UH, THIS IS UP FOR DISCUSSION AND, UH, HAVE A NOTE HERE THAT, UH, WE'LL VOTE ON THIS YAY OR NAYS, AND WE TC MAY NOT ADD CONDITIONS.

SO WITH THAT, UM, I'M GOING TO TRY TO QUICKLY REVIEW THE ITEMS THAT ARE ON CONSENT CHAIR, COMMISSIONER, MY SON, ANDREW RIVERA.

YES, SIR.

I'VE JUST BEEN INFORMED THAT THE APPLICANT FOR B NINE AND B 10 WISHES TO DISCUSS THE INDEFINITE POSTPONEMENT.

OKAY.

ALL RIGHT.

SO, SO WE WOULD HANDLE THAT AFTER THE CONSENT AGENDA, BEFORE WE REMOVED THOSE TWO FROM THE CONSENT AGENDA.

ALL RIGHT.

SO, OKAY, SO WE'RE GOING TO REMOVE NINE AND 10 FROM THE CONSENT, AND THEN JUST FOR CLARIFICATION, UH, MR. RIVERA WITH THAT, THEN WOULD WE JUST PULL THE US FOR DISCUSSION, DISCUSSION POSTPONEMENT? OKAY.

SO, ALL RIGHT.

OKAY.

UM, OKAY.

SO LET'S REVIEW THE CONSENT AGENDA.

SO

[Consent Agenda]

ON THE CONSENT AGENDA, AND WE HAVE, UH, ITEMS, THE ONE V2 V3 BEFORE, UH, BEING POSTPONED TILL NOVEMBER 24TH, WE HAVE B FIVE ON CONSENT.

WE HAVE THE SIX ON CONSENT.

THE SEVEN FOR CONSENT WILL BE EIGHT FOR CONSENT.

UH, WE'RE GOING TO TAKE OFF, UH, BENIGN TO BE 10 ON DISCUSSION FOR A DISCUSSION POSTPONEMENT.

WE HAVE, UH, B 11 IS FOR DISCUSSION.

WE HAVE B12 ON CONSENT AND WE HAVE POSTPONE UNTIL NOVEMBER 10TH.

AND, UM, B 14 IS WITHDRAWN THE 15 AS FOUND ON NOVEMBER 24TH AND THE 16 IS, UH, FOR DISCUSSION.

SO, UH, DO I HEAR ANY, UH, DO ANY COMMISSIONERS WISH TO PULL ANY OF THE ITEMS THAT I'VE LISTED FOR CONSENT APPROVAL? UH, YES, I HAVE.

I DON'T WANT TO PULL ANYTHING, BUT I DO HAVE A QUESTION ON B12, THE CONSENT FOR EVERGREEN AT MARY, IF THERE WAS, UM, IF STAFF COULD TELL US WHAT, UM,

[00:15:01]

HOW THE VOTE WENT ON FROM AN HISTORICALLY, UH, LAND COMMISSION ON THEIR RECOMMENDATION.

OKAY.

UH, DO WE HAVE STAFF AVAILABLE TO GIVE US A QUICK, I'M JUST CURIOUS ABOUT THAT, THAT, UH, IT PASSED ON CONSENT TO DELIBERATE.

THANK YOU.

OKAY.

SO TWO THAT ONE ON CONSENT, ANY OTHER, UH, QUESTIONS OR ITEMS? ALRIGHT.

I, UM, OKAY, SO WITH THAT, UH, CAN I HAVE A MOTION FOR THE, UH, TO APPROVE THE CONSENT AGENDA? UH, WHICH INCLUDES THE MINUTES CORRECTED MINUTES WITH THE OCTOBER 30TH DATE? UH, LET'S SEE.

UH, I SEE, UH, COMMISSIONER HEMPHILL.

DO I HAVE A SECOND? UH, COMMISSIONER IS, UH, CZAR AND I GUESS LET'S GO AHEAD AND VOTE.

OH, YES, I, UM, I OKAY.

YOU'RE CALLING IN, SO, OKAY.

YOU VOTE? YES.

AND JADA SPOLETO, I CANNOT SEE YOU EITHER HOLD THAT.

I WAS JUST GOING TO ASK, CAUSE I ACTUALLY WAIVED EARLY, EARLY ON AND I FIGURED YOU CAN'T SEE ME.

SO THIS IS ALWAYS A STRUGGLE FOR SOME REASON.

I DON'T EVER HAVE ISSUES EXCEPT CISCO AT PLANNING COMMISSION, BUT I'M HOLDING UP GREEN AND I'M GONNA SEE IF I CAN GET A STRONGER CONNECTION.

OKAY.

SO WE'VE GOT A UNANIMOUS APPROVAL OF THE, UM, INCENTIVE AGENDA, WHICH INCLUDES THE OCTOBER 13TH MINUTES.

ALL RIGHT.

OKAY.

UM, ALL RIGHT.

SO NOW, UH, WE HAVE AN ITEM FOR DISCUSSION POSTPONEMENT AND I GUESS A LITTLE HELP HERE, ANDREW.

I'M NOT SURE.

UM, THERE, IF THEY WANT TO, WHO IS, UH, WHO IS IN, UM, I GUESS STAFF IS WANTING TO POSTPONE THIS SURE.

COMMISSION.

YES, THAT'S CORRECT.

STAFF HAS REQUESTED, I BELIEVE THE APPLICANT A DATE SPECIFIC.

I'M NOT SURE.

ALL RIGHT.

SO LET'S, LET'S GO AHEAD.

UH, SO WE'RE GOING TO GO IN AND DISCUSS THIS

[Items B9 & B10]

DISCUSSION POSTPONEMENT FOR ITEM B NINE AND B 10.

AND, UH, JUST A REMINDER, WE'RE JUST GOING TO HEAR THE MERITS OF THE POSTPONEMENT AND NOT DELVE INTO ANY MERITS OF THE CASE.

AND, UH, SO STAFF, DO I GUESS NO INTRODUCTION HERE.

SO WE'RE JUST GOING TO HEAR FROM THE APPLICANT THEN, UH, QUICKLY FOR A COUPLE OF MINUTES.

UH, CAN YOU, UH, GO AHEAD AND DISCUSS THE, UH, UH, WHAT YOU'RE LOOKING FOR? SURE.

THIS IS RICHARD SETTLES.

CAN YOU HEAR ME OKAY? YES, I CAN HEAR YOU.

OKAY.

UM, MY NAME'S RICHARD SETTLE.

I'M HERE ON BEHALF OF THE APPLICANT AND THIS IS STATESMAN A REDEVELOPMENT BUD, AND THE REASON IT'S ACTUALLY A BED AMENDMENT TO AN EXISTING PUD AND THE RE THE WHOLE REASON FOR DOING IT IS WE'RE TRYING TO, UM, WE'RE TRYING TO IMPLEMENT THE SOUTH CENTRAL PLAN WITHOUT HAVING THE SOUTH CENTRAL PLAN IMPLEMENTING PLAN IN PLACE.

SO IT'S A COMPLEX, COMPLICATED CASE WE HAD WE'VE RECENTLY TURNED IN A SECOND ROUND OF COMMENTS TO STAFF COMMENTS, AND IT'S, LIKE I SAID, IT'S VERY COMPLICATED, BUT WE WERE A LITTLE DISAPPOINTED TO SEE THAT THE STAFF WAS RECOMMENDING AN INDEFINITE POSTPONEMENT, BECAUSE THAT MEANS THAT WE'RE PROBABLY LOOKING SOMEWHERE OUT PAST THE END OF THE YEAR.

I'VE SINCE TALKED TO THE STAFF AND TO DERRY.

AND IT'S, I THINK IT'S A MATTER OF, OF NOTIFICATION ISSUES.

AND, UH, JERRY CONVINCED ME THAT WE NEED TO HAVE NOTIFICATION GO OUT AGAIN ON THIS, BECAUSE IT'S BEEN SITTING AROUND FOR OVER A YEAR AND A HALF, BUT I WANTED TO AT LEAST GET THE CONVERSATION GOING AND AT LEAST GET SOME DIRECTION AS TO THE LOWER OR THE, THE OTHER, THIS IS GOING TO HAVE TO GO TO THE ENVIRONMENTAL BOARD.

YOU'RE PROBABLY GOING TO WANT TO SEE IT BEFORE THE ENVIRONMENTAL, SEE IT, BEFORE IT COMES TO YOU BY CODE, IT HAS TO GO TO THAT JOINT, SMALL AREA PLANNING COMMITTEE.

WE'D LIKE FOR THAT TO BE SCHEDULED, WHAT WE NEED IS SOME, SOME TRACTION AND SOME ENCOURAGEMENT THAT WE'RE ACTUALLY GOING TO START HEARING PROCESS.

[00:20:01]

OTHERWISE WE'RE GOING TO HAVE TO PULL THE NEW YEAR BUTTON UNDER 25 TO EIGHT OR WHATEVER IT IS, TWO 82, WHERE WE DEMAND A MEETING AND IT WON'T BE WRITTEN.

SO WHAT WE'RE ASKING FOR IS SOME ENCOURAGEMENT.

IF IT CAN'T BE AN INDEFINITE, I MEAN, IF IT HAS TO BE AN INDEFINITE POSTPONEMENT TO DO NOTICE, I UNDERSTAND THAT, I GUESS WE COULD ALSO PAY FOR NOTICE IF WE COULD GO SOONER OR, UM, I JUST WANT TO SEE WHAT FOR PERMISSION AND THAT'S MY TWO MINUTES.

SO FOR THIS ITEM, UH, UM, UM, MR. SETTLE, DO YOU HAVE ANYBODY ELSE THAT YOU WANT TO SPEAK TO THIS SIDE? NO, I FIGURED Y'ALL HAD A LONG ENOUGH NIGHT.

I DIDN'T WANT TO LINE THEM UP.

AND THEN I'M NOT A PLAYER, I GUESS, ON THE OPPOSITION TO THIS WOULD BE FROM STAFF.

SO, UH, COMMISSIONERS, SHOULD WE HEAR FROM STAFF ON WHAT THEY PROPOSE, UM, WHO DO WE HAVE THAT CAN SPEAK TO THIS ITEM MEMBERS? THIS IS JERRY AND PLANNING DEPARTMENT.

UM, THE REASON WAS THIS WAS AN FOR IN-DEPTH.

THE POSTPONEMENT IS THE CODE WILL EXPIRE THE CASE UNLESS IT HAS ACTION EVERY HUNDRED 80 DAYS.

SO WE'RE HERE FOR, FOR, UM, MR. AVERY'S THOSE TO KEEP THE CASE ALIVE.

UM, WE ARE NOT AT A POINT YET WHERE WE CAN, UM, EITHER RECOMMEND OR NOT RECOMMEND THE, UH, THE PUD APPLICATION.

UH, BUT MR. CELLO'S, RIGHT, THE CASE HAS BEEN AROUND FOR, UM, OVER A YEAR NOW.

UM, THERE'S A LOT OF BACK AND FORTH.

THERE'S A LOT OF MOVING PARTS ON THIS CASE BESIDES OBVIOUSLY A VERY IMPORTANT, UM, SITE TO THE CITY.

IT'S A VERY PROMINENT LOCATION, UM, AT TYRUS IN THE RIVER.

UM, I HAVE SPOKE WITH MR. EARLIER TODAY AND, UM, I DO AGREE WITH HIM THAT THE CASE NEEDS TO GET A MOVE ON.

UM, IT HAS BEEN AROUND FOR TOO LONG.

SO RIGHT NOW, THE BALL'S IN OUR COURT, THEY, THEY DID RESPOND TO, UM, OUR SECOND STAFF REPORT ABOUT TWO WEEKS AGO.

AND SO SHORTLY WE'LL BE GETTING THEM OUR RESPONSE TO THEIR, UM, UH, RESPONSE TO OUR ORIGINAL COMMENTS.

UM, AND, BUT I WAS COMMITTED TO DOING IS JUST SETTING UP MEETINGS WITH THE DIFFERENT DEPARTMENTS FACILITATED BY, UH, MYSELF AND THE CASE MANAGER TO TRY AND GET, UH, SOME OF THE ISSUES OF STANDING THAT ARE RESOLVED.

UM, AND TO GO AHEAD AND TRY AND GET THE CASE SCHEDULED FOR THE COMMISSIONS THAT MR. SUTTLE MENTIONED, UM, AS THOSE THINGS, UM, AS THOSE ISSUES, UM, GET TO A POINT THAT THEY'RE READY.

SO MAYBE WE CAN GO THE ENVIRONMENTAL BOARD, UM, SOONER RATHER THAN LATER.

UM, AND THEN UNDER THE, THE, UH, SOUTH CENTRAL WATERFALL OF THE SWAB, UH, SCHWAB AS WELL AS THE SUB COMMITTEE.

UM, SO WE'RE GOING TO TRY AND PUSH ON THE PEDAL A LITTLE BIT ON THIS ONE AND GET IT MOVING.

UH, WE'RE JUST NOT, I JUST CAN'T COMMIT RIGHT NOW.

THERE'S TOO MANY OUTSTANDING ISSUES TO COMMIT TO A DATE, BUT I DO COMMIT TO, UM, UM, GETTING THE CASE BACK ON TRACK.

OKAY.

UM, I WOULDN'T THINK WE HAVE ANY OTHER, UH, UH, SPEAKERS ON THIS, UH, THAT IS ANYBODY ELSE OUT THERE TO SPEAK TO THIS POSTPONEMENT.

SO I GUESS WE'RE GOING TO, LET'S GO AND MOVE INTO QUESTIONS ON THIS ONE.

UM, COMMISSIONERS ARE STANDARD, UH, COMMISSIONERS, AND YOU GOT FIVE MINUTES TO ASK QUESTIONS OF, UH, UH, THE OR STAFF.

DO WE HAVE ANY QUESTIONS? SURE.

COMMISSION LIAISON.

AND FOR, SO I HAVE MR. RUSSELL FRASER ON THE LINE, HE HAD SPOKEN, UH, HE HAD SIGNED UP IN CASE THE ITEM WAS GOING TO BE PULLED FOR DISCUSSION.

UM, BUT IF HE WISHES TO SPEAK ON THE POSTPONEMENT.

OH YEAH.

SO I SEE HERE, UH, SPEAKING SIGNED UP TO SPEAK AGAINST, UH, SO IS MR. FRASIER, DO YOU WISH TO SPEAK, UM, THE POSTPONEMENT? YES.

JUST A FEW WORDS.

THANK YOU.

MY GUY, UM, I RESIDE IN THE SOUTH CITY, SOUTH RIVER CITY NEIGHBORHOOD ASSOCIATION, WHICH IS INCLUDED IN THE GREATER SOUTH RIVER CITY COMBINED NEIGHBORHOOD PLAN.

WE'RE SORT OF THE GROUND ZERO NEIGHBORHOOD, UH, FOR IMPACT, UH, DUE TO THIS DEVELOPMENT.

