UH, GOOD AFTERNOON, EVERYBODY. MY NAME IS BREE BRONCO. I'M THE, UH, LEGISLATIVE DIRECTOR OFFICER. LET ME SAY THAT AGAIN. IN A GOVERNMENT RELATIONS OFFICER FOR THE CITY OF AUSTIN, I'M HERE TO PRESENT TO YOU TODAY, UM, ON THE STATE LEGISLATIVE AGENDA FOR THE UPCOMING TEXAS LEGISLATIVE SESSION. I KNOW THAT IT'S, [00:05:01] UH, WE'RE NOW IN AUGUST, ALMOST IN SEPTEMBER. SO WE'RE NOT THAT FAR AWAY FROM THAT STARTING IN JANUARY. I'D LIKE TO ASK IF, UH, THE STAFF COULD PLEASE PULL UP MY POWERPOINT. THAT'S CALLED 87TH LEGISLATIVE AGENDA FOR THE GROUP. AND IF WE COULD START ON SLIDE TWO, THE STAFF CAN CONFIRM WHAT SETS UP FOR EVERYBODY. THAT'S BEEN ON SLIDE TWO. THANK YOU SO MUCH. UM, SO I LIKE TO SHOW THIS SLIDE TO EVERYBODY. THIS ISN'T 10 YEAR, LOOK BACK OVER THE NUMBER OF BILLS THAT GO THROUGH THE LEGISLATURE. UM, AND I WANT YOU TO PAY PARTICULAR ATTENTION TO THAT TOP LINE AND MY SPENDING AND COMPARE IT TO THAT BOTTOM LINE IN 2019. AND WE'LL SEE, THAT HAS INCREASED ABOUT 1500 TOTAL NUMBER OF BILLS PASSED HAS ACTUALLY DECREASED SLIGHTLY. WE ALWAYS SAY IT'S HARDER TO PASS THE BILL THAN IT IS TO KILL A BILL IN THE LEGISLATURE. THAT'S HOW THE SYSTEM IS DESIGNED. UM, BUT IF YOU LOOK AT THAT TOTAL NUMBER OF CITY RELATED BILLS, THAT NUMBER HAS JUMPED SUBSTANTIALLY. IT ALMOST REPRESENTS THE ENTIRE OVERALL INCREASE OF 1500 BILLS. AND THIS IS SIGNIFICANT BECAUSE THE MAJORITY OF THOSE BILLS DON'T HELP CITIES, UH, DO WHAT THEY'RE TRYING TO DO. THEY'RE VERY MUCH ABOUT PREEMPTING CITIES AND RESTRICTING THE ABILITY OF CITIES TO DO THE WORK THAT THEIR RESIDENTS HAVE ASKED THEM. UM, AND THEN IF YOU LOOK AT THE NUMBER OF CITY RELATED BILLS THAT HAVE PASSED AGAIN, THERE'S BEEN A SUBSTANTIAL INCREASE OF THAT. AND ON THE SIDE, YOU'LL SEE TWO BULLETS THAT SUMMARIZE THAT INCREASE OF ABOUT 182 MORE CITY RELATED BILLS HAVE PASSED IN THAT 10 YEARS ALONE. SO WE, WE FACE THE CLIMATE OF HAVING TO DEAL WITH A LOT OF LEGISLATION AND HAVE VERY DEFENSIVE MODE. UM, I KNOW THAT THIS COMMUNITY IS OFTEN SEEKING, UM, NEW LEGISLATION INITIATIVES, AND I APPRECIATE THAT, AND I WISH I COULD SPEND MORE TIME ON THAT AT THE SAME TIME. OUR OFFICE DOES HAVE TO DEDICATE A LOT OF TIME TO JUST, UM, KILLING BAD BILLS. SO NEXT SLIDE, PLEASE SLIDE THREE. UM, THIS SLIDE SHOULD SHOW YOU ALSO A SUMMARY OF WHAT WE DEAL WITH DURING SESSION, UH, SESSION BILL FILING, WE'LL SEE, NOVEMBER EARLY NOVEMBER SESSION WILL START IN JANUARY, BUT THEY HAVE UP UNTIL