AND I SPECIFICALLY SENT YOU INFORMATION ABOUT A GENTLEMAN NAMED MAURICE JONES. HE'S AN ATTORNEY AND HE ALSO TESTIFIED MAY 17, 2018 BEFORE CONGRESS. SO HE HAS A GREAT DEAL OF EXPERIENCE IN THIS AREA IS THE JOINT ECONOMIC COMMITTEE CONGRESSIONAL HEARING. AND IF YOU LOOK AT THE EXAMPLE THAT I GAVE YOU THE ASSISTANCE MIXED USE DEVELOPMENT, AND IT SHOWS A, A MINI WALMART AND IT WAS AFFORDABLE HOUSING, I'M NOT SAYING THAT'S THE RIGHT ANSWER FOR EVERY OPPORTUNITY ZONE, BUT IT COULD ACTUALLY BE THE ANSWER FOR SOME OF THE ONES IN EAST BOSTON, AS OPPOSED TO SIMPLY MITIGATING THIS PLACEMENT. THE OTHER EXAMPLE THAT I WOULD CALL TO YOUR ATTENTION IS THE AM FORMER AIR FORCE BASE BOOK'S AIR FORCE BASE IN SAN ANTONIO. THEY WERE ONE OF THE FIRST IN TEXAS TO ACTUALLY BE DESIGNATED AS AN OPPORTUNITY ZONES. AND BEFORE THE DESIGNATION, THE COMMUNITY HAD ALREADY ENERGIZED AND THEY WILL BASICALLY READY TO ENGAGE IN A MIXED DEVELOPMENT, MIXED USE DEVELOPMENT PROCESS. THE LAST EXAMPLE I'LL GIVE YOU IS SPARTANBURG, SOUTH CAROLINA. I DON'T HAVE IT IN, I CAN SEND IT TO YOU, BUT THERE'S A $7.5 MILLION WAS ACTUALLY INFUSED IN THE AREA, WHICH WAS A FOOD DESERT. AND THEN IF YOU GO ONLINE, THERE'S A SEVEN MINUTE VIDEO OR SO, AND IT JUST SHOWS THE HEALTHY FOODS. SO THE AREA THAT COMES TO MIND FOR ME IS REALLY FM NINE 69, AS YOU'RE FAMILIAR WITH IT, IT'S A FOOD DESERT AND THEY HAVE A BROWNFIELD AREA THERE WHICH COULD ACTUALLY BE ENERGIZED. I DON'T THINK IT'S AN OPPORTUNITY ZONE, BUT THAT'S JUST AN EXAMPLE OF WHERE, UM, SOME TYPE OF MIXED USE DEVELOPMENT CAN HAPPEN. YOU DID HAVE AN OPPORTUNITY IS ON, ON MLK THOUGH, EAST MLK, WHICH IS A PROPERTY THAT WAS RECENTLY MADE RECENTLY WENT BEFORE COUNCIL. MY POINT IS THAT ALL TOO OFTEN, WHAT I SEE IS THAT THE DEVELOPERS ARE PRIMARILY RELYING ON THE LOW INCOME HOUSING TAX CREDITS. AND I JUST AM PERPLEXED AS TO WHY THEY'RE NOT TAKING ADVANTAGE OF THE DEFERRED TAXES THAT, YOU KNOW, IF YOU HAVE A LOT TO INVEST IN THE CAPITAL GAINS TAX DEPARTMENT WOULD SEEM TO BE AN IDEAL WAY TO GO. IT'S A WIN, WIN FOR THE COMMUNITY. IT'S A WIN, WIN FOR THE INVESTOR AS WELL. LASTLY, THE OTHER THING I WOULD ASK YOU TO CONSIDER HAVING ALL OF THE STAFF TALK ABOUT IS WHAT HOUSING AND I'LL JUST END THERE, BUT THAT DOESN'T, THAT I'M CARE IS FROM 2007 AND THE STAFF IS ABLE TO WAIVE THE TRANSIT ORIENTED, UM, PORTION OF SMART. SOME OF, YOU KNOW, I'M INVOLVED WITH THE SOUTHEAST COMPANY, THE STEEL VALLEY COMMUNITY, BECAUSE WE'RE, WELL, PART OF OUR STUDENTS ARE CONTACTING YOU GO TO DEL VALLEY ISD, BUT THE DEL VALLEY COMMUNITY APPROACH, THERE ARE CONTACTING, SEEKING ASSISTANCE TO HAVE A DEVELOPMENT OF A SMALL AREA PLAN BECAUSE THEY KNOW OF ALL OF THE GROWTH IS HAPPY IN THAT AREA. AND THEY WOULD LIKE TO BE PROACTIVE AND BE INVOLVED IN THAT PLANNING. SO JUST WANT