UM, AND I JUST WANT TO REMIND, UH, UH, THE COMMISSION THAT, UM, YOU KNOW, LETTER IN A LETTER LAST YEAR, WE URGE

[00:25:01]

COUNCIL, UM, AND THE COMMISSION THAT THE QUOTE, THE FINANCIAL AND GOVERNANCE TOOLS MUST BE IN PLACE TO ENSURE THE VASTLY INCREASED DEVELOPMENT, ENTITLEMENTS, RESOLVING COMMUNITY BENEFITS.

AND, UH, ALSO I'D LIKE TO REMIND THE COMMISSION THAT THE SOUTH CENTRAL COALITION AND NEIGHBORHOODS SECTOR SEVEN, THAT'S WHERE OUR NEIGHBORHOOD IS SECTOR SEVEN ON AND SO ON SILK OR WHATNOT, UM, RESOLUTION, UH, TO THE COMMISSION AND COUNCIL, BUT PLANNING COMMISSION DEFER ANY ACTION ON ANY COMMANDMENT REQUESTS FOR THREE OH FIVE SOUTH CONFERENCE PROJECT UNTIL REGULATION AND FINANCIAL PLANS ARE COMPLETED BY THE CITY COUNCIL.

UM, SO, UH, THAT'S, THOSE ARE TWO PREVIOUS RESOLUTIONS AND LETTERS THAT HAD BEEN SENT.

ALSO, I'D LIKE TO MENTION THAT, UM, UH, WOULD IT BE POSSIBLE TO INCLUDE A TRAFFIC IMPACT ANALYSIS BEFORE ANY, UH, CONSIDERATIONS ARE MADE FOR THESE ZONING CHANGE AND, UH, FURTHER ENTITLEMENTS? OKAY.

UH, SO MR. FRAZIER, WE'RE JUST SPEAKING TO THE, UH, YOU KNOW, TO THE POSTPONEMENT ONLY, NOT THE MERITS OF THE CASE.

SO THAT'S ALL WE'RE HERE TO TALK ABOUT RIGHT NOW.

OKAY.

SO, UH, DID I HEAR, UH, MR. RUSSELL, THE NUMERATED, SOME OF THE, UH, THE NEXT STEPS IS, CAN I ASK IF TRAFFIC IMPACT ANALYSIS COULD BE INCLUDED IN THOSE, WHICH I THINK THEN THE MERIT.

OKAY.

YEAH.

I, I THINK THAT'S MORE, UM, OUTSIDE OF WHAT WE'RE LOOKING AT RIGHT NOW, SO WE'RE JUST ON WHAT, YOU KNOW, TO TAKE THIS UP NOW OR POSTPONE IT.

SO, UM, OKAY, WELL, THANK YOU.

UH, AND, UH, SO NOW I GUESS, LOOK, I THINK THAT'S ALL THE SPEAKERS, UM, SITTING ON MY LIST, SO LET'S GO AHEAD AND MOVE INTO QUESTIONS.

DO, UH, ANY OF THE COMMISSIONERS HAVE QUESTIONS FOR THE APPLICANT OR STAFF OR MR. FRASER, UH, COMMISSIONER YANNIS.

POLITO.

OKAY.

THAT MEANS YOU CAN SEE ME.

YES, I CAN.

I JUST HAD A BRIEF QUESTION.

I HOPE FOR STAFF, UM, IF THEY COULD SPEAK TO THE STATUS OF THE IMPLEMENTATION OF THE SOUTH CENTRAL, UH, WATERFRONT VISION FRAMEWORK AND WHERE THAT STANDS AND WHAT IMPLICATIONS THAT MAY HAVE, UM, FOR THIS CASE, NOT THE MERITS, BUT JUST POSTPONEMENT AND TIMELINE.

THIS IS JERRY WEST OVEN.

UM, THE IMPLEMENTATION, THE SOUTH CENTRAL WATER COMPONENT OBVIOUSLY HAS BEEN APPROVED BY THE COUNCIL.

UM, WHAT IS NOT DONE YET IS THE RIGHT LANE PLAN THAT GOES WITH IT, UH, THAT RAY LANE PLAN WASN'T BEING IMPLEMENTED AS A PART OF THE, UM, CODE REWRITE, WHICH OF COURSE IS, UM, TIED UP IN A LAWSUIT RIGHT NOW.

SO WE ARE STILL WORKING ON, UM, WHAT FORM THE, THE IMPLEMENTATION OF THE PLAN WOULD TAKE, UH, PENDING THE, UM, THE, OF COURSE DECISION ON THE CODE TO BE RIGHT.

IF I COULD ADD QUICKLY TO, UM, THERE IS A TRAFFIC IMPACT ANALYSIS TO GO WITH THIS CASE TO ADDRESS THE SPEAKER'S CONSENT.

UM, THAT IS ONE OF THE THINGS THAT IS STILL UNDER REVIEW ASK IF THE, AS A FOLLOWUP TO THAT, IF THE, I UNDERSTAND THAT THE VISION FRAMEWORK WAS I'M SORRY, THE REGULATING PLAN ADJUSTMENTS WERE TO BE WRAPPED UP IN THE COMPREHENSIVE REWRITE, BUT IS THERE ANYTHING PRECLUDING THE COUNCIL FROM TAKING ACTION TO, UH, AMANDA ABOUT REGULATING PLAN OR ADOPT IT ACCORDINGLY? UM, AS A STANDALONE ITEM, UM, I CAN'T GET INTO TOO MUCH LEGAL DETAIL ONE BECAUSE I'M NOT A LAWYER AND TWO WHERE WE'RE NOT IN THE EXECUTIVE SESSION, BUT, UM, A PART OF THE ISSUE OR PART OF THE CONCERN DOES HAVE TO DO WITH THE ISSUES THAT WERE RAISED IN THE LAWSUIT WITH REGARD TO HOW CODE AMENDMENTS ARE HANDLED, UM, WOULD APPLY TO, UM, THE ADOPTION OF A NEW REGULATING PLAN.

SO ANY FURTHER QUESTIONS, COMMISSIONER.

OKAY.

ANY OTHER, UH, COMMISSIONERS HAVE QUESTIONS? YEAH.

UM, UH, OKAY, SO I'M, I DID SEE HERE THERE'S ONE OTHER SPEAKER AND, UH, I MISTOOK, I THOUGHT THIS WAS A STAFF.

IT IS NOT.

SO IS THERE A WINDY TIME PRICE ON THE LINE?

[00:30:02]

UH, STAR SIX TO UNMUTE.

OKAY.

SO I THINK THEY HOPEFULLY DID NOT WANT TO SPEAK TO THE POSTPONEMENT.

OKAY.

SO, UH, I GUESS THIS ONE WE'RE NOW GOING TO, UH, NEED TO, UH, VOTE ON AND DO I HAVE A MOTION ON THE POSTPONEMENT, UH, COMMISSIONER AZAR MAKE A MOTION.

OKAY.

DO I HAVE A SECOND? UH, UH, CAUSE AT THE SECOND BY COMMISSIONER, LEON IS POLITA SO, UM, UH, LET'S GO AHEAD AND, OH, DO WE HAVE ANY DISCUSSION ON THIS ONE? IF I CAN JUST SPEAK? I THINK I, IF I COULD JUST SPEAK TO THE MOTION, I JUST WANT TO SAY, ARE YOU HERE? UM, MR. S UH, I FORGOT THE NAME, BUT ESSENTIALLY I HEAR THE CONCERN ON POSTPONING IT INDEFINITELY.

I REALLY HOPE THAT STAFF THINKS OF IT OUT AND THEN INFORM DRESSED AS SOON AS POSSIBLE.

AND WE CAN EXPEDITE THIS CONSIDERING THAT THEY HAVE BEEN READING AND HAVE SHOWN PATIENTS.

SO I APPRECIATE THEIR PATIENTS AND ASK FOR A LITTLE BIT MORE AND HOPEFULLY STAFF AND HELP US RESOLVE THIS AS SOON AS POSSIBLE.

OKAY.

ANY COMMISSIONERS, UH, AGAINST, UH, HEARING NONE, UH, COMMISSIONER YANEZ, PALITO, WOULD YOU LIKE TO SPEAK TO YOUR SECOND? UH, I WOULD LOVE TO DO SOME FOLLOW-UP WORK TO SEE HOW THIS CAN BE MOVED ALONG.

UM, BUT ALSO VERY CURIOUS ABOUT THE REGULATING PLAN ASSOCIATED WITH THE WATERFRONT, UH, VISION FRAMEWORK.

UM, BECAUSE I DO THINK THAT THAT'S, UH, THAT'S POTENTIALLY CHANGES TO THE CODE THAT COULD BE MADE WITHOUT, UM, GETTING INTO A LAWSUIT TERRITORY.

SO I, I WOULD LOVE TO SEE HOW THAT CAN PLAY OUT AND HOW WE CAN GET THIS MOVING ALONG.

OKAY.

OKAY.

UH, WELL, LET'S GO AHEAD AND VOTE ON THE MOTION, UH, FOR, UM, INDEFINITE POSTPONEMENT AS REQUESTED BY STAFF.

UM, UH, THE MOTION MADE BY COMMISSIONER SECONDED BY COMMISSIONER IS TOLEDO.

UH, GO AHEAD AND DOES IN FAVOR AND, UH, OKAY.

I HEAR YOU COMMISSIONER SEGER.

SO THAT'S 11 ZERO, UH, IN FOR THAT, UH, ON THAT DISCUSSION POSTPONEMENT ITEM THAT'S, UH, ITEMS WE'LL NOW GO FOR INDEFINITE POSTPONEMENT.

ALL RIGHT.

SO WE CLEARED THAT OFF.

SO LET'S GO TO THE NEXT ITEM.

AND, UH, IF I'M CORRECT, THAT WOULD BE ITEM

[B11. Rezoning: C14-2020-0093 - 4329 S Congress Ave; District 3]

A, B 11 IS OUR NEXT DISCUSSION ITEM.

SO IF WE COULD START WITH THE, UM, UH, LET'S SEE.

YEAH, IT'S JUST B 11.

AND WE'LL START WITH THE STAFF INTRODUCTION HERE.

DO WE HAVE, UH, FROM S STAFF, UH IT'S UM, THIS IS WENDY ROSE WITH HOUSING AND PLANNING DEPARTMENT.

AND TO INTRODUCE THIS PACE, UH, THIS, THIS IS A, UH, TRACKED ON SOUTH CONGRESS AVENUE.

IT HAS HAD AT CS, M U N P ZONING SINCE AUGUST OF 2005.

THERE, THERE ARE COMMERCIAL USES AND APARTMENTS ALONG BOTH SIDES OF CONGRESS.

UH, THIS, THE STAFF IS RECOMMENDING THIS PROPERTY FOR CS, M U V N P AS IT IS LOCATED ON A CORE TRANSIT CORRIDOR.

AND THERE ARE OTHER RECENTLY CONSTRUCTED A CONDOMINIUM AND MULTI-FAMILY RESIDENTIAL PROJECTS ON THIS STRETCH OF SOUTH CONGRESS.

UH, TO THAT END, THE APPLICANT HAS BEEN MEETING WITH THE SOUTH CONGRESS COMBINED NEIGHBORHOOD PLAN CONTACT TEAM, AND THAT IS THE CONCLUDES MY I'M AVAILABLE FOR QUESTIONS.

THANK YOU.

ALL RIGHT.

THANK YOU, MS. RHODES.

AND, UM, NOW WE'LL HEAR FROM THE APPLICANT.

UH, I HAVE, UH, AMANDA'S FLOOR.

UH, LET ME KNOW WHEN MY IS PULLED UP.

I WILL GLADLY START RUNNING THROUGH THIS PRESENTATION.

OKAY.

WE'RE NOT.

OH, THERE WE GO.

THIS 10% OF THE UNITS AT 80% MEDIAN FAMILY INCOME DOES NOT COME WITH THE REQUIREMENTS TO PROVIDE A MIX OF AFFORDABLE UNIT.

WHEN WE SUBMITTED THE REASON YOUR CLASS, WE REACHED OUT TO THE NEIGHBORHOOD SEND CONTACT TEAM.

AND AS PART OF THE DISCUSSIONS THAT WE HAVE HAD OF THE CONTACT TEAM, WE WERE ASKED IF WE COULD PROVIDE DEEPER LEVELS OF AFFORDABILITY ALONG THE CORRIDOR PROJECT IS PROPOSING TO RESERVE 5% OF THE ON-SITE AFFORDABLE HOUSING UNIT FOR HOUSEHOLDS EARNING NO MORE THAN 80% OF THE MEDIAN FAMILY INCOME, BUT THE OTHER 5% OF THE ON-SITE AFFORDABLE HOUSING UNIT WAS THERE FOR HOUSEHOLD EARNING NO MORE THAN 50% OF THE MEDIAN FAMILY INCOME.

IN ADDITION TO PROVIDING 5% OF THE UNIT AT AN AFFORDABLE RATE THAT IS SIGNIFICANTLY BELOW WHAT IS REQUIRED BY CODE THE DEVELOPER IS ALSO COMMITTING TO PROVIDE ALL OF THE ONSITE AFFORDABLE UNITS WITH A MIX OF AFFORDABLE UNIT, BUT DISPROPORTIONATE TO THE UNIT MIX OF THE PROJECT.

THESE AFFORDABLE HOUSING REQUIREMENTS WILL BE MEMORIALIZED.

YES, PRIVATE RESTRICT HIS COVENANT WITH A THIRD PARTY PRIOR TO THE CASE BEING PRESENTED AT CITY COUNCIL.

AND WITH THAT, I'M HAPPY TO PAUSE AND ANSWER ANY QUESTIONS.

OKAY.

THANK YOU.

AND, UH, NEXT WE HAVE SPEAKING NEUTRAL, UH, IS MARIO KENTU.

ARE YOU ON THE LINE, UH, STAR SIX TO UNMUTE BY MARIO CANTU? YES, SIR.

OKAY.

ALL RIGHT.

WE CAN HEAR YOU.

HOW LONG DO I HAVE,

[00:40:02]

HOW LONG DO I HAVE ON TIME? UH, OH YES, YOU HAVE, UH, THREE, UH, FIVE MINUTES.

OKAY.

OKAY.

THANK YOU.

MY NAME IS MARIO CANTU.

I'M WITH THE SOUTH CONGRESS CONTACT TEAM, UH, CHAIR OF THE CONTACT TEAM.

AND, UH, JUST WANT TO SAY, UM, TO TONIGHT I'VE NOTICED THERE'S A LOT OF NEW FACES ON THE PLANNING COMMISSION, AND I WANT TO THANK EACH AND EVERY ONE OF Y'ALL FOR YOUR SERVICE ALSO WANT TO THANK, UH, FIRST RESPONDERS, HEALTHCARE WORKERS THAT ARE STILL IN ESSENTIAL WORKERS THAT ARE STILL ON THE FRONT LINES AND DOING THINGS RELATED TO COVID-19.

UH, WITH THAT SAID, I JUST WANT TO BRING BACK THE SURFACE A LITTLE BIT, THAT WE ALL NEED TO UNDERSTAND THAT WE STILL HAVE A LOT OF PROBLEMS GOING ON WITH COVID-19 IN REGARDS TO INDIVIDUALS THAT ARE HAVING A HARD TIME PAYING RENT.

