ALL RIGHT.

UM,

[Call to Order]

WE'RE GONNA GO AHEAD AND CONVENE.

UH, TODAY'S UH, CITY COUNCIL MEETING.

IT IS THURSDAY, SEPTEMBER 15TH, 2022.

WE'RE IN THE, UH, CITY COUNCIL CHAMBERS, UH, HERE IN, UH, CITY HALL.

UH, THE TIME IS, UH, 10, 12.

WE HAVE A QUORUM PRESENT.

WE HAVE A LOT OF SPEAKERS TODAY.

UH, GUYS, I THINK AS OF YESTERDAY WE HAD 131 SPEAKERS SIGN UP TO SPEAK THIS MORNING, UH, AT 10, UH, I DON'T KNOW IF THERE ARE ADDITIONAL SPEAKERS, UH, PROBABLY ARE SIGN UP AT THE KIOSK.

I DON'T HAVE A FINAL NUMBER.

UH, AND THEN WE HAVE, UM, ANOTHER 40.

SO, UH, UH, SPEAKERS, UH, I THINK, UH, ON THE, UH, ZONING, UH, TO BE CALLED AT TWO, IF WE START SPEAKERS RIGHT AWAY AND WE RUN EVERYBODY AT A MINUTE, WHICH IS WHAT PEOPLE HAVE, AND IT WORKS REALLY FAST.

THEN WE'RE PROBABLY LOOKING AT ABOUT 1230 TO FINISH SPEAKERS.

UH, WE HAVE THE, UH, PUBLIC, UH, COMMUNICATIONS SPEAKERS THAT ARE SIGNED UP AT THREE MINUTES.

EACH, IF WE GO STRAIGHT INTO THAT, IT GETS US INTO ONE O'CLOCK.

WE HAVEN'T BEEN ABLE TO TALK TO EACH OTHER YET AT THAT POINT IN TIME.

AND THAT'S PROBABLY WHEN WE BREAK FOR LUNCH, UM, SO THAT, UH, WE CAN, WE CAN GET THERE.

SO LET'S GET TO THE SPEAKERS AS QUICKLY AS WE CAN, UH, CHANGES IN CORRECTIONS, READING INTO THE RECORD.

UH, ITEM NUMBER 21 IS WITHDRAWN 31, UH, CONCERNS POLICE 37 IS WITHDRAWN.

38 IS POSTPONED TO SEPTEMBER 29TH, 2022 ITEM 42.

TWO IS WITHDRAWN AND REPLACED BY ADDENDA ITEM 89.

ITEM 65 IS RELATED TO ITEM 85 81 IS IN DISTRICT 7 85 SHOULD BE NOTICED THAT A VALID PETITION HAS BEEN FILED IN OPPOSITION TO THIS ZONING REQUEST.

ITEM NUMBER 90, UH, COUNCIL MEMBER ELLIS HAS JOINED AS A SPONSOR.

THANK YOU FOR, FOR DOING THAT.

UH, AND, UM, THE, UH, HEADER FOR COUNCIL DISCUSSION SHOULD SAY DISCUSSION AND POSSIBLE ACTION.

WE HAVE SOME ITEMS THAT HAVE BEEN PULLED OFF THE CONSENT AGENDA, THE, UH, PARKLAND DEDICATION ITEMS, 53 59, UH, 66 AND 67 HAVE BEEN PULLED.

I THINK WHEN WE GET TO THOSE, THOSE WILL MOVE FAIRLY QUICKLY.

UH, ITEM NUMBER 54, UM, AND ASSOCIATED WITH ITEM NUMBER 61 IS THE COUNCILMAN BULL HOUSE ITEM 55 IS THE CONVENTION CENTER GARAGE, UH, ITEM ASSOCIATED WITH ITEM 60, ALSO BEING PULLED ITEM 56, WHICH IS THE LICENSE PLATE READER ITEM 86, 87 AND 91.

UH, ALSO BEING PULLED.

WE HAVE LATE BACKUP IN ITEMS 3 30, 1 49, 47, 49, 50 51 52 53 54 55 56 59 61 66, 72, 73, 77, 79 81 AND UH, 85, UH, BEFORE WE GET TO, UH, UH, SPEAKERS.

UH, IS THERE ANYONE THAT WANTS TO SAY ANYTHING? COUNCIL MEMBER TOGO? YEAH, I'D LIKE TO PULL 29 AND 30 PLEASE.

OKAY.

29 AND 30 ALSO BEING PULLED.

DO YOU ANTICIPATE THOSE, UH, ARE QUICK ITEMS AND BUY QUICK ITEMS? THAT MEANS, UH, THEY'RE UP AND DOWN IN FIVE MINUTES.

I'LL HAVE TO THINK ABOUT IT.

OKAY.

I'M STILL THINK ABOUT THAT.

AND ALSO 90 PLEASE.

93, NO 90.

I DON'T THINK IT'S BEEN PULLED AND I'M GONNA PULL THAT ONE AS WELL.

THANK YOU.

OKAY.

COUNCIL MEMBER KELLY.

YES.

UM, I'VE CIRCULATED A MOTION SHEET FOR ITEM 26.

IT'S NOT MY INTENTION TO PULL THAT ITEM, BUT TO RATHER POSSIBLY ADOPT THAT ON CONSENT.

THIS IS THE LEGISLATIVE AGENDA ITEM.

YES.

AND I THINK COUNCIL MEMBER HARPER, MADISON ALSO HAS AN AMENDMENT FOR THAT.

UH, I THINK IF IT'S BEEN CIRCULATED, WE'LL SEE AGAIN, IF WE CAN HANDLE THOSE EXPEDITIOUSLY, IF ANYBODY WANTS TO DISCUSS THEM OR TALK ABOUT THEM, THEN WE'LL PULL THE ITEM AND, AND HANDLE IT IN DELIBERATIONS.

WHICH NUMBER WAS THAT AGAIN? THAT WAS, UH, ITEM 26, WHICH IS THE LEGISLATIVE AGENDA.

WE'RE GONNA SEE IF WE CAN DO THAT WITHOUT PULLING.

OKAY.

ALL RIGHT.

WE HAVE A LOT OF SPEAKERS WITH US TODAY.

YES.

UM, I WAS JUST WONDERING IF THERE WAS A, I WAS JUST WONDERING IF FOR, UH, COUNCIL MEMBER HARPER MADISON'S FOR THE INTERGOVERNMENTAL.

