USES.

UM, SINCE 2013, I'VE EXPERIENCED FREQUENT NOISE NUISANCES FROM WASTE MANAGEMENT AT 1700 SOUTH LAMAR.

AND I'VE APPRECIATED THE NEW OWNER'S EFFORTS TO MITIGATE THIS NUISANCE THROUGH MIGRATION OF THEIR WASTE SERVICES TO A NEW VENDOR.

BUT UNFORTUNATELY, THE NOISE NUISANCE HAS NOT ABATED AS THE WASTE CONTINUES TO BE COLLECTED AT NIGHT.

UH, OFTEN WITH REPEATED VISITS BETWEEN THREE AND 5:00 AM SEVERAL TIMES A WEEK WITH SUBSTANTIALLY LESS WASTE BEING PRODUCED TODAY THAN THE PROPOSED DENSITY WILL GENERATE.

UM, AS PROVIDED IN BACKGROUND MATERIALS, I PROVIDED A COMMISSION YESTERDAY.

JOAN LAKE HAS PROVIDED ME A DRAFT MEMORANDUM OF UNDERSTANDING, AGREEING TO LOCATE ALL WASTE AND LOADING THEM IN AREAS OF THE PROPERTY NOT ABUTTING OR FACING THE WESTERN SETBACK, WHICH IS THE 75 FOOT SETBACK THEY'VE COMMITTED TO ESTABLISHING FROM THE WESTERN PROPERTY LINE ADJOINING MY PROPERTY.

AND I APPRECIATE THIS COMMITMENT AND HAVE PROVIDED MY CONDITIONAL SUPPORT FOR THE PROJECT.

UM, WE PURCHASED OUR CURRENT HOME WITH THE AIM OF BEING CLOSE TO DOWNTOWN AND THE RESTAURANTS AND RETAIL THAT GO WITH IT.

UH, SOUTH MAR THE MAJOR TRANSIT CORRIDOR AS MENTIONED PREVIOUSLY, AND I EXPECTED IT TO GROW WITH MY FAMILY.

UH, THIS PROJECT PROVIDES MUCH NEEDED HOUSING AND WILL BRING NEW RE NEW RETAIL THAT THE NEARBY NEIGHBORHOODS WILL BENEFIT FROM.

UH, THE CURRENT LOT IS BLIGHTED AND NOT WELL ORIENTED TO THE STREET WITH UNUSED SURFACE PARKING.

UH, THE NEW PROJECT I THINK IS A RESPONSIBLE DEVELOPMENT AND I'M REALLY LOOKING FORWARD TO IT.

AND HOW ARE YOU REACHING A COMMUNITY WITHOUT EVEN REACHING YOUR NEIGHBORS AND MAKING SURE THAT THEY KNOW WHAT'S HAPPENING? NOW, THE MAJORITY OF THE PEOPLE, AND THIS IS 32 UNITS OF PEOPLE IN THIS COMMUNITY, THE SAGE, WHICH IS 1702, HAVE BOUGHT THEIR PROPERTY SINCE 2014 BECAUSE OF THE PROPERTY THAT WAS BUILT ON THE SOUTH SIDE OF IT.

JUST DOING A COMP OF WHAT THOSE VALUES WENT DOWN FOR IS ASTRONOMICAL.

SO IF YOU GO TO THE NORTHERN SIDE, WHICH IS MY SIDE, WHERE YOU HAVE A LIMITED VIEW, YOU HAVE SOME SKYLINE, YOU HAVE SOMETHING, OUR UNITS ARE ABOUT $670,000 TO PURCHASE.

HOWEVER, THE OTHER SIDE, BECAUSE OF THE OBSTRUCTION OF THAT BUILDING ARE 561,000 ON AVERAGE, SIGNIFICANTLY LOWER.

SO NOT ONLY WOULD IT TAKE AND WIPE OUT THE LAST VIEW THAT WE HAVE, WE WOULD BE LIVING IN CEMENT BLOCKS, BUT, YOU KNOW, OUR VALUES WOULD BE COMPLETELY WIPED OUT.

I MEAN, ME AS A SINGLE MOM, I SOLD MY HOUSE IN BEAVE BEAUTIFUL HOUSE BECAUSE I WANTED TO LIVE DOWNTOWN.

AND WHAT SOLD ME ON THIS UNIT WAS MY VIEW.

AND ALREADY WITH A MAXINE STUDY, HALF OF THAT WAS WIPED OUT WITH THIS NEW DEVELOPMENT.

ALL OF OUR UNITS WOULD BE SEEING CEMENT.

SO WE HAVE BALCONIES, WE HAVE, YOU KNOW, I I MADE A VERY STRONG FINANCIAL DECISION FOR ME AND MY FAMILY AND MOVED US ALL ACROSS TOWN FOR NOW, SOMETHING THAT IS NOT EVEN GONNA BE THERE.

SO WE ARE JUST HOPING THAT THIS, YOU KNOW, DEVELOPMENT UNDERSTANDS THAT WE'RE NOT AGAINST REDEVELOPING.

UM, WELL, I SUPPORT RESPONSIBLE GROWTH.

THIS PARTICULAR PROJECT WILL DIRECTLY AND NEGATIVELY IMPACT HOMEOWNERS LIKE MYSELF.

THE STRUCTURES HEIGHT AND DENSITY WILL LIKELY BLOCK VIEWS, UM, THAT NOT ONLY I,

UM, I WANNA ONCE AGAIN, VOICE FOR NOT AGAINST DEVELOPMENT, UM, WHERE I'M IN OPPOSITION OF OVERDEVELOPMENT THAT DISREGARDS EXISTING RESIDENTS FOR FURTHER COMMERCIALIZATION.
