UM, WE, WE HAVE FOUR SPEAKERS WHO SIGNED UP FOR INTERESTED PARTIES.

I BELIEVE ALL OF YOU WERE, WERE SWORN IN, AND IT WAS ANYBODY NOT SWORN IN.

I SAW ALL OF YOU HERE.

SO, UM, ANY OF THE COMMISSIONERS HAVE QUESTIONS FOR INSPECTOR ALVAREZ.

WE CAN ASK HIM QUESTIONS NOW WHERE WE CAN JUST LISTEN TO THE, BOTH, BOTH THE PARTY IS THE OTHER PARTY AND THEN ASK HER QUESTIONS AFTERWARDS.

OKAY.

OKAY.

SO, UM, WHAT I'LL DO IS I'M, I'M GOING TO CALL OUT YOUR NAME AND YOU CAN RAISE YOUR HAND, JUST, I WANT TO KNOW WHO'S WHO, AND THEN YOU, UM, YOU, WE HAVE THIS TABLE WITH THE MIC SET UP.

YOU'RE WELCOME TO SIT ONE AT A TIME OR IMPAIRS, OR IF ALL OF YOU WANT TO SIT THERE AND AT THE SAME TIME, YOU YOU'RE WELCOME TO USE THESE TWO CHAIRS.

UM, MR. KENDALL, HOW MUCH TIME, UH, DID, DID, UM, INSPECTOR ALVAREZ USE IN HIS PRESENTATION APPROXIMATELY 57 MINUTES.

OKAY.

SO,

[01:10:01]

UM, YOU HAVE APPROXIMATELY 57 MINUTES.

UH, YOU DON'T NEED TO USE ALL OF IT AND THAT IS COMBINED, UM, NOT EACH OF YOU INDIVIDUALLY.

UM, SO AGAIN, I'M GOING TO CALL OUT YOUR NAMES AND THEN YOU CAN GO IN WHATEVER ORDER YOU WANT TO SPEAK, OR I, AS I SAID IN GROUPS, AND, UM, WE WON'T START TIMING YOU UNTIL YOU ACTUALLY START TALKING WHEN YOU BEGIN SPEAKING, IF YOU JUST INTRODUCE YOURSELF AGAIN.

SO JESSICA SEGORA, YOU'RE NOT SPEAKING.

OKAY.

UH, BENOA RASHAD.

OKAY.

UH, AN EQUAL TRY TWICE.

AND I'M SORRY IF I GET THE NAMES WRONG AND DANIEL BENNETT DEATH.

OKAY.

SO AGAIN, WHOEVER WANTS TO SPEAK FIRST, YOU'RE WELCOME TO TAKE A SEAT.

OKAY.

THANK YOU.

AND MR. CANDELLA, YOU'LL KEEP TIME AGAIN.

THANK YOU.

WELCOME.

AND, AND INTRODUCE YOURSELF AND GO AHEAD.

UH, GOOD EVENING COMMISSION COMMISSIONER, CITY INSPECTORS.

UM, FIRST OF ALL, UH, APOLOGIES THAT WE NEED TO BE HERE.

UH, FIRST AND FOREMOST, UH, THE SAFETY AND COMFORT OF OUR RESIDENTS IS OF UTMOST IMPORTANCE.

UH, SO AS I MENTIONED, WE ARE DISAPPOINTED TO BE HERE TODAY.

THAT BEING SAID, UM, YOU KNOW, SEEING STAFF'S RECOMMENDATIONS AT THE END.

UM, TOTALLY AGREE.

AND CAN, UH, YEAH, I AGREE TO THAT.

WE, UH, HAVE EITHER THESE THINGS UNDER PROCESS, UH, RE SOME OF THESE ITEMS HAVE BEEN REPAIRED RECENTLY, OR WE ARE WORKING THROUGH, UH, THE CITY'S PERMITTING DEPARTMENT ON ALL OF THESE ITEMS. SO, UH, HAVING ALL OF THESE REPAIRS DONE IN THE NEXT 90 DAYS IS A REASONABLE AND A DESIRED OUTCOME FOR US.