IF THERE WERE, IF THERE WAS A, I SAW THE MESSAGE BOARD POST, WAS THERE ALSO A

[00:05:01]

PARTICULAR MOTION FOR THE WORDING AND HOW IT WOULD APPEAR THERE? IT SHOULD HAVE BEEN CIRCULATED, UM, ON THE DI, BUT I'LL MAKE SURE THAT MY STAFF GETS YOU THAT, UH, UH, BY EMAIL AS WELL.

THANK YOU.

AND IF YOU, FOR, UH, FOR COUNCIL MEMBER KELLY, THAT'D BE GREAT.

THANK YOU.

YOU BET.

IF YOU COULD GET THOSE TO THE CLERK, SO THE CLERK CAN, UH, POST THEM INTO A BACKUP THAT WOULD ALSO BE HELPFUL.

SO COMMUNITY CAN SEE IT AS WELL.

THANK YOU, COUNCIL MEMBER.

UH, YES.

SO ON ITEM 26, THE, UH, STATE LEGISLATOR AGENDA.

YES.

ITEM.

UM, IS IT GONNA BE, UH, TOO LATE IF, UH, IF WE WROTE ON THAT TODAY AND ABOUT PUTTING IN AN AMENDMENT? NO, WE CAN PUT ON AMENDMENTS TODAY IF WE WANT TO, BECAUSE I, DURING THE VISIT OF BOSTON, I, I NOTICED THAT, UH, SOME OF THE DISCUSSION THAT HAS BEEN GOING ON ABOUT THE CAPITAL VIEW AND, UH, UH, IS THESE WIRES THAT ARE STRESSED ACROSS THAT, UM, THE, UH, THE, THE RAIL TRAIN HOOK UP TO, TO IT, AND THAT'S HOW IT RUNS.

AND THAT'S WHAT THEY'RE SAYING, THAT IT'S GONNA BLOCK THE VIEW OF THE CAPITAL, WHICH I WENT DOWN THERE AND WE SAW THAT THERE WAS A LOT OF, UH, UH, LINES GOING ACROSS THERE FOR THE LIGHTS INSECURITY, LIGHTS THAT THEY HAVE THERE IN THE SAFE WALKING LIGHTS FOR WHEN STUDENTS CROSS THE SCHOOL.

AND I JUST DON'T UNDERSTAND WHY IT'S GONNA COST A TAXPAYER, ANOTHER BILLION DOLLARS TO PUT IT UNDERGROUND, JUST TO PROTECT THAT, THAT VIEW THAT, UH, MY UNDERSTANDING OF THE LAW SAYS THAT IT'S, UH, IT HAS, SHOULD BE A, IT HAS TO BE A STRUCTURE AND NOT A, AN ELECTRICAL LINE GOING ACROSS THE STREET.

SO I WOULD LIKE TO SEE THAT PUT IN THERE ALSO.

OKAY.

IF YOU GO AHEAD AND WRITE THOSE THINGS UP OR GIVE NOTES, GIVE IT TO THE CLERK.

IF WE HAVE A LOT OF CHANGES TO THE LEGISLATIVE AGENDA, WE'LL PULL THAT ITEM AND HANDLE IT AS A, UH, PULLED, UH, ITEM.

IT SOUNDS LIKE WE MAY HAVE MORE THAN A QUICK THING TO TAKE CARE OF.

[Public Comments (Part 1 of 3)]

UH, BUT LET'S GO STARTED IN SPEAKERS, CUZ WE'RE GONNA BE, UH, HAVING THE OPPORTUNITY TO LISTEN TO THE COMMUNITY PRETTY MUCH ALL MORNING HERE.

UH, WE'RE GONNA START, I THINK WE SAID WITH, WAS IT REMOTE SPEAKERS THAT WORKED BEST FOR YOU? UH, AND I THINK THE FIRST SPEAKER, UM, UM, IS, UH, UH, AMERICAN SIGN LANGUAGE SPEAKER, CORRECT.

SO THEY ENDED UP SENDING A VIDEO, SO THEY STILL RECEIVE THE TWO MINUTES.

SO OKAY.

IF WE CAN PLAY THAT AND IT'S TYRE TK, HELLO.

MY NAME IS TYREE TALLY.

I AM ORIGINALLY FROM ALABAMA AND MOVED TO AUSTIN, TEXAS IN 2014.

AND THE REASON THAT I LOCATED HERE IS BECAUSE IT'S SUCH A SAFE PLACE WHERE I CAN BE PART OF SUCH A LARGE DEAF COMMUNITY, WHERE THERE ARE MANY ACTIVITIES, A LOT OF DIVERSE PEOPLE, AND WE HAVE GREAT TACOS IN AUSTIN.

I LOVE AUSTIN.

HOWEVER, ON MAY THE 30TH, MY LIFE WAS CHANGED DRAMATICALLY.

I WENT INTO A BLACK LIVES MATTER PROTEST AND I WAS THERE THROUGHOUT THE DAY IN THE EVENING.

AND THAT NIGHT, A P D ASSAULTED ME WITH RIFLES AND BULLETS PELLETS WITH INJURIES TO MY HEAD, MY BODY AND MY TOES.

AND I WAS VERY FORTUNATE THAT MY EYES WERE NOT IMPACTED BEING DEAF.

I COULD HAVE BEEN BLINDED.

UM, I DID NOT KNOW WHAT WAS GOING ON.

I HAD NO WARNING AND UNFORTUNATELY I WENT THROUGH, UM, POST TRAUMATIC STRESS.

I BECAME HOMELESS.

I AM STILL SUFFERING WITH WHAT HAPPENED AND I AM TRYING TO ACHIEVE SOME EQUITY.

A P D HAS PUT THE DEAF COMMUNITY AT A DISADVANTAGE.

THEY HAVE NOT KEPT THEM IN THEIR THOUGHTS.

DEAF PEOPLE RELY ON THEIR HANDS AND THEIR EYES TO COMMUNICATE.

SO I THINK THAT THE CITY SHOULD REJECT AGENDA ITEM NUMBER 56 AND SUPPORT AGENDA ITEM 86 MAYOR.

I'D LIKE TO THANK YOU AND THE COUNCIL FOR LISTENING TO MY STORY TODAY.

I APPRECIATE YOUR TIME.

THANK YOU VERY MUCH, DAVID KING.

THANK YOU.

I AM SPEAKING ON THE PARKLAND DEDICATION FEES ITEMS,

[00:10:01]

AND I'M URGING YOU TO PLEASE APPROVE THE STAFF RECOMMENDED COMMERCIAL AND RESIDENTIAL PARKLAND, DEDICATION FEES FOR LUXURY AND MARKET RATE DEVELOPMENT.