UH, THEY'RE HAVING TO LIVE HOUR BY HOUR, DAY TO DAY, UH, WHEN IT COMES TO FOOD AND RENT.

UH, AND WE, WE RECOGNIZE THAT AS A CONTACT TEAM, YOU KNOW, WE SEE IT ON TV, WE HEAR ABOUT IT.

WE ENCOUNTER PEOPLE ABOUT IT.

AND EVEN BEFORE COVID-19 SO HAD THESE PROBLEMS GOING ON AND IT'S NOTHING NEW, IT'S JUST, UH, IT'S JUST COMPOUNDED MORE.

AND IT'S BEEN BROUGHT TO THE SURFACE MORE WITH COVID-19, WHICH, UH, HAS PRESENTED THE PROBLEMS THAT WE NEED TO RECOGNIZE.

AND WE ACTUALLY DO SOMETHING ABOUT, AND AS A CONTACT TEAM, THAT'S WHAT WE'RE STRIVING TO DO WHEN IT COMES TO AFFORDABILITY AND AFFORDABLE HOUSING.

UH, WE RECOGNIZE THAT, UH, AT THE 80% MFI, YOU KNOW, TARGET SOMEBODY THAT'S MAKING AN 80 TO $90,000 RANGE.

UH, SO, YOU KNOW, WE LOOK AT THE REALLY LOWER PERCENTAGES AT 50% TO 60% NFI.

AND JUST SO YOU KNOW, THAT THE NEIGHBOR NEXT DOOR TO THIS PROJECT, UH, WAS THE LAST ONE THAT WE WORKED WITH.

UH, THEY GAVE 50% MFI AND 60% MFI FIVE AND FIVE, A TOTAL OF 10 SPLIT.

SO, YOU KNOW, WE'RE, WE'RE CONTINUING TO WORKING WITH THE DRAENOR GROUP, UH, AMANDA AND HER TEAM.

IT'S A REALLY GOOD TEAM.

WE'VE BEEN IN CONVERSATIONS WITH THEM.

WE APPRECIATE THEIR TIME AND THEIR HELP, AND WE CONTINUE TO STRIVE TO DO THAT.

BUT ANOTHER PROBLEM IS THE TRAFFIC.

UH, YOU KNOW, BASICALLY YOU'RE, YOU'RE TAKING LIKE HALF OF BARTON CREEK MALL AND YOU'RE SMASHING IT ALL TOGETHER.

AND JUST ONE TOE AREA OF THE INDUSTRIAL, UH, PART OF SOUTH CONGRESS WITH MANY PEOPLE IN MANY CARS.

SO, UH, THAT THAT'S A PROBLEM.

AND WE WANT TO MAKE SURE THAT WE DON'T HAVE BIGGER PROBLEMS AS THINGS PROGRESS WITH THE, ANY ONE OF THESE DEVELOPMENTS THAT ARE BEING KIND OF PUSHED INTO THIS ONE AREA.

SO THE TIA IS, UM, WE'RE STILL IN TALKING WITH THE DRAENOR GROUP ABOUT THAT AND WHEN IT COMES TO TRAFFIC.

SO, UH, OTHER THINGS I'VE WANTED TO MENTION IS THAT WE DID TALK TO THEM ABOUT THE ADULT WARRANTY BUSINESSES, THAT THOSE ARE PART OF THE ZONING THINGS THAT, THAT COME WITH THIS ZONING, UH, ALTERNATIVE FINANCIAL SERVICES THAT INCLUDES PAYDAY LOANS, DELBANCO SERVICES AND OUTDOOR ENTERTAINMENT THAT WE WOULD NOT LIKE TO HAVE THAT IMPLEMENTED WITH THE ZONING.

UM, AND THEN ALSO WHAT ALSO CAME TO SURFACE WAS THE RENT SUCH AS SECURITY AMENITIES, PARKING, ET CETERA.

SO WHAT HAPPENS IS A LOT OF TIMES WHEN THESE INDIVIDUALS, UM, GO IN AND RENT ONE OF THESE CONDOS OR UNITS, THEY'RE PLAGUED BY A LOT OF THESE, UH, UH, RENTAL FEES AND STUFF LIKE THAT.

SO WE WERE ALSO TALKING WITH THEM ABOUT THAT AND MAYBE HOPEFULLY KIND OF WORKING SOME THINGS OUT.

UH, SO THAT'S BEEN A VERY, VERY WELL TAKEN UPON THE TURNER GROUP AND AMANDA AND THEM.

AND I THINK THAT'S GOING TO BE ABOUT IT.

UM, AFFORDABILITY IS OUR BIGGEST THING.

UH, YOU KNOW, WE'RE STRIVING TO, TO GET THE NUMBERS WHERE WE REALLY, REALLY NEED THEM BECAUSE, UH, AGAIN, YOU KNOW, SINGLE MOM WITH A CHILD, UH, MOM AND DAD, JUST TO FOLLOW YOURSELF, HAVING PROBLEMS NOWADAYS.

AND, UH, YOU KNOW, THAT WE LOST A LOT OF HOUSING STOCK IN THE PAST, IN THIS PARTICULAR AREA.

AND, YOU KNOW, I THINK WE NEED TO GET BETTER AND BETTER WHEN IT COMES TO THIS, UH, HOUSING STOCK OF AFFORDABILITY FOR THE FUTURE, BECAUSE, UH, YOU KNOW, COVID-19 IS GOING TO PRODUCE SOME, SOME THINGS THAT WE PROBABLY DON'T WANT TO SEE, BUT WE'RE GOING TO HAVE TO DEAL WITH NO MATTER WHAT, WHEN IT COMES TO INDIVIDUALS LOSING THEIR HOMES AND WHERE THEY'RE GOING TO HAVE TO USE THIS LOW AFFORDABILITY WHEN IT COMES TO THESE NUMBERS AND HOPEFULLY PUTTING SOME NEW INDIVIDUALS IN MOST LOCATIONS.

THANK YOU.

THANK YOU, MR. KENTU.

AND SO THAT CONCLUDES OUR SPEAKERS ON THIS ITEM.

AND SO WE'LL GO INTO A PLANNING COMMITTEE, I GUESS WE'RE GONNA CLOSE THE PUBLIC HEARING IS THE FIRST STEP, UH, SHALL I HAVE A FUNCTION? YES.

REBUTTAL PLACE.

OH, THANK YOU.

I ALMOST MISS THAT.

UH, APPLICANT REVITAL.

SORRY ABOUT THAT.

UH,

[00:45:01]

THAT WOULD BE A AMANDA S FOUR OR IF YOU'RE STILL ON THE LINE.

YES.

SURE.

THANK YOU FOR THE OPPORTUNITY TO PROVIDE HER, BUT I'LL, UH, I WOULD JUST WANT TO START BY THANKING MARIO FOR TAKING THE TIME TO SIGN UP AND SPEAK.

WE'VE REALLY ENJOYED THE OPPORTUNITY TO WORK WITH THEM IN THE NEIGHBORHOOD, HIM IN THE NEIGHBORHOOD PLAYING CONTACT GAME.

I WOULD JUST ADDRESS A COUPLE OF THE POINTS, UH, IF THE COMMISSION AS WELL, WE HAVE BEEN WORKING AND STARTED THE PROCESS WITH AUSTIN TRANSPORTATION DEPARTMENT TO GO WITH, UM, TRAFFIC MITIGATION IN THE AREA THAT TIA AND TIA MITIGATIONS WERE DEFERRED TO THE TIME OF FLIGHT PLAN, GIVEN THE CURRENT CONDITIONS OF THE MARKET.

AND THEN, UH, MR. KENJI BROUGHT UP A WONDERFUL POINT ABOUT THE PARKING COSTS THAT ARE ASSOCIATED WITH AFFORDABLE HOUSING.

AND IT'S ONE OF THE ITEMS THAT I DIDN'T MENTION IS THAT IN ADDITION TO PROVIDING THE ON-SITE AFFORDABLE HOUSING AT A HIGH PERCENT AT 80% AND 5% AT 50%, THE DEVELOPER HAS ALSO AGREED TO REDUCE, UM, THIS WILL BE A PROJECT AS MOST ARE THESE DAYS WHERE PARKING SPACES ARE DECOUPLED AND RENTED SEPARATELY FROM A UNIT.

AND THAT THOSE PARKING SPACES WOULD BE THE FEES WOULD BE REDUCED PROPORTIONATELY TO THE REDUCTION IN, IN RENT, UM, BASED ON THE AFFORDABLE HOUSING COMPONENT.

THEN, UM, WITH THAT, I'M HAPPY AGAIN, TO ANSWER ANY QUESTIONS AND REALLY STATE THE COMMISSION ABILITY TO LET US FOR THEM.

OKAY.

UH, SO THAT, UH, DO I HAVE A MOTION TO CLOSE THE PUBLIC HEARING? I SEE, UH, UH, COMMISSIONER SCHNEIDER SECOND BY COMMISSIONER.

WAS THAT ANDERSON SECOND.

OKAY.

UH, SO LET'S GO AHEAD AND, UH, UH, IT'S GOING TO TAKE A VOTE ON THAT.

LET'S SEE YOUR GREEN AND COMMISSIONER CIGARETTES.

YES.

ALL RIGHT.

I'VE GOT IT.

ALL RIGHT, THANKS.

SO THAT'S UNANIMOUS 11 ZERO, AND NOW WE'LL GO INTO OUR, UH, ROUND ROBIN QUESTIONS.

UM, DO I HAVE A FIRST COMMISSIONER WITH, UH, A QUESTION ON THIS ITEM? ANYONE? OKAY.

SO DO I HAVE A MO OH, I SEE.

UH, COMMISSIONER SCHNEIDER.

DID YOU HAVE A QUESTION? OKAY.

UH, YEAH, I THINK IT'S FOR, UH, FOR MS. SWORE, UM, THE, UH, THE NEIGHBORHOOD CONTACT TEAM MENTIONED SOME PROHIBITED USES, UM, I THINK LIKE ADULTS ORIENTED BUSINESSES AND, UM, ALTERNATIVE LENDERS, UH, IS THAT SOMETHING THAT YOU'VE HAD DISCUSSIONS WITH THEM ABOUT AND IS THAT AGREEABLE TO YOU? YES, SIR.

THANK YOU VERY MUCH FOR ASKING THE QUESTION.

WHEN I STOPPED TALKING, I REALIZED I HADN'T BEEN ADDRESSED THAT POINT.

UM, WE ARE AMENABLE TO ALL OF THE USES THAT THE NEIGHBORHOOD CLAIM CONTACT TEAM HAS ASKED TO BE INCLUDED IN THIS.

I KNOW THEY SENT YOU A LETTER WITH THAT, AND IF IT'S THE WILL OF THE COMMISSION, WE ARE SUPPORTIVE OF ADDING THOSE PROJECTS.

THANKS.

UM, AND, UH, UH, FOR MR TO, UM, UH, I THINK YOU MENTIONED A DOVE ORIENTED BUSINESSES, ALTERNATIVE LENDERS, AND WAS THERE SOMETHING ELSE OUTDOOR, UH, ENTERTAINMENT? I THINK THAT WAS RIGHT.

DOES MARIO, DID YOU HAVE TO HEAR MY QUESTION? YES, SIR.

SO A DARK ADULT FOR TWO BUSINESSES, UH, ALTERNATIVE FINANCIAL SERVICES.

THIS INCLUDES PAYDAY LOANS, BAIL BOND SERVICES, AND OUTDOOR ENTERTAINMENT.

THANKS.

ANY FURTHER QUESTIONS? COMMISSIONER CENTER.

OKAY.

UH, ANY OTHER COMMISSIONERS HAVE QUESTIONS? UH, OKAY.

COMMISSIONER CONLEY.

UH, WHO DO YOU, UH, JUST LET US KNOW.

YOU WANT TO TALK? OKAY.

I HAVE A QUESTION FOR, I GUESS, FOR BOTH, BUT I GUESS FOR AMANDA SWORE.

OKAY.

UM, I JUST WANTED TO, YOU KNOW, I MEAN, FIRST OF ALL, I THINK IT'S, YOU KNOW, IT'S UNFORTUNATE THAT WE DON'T HAVE THE NEW LAND DEVELOPMENT CODE BECAUSE WITH THE NEW CODE, WE REALLY WOULDN'T HAVE A REQUIREMENT FOR MUCH MORE AFFORDABILITY ON THIS SITE, UM, AS PART OF NEW TEXTS.

SO IT'S REALLY SAD THAT WE'RE LOSING THAT AFFORDABILITY.

BUT MY QUESTION IS, UM, HAS THERE BEEN SOME CONVERSATION ABOUT, UH, TO ARRIVE AT THAT NUMBER OF, UH, 5% FOR 50? AND I WOULD JUST WANTED TO UNDERSTAND WHAT, WHAT, WHAT THE REASONING THERE WAS

[00:50:03]

ABSOLUTELY COMMISSIONER.

SO WE WE'VE BEEN WORKING FOR THE LAST, UH, I, ONE OF THE, IT'S PROBABLY BEEN A MONTH TO SIX WEEKS WITH THE CONTACT TEAM, REALLY SEEING WHAT LEVEL OF AFFORDABILITY THAT WE COULD GET TO.

AND WE HEARD THEM LOUD AND CLEAR THAT THEIR PREFERENCE IS TO GET TO THOSE LOWER LEVELS OF AFFORDABILITY.

WE LOOKED AT.

WAS THERE AN OPTION TO ADD MORE AFFORDABILITY AT AN 80% LEVEL, OR HAVE THE LEVEL OF AFFORDABILITY THAT WOULD ALLOW FOR THERE TO ACTUALLY BE ONE AND TWO BEDROOM UNITS AT THAT 50% MEDIAN FAMILY INCOME VERSUS JUST ONE BEDROOMS. AND SO THAT'S WHERE WE LANDED TO THAT.

WE'RE GETTING TO THAT 5% AT 50%, BUT ALLOWING US TO PROVIDE THE MIX OF UNITS FOR BOTH THE 5% AT 80% AND 5% AT 50% TO PROVIDE BOTH ONE AND TWO BEDROOMS UNITS AT THAT AFFORDABILITY LEVEL.

THANK YOU.

AND ONE MORE QUESTION, UH, WAS, UH, WAS THE POSSIBILITY OF, UH, 60% UNITS, UH, EVER PART OF THE DISCUSSION.

IT WAS A COMPONENT THAT WE TALKED ABOUT AT ONE POINT IN TIME, BUT WE DEFINITELY HEARD THE CONTACT TEAM THAT GETTING TO THAT 50% LEVEL WAS THEIR DESIRE AND TO REACH 5% AT 50%, THE OTHER 5% NEEDED TO REMAIN AT THE 80% THRESHOLD.

OKAY.

UM, YEAH, I THINK THAT'S IT.

I THINK THAT ANSWERS IT FOR NOW.