THE BEGINNING OF MARCH TO FILE BILLS. SO THEY HAVE A LOT OF TIME. AND AS YOU SEE ON THAT, HER SCHOOL AT LAST SESSION, THEY FILED ABOUT 4,000 BILLS JUST IN THE LAST 10 DAYS OF THE BILL FILING. AND SO MY DEPARTMENT HAS TO GO THROUGH ALL THOSE BILLS, ANALYZE THEM, ASK ALL THE OTHER CITY DEPARTMENTS TO HELP US ANALYZE THEM AND DETERMINE OUR LEGISLATIVE RESPONSE. AND THIS ALL HAPPENED LONG. WE'RE ALREADY STARTING TO HAVE HEARINGS. SO IT'S A VERY CHAOTIC, UM, SCHEDULE. AND I THINK SOME OF YOU ALREADY KNOW THAT, BUT THIS JUST GIVES YOU A SENSE OF WHAT THAT'S LIKE, UM, IN ACTUAL NUMBERS. NEXT SLIDE PLEASE. UM, I KNOW THERE'S A LOT OF TALKS ABOUT THE UPCOMING ELECTION AND WHAT THAT'S GONNA LOOK LIKE. THERE'S A LOT OF TALK ABOUT A BLUE WAVE AND WHAT THAT LOOKS LIKE MAY LOOK LIKE, OR MAY NOT. I DON'T, UM, WORK ON CAMP HAD NEVER WORKED ON CAMPAIGN HAIR PROGNOSTICATE ON THAT, BUT I CAN TELL YOU TWO THINGS THAT AREN'T GOING TO CHANGE, AND THAT'S WHY THAT THE GOVERNOR SEAT WON'T CHANGE, BUT I DOUBT IT WILL STILL BE OUR GOVERNOR. AND HE HAS GONE ON RECORD ON SAYING THAT HE THINKS THE STATE PREEMPTING LOCAL GOVERNMENTS IS A SUPERIOR APPROACH. UM, HE, IN FACT, THE ONLY SET SPECIAL SESSION HE'S EVER CALLED, YOU KNOW, WE'VE HAD A NUMBER OF, UM, MAJOR EVENTS IN TEXAS THAT OTHER GOVERNORS MIGHT CONSIDER CALLING A SPECIAL SESSION FOR THERE. WITH HURRICANE HARVEY. THERE WAS THE SHOOTING IN SANTA FE, OUTSIDE OF HOUSTON. THERE HAVE BEEN THE PAM DAMMIT AND THERE HASN'T BEEN A SPECIAL SESSION CALLED ON ANY OF THOSE ITEMS, BUT THE ONE SPECIAL SESSION HE HAS CALLED SO FAR, HE PUT 10 ITEMS ON THAT CALL THAT DEALT WITH CITIES AND RELATED TO ISSUES LIKE TREES AND TREE ORDINANCES AND PERMITTING AND SO FORTH. SO HE IS VERY INTERESTED IN WHAT WE DO AS A CITY. AND THE NEXT SIDE, PLEASE, TO STAFF WE'RE ON SLIDE FIVE. ALSO, PATRICK WILL CONTINUES TO BE THE LIEUTENANT GOVERNOR AND CONTROL THE TEXAS SENATE. AND SO THAT'S ALSO HASN'T CHANGED. UM, AND AGAIN, HE'S GONE ON RECORD TO SAY THAT HE SEES THIS FIGHT WITH CITIES AS A REPUBLICAN VERSUS DEMOCRAT SIDE. UM, AND HE ALSO LEADS ON VERY, UM, HEAVY ANTISEMITIC. NEXT SLIDE SLIDE SIX IS, UM, WE WILL HAVE A NEW SPEAKER. UM, [00:10:01] PART OF THAT HAS TO DO WITH IT. THE CURRENT SPEAKER, THE SPOT AND WHAT'S CAUGHT ON WAS RECORDED BY A MEMBER OF A POLITICAL ACTION COMMITTEE ASKING THAT COMMITTEE TO ATTACK MEMBERS OF HIS OWN PARTY WHO HAD VOTED AGAINST A BILL AFFECTING CITIES THAT HE