AND TO BE PERFECTLY FRANK, IDEALLY, UH, SOONER THAN THAT, I WOULD LIKE TO CLARIFY AND, UH, HAPPY FOR CITY STAFF TO CONFIRM, UM, THAT THE, THE PICTURE PAINTED BY THESE EXHIBITS IS, UM, NOT NECESSARILY REPRESENTATIVE OF HOW WE OPERATE, UH, THE CITY STAFF CONFIRMED, BUT ALL OF THE SUB FLOOR UNPERMITTED WORK IS DEFINITELY OLDER THAN THE LAST 12 MONTHS, WHICH IS HOW LONG WE'VE OWNED THE PROPERTY.

AS YOU SAW WITH SOME OF THE HVC UNITS, THEY ARE SIGNIFICANTLY OLDER THAN ONE YEAR.

SO A LOT OF, TO MY KNOWLEDGE, NO UNPERMITTED WORK, UH, FOR THE FOUNDATIONS OR THE HVC WAS DONE UNDER OUR OWNERSHIP.

SO WE, UH, WE'LL WORK WITH THE CITY STAFF AND WITH OUR CONTRACTORS TO, TO BRING THAT ALL UP TO CODE AND MAKE THE REPAIRS.

BUT I JUST WANT TO KIND OF CLARIFY THAT THAT IS NOT OUR OPERATING PROCEDURES, UH, AND OUR OPERATING PROCEDURES ARE ACTUALLY MUCH MORE REPRESENTATIVE OF THE FIRE UNITS, UH, THAT WERE GUTTED FOR, UH, I WOULD SEEK CONFIRMATION FROM, UH, I ASSUME MAYBE FIRE CHIEF, BUT AT LEAST SENIOR FIRE STAFF, THAT IT IS RECOMMENDED TO REMOVE ALL OF THE DRY WALL, REMOVE THE AFFECTED FLOORING AND EXPOSE ALL OF THE ELECTRICAL AND PLUMBING SO THAT YOU CAN SEE THE EXTENT OF THE FIRE DAMAGE AND MAKE SURE THAT THE PREMISES ARE SAFE AND HABITABLE.

UH, THAT FIRE HAPPENED IN FEBRUARY.

WE HAVE NOT DONE THE NECESSARY REPAIRS AS WE HAVE BEEN, UH, FOCUSED ON OTHER AREAS OF REPAIR.

CAUSE ANOTHER THING I WOULD LIKE TO HIGHLIGHT IS, UH, TONIGHT WE DID NOT HIGHLIGHT ALL OF THE REPAIRS THAT WE HAVE MADE, UH, WHICH ARE MANY, UH, WHEN WE PURCHASED THE PROPERTY, THERE WERE WHAT WE CALL AN INDUSTRY PARLANCE 40 DOWN UNITS.

SO THAT'S VARIOUS STATES OF MISSING APPLIANCES, MISSING FLOORING, MISSING DRY WALL, ET CETERA.

UH, SO WE STARTED BY REPAIRING THOSE.

THEN IN THE FALL, WE HAD THE FIRST MAJOR OF WATERLINE ISSUE, UH, WHICH I THINK ACTUALLY STARTED BEYOND OUR PROPERTY LINE, UH, WITH THE CITY AND THEN, UH, MIGRATED OVER INTO OUR PROPERTY.

WE HAVE SINCE DONE SIX MAJOR WATER LINE REPAIRS AND CORRECT ME IF I'M WRONG, MR. ALVAREZ, BUT SOME OF THE WATER PRESSURE ISSUES COULD HAVE BEEN DUE TO THAT AS THAT IS, UH, AN ONGOING, WELL, SOME OF, OBVIOUSLY OF THE SIX WATER LINES, SOME HAVE BEEN REPAIRED NOW, BUT SOME OF THAT IS STILL ONGOING.

AND I THINK CITY STAFF CAN ATTEST THE FACT THAT THAT WORK IS HAPPENING AND IS VERY SERIOUS AND VERY MAJOR.

UM, I MEAN, ESSENTIALLY NUMBER OF THE BUILDINGS, THE PARKING WAS AN ACCESSIBLE, UM, WE HAD BUILDINGS WITHOUT WATER FOR A WHILE.