THANK YOU.

OKAY.

THANK YOU, CHAIR.

UH, COMMISSIONER CONLEY.

UM, AND IF THERE'S YES, COMMISSIONER ANDERSON, WE HAVE APPROVAL.

OKAY.

COMMISSIONER ANDERSON MAKES A MOTION FOR APPROVAL OF, WOULD THAT BE STAFF RECOMMENDATION? OKAY.

DO WE HAVE A SECOND, SECOND, UH, UH, COMMISSIONER HEMPHILL, UH, FOR AN AMENDMENT.

OKAY.

UH, IN A MINUTE.

OKAY.

YES, AN AMENDMENT, UH, TO ADD, UH, PROHIBITED USES OF ADULT ORIENTED BUSINESSES, ALTERNATIVE FINANCIAL SERVICES, INCLUDING BAIL BONDS AND PETTY LENDERS.

AND, UH, AFTER ENTERTAINMENT, QUICK QUESTIONS FOR STAFF.

WOULD THAT BE A, UH, HOW WOULD THAT BE DONE? THAT WOULD BE DONE THROUGH A CONDITIONAL OVERLAY.

THIS IS WENDY RHODES, THE CASE MANAGER.

SO I GUESS I'M HEARING THAT IS AN AMENDMENT.

DO WE HAVE A SECOND, UH, FOR THE AMENDMENT I WAS HERE A SECOND FROM COMISARY ON IS PALITO.

UH, DO WE WANT, UH, SO DISCUSSION, UH, COMMISSIONER SCHNEIDER, DO YOU WANT TO SPEAK TO YOUR PROPOSED AMENDMENT? UH, THANKS.

UM, I, UH, I HAVE GREAT RESPECT FOR THE, UM, ALL THE WORK THAT THIS, UH, NEIGHBORHOOD CONTACT TEAM HAS DONE.

THEY'VE REALLY WORKED IN GOOD FAITH ON A NUMBER OF, UH, PROPOSALS ALONG SOUTH CONGRESS AND WORK TO IMPROVE AFFORDABILITY.

AND, UH, AS THE PEOPLE WHO LIVE THERE, I THINK, UM, THEY ARE IN A, IN A REALLY GOOD POSITION TO APPRECIATE THE CONCERNS OF NEIGHBORS AROUND CERTAIN SORTS OF BUSINESSES.

I KNOW WE HAVE SOME CONCERNS ABOUT ADDING CONDITIONAL OVERLAYS, BUT GIVEN WHERE WE ARE NOW WITH THE LAND, UH, CODE, UM, THIS IS THE WAY THAT WE CAN DO IT.

SO, UM, JUST TO RESPECT THE WISHES OF THE NEIGHBORHOOD AND UNDERSTANDING THAT THE APPLICANT HAS NO CONCERNS ABOUT THESE RESTRICTIONS, I, UH, WOULD OFFER IT UP.

OKAY.

UH, DO WE HAVE ANY ONE SPEAKING AGAINST THIS AMENDMENT COMMISSIONER ANDERSON? YOU HAVE ONE MINUTE GOOD IN IT.

I GET IT.

UM, IT'S JUST ANOTHER CONDITIONAL OVERLAY WAS JUST NASTY AND IT'S JUST A WHOLE NEW ZONING CATEGORY.

IT'S A WHOLE NOTHER THING THAT GETS STUCK IN OUR BOOKS.

AND IT'S JUST ANOTHER GREAT EXAMPLE OF HOW DESPERATE WE ARE FOR A NEW LAND DEVELOPMENT CODE THAT HAD BETTER ZONING THAT ALREADY TOOK CARE OF THESE THINGS THAT ALREADY GOT RID OF THESE USES.

BUT HERE WE ARE STUCK WITH OUR ANTIQUE LAND DEVELOPMENT CODE AND WE HAVE TO DO ALL THESE SILLY THINGS.

SO OF COURSE, I THINK IT HAS THE SUPPORT HERE, BUT IT'S JUST REALLY RIDICULOUS.

WE'RE STUCK IN THE PAST COMMISSIONER AGAIN, JUST POLITO.

DO YOU WANT TO SPEAK, UH, FOR THE ITEM? THAT'S SURE.

UM, I ACTUALLY THINK A CONDITIONAL OVERLAY CAN BE A USEFUL TOOL IN THIS MANNER, AND I WOULD LOVE TO BE EDUCATED BY COMMISSIONERS ANDERSON AND, UH, CONNOLLY ON HOW THE NEW LAND DEVELOPMENT CODE WOULD ACTUALLY ADDRESS THE AFFORDABILITY CONCERNS IN THIS.

NOT AT THIS TIME, WE CAN TALK ANOTHER TIME.

UM, BUT ALSO, UM, WHY IN PARTICULAR IT IS SO HONOROUS, TO ME, THIS ACTUALLY REPRESENTS, UH, YOU KNOW, A FORM OF

[00:55:01]

COMMUNITY PLANNING.

AND WHEN WE ALLOW BY RIGHT ENTITLEMENT, WE DON'T ACTUALLY GET TO D DISCUSS THE NUANCES OF WHAT WILL ACHIEVE MAXIMUM BENEFIT TO THE COMMUNITY.

IN ADDITION TO MAXIMUM RETURNS ON THE INVESTMENT, BECAUSE THIS IS A LARGE INCREASE IN ENTITLEMENTS TO VERTICAL MIXED USE.

IT'S A MASSIVE AMOUNT OF VALUE, AND WE SHOULD BE ABLE TO CAPTURE MORE.

UM, SO I THINK WE SHOULD USE THE TOOLS THAT WE HAVE AT HAND.

AND I THINK THAT CONDITIONAL OVERLAY IS APPROPRIATE IN THIS SITUATION.

ALL RIGHT.

COMMISSIONER SPEAKING AGAINST ANYONE ELSE WANT TO SPEAK FOR THIS ITEM? OKAY.

SO, UM, LET'S GO AHEAD AND PUT THIS TO A VOTE.

SO THIS IS AN AMENDMENT TO, UM, TO ADD A CONDITIONER CONDITIONAL OVERLAY, AND LET'S SAY, I'M GOING TO NEED, UM, CAN YOU COMMISSIONER SNYDER REPEAT THOSE, UH, THOSE ITEMS AGAIN THAT YOU WANT INCLUDED IN THE CO UH, RESTRICTIONS AGAINST ADULT ORIENTED BUSINESSES, ALTERNATIVE FINANCIAL SERVICES, INCLUDING BAIL BONDS AND PAYDAY LENDERS AND OUTDOOR ENTERTAINMENT.

UM, MAY I ASK ONE QUESTION FOR CLARIFICATION? UH, YES, GO AHEAD.

UH, FOR CLARIFICATION.

YEAH.

WHAT IS, UH, OUTDOOR ENTERTAINMENT? HOW IS OUTDOOR ENTERTAINMENT EXACTLY DEFINED? I'M SORRY.

I'M, I'M NEW TO THIS.

COULD WE GET IT EXPLANATION? YEAH.

STAFF, CAN YOU QUICKLY EXPLAIN OUTDOOR ENTERTAINMENT? HOW IT'S DEFINED IN THE CODE? YES.

JUST A MOMENT.

I'LL, I'LL LOOK UP MY, UH, CLASSIFICATION AND THE DESCRIPTION IN THERE.

READ IT FROM THE CODE BASE MOMENT.

RIGHT? TUITION ASSISTANCE, JERRY WEST.

I HAVEN'T, UM, I HAVEN'T HAD THAT RIGHT IN FRONT OF ME IF YOU'D LIKE I COULD SPEAK TO IT VERY QUICKLY BEFORE PROBABLY BEFORE WENDY COULD LOOK IT UP.

SORRY.

WHEN HE, UH, AFTER THE FAMOUS TO FIND HIS, UH, PREDOMINANTLY EXPECTED TO USE CONDUCTED IN AN OPEN PARTIALLY ENCLOSED OR SCREEN FACILITIES, EXAMPLES INCLUDE SPORTS, ARENAS, RACING FACILITIES, AND AMUSEMENT PARKS, THE WAY IT'S DEFINED IN THE CODE.

OKAY.

ALL RIGHT.

SO, UH, ON THAT, UH, AMENDMENT, LET'S GO AHEAD AND, UH, TAKE A VOTE.

UH, CAN I SEE THOSE IN FAVOR ONE, TWO, THREE, FOUR, FIVE, SIX, SEVEN, EIGHT.

OKAY.

SO WE HAVE EIGHT IN FAVOR, UH, THOSE VERDE AGAINST, OH, I'M SO SORRY.

ONE, TWO.

I HAVE A COMMISSIONER HENDERSON, COMMISSIONER THOMPSON, UH, VOTING AGAINST AND ABSTAINING, UH, COMMISSIONER CONLEY.

DID I, I MIGHT'VE MISSED YOUR VOTE.

YOU HAVE STATE.

OKAY, SO YOU'RE ONE.

OKAY.

SO WE HAVE EIGHT, FOUR, TWO AGAINST, AND ONE ABSTAINING.

UH, SO THAT MOTION PASSES, UH, THAT AMENDMENT PASSES.

NOW WE NEED TO VOTE ON THE MAIN, UH, MOTION THAT WAS, UH, COMMISSIONER ANDERSON AND WHO IS THE SECOND? AYE.

WHAT'S THE SECOND TO THE MAIN MOTION.

WAS THAT? THAT WAS FIVE.

YES.

THANK YOU.

UH, OKAY.

SO SECOND ADVICE.

YOU'RE HELPFUL.

AND SO LET'S GO AHEAD AND, UH, WE DID NOT, DO WE HAVE ANY, WE DID NOT, UH, HAVE DISCUSSION ON THAT ITEM.

DO WE NEED ANY DISCUSSION ON THIS ITEM? I'D LIKE TO SPEAK TO HER BRIEFLY.

OKAY.

OKAY.

SURE.

SO THIS IS THE CASE RIGHT ON CONGRESS.

IT MAKES A WHOLE LOT OF SENSE, A HUNDRED PERCENT AGREE WITH COMMISSIONER CONNOLLY.

IT'D BE AMAZING IF WE HAD A LAND DEVELOPMENT CODE THAT DIDN'T REQUIRE SO MUCH PARKING IT'S, IT'S REALLY GREAT AND WONDERFUL TO STORE A BUNCH OF WHOLE LOT OF VEHICLES THERE.

IT DOES NOT ALLOW ANYWHERE NEAR THE AMOUNT OF HOUSING THAT WE COULD GET THERE, WHICH DEFINITELY COSTS US A LOT OF MARKET RATE UNITS AND AFFORDABLE UNITS.

UM, YOU KNOW, THAT'D BE FINE DANDY IF WE HAD ANYWHERE NEAR ENOUGH HOUSING UNITS ON THE GROUND, BUT WE DON'T.

AND SO WE'RE ALWAYS GOING TO BE KIND OF CATCH UP.

WE'RE GETTING FURTHER AND FURTHER BEHIND AVERAGE COST OF HOUSING IS RISING.

DISPLACEMENT IS SKYROCKETING, AND WE ARE TAKING TINY LITTLE STEPS HERE AND THERE TO ADD MORE HOUSING THAN WE DO EVEN DO LAND DEVELOPMENT CODE.

SO HERE WE ARE STUCK WITH OUR TERRIBLE LAND DEVELOPMENT CODE.

THE NEXT IS BEG FOR HOUSING, AND IT'S JUST FAILING US MORE AND MORE BY THE DAY.

SO

[01:00:01]

HOPEFULLY WE CAN GET OUR ACT TOGETHER AND FIX IT.

OKAY.

THANK YOU.

UH, COMMISSIONERS THAT WILL BE VOTING AGAINST THE ONE TO SPEAK, UH, COMMISSIONER AZHAR, I'M JUST GOING TO SPEAK NEUTRAL AND REALLY COMMON.

I JUST WISH AT SOME POINT, STAFF CAN COME BACK TO PLANNING COMMISSION WHERE THEY EMAIL OR AS A FOUNDATION WHO HELP US UNDERSTAND THE OVER THE ISSUE HAS NOT GONE UP MULTIPLE TIMES.

AND WE JUST NEED TO UNDERSTAND WHAT IS, WHAT IS STAFF WANTING US DOING HOUSING COUNCIL, WANTING US TO TAKE ON ALL THESE.

THANK YOU.

OKAY.

UH, COMMISSIONER HIPPO.

UH, DO YOU WANT TO SPEAK TO YOUR SECOND, MR. HEMPHILL? DO YOU WANT TO STICK TO YOUR SECOND, BUT NOTHING YOUR INTEREST IN HAND AND SAID ALREADY, IT'S JUST, UM, HOUSING ON A W ON A TRANSIT CORRIDOR.

IT MAKES SENSE.

OKAY.

ANY OTHER, UH, COMMISSIONER SPEAKING AGAINST, UH, COMMISSIONER YONIS, TOLEDO, I'M ALSO SPEAKING CLOSER TO NEUTRAL THAN AGAINST, BUT I THINK IT'S REALLY IMPORTANT TO, TO QUALIFY A COUPLE OF THINGS THAT HAVE BEEN SAID, UM, BECAUSE THE COST OF HOUSING DOESN'T SIMPLY HAVE TO DO WITH THE SUPPLY OF THE UNITS ON THE GROUND.

I'M GOING TO PUSH BACK AGAINST THAT AGAIN, AND JUST REMIND FOLKS THAT THE MEDIAN FAMILY INCOME FOR THIS PARTICULAR AREA OF AUSTIN IS MUCH LOWER, ABOUT $30,000 LOWER THAN THE MEDIAN FAMILY INCOME FOR THE REST OF THE CITY.

SO WHEN WE'RE TALKING ABOUT 50%, MFI, 80% MFI, 80% OF MFI IS WAY OUT OF REACH FOR ANYONE WHO IS STRUGGLING TO PAY RENT RIGHT NOW.

AND, UM, THIS IS A MOVING TARGET BECAUSE WHEN WE CHOOSE DENSITY AND WE DON'T HAVE, YOU KNOW, I'D LOVE TO SEE COST BENEFIT.

LET'S TALK ABOUT PARKING AND LET'S TALK ABOUT MORE EQUITABLE TRANSIT.

BUT RIGHT NOW, WHEN WE INCREASE THE NUMBER OF UNITS, WE ARE INCREASING THE LAND VALUE AND WE ARE IMPACTING EVERYBODY IN THAT AREA.

AND WE CAN SAY, YOU KNOW, WE'RE GRATEFUL FOR FOUNDATION COMMUNITIES PROVIDING SO MANY AFFORDABLE UNITS AT SIERRA RIDGE AND SIERRA VISTA RIGHT ACROSS THE STREET.

I'VE WORKED WITH THOSE COMMUNITIES AND KNOW A LOT OF PEOPLE WHO HAVE RELIED ON THAT HOUSING.

AND I WANT TO REMIND FOLKS THAT FOUNDATION COMMUNITIES CONTINUES EVICT PEOPLE, BECAUSE THEY CAN NO LONGER PAY THE CURRENT 50% MFI OR THE CURRENT 60 OR 70 OR 80%.