TO SHARE THAT WITH THE END, THIS TIES INTO WHAT IS BEING PRESENTED BY MS. JOSEPH AND SUPPORTED BY COMMISSIONER KEY. SO THIS COMMENT IS RIGHT ON POINT, UM, YOU KNOW, WITH TESLA AND ALL OF THAT GROWING IN THE AREA, IT WOULD BE A GREAT OPPORTUNITY FOR THE COMMUNITY TO ACTUALLY HAVE A SAY. SO IN WHAT THEY WOULD LIKE TO SEE IN THEIR AREA, AS OPPOSED TO A DEVELOPER, GETTING EXCITED THAT TESLA'S COMING AND THEN, YOU KNOW, INFUSING ONTO THEM WHAT HE WANTS TO SEE, BUT THAT'S AN OPPORTUNITY ZONE IN THAT AREA THERE. WE NEED MORE AMENITIES IN CERTAIN, ALL THESE AREAS AND THE FOOD DESERT ISSUE IS IMPORTANT TOO. SO WHAT CAN WE DO AND WHAT CAN THE CITY DO? AND WHERE IS THE CITY RIGHT NOW? AND IT'S AN OB, YOU MIGHT BE THE BEST PERSON TO ASK FIRST, UM, BECAUSE WE DON'T HAVE CITY STAFF HERE TO ANSWER THAT, BUT WHERE DO THINGS STAND WITH THE CITY ON OPPORTUNITIES ZONES? YES. MADAM CHAIR OPPORTUNITIES ON THE ASKING YOU DETERMINED THEY WERE DETERMINED BY THE GOVERNOR, BUT, UM, MAYOR ADLER HAD INPUT INTO THE PROCESS. SO HE DESIGNATED AREAS THAT ARE REALLY SOUTHEAST. SO THE AIRPORT AREA, UM, AND THEN THERE'S NORTHEAST THAT ARE PREDOMINANTLY AREAS THAT ARE UNDERREPRESENTED, BUT, UM, YOU WILL FORGIVE ME FOR NOT HAVING THE EXACT NUMBER AND A HAND LIKE I USUALLY DO, BUT THEY'RE ARE ACTUALLY DESIGNATED AND THERE IS ACTUALLY A LEAK I CAN SEND TO YOU. AND THEN YOU CAN JUST PUT AN ADDRESS. AND SO AS CASES COME BEFORE YOU, YOU COULD AT LEAST TARGET THAT ADDRESS, JUST TYPE IT IN. AND THEN IT ACTUALLY COLORS THE MAP. AND YOU CAN SEE IF IT'S IN THE OPPORTUNITIES ON OR NOT, AND REALLY WHAT IT IS, IT'S THE TAX DEFERMENT. SO IT'S UP TO THE INVESTOR TO REALLY WANT TO DEFER TAXES. SO IF IT'S FIVE AND 10 YEARS, SO IN THE FIRST FIVE YEARS, IF THERE'S A QUALIFIED OPPORTUNITY, UM, IT'S, UM, YOU HAVE TO ACTUALLY SET UP THE ACCOUNT. SO WITH, IF THERE'S A QUALIFIED OPPORTUNITY FUND, THAT MONEY JUST SITS IN FOR FIVE YEARS, THEN THEY PAY ONLY 90% OF WHAT YOU KNOW OF THE RETURN. AND THEN IF IT'S SEVEN YEARS, IT'S 85% THAT THEY PAY. SO THEY GET A CUT EACH TIME. AND IF IT STAYS IN THAT ONE FOR 10 YEARS, THEN THEY COULD ACTUALLY ALMOST REALLY HAVE, YOU KNOW, IT COULD BALANCE OFF IF YOU GET ENOUGH TAXES, YOU KNOW, TAX CREDITS. AND SO THAT'S KINDA HOW IT WORKS. SO IT'S A REALLY BIG INCENTIVE, BUT THE DOWNSIDE FOR THE COMMUNITY IS THAT IF WE DON'T GET THOSE TAXES INTO THE FEDERAL GOVERNMENT, THEN IT COULD CUT INTO OTHER PROGRAMS BECAUSE THEY'RE REALLY THE, INVESTOR'S THE ONE THAT'S BENEFITING, YOU KNOW, CAUSE IT'S HIS OR HER MONEY, BUT THAT'S HOW IT'S ALREADY DESIGNATED. UM, IT'S BEEN SINCE 2017, IT'S THE TAX CUTS AND JOBS ACT OF 2017. AND THE BILL WAS SPONSORED BY CORY BOOKER. AND, UH, TIM SCOTT IN SOUTH CAROLINA IS ACTUALLY HIS AREA. AND THAT'S WHAT DREW ME TO THAT PARTICULAR EXAMPLE.