AND DURING THOSE PERIODS WE RENTED FEMA TRAILERS WERE SHOWERED AND PROVIDED ALTERNATIVE, UM, WATER ACCESS FOR, FOR OUR RESIDENTS.

BUT, UM, BY NO MEANS A PLEASANT SITUATION FOR ANYONE INVOLVED.

AND THEN THE OTHER THING I'D LIKE TO HIGHLIGHT IS, UH, THAT THE CONSTRUCTION, UH, TYPE OF THESE BUILDINGS, THEY ARE PIER AND BEAM, WHICH LEAVES THEM EXPOSED.

UH, AND SO LIKE A LOT OF THE ROCK, UH, THAT WAS HIGHLIGHTED IS ACTUALLY THERE SO THAT BECAUSE THE BUILDINGS ARE ELEVATED, THERE'S NOT A SLAB

[01:15:01]

OF CONCRETE BELOW THE BUILDINGS.

SO IT IS ROCK BENEATH.

A LOT OF THE ROCK AROUND THE HVC IS ACTUALLY THERE TO PREVENT WATER FROM ERODING.

AS WE SAW IN SOME OF THE PHOTOS THAT WERE, THERE WERE NOT ROCKS THAT ERODED UNDER THE CONCRETE PAD, BUT SO THE PREVAILING OF ROCK AROUND THERE IS ACTUALLY INTENTIONAL AND THE PIER AND BEAM CONSTRUCTION.

SO A LOT OF THESE ISSUES THAT WE ARE WORKING TO FIX ACTUALLY STEM FROM THE, UH, FREEZE THAT WE HAD IN WINTER OF 21 WITH THE ELEVATED STRUCTURE OF THE BUILDINGS, UH, AND PRIOR EITHER THE DEVELOPER PRIOR OWNERSHIP, NOT, UM, HAVING, YOU KNOW, I GUESS, WELL, I DON'T KNOW, AUSTIN IS NOT NECESSARILY USED TO HAVING FREEZING WEATHER FOR WEEKS.

I DON'T KNOW THAT WE CAN EVEN CALL IT IMPROPER, BUT WITHOUT SUFFICIENT INSULATION UNDERNEATH THE BUILDINGS THAT CAUSED THE RUPTURE OF A LOT OF PIPES, UH, WHICH OBVIOUSLY WE'VE BEEN WORKING TO FIX.

UM, BUT THAT IS THE ROOT CAUSE OF A LOT OF THAT SUB UH, BUILDING DAMAGE.

BUT ALL THAT TO SAY IS, UM, WE, UH, ARE WORKING CITY STAFF HAVE THE MEANS AND WILLINGNESS TO ADDRESS ALL OF THESE ISSUES AND LOOK FORWARD TO NOT HAVING TO COME BACK, BUT A SUCCESSFUL RESOLUTION OF ALL OF THESE ISSUES.

THANK YOU.

WAS THAT DEBT? YEAH.

THAT'S IT.

UNLESS YOU GUYS HAVE ANY QUESTIONS FOR ME? W WELL, I MEAN, I HEARD YOU SAY YOU HAD A COUPLE OF QUESTIONS, I THINK FOR INSPECTOR AUBREY'S.

I DON'T KNOW IF THEY WERE JUST HORRIBLE.

IF ANYTHING I'VE STATED IS INCORRECT, WHETHER FOR FIRE OR CITY STAFF, I'D BE HAPPY FOR ANYONE TO CORRECT ME.

OTHER COMMISSIONER, IF I UNDERSTOOD YOU CORRECTLY, YOU STARTED BY SAYING, YOU THOUGHT THESE WERE REASONABLE REQUESTS.

YEAH.

AT THE END OF THE NIGHT.

YEAH.

HAVING EVERYTHING REPAIRED WITHIN 90 DAYS IS SOMETHING THAT WE CAN ACHIEVE AND ARE WANTING TO ACHIEVE IF NOT SOONER.

OKAY.

WHERE DO YOU STAND CURRENTLY IN THE PERMITTING PROCESS? AND DO YOU EXPECT, OBVIOUSLY YOU DESIRE 90 DAYS, UM, AND YOU EXPECT TO BE DONE WITHIN THAT TIMELINE, BUT IS THERE ANY, ARE THERE ANY HOLD-UPS THERE AND WHERE DO YOU STAND IN THAT PROCESS? YEAH, THERE, THERE, UH, THE F MAJOR HOLDUP THAT WE'RE WORKING THROUGH IS, UH, ON SOME OF THESE REPAIRS, UH, THE PERMITS WERE DENIED BECAUSE WE NEEDED THE AS-BUILTS.