I'M A FIRE, WHATEVER THAT IS.

SO YOU SAW THE CURRENT MFI RIGHT NOW, BUT THAT WILL BE HIGHER NEXT YEAR AND HIGHER THE FOLLOWING YEAR.

AND IT WILL BE HIGHER AS THESE HIGHER INCOME EARNERS MOVE INTO THE AREA.

AND THAT'S HOW PEOPLE GET EVICTED, UH, BECAUSE THEY'RE NOT LOCKED IN AT THE RENT THAT THEY'RE PAYING IN THE BEGINNING, THEY'RE BEING JUDGED ON THE INCOMES OF OUR MEDIAN FAMILY INCOME CITYWIDE.

SO WE DON'T HAVE A LACK OF UNITS.

WE HAVE A LACK OF AFFORDABLE UNITS, AND WE'RE GETTING MAYBE 14 CLOSE TO WHAT THE COMMUNITY MIGHT ACTUALLY BE ABLE TO BENEFIT FROM, FROM THIS DEVELOPMENT.

THAT'S GREAT.

UM, THERE ARE ALSO OTHER CONSEQUENCES OF THIS ZONING WITHOUT ACTUAL ANTI-DISPLACEMENT PROGRAMS AND MEASURES IN THE AREA.

SO, UM, THAT'S ALL I HAVE TO SAY.

UM, I AM VERY GRATEFUL FOR THE WORK.

THIS CONTACT TEAM HAS DONE.

THEY HAVE NEVER BEEN ANTI-DEVELOPMENT, BUT I UNDERSTAND THEIR CONCERNS.

OKAY.

DO WE HAVE ANY, UH, COMMISSIONERS THAT WANT TO SPEAK, UH, FOR THE SIGN THEM AGAINST, SO THAT KIND OF WRAPS UP OUR, UM, SO NOW LET'S GO AHEAD AND VOTE ON THE MAIN MOTION, UM, AND SEE THE, UH, UH, THOSE THAT ARE VOTING FOR FOUR.

SO THAT'S 10, FOUR, AND THOSE VOTING AGAINST, UM, I SEE NONE AGAINST ANY VOTING ABSTAINING.

WE HAVE ONE, UH, CHERRY ANDERSON.

I DON'T KNOW IF I GOT YOUR VOTE.

MAYBE IT WAS BEHIND YOUR NAME.

OH, YOU WERE GREAT.

THANK YOU.

ALL RIGHT.

NO, I DID GET YOU.

THANK YOU.

ALL RIGHT, SO THAT'S 10 AND, UH, ZERO ONE.

WHAT'S THE VOTE ON THAT ITEM.

OKAY.

THANK YOU VERY MUCH FOR HELPING ME OUT THERE.

UH, NOW YES, YES, I DID.

UH, WE HAVE, UH, 11 TOTAL AND I, I READ IT IS 10 ZERO ONE.

THANK YOU.

OKAY.

[B16. Code Amendment: C20-20020-006 North Burnet / Gateway Regulating Plan – Civic Uses]

UH, SO NOW WE MOVE INTO ITEM 16.

THIS IS CODE AMENDMENT, UH, C 22 ZERO ZERO TWO ZERO DASH OH OH SIX, NORTH BURNETT GATEWAY REGULATING PLAN, UH, CIVIC USES.

AND I JUST WANT TO SAY, UM,

[01:05:02]

UH, REAL QUICK, UH, WE NEED TO GO AHEAD AND VOTE TO EXTEND QUESTIONS.

UH, CAUSE I KNOW SOME OF YOU MIGHT HAVE ADDITIONAL QUESTIONS.

SO CAN I, UH, GO AND GET A, I WOULD LIKE TO PROPOSE THAT WE OPEN IT UP FOR EIGHT COMMISSIONERS, FIVE MINUTES A PIECE, JUST KIND OF START FROM THE BEGINNING.

UH, DO I HAVE A MOTION TO ALLOW ADDITIONAL QUESTIONS? UH, OKAY.

WE HAVE, UH, UH, UH, BUSTER HEMPHILL.

AND DO I HAVE A SECOND, UH, COMMISSIONER SCHNEIDER SECONDS? UH, LET'S GO AHEAD AND VOTE ON THAT MOTION.

YEAH.

ALL RIGHT.

LET'S SEE IF THERE'S YES.

ONE, TWO, THREE, FOUR, FIVE, SIX, SEVEN, EIGHT, NINE, COMMISSIONER, HONEST, PALITO.

I'M SORRY.

I LOST TRACK OF WHAT WE'RE ACTUALLY VOTING ON.

SO WE'RE VOTING, WE HAD CONSUMED ALL OF OUR Q AND A LAST TIME AT THE LAST WORD HERE.

SO WHAT I'M ASKING IS TO RESET IT TO WHERE WE ALLOW EIGHT COMMISSIONERS, FIVE MINUTES APIECE FOR Q AND A AGAIN.

SO THAT'S, THAT'S THE MOTION ON THAT WE'RE, UH, VOTING ON.

THANK YOU.

I APOLOGIZE.

ALL RIGHT.

SO I THINK WE'VE GOT UNANIMOUS 11 L ON THAT ONE.

THANK YOU.

ALL RIGHT, SO NOW WE'LL GET STARTED WITH THE, WE HAVE, UM, OKAY.

I'M LOOKING HERE.

WE HAD ALREADY HEARD FROM STAFF, UH, I GUESS RIGHT NOW WE'LL DO WE NEED TO HEAR FROM STAFF ON THIS AGAIN? UH, ANYONE.

OKAY.

I KNOW WE ALREADY HAD THE STAFF PRESENTATION AND, UH, SOME Q AND A, BUT DO WE NEED THE HEATER? UH, DO WE HAVE ANY, UH, DIFFERENT STAFF, UH, THEY WANTED TO SPEAK TO THIS? YES.

MR. THIS JERRY WEST OVER THROUGH OUR HOUSING AND PLANNING DEPARTMENT, JUST TO REFRESH MY MEMORY.

UH, THIS IS AN ITEM TO MEN.

THE NORTH PREDICT GATEWAY REGULATING PLAN TO ALLOW FOR TWO ADDITIONAL CIVIC USES, UM, MAJOR UTILITY FACILITIES AND MAINTENANCE AND SERVICE FACILITIES WITHIN THE DISTRICT KNOWN AS TOD WITHIN THE NORTH BURNET GATEWAY.

UM, IT DOES NOT APPLY TO A SINGLE PROPERTY WOULD APPLY TO ALL PROPERTIES UNTIED WITHIN THERE.

HOWEVER IT IS A CIVIC USE AND A WOULD APPLY ONLY TO GOVERNMENT USE.

AND, UH, IT'S BEEN DONE AT THE REQUEST OF AUSTIN ENERGY WHO WOULD LIKE TO ADD A UTILITY SUBSTATION AT THEIR KRAMER LANE SERVICE CENTER SITE.

UH, THE KRAMER SITE'S BEEN THERE FOR A LONG TIME SINCE THE SIXTIES, AND, UM, UM, THEY NEED THE SUBSTATION TO SERVE THE ADDITIONAL GROWTH THAT IS OCCURRING AS A RESULT OF THE NORTH BURNET GATEWAY PLAN, AS WELL AS THE DOMAIN.

UH, MOST IMPORTANTLY, THE BROADMORE PROJECT, UH, THIS ACROSS THE RAILROAD TRACKS, WHICH HAS 6 MILLION SQUARE FEET OF DEVELOPMENT APPROVED BY THE CITY COUNCIL.

UM, HOWEVER IT WOULD SERVE ADDITIONAL PROPERTIES BESIDES THAT ONE.

UH, WE DO HAVE AUSTRALIA, NEW STAFF, AS WELL AS MYSELF ON THE LINE.

IF YOU HAVE ANY QUESTIONS, THE ITEM IS ALSO GENDER.

OKAY.

OKAY.

SO WE HAVE A LITTLE TIME LEFT IN THE FIVE MINUTES FROM STAFF DISASTER AND ENERGY.

DO Y'ALL HAVE ANYTHING ADD TO THAT, OR YOU JUST WANT TO WAIT ON THE Q AND A, THIS IS SUSAN GROSS FROM AUSTIN ENERGY OF WE'LL DEFER TO YOU, UH, MR. TODD, WHATEVER YOUR PREFERENCE IS.

WE CAN, WE, WE DO HAVE SOME MAPS THAT WERE REQUESTED BY THE COMMISSIONERS.

UM, UM, MR. SHAW, AND WE CAN GO THROUGH THAT OR WE CAN ANSWER QUESTIONS, WHATEVER YOUR PREFERENCE IS.

UH, I, I WOULD, UH, THINK LET'S GO AHEAD AND, UM, MUTE TO THE SPEAKERS THAT WE, OTHER SPEAKERS WE HAVE, AND THEN WE'LL SAVE ANY, UH, PRESENTATION ITEMS YOU HAVE PULLED US UP DURING THE Q AND A, I THINK THAT WOULD BE THE BEST WAY TO MOVE FORWARD.

ALL RIGHT.

THANK YOU.

SO, UH, NEXT WE HAVE MR. WALD, I BELIEVE IS ON THE LINE.

UH, YES, TOM WALTER, ARE YOU THERE SPEAKING NEUTRALLY? I'M HERE.

OKAY, GO AHEAD.

YES, I CAN HEAR YOU.

I THINK MY REMARKS WILL BE PRETTY BRIEF.

SO, UM, YEAH, I WANTED TO THANK AUSTIN ENERGY STAFF.

WE MET WITH THEM LAST WEEK, ALONG WITH URBAN TRAILS STAFF AND, UM, HAD A GREAT DISCUSSION, REALLY GOT THROUGH A LOT OF THE, THE, UH, CONCERNS THAT AUSTIN ENERGY HAD.

AND B ALSO DESCRIBED WHAT WE WERE LOOKING FOR AS FAR AS THE TRAIL ALIGNMENT WENT.

UM, WE HAVE SOME INITIAL IDEAS FOR AN AGREEMENT, BUT NOTHING HAS BEEN FINALIZED YET.

UM, I THINK AT THIS POINT WE ARE EXPECTING THAT WE'LL TAKE THE CONVERSATION

[01:10:01]

TOWARD THE COUNCIL AND HAVE THE CONVERSATION IN THAT CONTEXT.

UM, YOU KNOW, FROM THE ALWAYS NEVER BEEN OPPOSED TO SUBSTATION AT ALL, IT WAS JUST CONCERNED ABOUT PATIENT WITH THE TRAVEL ALIGNMENT.

UM, I'LL ADD A COUPLE OF THINGS THAT, THAT WE'VE LEARNED, UM, YOU KNOW, BETWEEN AUSTIN ENERGY, THE CITY AND CAPITAL METRO IT'S, UH, BECOME PRETTY APPARENT THAT THE RAIL SPUR IS LIGHT, THAT IS ON THE WEST EDGE OF THE PROPERTY IS LIKELY TO BE REMOVED.

AND THAT WOULD HAPPEN AS PART OF, UH, UH, BROADMORE STATION, UH, COMPLETION AND DOUBLE TRACKING.

UM, AND THEN I'LL JUST NOTE TOO, FOR THOSE WHO AREN'T AWARE, THERE ACTUALLY IS A SPECIAL CITY COUNCIL MEETING ON THURSDAY TO ADDRESS THE SAME SUBSTATION QUESTION THROUGH A DIFFERENT MECHANISM.

AND SO WE'LL HAVE TO SEE WHICH MECHANISM ENDS UP GOING FORWARD, BUT, UM, I JUST WOULD ENCOURAGE Y'ALL TO BE AWARE OF THAT.

UM, AND I DON'T THINK I REALLY HAVE ANYTHING MORE TO REPORT AT THIS POINT.

I'D ALREADY SAID QUITE A BIT LAST WEEK.

UM, IF THERE ARE ANY QUESTIONS AND WELCOME TO WELCOME TO AN ANSWER AND THANKS VERY MUCH.

OKAY.

SO, UH, AS I SAID, I WOULD LIKE TO MOVE IN, UH, INTO THE QUESTION AND ANSWERS HERE, JUST BECAUSE I KNOW THERE MAY BE COMMISSIONERS THAT WANT TO FOLLOW UP ON, UH, KIND OF WHERE WE LEFT OFF LAST TIME.

SO, UH, AT THIS POINT, THOUGH, I THINK WE ARE GOING TO GO AHEAD AND CLOSE.

THE PUBLIC HEARING WOULD BE THE FIRST THING WE NEED TO DO.

DO I HAVE A MOTION TO CLOSE THIS PUBLIC HEARING? UH, OKAY.

I HAVE MOTION BY COMMISSIONER AZHAR COMMISSIONER CONLEY, UH, SECONDS.

UH, LET'S GO AHEAD AND VOTE ON CLOSING THE PUBLIC HEARING.

YEAH.

AND COMMITTED SECRETS.

YES.

MR. THOMPSON, ARE YOU IN FAVOR OF, OKAY.

I THINK THAT'S UNANIMOUS, UH, ON CLOSING THE PUBLIC HEARING.

SO NOW WE'LL MOVE INTO OUR Q AND A, DO WE HAVE, WE'RE GOING TO START EIGHT AGAIN, DO WE HAVE A FIRST COMMISSIONER THAT WOULD LIKE TO ASK QUESTIONS OF, I GUESS AUSTIN ENERGY, MR. WALD, ANY QUESTIONS? I DON'T SEE ANY HANDS, UH, COMMISSIONER CZAR.

THANK YOU, CHAIR.

UM, I GUESS MY FIRST QUESTION IS FOR, UM, MR. RESTAURANT, IF HE CAN HELP ME UNDERSTAND.

SO WE WERE TOLD THAT WE MAY NOT ADD CONDITIONS AND I JUST WANT TO UNDERSTAND IS THAT COMMON PRACTICE? IS THAT SOMETHING THAT WE CAN BE TOLD WHAT TO DO WITH, LIKE, HOW DOES THAT WORK? I'VE JUST NEVER SEEN IT BEFORE.

SO I'M JUST TRYING TO UNDERSTAND FROM A PROCEDURAL PERSPECTIVE, I SUPPOSE ANYONE FROM STAFF CAN HELP ME ASK THE QUESTION, MR. RUSS TOBIN, ARE YOU THERE IN FACT, MR. YEAH, I'M, I'M SORRY.

THAT WAS, THAT WAS MY BAD.

UM, THE, UH, IF THE QUESTION, AS I UNDERSTOOD, UH, WAS THAT, UH, UM, WHY CAN CONDITIONS NOT BE ADDED TO THIS CASE? IS THAT CORRECT? THAT'S GREAT.