REDUCING THE RECOMMENDED COMMERCIAL AND RESIDENTIAL PARKLAND DEDICATION FEES WILL SHIFT THE COSTS FOR PARKLAND FROM LUXURY AND MARKET RATE DEVELOPMENTS TO LOW END MIDDLE INCOME TAXPAYERS.

AND YOU KNOW, THIS, IF DEVELOPMENT DOESN'T PAY ITS FAIR SHARE OF PARK END DEDICATION FEES, THOSE COSTS WILL BE SHIFTED TO LOW AND MIDDLE INCOME FAMILIES THROUGH HIGHER PARK USER FEES.

AND YOU KNOW THAT TOO REDUCING OR DELAYING PARK END DEDICATION FEES IS INEQUITABLE AND LOW TO LOW AND MIDDLE INCOME FAMILIES.

AND YOU KNOW THAT TOO.

DON'T COME BACK NEXT YEAR AND TELL THE PUBLIC, WE NEED A MULTIMILLION DOLLAR PARK BOND.

IF YOU DON'T MAKE DEVELOPMENT, PAY ITS FAIR SHARE MANY OF YOU CAMPAIGN ON MAKING DEVELOPMENT, PAY FOR ITSELF, PLEASE HONOR YOUR COMMITMENT.

PLEASE.

DON'T BE LIKE OTHER POLITICIANS WHO GET URGE VOTERS TO SUPPORT THEM AND THEN TURN THEIR BACKS ON THEM WHEN THEY'RE IN POWER, WHEN THEY HAVE POWER.

THANK YOU.

THANK YOU.

NEXT SPEAKER IS SUSAN STA SPEAKING ON ITEM 56.

HI, GOOD MORNING.

UM, I JUST WANNA SAY THAT, UM, AS A MEMBER OF THE AUSTIN COMMUNITY, I REALLY BELIEVE THAT WE NEED TO CONTINUE TO SUPPORT OUR AUSTIN POLICE DEPARTMENT, UM, WITH GIVING THEM THE TECHNOLOGY AND TOOLS NEEDED TO SAVE LIVES, CATCH CRIMINAL, AND PROTECT US.

UM, I REALLY CAN'T UNDERSTAND QUITE FRANKLY, WHY ANY CITY WOULD EVER DEFUND THEIR POLICE FORCE.

UM, IT IS MY OPINION THAT WE HAD TAKEN AWAY THE TRUST AND RESPECT, UM, OF THE POLICE, UM, DEPARTMENT.

AND, YOU KNOW, THESE ARE SOME OF AUSTIN'S FINEST PEOPLE, MEN AND WOMEN THAT ARE, YOU KNOW, PROTECTING US AND GETTING OUT THERE EVERY DAY, UM, AND SAVING LIVES.

AND, YOU KNOW, I THINK THAT, YOU KNOW, WE NEED TO GIVE OUR AUSTIN POLICE DEPARTMENT THE BENEFIT OF THE DOUBT.

UM, YOU KNOW, I DO KNOW THAT THERE ARE BAD COPS.

I RECOGNIZE THAT.

UM, I THINK THAT, YOU KNOW, EVENTUALLY YOUR TIME HAS EXPIRED.

THEY ARE THANK YOU FOR PARTICIPATING WITH US TODAY.

THANK YOU.

MM-HMM DAVID HENSLEY ON ITEM 56 AS A CONCERNED CITIZEN, EF F BOARD MEMBER AND DISTRICT 12 RESIDENT I AGAINST ITEM 56 AND URGES YOU TO CONSIDER A FEW ISSUES REGARDING THE STATEMENT OF A LDRS VIGILANT SOLUTIONS.

APTS PREVIOUS A LDR VENDOR FACE THE CLASS ACTION LAWSUIT IN 2020 FOR VIOLATING THE ILLINOIS BIOMETRIC INFORMATION, PRIVACY ACT VENDORS NEED TO BE PROPERLY AND THOROUGHLY VETTED FOR THEY TOO, HAVE ACCESS TO THE DATA COLLECTED THE LIVES THAT YOU TO PROTECT WILL BE INHERENTLY LIABLE TO VARIOUS SAFETY THREATS SIMPLY BY THE NATURE OF SUCH DATA BEING COLLECTED WITHIN THE LAST TWO YEARS FUSION CENTERS COLLABORATING WITH APD HAVE FACED SECURITY BREACHES, WHICH HAVE LED LAW ENFORCEMENT DATA BEING LEAKED ONTO TO THE INTERNET, ANY AND ALL DATA COLLECTED OR CONTEXTUALIZED BY A P WILL BE VULNERABLE TO SUCH CATASTROPHE.

THE CURRENT RESOLUTION DRAFT HAS A LOT OF LANGUAGE ABOUT THE PREVENTION OF DISCRIMINATORY POLICING PRACTICES.

SUCH LANGUAGES HAS FAILED TO PREVENT SUCH PRACTICES IN THE PAST THE PREDICTIVE POLICING FOR WHICH A P DATABASES COULD SUPPORT WOULD ENSURE DISCRIM WORTH PRACTICES.

I EMPLOY YOU TO LOOK UP THE WORKS OF LEGAL, LEGAL SCHOLAR, ANDREW FERGUSON, FOR MORE DETAILS.

THANK YOU FOR YOUR TIME AND CONSIDERATION JAMIE SEPATA ON ITEM 56.

HI, MY NAME'S JAMIE SEPATA.

I LIVE IN DISTRICT FIVE, UM, AND HAVE BEEN WORKING FOR THE LAST 10 YEARS AS A, UH, CRIMINAL DEFENSE INVESTIGATOR IN CAPITAL MURDER CASES AND WANTED TO SPEAK ON ITEM 56, UM, AGAINST, UH, TRYING TO ENACT A VERY AUTHORITARIAN SURVEILLANCE PROGRAM THAT HAS BEEN PROVEN TIME AND TIME AGAIN, TO BE PRETTY INEFFECTIVE.

AND WE SEE CONSTANTLY IN MY WORK, THE WAY THAT THESE PROGRAMS ARE USED TO VIOLATE FOURTH AMENDMENT RIGHTS OF CITIZENS AND ARE DISPROPORTIONATELY WEAPONIZED AGAINST THE POOR AND PEOPLE OF COLOR.