UH, THE PROPERTY WAS BUILT IN 1985.

WE'VE ONLY OWNED IT A YEAR.

I DO NOT HAVE THE AS-BUILTS HANDY.

UH, IT'S MY UNDERSTANDING, THOSE ARE SOMEWHERE WITHIN THE BUILDING DEPARTMENT AT THE CITY.

SO I WOULD IMAGINE WITHIN 90 DAYS, HOPEFULLY WE'LL BE ABLE TO RESOLVE THAT.

AND IF NOT, WE CAN ALWAYS WORK TO GET A NEW ASSESSMENT OF THE EXACT, UH, LOAD THAT IS GOING TO BE REQUIRED ON SOME OF THESE REPAIRS AND DO THE NECESSARY REPAIRS.

YES.

WHERE DO YOU, UH, MR. THOMPSON? YEAH, VERY SIGNIFICANT INCLINE.

UH, SORRY.

THE QUESTION WAS, ARE THE BUILDINGS BUILT ON INCLINE? YES.

I THINK ONE OF THE THINGS THAT LOOKS SCARY TO ME IS THAT YOU'RE ON AN INCLINE AND YOU DON'T HAVE MUCH SUPPORT FOR THE BUILDINGS.

UH, SURE.

UH, I MEAN, THE, THE BUILDINGS WERE BUILT TO CODE.

UM, I THINK THERE'S A LOT MORE SUPPORT THAN IS VISIBLE IN THESE PHOTOS.

UM, AND I I'M, I'M NOT AN ENGINEERING EXPERT, BUT THAT BUILDINGS HAVE BEEN STANDING STRAIGHT UP FOR 40 YEARS.

UM, I MEAN, THERE'S A LOT UNDERNEATH THOSE BUILDINGS.

UH, THE CITY HAD THEIR ENGINEER OUT AND OTHER THAN A FEW, UH, ITEMS HIGHLIGHTED IN THE VIOLATIONS AND THAT WE, UH, HAVE DISCUSSED WITH THEM THAT NOT FIND ANYTHING OF NOTE AND HOW MANY OF THESE ARE, UM, OCCUPIED, UH, ALL BUT THE FIRE UNITS.

OKAY.

COMMISSIONER FRYBERGER I JUST WANTED TO CLARIFY, ARE YOU MR. RASHARD? YES MA'AM.

OKAY.

OKAY.

AND YOU ARE ALL PART OF THE MANAGEMENT COMPANY OWNERS.

YEAH.

SO I'M PART OF THE OWNERSHIP.

SO I OVERSEE ALL OF OUR PROPERTIES.

UH, JESSICA IS OUR PROPERTY MANAGER AND WAS ONE OF OUR REGIONAL MANAGERS IN AUSTIN.

AND, UM, I'M SORRY, I'M HAVING DANIEL, UH, IS ONE OF OUR CONSTRUCTION MANAGERS, UH, FOR THE REGION.

OKAY.

AND THESE ARE ALL, ALL OF THESE UNITS ARE FOR RENT.

YES, MA'AM CONDOMINIUMS. OKAY.

CORRECT.

THANK YOU.

THAT WAS MY ONLY QUESTION, COMMISSIONER MUELLER.

UM, THANK YOU.

SO MY QUESTION FOR THE OWNER IS ONE OF THE RECOMMENDATIONS THAT STAFF MADE WAS THAT YOU HAVE AN ENGINEER PREPARE A REPORT FOR YOU ON KIND OF THE STABILITY OF THE BUILDINGS AND ALL THAT.

HAVE YOU ALREADY DONE THAT? THAT ARE IN LINE WITH THAT RECOMMENDATION AS WELL? YEAH, IT'S, IT'S IN PROCESS,

[01:20:02]

UM, WITH THE NUMBER OF BUILDINGS AND THE NUMBER OF AS YOU, IT ISSUES, UM, IT'S, IT'S TAKING SOME TIME.