SO THE REASON IS THAT WHAT WE ARE DOING HERE IS IT'S NOT AS OWNING CASE THAT CAN HAVE A CONDITIONAL OVERLAY, LIKE THE LAST ONE YOU DISCUSSED OR A RESTRICTED COVENANT FOR THAT MATTER, WE ARE DOING HERE IS CHANGING THE PERMITTED USE TABLE WITHIN BERTA K WAY, JUST LIKE WE HAVE A PERMITTED USE TABLE WITHIN THE OVERALL CODE THAT SAYS WHAT'S ALLOWED IN, FOR EXAMPLE, GI WHAT'S NOT ALLOWED IN GR WE ALSO HAVE A PERMITTED USE TABLE IN THE BURNET GATEWAY PLAN THAT SAYS, WHAT IS PERMITTED IN THIS DISTRICT AND WHAT IS NOT? SO WHAT WE ARE DOING IS THIS IS TRULY A CODE AMENDMENT IS NOT AS UNENGAGED FOR THE KRAMER PROPERTY.

AND WE WERE SAYING WITH THESE, THESE TWO USES WOULD BE PERMITTED WITHIN THAT DISTRICT.

SO THERE'S NOTHING TO HAIN A CONDITION THAT IS SIMPLY CHANGING A DASH TO A P IN A TABLE.

THANK YOU.

THAT WAS REALLY HELPFUL.

UM, MY OTHER QUESTION WAS, CAN STAFF SPEAK TO THE CONSIDERATION OF ESSENTIALLY, UM, WORKING IN THE FUTURE ON THAT DREAM ASPECT OF THE SITE YOU'VE, WE'VE HEARD FROM MR. WALL AND SOME OF THE STATIONS, CAN YOU ALL PLEASE SPEAK TO IT? SORRY.

YOU'RE ASKING ABOUT THE FUTURE FUTURE FUTURE THINGS.

SO IT COULD BE ON THE SIDE OF THE QUESTION.

OKAY.

ESSENTIALLY COMMUNITY, PERHAPS IT'S THE QUESTION OF AUSTIN ENERGY YOU HAVE, HOW, WHAT WERE YOU HAVE THE CONVERSATIONS REGARDING THE POTENTIAL TRAIL ON THE SITE GONE? LIKE, HOW ARE THOSE CONVERSATIONS GOING? IS THAT SOMETHING THAT IS BEING CONSIDERED? YES, THIS IS SUSAN GROSS FROM AUSTIN ENERGY.

UM, AS

[01:15:01]

WAS STATED EARLIER, THERE WAS A MEETING BETWEEN AUSTIN ENERGY STAFF FROM URBAN TRAILS WITH PUBLIC WORK, AS WELL AS THE RED TRAIL, UH, INITIATIVE.

WE DISCUSSED, UM, THE PREFERRED LOCATION OF THE RED TRAIL, WHICH WAS ENDORSED BY THE RED TRAIL INITIATIVE, WHICH IS ALONG THE WESTERN SIDE OF THE PROPERTY.

UM, WE TALKED ABOUT SOME SAFETY CONCERNS AND VARIOUS WAYS TO ADDRESS THOSE SAFETY CONCERNS.

UM, OFTEN ENERGY IS LOOKING AT DESIGN ALTERNATIVES FOR THE LOCATION OF THE SUBSTATION THAT COULD POTENTIALLY GIVE ADDITIONAL SPACE FOR THE, UM, UH, GET THE TRAIL ON THE WEST SIDE OF THE PROPERTY, AS WELL AS WHAT HAS ALREADY BEEN MENTIONED, WHICH IS ELIMINATION OF THE RAIL SPUR, WHICH PROVIDES ADDITIONAL SPACE.

UM, YOU KNOW, AUSTIN, ENERGY'S NOT IN A HUNDRED PERCENT CONTROL OF THE APPROPRIATE DESIGNATION OF THE TRAIL ON THE PROPERTY BECAUSE WE HAVE NOT BEEN THROUGH SITE PLANNING YET.

UH, BUT WE'VE AGREED TO SUPPORT THE WESTERN LOCATION IF IT'S POSSIBLE AND WORK WITH ALL OF THE STAKEHOLDERS THAT WILL BE INVOLVED AND THAT WILL INCLUDE WATERSHED AND OTHER DEPARTMENTS AS WELL.

DOES THAT ANSWER THE QUESTION? WAIT, WE ARE COMMITTED TO THE TRAIL BEING ON THE PROPERTY.

YOU KNOW, WE'VE AGREED WITH THE RECOMMENDATION THAT YOU'D GO ON THE WESTERN SIDE.

WE JUST, AT THIS POINT ARE NOT ABLE TO MAKE A FINAL DESIGNATION ON WHERE IT WILL BE CITED.

THANK YOU.

I APPRECIATE THAT ANSWER.

AND I APPRECIATE STAFF WORKING ON THIS WITH A STAKE HOLDER.

THANK YOU.

THAT'S ALL MY QUESTIONS.

ANY OTHER COMMISSIONERS WITH QUESTIONS? UH, COMMISSIONER THOMPSON.

SO, I MEAN, JUST TO CLARIFY WITH STAFF, I MEAN, WE CAN'T PUT CONDITIONS AT THIS TIME, BUT ON A TABLE THAT COULD BE A PERMITTED USE OR CONDITIONAL USE, IS THAT CORRECT? MR. ROSTOV? AND I THINK YOU MIGHT BE THE BEST ONE TO ANSWER THAT QUESTION.

IT TOOK ME A SECOND.

I, YES, YOU COULD MAKE IT A CONDITIONAL USE RATHER THAN A PERMITTED USE.

SO, AND IF THERE WERE A CONDITIONAL USE, THEN IF THERE WERE A SITE PLAN WITH A TRAIL ALIGNMENT AND THE PLANNING COMMISSION WOULD AGAIN SEE THAT, THAT SITE PLAN AND AGAIN, REVIEW THAT TRAIL ALIGNMENT.

THAT IS CORRECT.

OKAY.

I'M JUST CONCERNED ABOUT THE TIMELINE OF GETTING THE SITE PLAN PERMITTED, BECAUSE IT HAS BEEN HELD UP ABOUT THE, UH, THE, THE LAWSUIT ISSUE THAT WE'VE SPOKEN A LOT ABOUT THE BAG.

UM, SO THAT WOULD ADD SOME TIME TO TAKE IT BACK TO THE COMMISSION FOR APPROVAL, BUT IT IS POSSIBLE.

OKAY.

THANK YOU.

OKAY.

ANY OTHER COMMISSIONERS WISH TO ASK QUESTIONS? OKAY.

WELL, RIGHT.

UM, I'LL, UM, I GUESS I HAVE ONE, UH, FOR US AND ENERGY STAFF AND, UM, SO, UH, ONE THING I JUST WANTED TO MAKE, UH, MAKE SURE IS CLEAR TO, UM, ALL THE COMMISSIONERS AND MAYBE, UM, US INTRODUCE STAFF AND EXPLAIN.

SO WE HAVE CURRENTLY OPERATIONS THERE IN THIS LOCATION.

COULD YOU SPEAK TO WHAT OPERATIONS ARE THERE AND WHETHER OR NOT, UH, WHICH OF THOSE WILL CONTINUE, UH, YOU KNOW, EVEN AS THE SUBSTATION EXISTS ON THE PROPERTY, WHICH, UH, OPERATIONS WILL CONTINUE WITH ON THIS SITE, THIS IS SUSAN GROSS.

AGAIN, I'M CURRENTLY ON THE SITE.

WE HAVE WAREHOUSE FACILITIES, WE HAVE PARKING, WE HAVE OFFICE BUILDINGS, UM, THERE'S LAY DOWN YARD.

WE ALSO, UM, SHARE THE SITE WITH FLEET SERVICES AS WELL AS PUBLIC WORKS.

UM, AUSTIN ENERGY'S, UH, FACILITIES, UH, WILL BE SOMEWHAT DISPLACED BY THE, UM, SUBSTATION ON THE SITE, AS I'VE INDICATED EARLIER, WE'RE STILL DETERMINING THE OPTIMUM LOCATION OF THE SUBSTATION ON THE SITE, ALTHOUGH IT IS EXPECTED THAT IT WILL BE ON THE NORTH END OF THE PROPERTY ADJACENT TO THE TRANSMISSION LINES.

UM,

[01:20:01]

SO WE WILL NOT BE ON THE KRAMER FRONTAGE FOR THE PROPERTY.

SO I GUESS JUST FOLLOWING UP ARE THESE ARE THE CREWS THAT ARE, UM, IT'S I UNDERSTAND THAT WE HAVE A SOUTH SERVICE CENTER THAT SIMILARLY SIMILARLY HAS VARIOUS CITY DEPARTMENTS, INCLUDING AUSTIN ENERGY.

AND THIS NORTH SERVICE CENTER ARE THE CREWS THAT RESPOND TO OUTAGES, UH, LOCATED AT THESE, UH, THESE TWO LOCATIONS, YES.

CREWS THAT RESPOND TO OUTAGES.

UM, WE HAVE OFFICE PERSONNEL THAT PERFORM ENGINEERING AND, UM, REVIEW SITE LENS AND ARE INVOLVED IN ALL ASPECTS OF AUSTIN ENERGY'S BUSINESS.

SO IT IS A CRITICAL LOCATION IN TERMS OF OUR RESPONSE TIME, UH, TO SERVICE CALLS AS WELL AS TWO OUTAGES.

OKAY.

ALL RIGHT.

THAT'S ALL I HAD.

SO, ANY OTHER QUESTIONS, UH, COMMISSIONERS, WE HAVE A FEW MORE SLOTS LEFT BY COMMISSIONER ANDERSON.

OKAY.

JUST A QUICK QUESTION FOR AUSTIN ENERGY AND THANK YOU FOR WORKING WITH, UM, THE RED LINE INITIATIVE AND WHATNOT OVER THE PAST COUPLE OF WEEKS.

SO KIND OF A YES OR NO QUESTION OR SO I HOPE IT TO BE, UM, IS AUSTIN ENERGY GOING TO DO EVERYTHING IN THEIR POWER TO HELP SEE THIS TRAIL THAT WE'VE BEEN TALKING ABOUT BUILDING FOR ABOUT 20 YEARS THROUGH TO FRUITION WHERE IT'S PLANNED TO BE, UH, IN BETWEEN THE RED LINE AND THE AUSTIN ENERGY PROPERTY COMMISSIONER OXTON, ENERGY'S BEEN COMMITTED ALL ALONG TO HAVING THE TRAIL ON THE PROPERTY.

WE'D HAD SOME QUESTIONS ABOUT THE APPROPRIATE LOCATION OF THE TRAIL ON THE PROPERTY.

WE'D PUSHED BACK FOR SOME SAFETY CONCERNS THAT WE HAD.

I THINK IT WAS REALLY HELPFUL TO MEET WITH MEMBERS OF THE RED TRAIL INITIATIVE, AS WELL AS URBAN TRAILS, UH, TO CONDUCT A SITE, WALK ON THE PROPERTY WITH URBAN TRAILS FOLKS.

WE DO THINK IT'S POSSIBLE TO PLACE THE TRAIL ALONG THE WEST SIDE OF THE PROPERTY.

WE'RE GOING TO WORK TOWARDS THAT END.

THE TRAIL WILL CLEARLY BE ON THE PROPERTY SOMEWHERE.

UM, AND, AND WE THINK THAT THE WEST IS CLEARLY, UM, THE MOST FAVORED LOCATION BY, UM, A NUMBER OF CITY GROUPS.

SO WE'VE INDICATED OUR SUPPORT FOR THAT ALIGNMENT, BUT WE CAN'T AGREE TO THAT RIGHT NOW AND, AND COMMIT TO THAT WITH AN EASEMENT BECAUSE WATERSHED IS NOT AT THE TABLE.

WE DON'T HAVE THE DESIGN PLANS YET FROM THE RAILROAD AS TO WHERE, UH, THEIR EASEMENT REQUESTS WILL BE FOR, UM, UH, DOUBLE TRACKING THE PROPERTY.

SO WE, WE FRANKLY COULDN'T DO FIELD NOTES AT THE MOMENT.

SO IT'S JUST NOT QUITE RIGHT YET IN TERMS OF DETERMINING THE EXACT LOCATION.

UH, BUT WE WE'RE, WE'RE VERY POSITIVE IN OUR EFFORTS TO MOVE FORWARD, BUT I BELIEVE I HEARD YOU SAY IS IT WOULDN'T BE AUSTIN ENERGY STANDING IN THE WAY THAT THAT'S ALMOST UP TO WATER AND CAP METRO.

AT THAT POINT, I FEEL THAT THEY WOULD BE FAVORABLE PARTNERS AND THAT WE CAN ALL WORK WITH THEM.

AND SO, OKAY.

THAT'S IT.

THAT'S A GOOD ANSWER.

SO GOOD.

THANK YOU FOR THAT.

HMM.

UH, OKAY.

LAST CHANCE FOR, UH, IN FRONT OF THEIR QUESTIONS FOR YOU PUT IT TO A VOTE.

I'M NOT SEEING ANY, DO WE HAVE A MOTION AND THE COMMISSIONERS WANT TO HAVE A MOTION ON THIS ONE? OKAY.

UH, UH, I A HEMPEL, UH, MAKE A MOTION TO MOVE FORWARD WITH STAFF, BUT STAFF RECOMMENDATION.

I HAVE A SECOND LOOK AROUND THE ROOM HERE.

I HAVE A SECOND BY MR. FLORES, BUT I DO WANT TO SPEAK TO YOUR, UM, YOUR MOTION BY CHER.

SURE.

UM, I, I REALLY APPRECIATE THAT THE RED LINE INITIATIVE, UM, AND AWESOME THE ENERGY TO ABLE TO MEET AND TALK ABOUT EACH OTHER'S CONCERNS.

AND I THINK THAT'S GONNA GO A LONG WAY, UM, FOR WHEN SITE PLANNING STARTS AND, UM, GOALS AND VISION FOR, FOR BOTH HAVE BEEN DISCUSSED AND CAN MAKE IT INTO THAT SITE PLAN.

RIGHT.

ANY, UH, COMMISSIONERS, UH, VOTING AGAINST WANT TO SPEAK ANY COMMISSIONERS WANT TO SPEAK IN FAVOR? UM, CHAIR.

YES.

I I'D LIKE TO MAKE A SUBSTITUTE MOTION.

OKAY.

A SUBSTITUTE MOTION.

OKAY.

GO AHEAD.

I'D LIKE TO SUGGEST THAT WE ADD

[01:25:01]

THIS AS A CONDITIONAL USE.

I REALIZED HOW IMPORTANT, AND, AND IT IS VERY HARD FOR ME TO DO THAT BECAUSE I REALIZED HOW IMPORTANT IT IS FOR THE CITY TO BUILD THE SUBSTATION.

AND I REALIZED HOW, HOW PRESSED THEY ARE FOR TIME, BUT IT'S BECAUSE THEY'RE SO PRESSED FOR TIME.

AND IT'S BECAUSE THEY'RE SO, SO THIS IS SO IMPORTANT TO THEM THAT I'M JUST CONCERNED THAT IN THE END, IF TIME GETS TIGHT, THAT THE, THEY WILL NOT TAKE THE BEST DECISION IN TERMS OF CONNECTIVITY FOR BICYCLES, TO WHAT WE'RE CALLING OUR SECOND DOWNTOWN.