I WAS REALLY DISMAYED TO HEAR THAT MY OWN COUNCIL MEMBER AND KITCHEN IS A SPONSOR OF THIS KIND OF, UH, USELESS PROGRAM THAT WE SEE ACROSS THE COUNTRY.

UH, BEING USED TO, UH, TARGET ALMOST ENTIRELY PEOPLE WHO ARE NOT, UH, GUILTY OF ANY CRIME WHATSOEVER.

UH, THANKS FOR YOUR TIME.

CLEO PETRI CHECK ON 56,

[00:15:02]

I AM A LATINA DEMOCRAT AND MOM AND IDENTIFYING STOLEN CARDS AS A NORM BENEFIT BENEFIT OF LPRS, BUT IT CAN ALSO EXONERATE THE INNOCENT ALIGN WITH AMBER AND SILVER ALERTS IN ASSISTING OFFICERS AND FINDING MISSING PERSONS.

LET'S TALK ABOUT KIDNAPPING MURDER AND HIDDEN RUN CASES THAT WERE SOLVED USING LPRS PEDRO, ER, WAS CHARGED WITH 18 FELONY CO COUNTS INVOLVING NINE SEPARATE SHOOTINGS AND WAS ARRESTED.

THANKS TO LPR DATA IN SAN JOSE, CALIFORNIA, AN OFFICER WAS ALERTED OF A STOLEN VEHICLE BY HIS PATROL CAR MOUNTED LCR SYSTEM.

AFTER FURTHER INVESTIGATION, THE OFFICER DISCOVERED THE VEHICLE WAS LINKED TO THE KIDNAPPING OF A 12 YEAR OLD GIRL.

THANKFULLY HE WAS CHARGED, UH, FOR KIDNAPPING ENFORCEABLE CHILD MOLEST STATION IN ROSEVILLE, ROSEVILLE, CALIFORNIA, A 76 YEAR OLD MAN WAS KILLED IN A HIDDEN RUN ACCIDENT.

UH, WITNESS THIS WE'RE ABLE TO CAPTURE PARTIAL LICENSE PLATE OF THE CAR, WHICH WAS PROVIDED TO LAW ENFORCEMENT AND SOLVE THAT CASE.

AS OF MAY 1ST, 2022, 1,114.

CHILDREN HAVE BEEN RECOVERED AS A RESULT OF THE AMBER ALERT PROGRAM.

70% OF ALL CRIMES ARE COMMITTED WITH THE USE OF A MOTOR VEHICLE AND THE A L P CAN SEARCH THE FBI'S NATIONAL CRIME INFORMATION CENTER, HOT LIST.

THANK YOU.

SPEAKER TIME HAS EXPIRED LAW ENFORCEMENT, ANOTHER TOOL.

THANK YOU VERY MUCH FOR BEING WITH US TODAY.

STANLEY TE TELL STAR ON ITEM 56.

I APPRECIATE Y'ALL ALLOW ME TO SPEAK WITH THE RELAY SOME PERSPECTIVE FROM AN ORDINARY CONSTITUENT FOR WHICH YOU ALL REPRESENT.

UH, ACCORDING TO TRAVIS COUNTY, TX.GOV AND EXPIRED LICENSE PLATE AND REGISTRATION COMES, UH, A COMPANY WITH A FINE OF $181 FOR A GRANT TOTAL OF $267 50 CENTS.

DO YOU GET PULLED OVER AND TICKETED, UM, IS EVEN FURTHER LIKE PAY TO PLAY.

SO DO WE THINK IT MATTERS IF SOMEONE IN A TESLA FORGOT, UH, TO RENEW VERSUS SOMEONE THAT'S LIKE WAITING IN THREE WEEKS FOR THEIR PAYCHECK TO COME IN AND THEY JUST CAN'T AFFORD IT RIGHT NOW, LIKE SOMEONE THAT LIKE LITERALLY CAN'T FIND IT IN THEIR MONTHLY BUDGET TO GET THEIR CAR INSPECTED AND REGISTRATION ON TIME.

UM, BUT I REALLY WANNA CHALLENGE LIKE WHY THIS DECISION IS ON OUR FEET IN AN AGE OF SURVEILLANCE.

WE'RE CONSIDERING HANDING OVER THIS TECHNOLOGY TO THE SAME PEOPLE THAT LET RAPE TEST KITS, MOLD DUE TO THEIR APATHY AND OR COMPETENCE.

UM, I DON'T KNOW.

I, I, I HOPE NOT.

MAYBE IT'S SAID D DREDGE UP FUNDING FOR THE CITY FOR THE COUNTY, BUT LET'S GO TO THE NUMBERS.

RIGHT? SO MOVE.ORG.

UM, THE SECOND WORST CITY, THE SECOND WORST CITY IN AMERICA FOR MINIMUM WAGE EARNERS IS OUR VERY OWN AUSTIN, TEXAS.

LET'S KEEP IT.

WE RIGHT.

THANK YOU.

YOUR TIME HAS EXPIRED REPORT SHANE ING ON ITEM 56.

HELLO, MY NAME IS SHANE ING.

I APPRECIATE THE OPPORTUNITY TO SPEAK TO YOU ALL TODAY.

UM, I WANTED TO SPEAK OUT AGAINST ITEM 56, BRINGING BACK THE AUTOMATIC LICENSE PLATE READER IS A TOOL OF MASS SURVEILLANCE.

AND I THINK AS BUSINESS, WE SHOULD ALWAYS BE AGAINST TOOLS OF MASS SURVEILLANCE.

THE POTENTIAL FOR ABUSE IS NOT EVEN SHOWN ANYTIME THE DATA'S COLLECTED, IT CAN BE ABUSED.

AND I, WHILE AS SOMEONE WHO DOES SUPPORT LAW ENFORCEMENT AND BELIEVE IN, IN POSITIVE POLICE REFORM, I THINK THERE ARE OTHER OPPORTUNITIES AND WAYS TO BRING ABOUT MORE OF A WIN-WIN SOLUTION TO THIS ISSUE.

AND I HOPE WE CAN WORK TO, TO UNCOVER THAT AND NOT BRING ABOUT TOOLS SUCH AS THE AUTOMATIC LICENSE PLATE READER OR OTHER THINGS THAT WE THINK DECEPTIVELY MIGHT, UM, IMPROVE CRIME, UM, AT A COST OF, OF SECURITY, PRIVACY, AND LIBERTY.

THANK YOU VERY MUCH.

REBECCA SANCHEZ ON ITEM 56.

GOOD MORNING.