DIDN'T LIKE. AND, UM, THESE ARE SOME OTHER THINGS HE SAID IN THAT RECORDING ABOUT CITIES, ABOUT MAYORS AND COUNTY JUDGES THAT MET WITH HIM WERE DUMB ASSES. AND I'M QUOTING HIM THOSE, AREN'T MY WORDS. THOSE ARE HIS. UM, AND SO WE'RE COMING OFF OF THAT TONE, BUT THERE WILL BE NEXT SLIDE, PLEASE. BY SEVEN, THERE WILL BE A NEW SPEAKER. THAT WILL BE THE FIRST THING THAT HOUSE WILL HAVE TO DO WHEN THEY COME TO ORDER. UM, WE'LL HAVE THE ELECTION RESULTS. WE'LL SEE WHAT THAT MEANS. WE'LL SEE IF THE NEW SPEAKER WILL BE FROM THE DEMOCRAT PARTY OR THE REPUBLICAN, WE ARE GOING TO HAVE SPECIAL SESSIONS CAUSE WE'RE, THEY'RE STILL GOING TO HAVE TO DO WITH DISTRICT DEAN AND THE NUMBER FROM THE FENCES WON'T BE AVAILABLE IN TIME FOR THEM TO DO THAT DURING THE REGULAR SESSION. UM, THEY'RE GOING TO HAVE TO DEAL WITH SCHOOL FINANCE AGAIN, BECAUSE UNFORTUNATELY FOR THEM THE BUDGET, THEY ALREADY SET UP A SYSTEM THAT WORKED HIM TO HAVE TO COME BACK TO DEAL WITH IT THIS SESSION. AND NOW WITH THE BUDGET WARS THAT THE NATION HAS SEEN FROM THE PANDEMIC, MAKE THAT ISSUE MORE DIFFICULT AND WILL AFFECT ALL THE OTHER, THE REST OF THE STATE BUDGET AS WELL. SO IT WILL BE WHAT'S CALLED A BUDGET SESSION ALSO PUT ON HERE. AND WE ALSO DON'T KNOW WHAT THE SESSION WILL LOOK LIKE WITH A PANDEMIC. WE DON'T KNOW IF THE WHOLE CARING REMOTELY, WE DON'T KNOW YET. IF THEY'RE NOT ALLOWED VOTING REMOTELY, WE DON'T KNOW HOW MANY PEOPLE THEY'RE NOT LET IN THE CAPITOL, IF AT ALL, UM, THESE THINGS ARE STILL TRYING TO DETERMINE. AND SO WE DON'T QUITE KNOW WHAT THIS SESSION'S GONNA LOOK LIKE BECAUSE OF THOSE FACTORS. I DO THINK IT'S GOING TO BE A GROWER SESSION. I DO THINK YOU'RE GONNA SEE LESS BILLS. THAT DOESN'T MEAN THEY'RE THE LESS BAD BILLS HAD THOSE OVERALL THAT GO THROUGH THE GETTY HEARING AND GO THROUGH THE SYSTEM. UM, NEXT BIWEEKLY. SO WITH THAT IN MIND, EVERY SESSION I GO TO COUNCIL AND I PUT THIS PYRAMID IN FRONT OF THEM AND I SAY, HERE'S THE ISSUES. THE LEGISLATURE IS ALREADY THE FINE THAT WE'LL HAVE TO DEAL WITH. UM, AND ALL OF THESE ISSUES ARE VERY DEFENSIVE. UM, SO RIGHT OFF THE TOP, WE HAVE, WHAT'S CALLED SUPER PREEMPTION. THERE'S BEEN A GROWING EFFORT AT THE LEGISLATURE CAN SAY, UNLESS YOU'RE SPECIFICALLY AUTHORIZED CITIES, YOU'RE NOT ALLOWED TO REGULATE IN AN AREA. UM, RIGHT NOW, IF A STATE DOESN'T SPEAK TO IT, CASE LAW AND, AND LAWS, THE CITIES CAN REGULATE IN THOSE AREAS. WELL, THIS BILL WOULD SAY, NO, YOU'RE GOING TO