THIS IS, YOU KNOW, ONE OF THE MAJOR, YOU KNOW, AN ACTIVITY CENTER OR ONE OF THE MAJOR PLACES FOR GROWTH, UH, AND A CONNECTED COMMUNITY.

AND, YOU KNOW, THE CONNECTIONS THAT WE BUILT THERE AND THE INFRASTRUCTURE THAT WE BUILT THERE ARE GOING TO BE THERE FOR 40 YEARS.

AND IF WE'RE SUPPOSED TO REDUCE OUR, OUR MODE SHARE, UH, YOU KNOW, FROM DRIVE ALONE IN A CORNER, YOU KNOW, IN THE NEXT DECADE OR SO TO SAVE THE PLANET, WE HAVE TO BE THINKING ABOUT HOW WE'RE GOING TO DO THIS FOR THE NEXT 50 YEARS AND THAT TRAIL, AND THAT ALIGNMENT IS GOING TO LIVE THERE FOR 50 YEARS AS WE BUILD INFRASTRUCTURE AROUND IT.

AND IT'S AN 80% EXTRA INCREASE JUST TO GO AROUND THE BUILDING THAT THEY PUT IT ON THE OTHER SIDE OF THE, UH, OF THE SITE.

AND IF WE MAKE THOSE TYPES OF DECISIONS WHERE WE'RE GOING 80% OUT OF THE WAY, EVERY TIME WE HAVE A DECISION OF WHICH WAY TO GO FOR BIKES, PEOPLE JUST AREN'T GOING TO RIDE BIKES.

IT'S GOING TO BE TOO TOUGH AND TOO HARD, AND WE HAVE TO MAKE IT EASY.

AND ALONG THE TRAIL, OR THE GREATEST IS FLAT AND THE CROSSINGS ARE FEW IS, IS THE BEST PLACE TO PUT IT.

AND I JUST, WE HAVE TO KEEP THAT TRAIL THERE.

AND BY PUTTING IN THIS AS A CONDITIONAL USE, WE SORT OF ENSURE THAT AUSTIN ENERGY DOES EVERYTHING IN THEIR, IN THEIR POWER TO MAKE IT THERE.

OKAY.

SO, UH, WHAT IS, GO AHEAD AND RESTATE YOUR, UM, YOUR SUBSTITUTE AGAIN, YOU ADD THE USES AS RECOMMENDED BY, BY STAFF EXCEPT TO MAKE THEM CONDITIONAL AND NOT PERMITTED.

OKAY.

DO I HAVE A SECOND, UH, FOR THIS SUBSTITUTE LOOKING AROUND THE ROOM, I SEE COMMISSIONER CONLEY SECONDS.

UH, GOT A SECOND BY COMMISSIONER CONLEY.

ALL RIGHT.

SO NOW WE'RE GOING TO, UH, SO, UH, I'M SORRY, COMMISSIONER TOXIN.

I'LL LET YOU SPEAK FOR QUITE A BIT.

DO YOU HAVE ANYTHING ELSE TO SAY TO YOUR MOTION? I THINK IF YOU CAN.

OKAY.

ALL RIGHT.

SO I'M GOING TO GO AHEAD AND COUNT THAT AS THE MOTION MAKER.

UH, AND THEN DO YOU HAVE ANY SPEAKERS AGAINST, SO I AM ACTUALLY GOING TO SPEAK AGAINST THIS ITEM, UM, AND I'LL, I'LL JUST EXPLAIN WHY WE'VE GOT TREMENDOUS AMOUNT OF GROWTH IN THIS AREA, WHICH INCLUDES A LARGE NUMBER OF HOUSING UNITS.

WE'VE GOT A SOCCER STADIUM.

UH, WE'VE GOT, UM, WE'VE GOT THE, UH, I'VE HEARD THAT UT HAS MORE SUPER COMPUTERS GOING IN.

IT'LL TAKE A, QUITE A BIT OF LOAD.

UH, WE'VE GOT THE DOMAIN EXPANDING, UH, KEEPS GROWING AND GROWING AND, UH, ELECTRICITY, YOU KNOW, I MEAN POWER TO THESE CUSTOMERS, IS IT, I MEAN, YOU'VE GOT TO HAVE IT RIGHT.

AND SO, I MEAN, IF WE DELAY, UH, THE AUSTIN ENERGY AND ITS ABILITY TO PROVIDE THE LOAD OR MEET THE DEMAND OF THIS AREA, UH, THAT IS NOT A GOOD THING.

AND THE OTHER THING IS, I THINK I I'VE HEARD A LOT OF PROGRESS JUST MADE IN THE LAST WEEK.

AND I THINK I AM ENCOURAGED BY, UM, THEIR COMMITMENT AND I JUST DON'T THINK THIS IS REALLY NECESSARY.

AND I THINK THEY'VE ALWAYS SLOWED DOWN, UH, THE PROGRESS AND PROMOTING THE GROWTH WE WANTED IN THIS AREA.

ANYWAY.

SO I'LL BE VOTING AGAINST A SUBSTITUTE, SAID WE HAVE ANY, UH, COMMISSIONERS VOTING FOR THE ONE TO SPEAK.

WE HAVE ONE MORE SPOT, UH, COMMISSIONER SNYDER.

THANKS.

UM, UH, LAST WEEK I WENT TO THE LIBRARY TO VOTE AND I WAS PARKING MY BIKE AND THERE WAS THIS PLAQUE TO A FORMER AUSTIN ENERGY, UM, EMPLOYEE, UH, DECEASED WOMAN, UH, UH, JUDITH FOWLER.

AND IT WAS, YOU KNOW, OBVIOUSLY SHE WAS VERY WELL LOVED BY HER COLLEAGUES AND OTHERS.

UM, BUT ANOTHER PIECE OF THE PLAQUE WAS HOW SHE HAD WORKED AT THE SUBSTATION THAT IS RIGHT THERE IN WHAT'S BECOME A PRETTY AMAZING LITTLE PART OF TOWN THAT OBVIOUSLY HAS A LOT OF THE SUBSTATION ITSELF HAS, UM, UH, THERE'S A LOT TO, UM,

[01:30:01]

TO SERVICE THE AREA.

UM, AND SO W WHAT THEY TOLD ME WAS TWO THINGS.

FIRST OF ALL, THAT IT'S DIFFICULT TO DO THIS DIFFICULT THING.

AND I JUST WANT TO, TO GIVE, UM, SOME, UH, PROPS TO MS. GROSS AND MR. , UH, PEOPLE AT AUSTIN ENERGY ARE WORKING ON THIS, AND I REALLY APPRECIATE THE, THE PROGRESS THAT Y'ALL, THAT Y'ALL WOULD MADE.

IT ALSO TELLS ME THAT IT'S POSSIBLE.

SO, UM, I KNOW THIS IS DIFFICULT, I'M HOPING IT'S POSSIBLE.

AND, UH, I, I THINK LIKE A LOT OF PEOPLE, UH, ON THE PLANNING COMMISSION HAVE A LOT OF CONCERN ABOUT, UM, THIS TRAIL AND, UH, HOW IT'S HANDLED WITH AUSTIN ENERGY.

SO I WOULD LIKE TO BOTH, UM, SUPPORT THAT CONDITIONAL USE, UH, AS WELL AS COMMIT TO REVIEWING THIS AS QUICKLY AS POSSIBLE WHEN IT COMES TO BEFORE US, UH, AGAIN, OKAY.

AND, UH, WE ACTUALLY HAVE, UH, ANY OTHER VOTING AGAINST, AND I HAVE ONE MORE SPOT FOR VOTING FOR ANYBODY ELSE WANTS TO BE A COMMISSIONER.

THANK YOU.

I'M GOING TO DISAGREE WITH COMMISSIONER THOMPSON AT ONE THING, THIS ISN'T INFRASTRUCTURE FOR 40 YEARS, THIS IS INFRASTRUCTURE FOR A LONG, LONG, LONG TIME, PROBABLY WELL, OVER A HUNDRED YEARS, HUNDREDS OF YEARS, UM, YOU KNOW, I DON'T HAVE A CAR I BIKE AND I WAS TRYING TO WALK EVERYWHERE AND I LIKE TO THE DOMAIN, AND IT'S PRETTY MUCH HELL, UM, YOU KNOW, FROM A DAYTIME.

AND, YOU KNOW, I LIKE TO REALIZE HOW DIFFICULT IT IS TO BUILD HOUSING IN AUSTIN.

ANYTIME I'M PRETTY MUCH GOING ANYWHERE.

I CAN'T HELP IT TO REALIZE HOW DIFFICULT IT IS TO BIKE SAFELY IN THE CITY.

IT'S NEARLY IMPOSSIBLE, BUT WITH THE GOOD EFFORTS OF FOLKS WORKING ON THE RED LINE INITIATIVE AND SENDING THE OTHER GROUPS LIKE BIKE AUSTIN, THAT'S CHANGING, THAT'S DEFINITELY CHANGING, BUT IF WE'RE GOING TO HELP PEOPLE GET OUT OF OUR CAR, IT'S NOT GOING TO BE BY GOING CIRCUITOUS ROUTES AND DRIVING OVER CURB CUTS AND, YOU KNOW, DOING THESE TYPES OF THINGS, UM, THE CITY OF AUSTIN, AND BE VERY GOOD FRIENDS TO AUSTIN ENERGY, THEY HAPPEN TO OWN AUSTIN ENERGY.

AND SO MY GUESS IS AUSTIN ENERGY GOING THROUGH THIS CONDITIONAL USE PERMIT IS GOING TO BE TREATED QUITE WELL AND FAVORABLY, AND THEY'RE GOING TO GET TO US AS SOON AS POSSIBLE WITH THIS, BUT THIS REALLY DOES MAKE SURE THAT THERE IS A BIT MORE OVERSIGHT THERE AND THAT WE'RE GOING TO GET TO SEE A SITE PLAN, AND THAT'S A REALLY BIG DEAL.

AND THAT'S JUST HOPEFULLY THAT EXTRA MOTIVATION IN CASE OSS ENERGY NEEDED TO MAKE SURE THE SITE PLAN IS DONE CORRECTLY.

AND THE TRAIL IS IN THE CORRECT PLACE.

THAT'S ALL.

OH, COMMISSIONER DESIRE.

DID YOU, I THINK WE'RE OUT OF SPOTS, BUT GO AHEAD.

CAN I ASK THE QUESTION OF THE MOTION MAKER JUST FOR CLARIFICATION BEFORE WE SURE.

UH, MY OWN QUESTION IS, UH, CHRIS, YOUR THOMPSON.

IF I UNDERSTAND YOUR DOOR MOTION CORRECTLY, IT IS ONLY ALLOWED FOR THE USE TABLE.

SO ESSENTIALLY THERE'S NOT EVEN SAYING IF ANYTHING WILL EVER BE GREETED ON THIS SIDE.

HE JUST SAYING THAT IT MIGHT BE ALLOWED IN THE FUTURE.

DO NOT HAVE ANY IMPACT ON THE ACTUAL PROJECT FROM AUSTIN ENERGY ITSELF.

AM I CORRECT? IN MY UNDERSTANDING, MY UNDERSTANDING IS IT BY ADDING IT AS A CONDITIONAL USE, THEN ONCE THEY HAVE A SITE PLAN, THEY NEED TO GET APPROVAL FOR THAT SITE PLAN FROM THE PLANNING COMMITTEE.

THANK YOU.

OKAY.

SO WE HAVE A SUBSTITUTE MOTION MADE BY COMMISSIONER THOMPSON AND, UH, BOY, MY NOTES ARE TERRIBLE.

IT WAS THAT SECONDED BY COMMISSIONER CONLEY.

WAS THAT RIGHT? OKAY.

I GOT IT.

RIGHT.

AND IT'S TWO, UH, FOUR ON ITEM B 16 FOR THE CIVIC USES TO ADD THESE AS CONDITIONAL USES IS THE SUBSTITUTE MOTION, IS THAT CORRECT? ALL RIGHT, SO LET'S GO AND TAKE A VOTE.

UH, THOSE VOTING FOR, I HAVE NOT, UH, NINE AND THE COMMISSIONER SEEKER OKAY.

OF STANDING AND, UH, THOSE 30 AGAINST, SO THAT'S NINE VOTING IN FAVOR ONE AGAINST AND ONE ABSTAINING.

AND SO THAT ITEM, THAT SUBSTITUTE MOTION PASSES.

OKAY.

SO I AM, WE ARE AT THE END OF THE, UH, SECTION B AND WE'RE NOW GOING TO MOVE INTO NEW BUSINESS, UH,

[C1. Discussion regarding Planning Commission meeting schedule for calendar year 2021.]

ITEM C AND WHAT THIS IS.

WE DO THIS EVERY YEAR COMMISSIONERS, AND THIS IS JUST FOR DISCUSSION.

[01:35:02]

UH, THERE WILL NOT BE ANY ACTION, BUT IT'S, UH, WE'RE GOING TO LOOK AT THE CALENDAR AND, UM, STAFF, DO YOU HAVE THE, UH, BACKUP, UM, THE SCHEDULE FOR PLANNING COMMISSION, IF WE CAN GO AND PULL UP THE, UH, THIS IS A CALENDAR FOR 2021, IT WAS IN THE BACKUP MATERIAL.

UH, JUST TO NOTE HERE, THERE'S NO HOLIDAY CONFLICTS.

UH, WE HAVE MEETINGS ON A MEETING SCHEDULED FOR NOVEMBER 23RD AND, UH, THANKSGIVING THAT YEAR IS ON NOVEMBER 25TH.

SO I WOULD ALSO LIKE TO SEE, I GUESS WHEN THE, UH, YES, SORRY.

I I'VE MY INTERNET MESSED UP, BUT I DID WANT TO ALSO POINT OUT I WAS LOOKING AT THIS FOR SOMETHING ELSE THAT AISD SPRING BREAK IS THE 15TH THROUGH THE 19TH.

AND THERE'S ALSO NO CONFLICTS THERE.

THAT'S USUALLY A QUESTION THAT COMES UP.

OKAY.

THANK YOU VERY MUCH.

SO I'M NOT SEEING, UH, TRYING TO GET, I JUST WANT HIM TO LOOK AT THE WINTER BREAK PERIOD AND SEE IF THERE'S ANY CONFLICTS THERE.

UM, SO I'M NOT SURE IF WE'RE GOING TO GET THAT CALENDAR UP OR NOT.

YES, ANDREW.

SURE.

WHICH MONTH WOULD YOU LIKE? UH, JUST DECEMBER, UH, WANTING TO SEE IF THERE'S ANY CONFLICTS DURING THE WINTER BREAK.

ALSO TO NOTE THERE IS A PC MEETING TWO DAYS BEFORE THANKSGIVING IN 2021.

UH, ARE YOU SHOWING THE I'M SHOWING THAT, UH, GOT A NOTE ON THE NOVEMBER 23RD IS OUR SCHEDULED MEETING AND 25TH IS THANKSGIVING.