MY NAME IS REBECCA SANCHEZ, UH, LIVE IN DISTRICT ONE.

UM, I AM ALSO CALLING ON ITEM NUMBER 56 AGAINST THE AUTOMATED LICENSE PLATE READER.

I KNOW THAT THERE'S PROBABLY, UH, AN AMENDMENT GOING AROUND TODAY THAT TRYING TO LIMIT THE SHARING OF THE DATA.

AND I WOULD WITH OTHER LAW ENFORCEMENT AGENCIES.

AND I WOULD SAY THE BEST WAY TO LIMIT THAT IS TO NOT COLLECT IT.

THIS IS A PIECE OF MASS SURVEILLANCE AND IT WILL BE WEAPONIZED.

AND I THINK WE JUST KEEP OPENING THE DOOR TO MORE AND MORE, UM, JUST SURVEILLANCE ACROSS THE CITY.

AND ONCE THAT DATA IS COLLECTED, IT WILL BE WEAPONIZED AGAINST ITS OWN PEOPLE.

SO I URGE YOU ALL POLICE SAY NO TO ITEM NUMBER 56.

THE POLICE DO NOT NEED MORE TOOLS IN THEIR TOOLBOX.

IF IT'S BEEN FRAMED, THEY ARE FINE.

THEY ARE ONE OF THE THEY'RE WELL FUNDED AND THEY WILL CONTINUE TO BE WELL FUNDED TODAY TO THE STATE LEGISLATURE.

SO I THINK THAT IDEA OF IT BEING

[00:20:01]

JUST AN ADDITIONAL TOOL IS NOT TAKING INTO FACT THE HARM THAT IT CAN AND WILL BE USED TO CAUSE THINKING CHRISTINA SWANSON ON ITEM 56.

HI, GOOD MORNING.

MY NAME IS CHRISTINA SWANSON.

I'M A REGISTERED NURSE HERE IN AUSTIN, TEXAS, AND I WORKED IN THE HOSPITAL THROUGHOUT THE ENTIRE PANDEMIC.

I AM THE WIFE OF A, UH, WONDERFUL WOMAN AS A QUEER PERSON HERE IN AUSTIN.

AND I AM THE MOTHER OF A, UH, BIRACIAL DAUGHTER.

THE POLICE HAVE SHOWN THAT THEY DO NOT CARE FOR AND DO NOT RESPECT PEOPLE WHO LOOK LIKE MY DAUGHTER.

SO I AM WOULD ASK THAT YOU PLEASE VOTE AGAINST ITEM 56 IN ACCURATE READS OR SURPRISINGLY COMMON ONE RANDOMIZED CONTROL STUDY SHOWED IN VIA CALIFORNIA THAT 37% OF ALL LTR HITS FROM FIXED READERS.

AND 35% FROM MOBILES WERE MISREAD.

THE ONLY SECURE DATA IS DATA THAT ISN'T COLLECTED AT ALL.

UK SHOWED US THAT, UM, THEIR INFORMATION WAS LEAKED TO THE INTERNET.

SO PLEASE VOTE AGAINST ITEM 56.

THE POLICE DO NOT NEED ANYTHING FROM US.

TODD HITTNER 56 MORNING.

THIS IS TODD HINER DISTRICT FIVE RESIDENT THIS MORNING.

I'M SPEAKING IN FAVOR OF ITEM 56, THE AUTOMATED LICENSE PLATE READERS.

AUSTIN IS KNOWN AS A HIGH TECH CITY LICENSE PLATE.

READERS ARE HIGH TECH.

THEY CAN ASSIST LAW ENFORCEMENT WITH SILVER ALERTS, AMBER ALERTS AND KIDNAPPINGS SILVER ALERTS HELP LOCATE ELDERLY MISSING CITIZENS.

AMBER ALERTS HELP LOCATE ENDANGERED MISSING AND ABDUCTED CHILDREN AND KIDNAPPINGS ARE NOT TYPICALLY STANDALONE OFFENSES.

OFTEN THEY LEAD TO MORE HEINOUS CRIMES.

THE COST IS A MERE 114,000 7 75 OR 0.02, 3% OF OUR BUDGET.

UH, IT WOULD SEEM THAT EVERYONE ON COUNCIL SHOULD SUPPORT, ASSISTING AND LOCATING ARE LOST ELDERLY, MISSING CHILDREN AND VICTIMS OF KIDNAPPING.

THANK YOU FOR YOUR TIME GUMBO.

VERTO ON ITEM 56 AND 86.

GOOD MORNING, THURSDAY MORNING.

HEAR ME ON THIS, BUT MY NAME IS GUMBO.

I PRONOUN.

I'M A RESIDENT VIRGINIA FIVE FRAUD MEMBER, 1624, AUSTIN DSA.

I'M A ITEM 56 AND FOR ITEM 86, THE DOCTOR OVERSIGHT, UH, I'D LIKE TO ASK IF YOU'VE EVER TRIED TO PUT A INTO A BAG, UH, BECAUSE A PROGRAM IS REALLY LETTING A DATA, LARGE FAT OUT OF A VERY SMALL BAG DATA COLLECTION PROGRAM WITH ONCE DONE CANNOT BE STOPPED.

AND THAT'S SIMPLY NOT HOW DATA WORKS, NO MATTER HOW MANY DATA SECURITY APPEARANCES WE PUT UP, IT WILL BE SHARED WITH OUTSIDE AGENCIES THAT ARE UNACCOUNTABLE TO HARM THINKING OF ACCOUNTABILITY.

IT WOULD BE IRONIC TO THAT THE, A PROGRAM AND NOT PASS TO THAT.

FOR YEARS, 20 YEARS, YOU'VE BEEN ASKING FOR THE BARE MINIMUM OF ACCOUNTABILITY AND OVERSIGHT AND PUTTING THE P OFF IN THE MIDAL DELAY THAT NECESSARY OVERSIGHT AND CAPTURING YOUR OWN LEVERAGE AND NEGOTIATING OVER 30,000 COLLECTED ON A POSITION THAT DEMONSTRATES YOUR DESIRE AND NEEDS TO OVERSIGHT.

AND I HEARD YOU PASS OUT MY TIME.

I HAD DIFFICULTY UNDERSTANDING THAT SPEAKERS BREAKING UP.

IF YOU COULD CALL THAT SPEAKER.

AND IF THAT SPEAKER COULD GET A BETTER CONNECTION, UH, WE CAN PUT HIM BACK IN THE QUEUE AND HAVE HIM COME BACK AGAIN.