HAVE TO ACT BY COUNTY AND YOU'LL HAVE TO COME GET PERMISSION FROM US EACH TIME, EVERY TIME YOU WANT TO LET US LEGISLATE ON ANYTHING OR AN ACT ORDINANCES AND AREAS THAT AREN'T SPECIFICALLY ALREADY GIVEN TO YOU THAT WOULD HAVE AFFECTED A NUMBER OF THINGS. THE CITIES DO, EVEN THINGS RELATED TO, UM, REGULATING, YOU KNOW, FOOD CONTROL AT RESTAURANTS, OR EVEN SAY CARE, QUALITY, UM, EVEN BILLBOARD SIGNAGE, IT JUST IT'LL RUN THE GAMBIT OF THINGS. UM, BUT THAT BILL HAS BEEN FILED THE LAST TWO SESSIONS AND, AND GOT A HEARING IN THE HOUSE LAST SESSION, DIDN'T MAKE IT TO GOD OUT OF THE SENATE, GOT TO THE HOUSE, GOT A HEARING, DIDN'T MAKE IT TO THE HOUSE FLOOR, BUT, UM, IT'S OUT THERE. UM, YOU ALSO SEE, AND I'M SURE YOU'RE WATCHING IN THE MEDIA, THERE'S A LOT OF BACK AND FORTH BETWEEN THE GOVERNOR AND THE MAYORS OVER WHAT THE MAYOR NAN COUNTY JUDGES CAN DO WITH COVID RIGHT NOW, WHETHER THEY COULD HAVE MASS ORDINANCES OR SHE SAID, WE COULDN'T NOW, THEN HE SAID HE COULD. AND YOU KNOW, IT'S JUST ALL OVER THE PLACE. AND THEN THERE'S BEEN AN ELEMENT OF HIS PARTY ATTACKING HIM FOR ALLOWING SOME OF THOSE THINGS TO GO IN PLACE. AND THEY WANT TO HAVE PREEMPTION TO NOT ALLOW LOCAL GOVERNMENT TO REGULATE IN THIS AREA, EVEN THOUGH LOCAL GOVERNMENTS ARE RESPONSIBLE FOR A NUMBER OF PUBLIC HEALTH MATTERS. AND THAT'S WHY THE AUSTIN PUBLIC HEALTH DEPARTMENT, THE AUSTIN, TRAVIS COUNTY PUBLIC HEALTH DEPARTMENT IS THE LEAD AUTHORITY FOR US ON THIS ISSUE. BUT WE WILL SEE COVID PREEMPTION LEGISLATION. WE WILL SEE LEGISLATION PROPERLY AGAIN, RELATED TO EMPLOYEES, RIGHTS AND BENEFITS. AND THOSE ARE ISSUES RELATED TO THINGS LIKE PATE SICKLY. IT'S ALSO OUR NONDISCRIMINATION ORDINANCE. YOU GUYS PROBABLY REMEMBER NOT TOO LONG AGO, DAN PATRICK REALLY WANTED THAT BATHROOM BILL, UM, AND THAT AFFECTED OUR NONDISCRIMINATION ORDINANCE. UM, AND THEN LAST SESSION, HE WANTED TO HAVE SIMILAR LANGUAGE PUT ON THE PAGE FISCALLY FILL, WHICH WOULD HAVE AFFECTED OUR NONDISCRIMINATION ORDINANCE. AND SO, YOU KNOW, WE'LL SEE WHAT NEW WAY THEY'LL TRY TO ATTACK THOSE RIGHTS. UM, THERE'S ALSO BEEN A TAX ON OUR ABILITY TO RESOLVE. [00:15:01] I'M GOING TO COME BACK TO THE NO CITY LOGGING IN A MINUTE. UM, ALSO OUR ABILITY TO REGULATE WHAT'S CALLED THE EXTRA TERRITORIAL JURISDICTION THAT AFFECTS OUR WATER QUALITY. UM, WE HAVE A TAX ON OFTEN ENERGY AND OFTEN WATER BY BY FOLKS WHO WANT TO BE REGULATE THEM AND PRIVATIZED THEM, TAKE THEM AWAY FROM THE CITY