AND SO AS WE'RE, UH, I GUESS THIS IS JUST FOR DISCUSSION COMMISSIONERS, ANY, UH, ANY CONCERNS WITH THE, UH, 2021 CALENDAR LOOKS LIKE WE'RE GETTING READY TO SEE DECEMBER HERE.

SO, UH, THIS IS THE WINTER BREAK.

WE HAVE DECEMBER 14TH, A MEETING AND DECEMBER 28TH, WHICH IS KIND OF BETWEEN, UH, CHRISTMAS AND NEW YEAR'S.

SO THIS IS JUST FOR DISCUSSION.

ANY COMMISSIONERS WANT TO BRING UP CONCERNS.

WE WILL BE VOTING ON, UH, THIS NEXT, NEXT TIME, BUT, UH, JUST OPENING UP FOR DISCUSSION AND I GUESS LET'S GO, UH, COMMISSIONER DAR.

YES.

YEAH, I WAS JUST GOING TO SAY, I DON'T KNOW.

I GUESS I WOULD JUST RAISE THE CONCERN BECAUSE IT DOES SEEM OBVIOUS THREE DAYS AFTER CHRISTMAS.

I'M I CAN ALMOST BE SECOND AT THIS POINT.

I WILL NOT BE AVAILABLE A YEAR, A FEW DAYS AFTER CHRISTMAS, SO I HAVE VISITED THE ABILITY TO MOVE BOTH THEM MEETING DATES IN DECEMBER EARLIER, BEFORE CHRISTMAS PATH.

THAT COULD BE MORE HELPFUL.

OKAY.

I'LL WRITE DOWN THAT AS A SUGGESTION.

OKAY.

HOW ABOUT THE, UH, 23RD? UM, WOULD WE WANT TO, BUT IT'S DISCUSSION ONLY MAYBE MOVE THAT UP IN THE MONTH AS WELL, AND TAKE THAT UP, UH, MOVE THAT MEETING UP EARLIER IN THE MONTH CHAIR, UH, AS I RECALL, OUR, OUR MEETING THIS YEAR IS ALSO, UH, TWO DAYS BEFORE THANKSGIVING, IS THAT CORRECT? OR COULD WE, YES.

AND WE ARE GOING TO, THAT IS A FUTURE AGENDA ITEM.

WE WILL BE TALKING ABOUT POTENTIAL ISSUES WITH NOVEMBER AND DECEMBER, UM, AT OUR NEXT MEETING.

SO I'M GOING TO ADD THAT AS THAT, GET THAT GET ADDED ONTO, UM, AS A FUTURE AGENDA ITEM.

CORRECT.

I MEAN, LOOKING AT THAT, IT SEEMS LIKE WE HAVE A FIFTH TUESDAY IN THAT NOVEMBER.

AND SO WHETHER WE KEPT THE, THE PC MEETING ON THE 23RD OR NOT, THAT IT MIGHT BE USEFUL TO, UM, TAKE ADVANTAGE OF THAT.

SO IF WE ONLY HAD ONE IN DECEMBER, WE COULD POSSIBLY HAVE A FIFTH TUESDAY THERE.

SO WHEN WOULD WE MEET, I GUESS, WHAT IS YOUR I'M JUST SAYING? WE COULD DO EITHER ONE, WE COULD EITHER MOVE THE 23RD TO THE 30TH OR MOVE THE LATER DECEMBER ONE TO THE 30TH, JUST SO WE HAD MORE MEETINGS FOR JUST TO GET MORE CASES THROUGH.

OKAY.

IF WE WERE ONLY GOING TO HAVE ONE MEETING IN DECEMBER, IF WE HAD ONE THE DAY BEFORE DECEMBER, WHAT MIGHT HELP LEAD

[01:40:01]

THAT BACKLOG? LET'S SEE.

OKAY.

ANY OTHER DISCUSSION ON THE SCHEDULE? UH, COMMISSIONER RIGHT.

OR AS AN ALTERNATIVE, IF WE NEEDED, UH, TO HAVE, UH, TWO MEETINGS IN DECEMBER, WE COULD JUST, UM, MOVE THEM UP A WEEK.

UH, THE FIRST ONE BEING, I THINK THE SEVENTH AND THEN I THINK ZAP MEETS THOSE DAYS IS THE PROBLEM.

SO, UH, UH, MR. RIVERA, WHAT ARE KIND OF THE OPTIONS FOR MOVING OUR MEETINGS AROUND? SURE.

COME AND SHOW WRITERS ON ANDREW FERRIS.

SO I WOULD, UM, PROBABLY STAY CLEAR OF THE FIRST AND THIRD TUESDAYS.

UM, BUT YOU COULD LOOK AT A, ANOTHER DATE HAS BEEN, UM, UH, WEDNESDAY OR, OKAY.

SO I ACTUALLY LOOKED AT ALTERNATIVE DAYS OF THE WEEK.

CORRECT.

OKAY.

IS THAT BECAUSE, UH, ZONING AND PLANNING, PLANNING MEETS ON A THOSE DAYS? CORRECT.

OKAY.

ANY OTHER DISCUSSION JUST TO KIND OF VET WHAT, UH, WE HAVE BEFORE US? UH, AGAIN, WE'RE NOT GOING TO TAKE ANY ACTION, JUST KIND OF SHARING CONCERNS, IDEAS, AND THIS WE'RE LOOKING AT DECEMBER NOW, AGAIN, THE WEEK AFTER CHRISTMAS IS GOING TO BE VERY DIFFICULT.

PEOPLE GO AWAY FOR THE CHRISTMAS HOLIDAYS TYPICALLY NOW WITH COVID THEY MAY NOT, I WOULD SAY, MOVE ON THANKSGIVING WEEK, MOVE THAT TO THE FIFTH TUESDAY, WHICH IS THE 30TH, AND WE COULD LEAVE OUR SCHEDULE AS IT'S FOR DECEMBER.

AND HOPEFULLY WE CAN GET A QUORUM ON THE WEEK, THE LAST WEEK OF DECEMBER.

SO, UH, MR. RIVERA, ARE THERE, WHAT ISSUES DO WE HAVE IF WE JUST HAVE ONE MEETING IN DECEMBER CHAIR? SO BY YOUR BYLAWS, UM, IT STATES THAT FOR ANY MEETING THAT'S CANCELED OR YOU SHOULD TRY TO RESCHEDULE THAT DATE.

OKAY.

SO WE WILL, NEXT TIME WE MEET, WE'LL TRY TO COME UP WITH A, COULD BE ANOTHER DAY OF THE WEEK, UM, THAT THEY'RE GOING TO TRY TO AVOID THE FIRST AND THIRD TUESDAY, UH, FOR THE SECOND MEETING.

SO JUST BE THINKING ABOUT THAT, UH, WE MIGHT, I MEAN, IT MIGHT BE, WE MIGHT HAVE TWO WEEKS, WE'LL START, WE MIGHT HAVE TWO MEETINGS IN A ROW.

UM, MAYBE TRY ON WEDNESDAY TO FILL THAT SPOT.

UH, SO JUST LOOK AT YOUR CAP.

I KNOW IT'S WAY OUT FOR NOW.

IT'S ALMOST A YEAR, SO IT'S KIND OF HARD TO SAY.

UH, SO WE MIGHT HAVE TO JUST TAKE A DATE AND HELP WE HAVE QUORUM.

UM, BUT I DO AGREE THE 28TH AND THE 23RD ARE BOTH, UH, YOU KNOW, LESS CHANCE WE'RE GOING TO HAVE FORUM ON THOSE DAYS.

SO WE SHOULD TRY FOR SOMETHING DIFFERENT.

TRY TO MOVE THOSE.

OKAY.

ANY OTHER DISCUSSION ON THIS ITEM? ALL RIGHT, SO WE'LL, UH, WE'LL TAKE ACTION NEXT WEEK.

I MEAN, NEXT MEETING.

[D. FUTURE AGENDA ITEMS]

SO FOR ITEM, UH, FUTURE AGENDA ITEMS, AS I SAID, I WANT TO ADD AN ITEM.

UH, JUST SO Y'ALL KNOW, I PROBABLY WON'T BE HERE TO CHAIR, SO YOU'LL HAVE VICE-CHAIR, HEMPEL KIND OF LEADING, UH, THE MEETING AND, UH, WHAT WE NEED TO DISCUSS SIMILARLY.

UH, AND WE'LL DO THAT NEXT TIME, OUR ALTERNATIVE, IF WE WANT TO MOVE ANY OF THE, IF WE HAVE QUORUM, WE'RE FINE.

ON THE CHRIS ON THE WEEKEND, A WEEK OF THANKSGIVING AND THE WEEK OF, UM, CHRISTMAS, UH, JUST CHECK CALENDARS.

I KNOW IT'S, IT'S A LOT OF UNCERTAINTY GIVEN COVID, BUT, UH, IF YOU CAN COME BACK AND WE CAN KIND OF ASSESS WHETHER OR NOT WE'LL HAVE QUORUM OR NOT WE'LL KNOW WHETHER OR NOT WE NEED TO MOVE THOSE MEETINGS.

COMMISSIONER SCHNEIDER, YOU HAVE A QUESTION.

UH, I, UH, I KNOW THAT WE'VE BEEN GETTING UPDATES ABOUT THE GOVERNOR EXTENDING THE EMERGENCY DECLARATION, WHICH, UM, I DON'T KNOW IF THAT IS THE ONLY THING THAT ALLOWS US TO MEET, UM, VIRTUALLY VIA, UM, VIA VIDEO CONFERENCE.

UH, IT, THAT PROBABLY MAKES A DIFFERENCE, YOU KNOW, EVEN IF SOMEBODY IS OUT OF TOWN, WHETHER THEY CAN PARTICIPATE IN ONE OR BOTH OF THOSE MEETINGS, I BELIEVE WE'RE GOOD THROUGH NOVEMBER, BUT I CAN'T RECALL.

AND I CAN'T RECALL IF WE'RE GOOD THROUGH DECEMBER

[01:45:01]

OR IF WE CAN CONTINUE MEETING LIKE THIS WHEN NECESSARY.

UM, REGARDLESS OF THE EMERGENCY DECLARATION.

I DON'T KNOW IF THERE'D BEEN ANY DISCUSSION ABOUT THAT FROM THE CITY, SO I, I'M NOT SURE.

AND I DON'T KNOW.

UH, LET'S, WE'LL GO AHEAD.

AND, UM, I GUESS I DO HAVE A QUESTION FOR, UH, MR. RIVERA THOUGH.

WE DO HAVE, I SEE, WE DID HAVE A POSTPONEMENT AND THIS'LL BE, OF COURSE, WE'LL TALK ABOUT THIS NEXT WEEK, BUT JUST SO WE CAN TAKE THIS INTO CONSIDERATION, IS THAT STAFF POSTPONEMENT FOR THE ITEMS, SEVERAL ITEMS WE HAD ON OUR AGENDA IS THAT, UH, IS THAT LOCKED IN THOSE ITEMS THAT WERE MOVED CHAIR, COMMISSIONER IS ON AND FARRAH SAID, YES, THAT WOULD BE, BUT WHAT THE COMMISSION COULD CONSIDER IS A CONSENT AGENDA AND THEN POSTPONE THOSE ITEMS. UH, HOW WOULD THAT WORK? THE COMMISSION WOULD ONLY HEAR CONSENT ITEMS, ANY DISCUSSION ITEMS WOULD BE POSTPONED TO A FUTURE DATE.

OKAY.

SO WE WOULD PROBABLY, OKAY.

SO I THINK THERE'S SOME OF THESE WE WILL BE WANTING DISCUSSION ON.

SO I DON'T KNOW THAT THAT REALLY HELPS THE APPLICANT.

OKAY.

UM, ALL RIGHT.

UH, SO ANY FUTURE AGENDA ITEMS THAT, UH, COMMISSIONERS WANT TO BRING UP? OKAY.

I DON'T KNOW.

THERE IS SOMETHING TO BE TALKED ABOUT HERE AND NOW, BUT I'VE BEEN HEARING THAT WITH THE NEW BUILDING, GOING UP HIGHLAND MALL, IF THERE'S SOME, SOME DESIRES BY SOME STAFF, I GUESS, TO, TO PUT MOST, IF NOT ALL COMMISSIONS UP THERE.

AND I WOULD REALLY HOPE THAT WE NOT BE PUT UP THERE.

I WOULD HOPE THAT WE GET TO STAY AT CITY HALL.

IF, IF, AND WHEN THAT DAY COMES, WE'RE ALL MEETING AGAIN IN PERSON.

I, IT JUST SEEMS LIKE SUCH A GREAT CONVENIENT SPOT FOR US TO ALL MEET.

AND I KNOW THE COMMUNITY ENJOY CITY HALL FOR THE MONTH QUITE A BIT.

AND SO I DON'T KNOW IF THAT'S THE CONVERSATION WE WANT TO HAVE, OR IF THAT'S UP TO US WHATSOEVER, BUT IF WE HAVE A VOTE IN THE MATTER, I WOULD HOPE THAT WE WOULD TAKE THAT VOTE, MAYBE HAVE THAT CONVERSATION, AND THEN MAYBE YOU GUYS FEEL DIFFERENTLY, BUT CITY HALL IS PRETTY TERRIFIC.

AND COMMISSIONER HOWARD DOESN'T HAVE AN OBJECTIONS, EVEN THOUGH IT'S ONLY ONE, ONE MINUTE AWAY FROM HIS OFFICE.

I WOULD LIKE TO SAY I WOULD ACTUALLY CONCUR WITH GUM SHATTERS.

AND JUST BECAUSE I KNOW THAT WE'RE IMPROVING FANS AND SERVICE UP THERE AND IT'S SLOWLY GETTING BETTER AND WE'VE ADDED MORE BUS LINES WITH THE MAP.

I STILL THINK THE KIND OF ACCESS THAT CITY HALL DOWNTOWN HAS.

WE JUST DO NOT HAVE THAT TRANSIT ACCESS ANYWHERE ELSE IN THE CITY.

SO I WOULD, AS A DRIVER USER MYSELF, I JUST, NOT ONLY FOR MYSELF, BUT I'M CAREFUL OF THE PEOPLE WHO WOULD LIKE THEM TO SPEAK TO US AND DEPEND ON TRANSIT.

UH, SO I DON'T, I'M TRYING TO THINK OF, UM, OKAY.

SO I JUST GOT, UH, UH, MR. RIVERA JUST IS TELLING ME THAT THE GOVERNOR'S, UM, ORDER GOES UP TO NOVEMBER 8TH.

UH, BOY, I WOULDN'T EXPECT THAT TO BE EXTENDED.

I WOULD, BUT WE HAVE, I MEAN, THE, SOME THINGS HAVE CHANGED IN OUR FAVOR HERE, I THINK IN AUSTIN.

UH, BUT, UH, YEAH, THAT'S THE EXTENT OF THE ORDERS.

SO THE ORDER'S GOING TO GO 30 DAY WINDOWS AS I UNDERSTAND IT, SO, OKAY.