NEXT SPEAKER, PLEASE.

LINDSAY.

IGNATOWSKI ON 56 AND 86.

HI, I WANNA MAKE SURE MY AUDIO'S OKAY.

UM, MY NAME IS LINDSEY IGNA HOKI.

SHE, THEY PRONOUNS AND I'M A MEMBER OF A RESIDENT OF DISTRICT FOUR.

THANKS COUNCIL FOR ALL THE HARD WORK YOU'RE DOING.

AND I DID WANNA SAY TO, UM, PLEASE DO NOT VOTE TO PASS THE AUTOMATIC LICENSE PLATE READERS.

WE'VE HEARD SO MUCH OF THE HARM, BUT ALSO I'M ONE OF THE VOLUNTEERS THAT HELP COLLECT 33,000 SIGNATURES ALL SUMMER AND SUPPORT OF THE AUSTIN POLICE OVERSIGHT ACT.

UNFORTUNATELY, THE CITY CLERK WAS NOT ABLE TO VERIFY THE SIGNATURES IN TIME, BUT WE DID REACH THE MINIMUM NUMBER OF SIGNATURES NEEDED TO PUT IT ON THE BALLOT.

BUT BECAUSE OF THAT TIMING, UM, IT WOULD BE FOR THE MAY BALLOT INSTEAD OF NOVEMBER, WHICH IS JUST TOO LONG TO HAVE EFFECTS ON, UM, THE EFFECTS WE NEED FOR THE UPCOMING POLICE CONTRACT.

SO I WANNA ASK CITY COUNCIL TO PLEASE HONOR THESE 33,000 AUSTIN THAT HAVE ASKED FOR THIS AUSTIN POLICE OVERSIGHT ACT AND PASS FOR THE

[00:25:05]

CTO ON 56 86.

HI, I'M A RESIDENT OF DISTRICT NINE.

I'M CALLING TO SPEAK IN AGAINST 56 IN, IN FAVOR OF THE AUSTIN POLICE OVERSIGHT ACT, LISTENING TO THE TESTIMONY OF OTHERS.

I THINK IT'S PRETTY OBVIOUS THAT THE REASONS CITED TO PASS 56 ARE HIGHLY ANECDOTAL AND THE REASONS NOT TO PASS 56, HAVE TO DO WITH SYSTEMIC STUDIES OF HOW EFFECTIVE LICENSE PLATE READERS ARE AND HOW THEY'RE MISUSED.

PLEASE VOTE AGAINST IT.

IN TERMS OF PASSING THE AUSTIN POLICE OVERSIGHT ACT.

UM, I JUST URGE COUNSEL NOT TO DO MOST OF ANOTHER FOUR YEARS OF THE CURRENT CONTRACT WITH OUR CIVIL LIBERTIES BEING ON THE BARGAINING TABLE WITH THE POLICE, PLEASE PASS THIS.

WE NEED IT IN PLACE.

WE NEED TO NOT HAVE ANOTHER FOUR YEARS.

THANK YOU, LYNN SPRAGUE ON 56 AND 86.

MY NAME IS LYNN SBR AND I LIVE IN DISTRICT ONE GOOD MORNING COUNCIL.

UM, I'M SPEAKING IN SUPPORT OF YOU ALL PASSING ITEM 86, THE APO A, UH, WITHOUT DELAY.

UM, AS THE PREVIOUS CALLER MENTIONED, WE CANNOT WAIT FOR THE LOW TURNOUT MAY ELECTIONS TO ENGAGE IN MEANINGFUL AND DESPERATELY NEEDED POLICE OVERSIGHT.

THE CITY OF AUSTIN NEEDS THIS LEGISLATION IN PLACE AS SOON AS POSSIBLE TO MAKE SURE IT'S THERE BEFORE POLICE CONTRACT NEGOTIATIONS HAPPEN.

I'M ALSO SPEAKING AGAINST ITEM 56, A THIS TECHNOLOGY'S RISKS FAR OUTWEIGH ANY BENEFITS, INCLUDING RISK TO DOMESTIC VIOLENCE AND VICTIMS OF STALKING, AND ALSO THE RISKS TO OUR IMMIGRANT COMMUNITY MEMBERS.

WE KNOW THAT ICE REGULARLY SEEKS AND USES THIS DATA TO DISCERN THE DAILY PATTERNS OF OUR IMMIGRANT COMMUNITY MEMBERS AND DETAINS AND DEPORTS THEM WITHOUT WARRANTS THROUGH TRAFFIC STOPS.

THIS IS A DIRECT CONTRADICTION OF OUR CITY'S SANCTUARY COMMITMENTS AND SHOULD NOT BE PASSED.

THANK YOU, ANDY COCO ON 56 AND 86, ANDY COCO DISTRICT ONE.

SO WHEN YOU ADD EVERYONE WHO ARE WORKING CLASS OR IMMIGRANTS OR COMMUNITIES OF COLOR FAMILIES WITH TRANS KIDS, ABORTION SEEKERS, WOW, YOU END UP WITH A WHOLE LOT OF PEOPLE.

UH, THOSE ARE THOSE OF US BEARING THE BRUNT OF SOCIAL PROGRESS, BACKLASH THROUGH CRIMINALIZATION OF OUR VERY EXISTENCE FOR SOME OF US, AND MAYBE SOME OF YOU, AT LEAST ONE IDENTITY IN THAT LIST APPLIES TO EVERY SINGLE PERSON WE LOVE.

A L P ARE TOUTED AS AN OCCASIONAL HELPER, BUT ARE UNJUST SURVEILLANCE AND AN EASY AVENUE TO FURTHER PUNISH THOSE OF US WHO ARE ALREADY OVERLY POLICED, VIOLATING EVERYONE'S FOURTH AMENDMENT PROTECTIONS IN EXCHANGE FOR RARE BENEFITS, NOT A FAIR EXCHANGE.

I'M SPEAKING IN FAVOR OF, UH, AGAINST ITEM 56 AND IN FAVOR OF POLICE OVERSIGHT WITH PEACE AND WITHOUT DELAY.

THANK YOU.

MAGDALENE BURNS 56 AND 86.

MICHELLE MANNING SCOTT ON ITEM 56 AND 86.

I AM A REGISTERED VOTER RESIDENT OF DISTRICT SEVEN, AND I AM IN FAVOR OF ITEM 86 POLICE OVERSIGHT NOW WITH NO DELAY AND AGAINST ITEM 56, A L P ON AUGUST 31ST, 2022, THE A P D O P RECEIVED THIS PHONE COMPLAINT.