OF AUSTIN, TAKE THEM AWAY FROM THE CITY OF AUSTIN, TAXPAYERS AND RATE WOULD'VE INVESTED IN THOSE UTILITIES. THEY WOULD LIKE TO PRIVATIZE THEM OR PUT THEM UNDER MORE STATE CONTROL. UM, AND THEN THERE'S LEGISLATION ON HOW WE'RE GOING, HOW WE MANAGE, HOW WE RAISE REVENUE. THERE WAS LEGISLATION FILED LAST THAT LIMITS THAT. AND THEN EVEN MORE RECENTLY, UM, THERE WAS, THERE'S BEEN A COMMENTS BY THE GOVERNOR ABOUT WHAT THE CITY HAS DONE WITH THE POLICE BUDGET. HE WANTS LEGISLATION FILED THAT WOULDN'T LIMIT THE ABILITY OF CITIES AND THEIR COMMUNITIES TO MAKE CHOICES ON THEIR LOCAL BUDGET. UM, SO THERE'S THAT. AND THEN LASTLY, THERE WAS A BILL LAST SESSION THAT, UM, GOT OUT OF THE SENATE, GOT THROUGH THE BACK TO THE HOUSE FLOOR AND, AND GOT VOTED DOWN ON A HOUSE FLOOR VOTE. AND I'LL TELL YOU, THAT'S RARE THAT THAT RARELY HAPPENS, BUT WHAT THIS BILL WOULD HAVE DONE, IT WOULD HAVE REALLY LIMITED HOW CITIES CAN PETITION THE STATE LEGISLATURE. AND WHAT DO I MEAN BY THAT? IT WOULD HAVE LIMITED US IN TWO WAYS, AND I HOPE WE'RE ONSITE EIGHT. I'M SORRY IF I HAVE NOT KEPT UP, BUT, UM, IT WOULD HAVE LIMITED IT BY SAYING ONE, UH, CITY OFFICIALS COULD ONLY SPEAK AT THE STATE LEGISLATURE IF THEY WERE ASKED A QUESTION BY A MEMBER OF THE LEGISLATURE, OR IF THEY'RE INVITED BY A COMMITTEE TO TESTIFY. SO RIGHT NOW WHEN THEY OPEN UP PUBLIC TESTIMONY, PUBLIC MEANS EVERYONE AND ANYONE, BUT THIS BILL WOULD HAVE LIMITED THAT, THAT IT WAS BEEN BY INVITATION ONLY. UM, AND THEN IT HAD ALSO SAY THAT WE COULDN'T HAVE A LOBBY TEAM. I DO HAVE A LOBBY TEAM FOR BOTH THE STATE AND THE FEDERAL. UM, THE CITY OF AUSTIN HAS A NUMBER OF BILLS. WE HAVE TO COVER A NUMBER OF REPRESENTATIVES WE HAVE TO REACH OUT TO. AND HONESTLY THIS JOB CAN'T BE DONE WITHOUT THAT. UM, OUR LOBBY TEAM IS A VERY SMALL COMPARISON TO SOME OF THE PRIVATE INTERESTS IN CORPORATION. WE HAVE TO GO UP AGAINST. UM, BUT WE DO HAVE THOSE THINGS AND THEY WANTED TO SAY THAT WE CAN NO LONGER HAVE THAT EITHER. SO IT WOULD, UM, SEVERELY LIMIT HOW CITIES COULD, WHO HAVE FOLLOWED THROUGH, ON WHAT THEIR RESIDENTS WANT, COULD THEN PETITION THE GOVERNMENT TO PROTECT THOSE INTERESTS. UM, NEXT SLIDE. SO HOW DO WE DEVELOP THE LEGACY OF IT? UM, AND THAT'S WHAT WE'RE WORKING ON RIGHT NOW. UH, WE, WE START WITH COUNCIL RESOLUTIONS THAT HAVE PASSED THROUGH THE PAST TWO YEARS AND ALSO, UH, OTHER PRIORITY ITEMS THAT THEY'VE DISCUSSED. UM, WE GET, UH, REVIEW AND INPUT FROM DEPARTMENTS.