YEAH.

BUT IT SEEMS LIKE THAT WOULD ADDRESS SOME OF THE COMMENTS.

PEOPLE HAVE BEEN MAKING ABOUT IT BEING ON A SLOPE AND WHATEVER, YOU KNOW, ENGINEERS WOULD BE ABLE TO SAY WHAT WAS NECESSARY.

AND WHEN, WHEN WE BOUGHT THE PROPERTY YEAR AGO, WE HAD A BASELINE REPORT DONE, BUT A CITY STAFF POINTED OUT TO ME THAT I HAD NOT REALIZED THAT IT WAS NOT STAMPED BY AN OFFICIAL ENGINEER.

UM, SO WE'RE NOW TAKING THAT NEXT STEP OF A MORE IN-DEPTH STUDY.

GREAT.

EX COMMISSIONER FRANCIS, JUST A QUICK QUESTION.

I MISSED OFFICER ALVAREZ.

I'M JUST CONCERNED ABOUT SOME OF THESE MORE PREVALENT HEALTH SAFETY ISSUES.

I MEAN, EXPOSED TO AIR CONDITIONINGS, YOU KNOW, THOSE CONTRACTORS, THAT'S A TWO 20, THAT'S ALL SITTING OPEN AND LEAVING THAT FOR 90 DAYS IS A LITTLE TROUBLING.

UM, THE OTHER STRUCTURAL STUFF THAT SEEMS REASONABLE, BUT I'M WONDERING WHAT YOUR THOUGHTS MIGHT BE ON.

WHETHER THOSE ITEMS SHOULD BE PARCELED OUT AN EXPEDITED MICROPHONE, PLEASE.

THANK YOU.

A LOT OF THOSE EXPOSED WIRINGS, IT'S A REALLY A SIMPLE FIX, JUST, YOU KNOW, HAVE A PANEL, COVER THOSE WIRES AND HAVE THE EXPOSED BOXES THAT WOULD, THAT WOULD SOLVE THAT ISSUE RIGHT AWAY.

YES, SIR.

YEAH.

I GUESS MY QUESTION IS, IS SHOULD THAT BE LIKE A 30 DAY THRESHOLD AS OPPOSED TO A 90.

I MEAN, THREE MONTHS IS A LOT OF TIME WITH THOSE EXPOSED.

IF THERE WERE CHILDREN ONSITE, I'M JUST THROWING THAT OUT THERE.

IF NO I'LL HIGHLIGHT, THEY'RE NOT EASILY ACCESSIBLE DUE TO THE TOPOGRAPHY, I'D BE, I'D BE SURPRISED TO SEE CHILDREN PLAYING AROUND THEM.

BUT I, I THINK 30 DAYS WOULD BE REASONABLE IF YOU WANTED TO REVISE THAT SPECIFIC ITEM, BUT THEY'RE NOT.

YEAH.

THEY'RE NOT EASILY ACCESSIBLE.

YES, SIR.

YEAH, I WOULD, I WOULD AGREE.

UH, LIKE I SAID, THE NOTICE OF VIOLATION WHAT'S, WHAT'S IN, YOU KNOW, BACK IN MARCH, SO THOSE 30 DAYS OBVIOUSLY ARE UP, BUT, UM, SIMPLE FIXES LIKE THAT, YOU KNOW, WHAT, WHAT WOULD PREVENT A LOT OF THAT STUFF, SOMEBODY GETTING DOWN THERE AND, OR A KID PLAYING DOWN THERE AND TOUCHING THAT A SIMPLE FIX COVERING IT UP.

IT WILL BE SUFFICE.

PART OF THAT IS YOUR RECOMMENDATION.

I'M ASSUMING YOU GUYS ARE GOOD WITH THAT.

IF IT'S 90 DAYS AND JUST WONDERED IF YOU HAD A DIFFERENT OPINION ON WHETHER THAT OUGHT TO BE IN A SHORTER THRESHOLD COMMISSIONERS I'M IF, IF A MACER, UM, DIEDRICH KNOX.

UM, THE REASON WE WENT WITH THE 90 DAYS, BECAUSE WE KNOW HOW LENGTHY THE PROCESS