THE COMPLAINT ALLEGES HER SON WAS ARRESTED BY A P D FOR WALKING ON THE STREET, WALKING ON THE STREET IS NOT A CRIME.

HE WAS CHARGED WITH NOT PROVIDING AN ID.

HER SON HAS A MENTAL DISORDER AND MAYBE HE DID NOT UNDERSTAND THE QUESTION HE WAS BEING ASKED BY A P D.

HER SON IS NOT FROM AUSTIN AND DOES NOT KNOW ANYONE HERE HE'S BEING HELD IN IMMIGRATION INSTEAD OF TRYING TO HELP HER SON, THEY ARRESTED HIM AND HE DID NOT COMMIT ANY CRIME.

SHE WANTS TO KNOW MORE ABOUT THE SITUATION.

THERE SHOULD HAVE BEEN A MENTAL HEALTH TEAM INSTEAD OF HE JUST CROSSED THE BORDER.

HER SON HAS BEEN HERE FOR YEARS, PAYS TAXES AND WENT TO SCHOOL.

THE PEOPLE WHO KNOW HER SON KNOW HIS MENTAL STATE, HER SON RESPECTS THE POLICE AND HE WAS PROBABLY NERVOUS.

DID NOT KNOW HOW TO RESPOND TO THE POLICE.

HE LOST HIS PHONE AND MONEY.

HER SON PULLED THE POLICE.

HE, HER SON TOLD

[00:30:01]

HER THE POLICE TOOK HIS ID.

WHY DID THE POLICE THROUGH YOUR TIME? HASN'T EXPIRED.

THANK YOU FOR, THANK YOU FOR YOUR ATTENTION.

WE HAVE MR. VROS BACK ON THE LINE.

THANK YOU.

UH, GOOD MORNING.

CAN YOU HEAR ME BETTER NOW? YES, WE CAN PLEASE GO AHEAD.

OH, BEAUTIFUL.

GOOD MORNING, THURSDAY MORNING.

MY NAME IS GUMBO.

YOU SAY THEM PRONOUNS.

I'M AT 50 65 JOB MEMBER OF 1624 IN AUSTIN DSA AGAIN, ITEM 56 AND FOR ITEM 86, UH, I'D LIKE TO ASK IF ANY OF YOU HAVE EVER TRIED TO FOOT A CAT INTO A BAG, UH, CAUSE PASSING THE A RPR PROGRAM WILL BE LETTING A DANGEROUS AND LARGE CAT OUT OF A REALLY SMALL BAG.

IT'S A DATA COLLECTION PROGRAM, WHICH ONCE THE GUN CANNOT BE STOPPED AND IT'S JUST NOT HOW DATA WORKS, NO MATTER HOW MANY APPEARANCES THE SECURITY PUT UP, IT WILL BE SHARED WITHOUT SENDING UNAC ACCOUNTABLE PEOPLE INVOLVED.

WE USE TO FIND PEOPLE IN THE CITY, SPEAKING OF ACCOUNTABILITY, IT WOULD BE IRONIC TO FACT IT WITHOUT PASSING APO.

FOR YEARS UPON YEARS, WE HAVE BEEN ASKING TO THE BARE MINIMUM OF ACCOUNTABILITY AND CIVILIAN OVERSIGHT AND PUTTING THE APO OFF TO THE MAY BALLOT, FURTHER DELAYS THAT NECESSARY OVERSIGHT, HAMS YOUR OWN LEVERAGE IN NEGOTIATING INSTITUTION.

SO FAST APO NO DELAY AND YIELD TIME.

THANK YOU.

MAGDALENE BURNS BURN SAID ALICIA.

THORE ON 56, MARA KENNY ON 56 AND 86.

HI, MY NAME'S MA KING.

I LIVE IN DISTRICT SEVEN.

I AM A LICENSED SOCIAL WORKER HERE IN AUSTIN.

I AM SPEAKING AGAINST ITEM 56.

I FEEL REALLY CONCERNED ABOUT THE IMPACT OF A P ON SPECIFICALLY IMMIGRANT MEMBERS OF OUR COMMUNITY.

MAY RATHER HAVE ADMITTED THAT THE CITY WOULD BE LEGALLY BOUND TO TURNOVER, DATED ICE IF REQUESTED.

OKAY.

VOCATION DATA CAN ALREADY BE SHARED WITH ICE FOR CIVIL IMMIGRATION ENFORCEMENT, WHICH CAUSES FAMILIES TO BE SEPARATED THROUGH DETENTION AND DEPORTATION.

MAYBE D HAS PREVIOUSLY SHARED UNNECESSARY INFORMATION WITH ICE THROUGH THE AIR FUSION CENTER.

I'M ALSO SPEAKING IN SUPPORT OF COUNCIL PASSING ITEMS, 66, THE AUSTIN POLICE POLICE OVERSIGHT ACT.

THE CITY SHOULD NOT BE FORCED TO CONCEDE EVEN MORE MONEY IN FOR YEARS TO COME BY STATE LEGISLATION IN EXCHANGE FOR EXTREMELY BASIC AND MINIMAL TRANSPARENCY AND OVERSIGHT FROM THE AUSTIN POLICE ASSOCIATION.

PLEASE DO NOT WAIT FOR THE LOW TURNOUT.

MY ELECTION.

THANK YOU FOR YOUR TIME.

GREG LEON ON 56, 86, 87 AND 91.

HI, MY NAME'S GREG BOSLEY.

I AM A RESIDENT OF DISTRICT THREE AND A MEMBER OF AUSTIN DSA.

AND I'M JOINING THE CHORUS OF CITIZENS WHO ARE TESTIFYING AGAINST FUNDING FOR ARS AND IN SUPPORT OF, UM, THE DIRECT PASSAGE OF, UH, THE APO A, UM, WE'VE HEARD THAT THERE'S NO EVIDENCE THAT A LS REDUCE CRIME.

UM, IT DOESN'T TAKE AN EXPERT TO UNDERSTAND THAT THE BROAD SWEEPING SURVEILLANCE METHODS THAT WERE PIONEERED DURING THE FAILED WAR ON DRUGS, UM, DON'T KEEP US SAFE.

SURVEILLANCE TOOLS HAVE, AND WILL ALWAYS BE USED TO TARGET SOCIAL AND POLITICAL MOVEMENTS AND VULNERABLE PEOPLE IN OUR CITY AND OUR COUNTRY.

THE CITY WILL NOT BE ABLE TO PREVENT ICE AND OTHER AGENCIES FROM USING ARS TO SEPARATE FAMILIES USING CRUEL DETENTION AND DEPORTATION, UM, AND TO TRACK PEOPLE WHO ARE SEEKING ABORTION.

UH, WE ALSO MUST PASS THE APO A WITHOUT DELAY.

IN ADDITION TO POLICE ABUSE OF SURVEILLANCE, UM, A P D'S USE OF VIOLENCE TO INJURING KILL WORKING CLASS BLACK AND BROWN CITIZENS, IMMIGRANTS, WOMEN, AND THE LOCAL NATIONAL MASS UPRISINGS AND PROTESTED.

THESE POLICIES, UM, UH, SHOWED THAT WE NEED URGENT ACTION.

ACTION SPEAKER.

YOUR TIME HAS EXPIRED IMMEDIATELY.

THANK YOU, CONNOR.

BROY ON 56 AND 86.

HI, GOOD MORNING.

TODAY.

I'M CONNOR.

BROY HE HIM? I'M SPEAKING IN OPPOSITION OF ITEM 56.

WE REJECT THE USE OF A L P IN AUSTIN AND

[00:35:01]

IN FAVOR OF ITEM 86 TO IMMEDIATELY ENACT POLICE OVERSIGHT ACT AS SOON AS POSSIBLE, THE ALLOW APD TO TRACK AND SHARE THE WHEREABOUTS OF THOSE SEEKING THE PORTIONS TO OUTSIDE LAW ENFORCEMENT THAT WILL CRIMINALIZE HEALTHCARE OUTSIDE OF THE CITY, UNDERMINING RACIST PROTECTIONS, TEXAS CRIME REPORTS ALSO SHOW A SIGNIFICANT DECREASE IN CRIME SOLVE EVERY SINGLE YEAR THE A WERE ORIGINALLY IN USE.

SO DESPITE THE CITY GIVING AWAY OUR PRIVACY, YOU ALSO PAY THE DEPARTMENT MORE EVERY SINGLE YEAR TO DO THEIR JOB WORSE JUST AS WE NO LONGER HAVE THE ABILITY TO DEFUND A FAILING DEPARTMENT, YOU HAVE NO WAY OF STOPPING THE STATE FROM LIVE ACCESS.

THE AAL MEANING AIM DATA COLLECTED REGARDLESS OF ITS HEALTH FOR 30 DAYS OR 30 SECONDS COULD END.

THIS COULD BE STASHED BY THE STATE FOR ETERNITY.

A ALSO HAVE A FUNDAMENTAL LACK OF OVERSIGHT AND NO FEASIBLE ACCOUNTABILITY.

CODE FRACTIONS ONLY HAVE A RISE TO AN INTERNAL INVESTIGATION OR REFERENCE TO OVERSIGHT BOARD, BOTH OF WHICH CAN SWEPT AWAY DUE TO A LACK OF CASE TO EMBARRASS THE DEPARTMENT.

SO THANK YOU ALL FOR YOUR TIME AND YOUR CAREFUL CONSIDERATION TODAY ON HOW WILLING YOU ARE TO GIVE A WEAPON TO A FAMILY DEPARTMENT THAT CANNOT BE TAKEN BACK.

THANK YOU.

YOUR TIME HAS EXPIRED.

YEAH.

CLAUDIA MUN ON 56.

HI, UM, MY NAME IS CLAUDIA MUNEZ.

I LIVE IN DISTRICT, UM, NINE AND I AM THE COURT EXECUTIVE DIRECTOR OF GRASS ISSUES.

I'M CALLING TO REGISTER OPPOSITION.

ONE OF THE FIRST CALLERS TOLD YOU HOW PHYSICAL WEAPONS OF POLICING ACTUALLY HEARD HIM A LOT.

THE, A PS ARE NOT PHYSICAL.

THEY'RE SOMETHING THAT YOU CANNOT SEE THEY'RE NOT TANGIBLE.

AND THIS GREAT CITY THAT PRIDES ITSELF IN BEING TECH FORWARD UNDERSTANDS VERY LITTLE ABOUT THE ADAPTATION OF POLICING TOOLS.

A DATA CAN BE SHARED, MAINTAINED AND SOLD WITHOUT YOU EVEN KNOWING.

SO I INVITE ALL OF YOU TO, INSTEAD OF TRYING TO GIVE THE POLICE NEW WEAPONS THAT MOST OF YOU HONESTLY DON'T EVEN UNDERSTAND.

UM, AND YOU DON'T UNDERSTAND HOW THE CONTRACTING HAPPENS, HOW THE SELLING HAPPENS, THAT YOU GET TO KNOW THAT TECHNOLOGY BETTER INSTEAD OF JUST BLANKET GIVING THE POLICE MORE TOOLS TO BE USED AGAINST VULNERABLE COMMUNITIES.

SO PLEASE DON'T KNOW ON ITEM 56.

THANK YOU, SAM.

PATAS ON 56 AND 86.

HI, MY NAME IS SAM PATAS.

I'M A RESIDENT OF DISTRICT SEVEN AND I AM, UH, ING COUNCIL TO VOTE TOUR, UH, 86 AND AGAINST 86, JUST ADDING TO THE COURSE AS ALREADY SPOKEN HERE TODAY.

UM, SOMEONE SPOKE ABOUT THE AMENDMENT OF LIMITING THE DATA SHARING, UM, FOR 56 AND HOPING, HELPING TO PASS IT THAT WAY.

AND I THINK THAT'S JUST, UM, YOU KNOW, A BILL OF A BILL OF FALSE GOODS.

UH, THERE'S REALLY, THE ONLY WAY TO COLLECT DATA SAFELY IS TO NOT COLLECT IT AT ALL.

WE HEARD HOW, UH, HARMFUL THESE PROGRAMS CAN BE.

UM, SO I REALLY HOPE YOU ENACT THESE OVERSIGHT AS SOON AS POSSIBLE AND DO NOT PASS THIS HARMFUL, UH, SURVEILLANCE TOOL IN OUR CITY.

THANK YOU, BEN SU TO BE ITEM 56, 86 AND 87.

HI, I'M BEN SETE RESIDENT OF DISTRICT FOUR.

I USE HE HIM L PRONOUNS.

I WANTED TO SPEAK IN OPPOSITION TO ITEM 56 IN FAVOR OF 86 AND AGAINST 87.

UH, AS WE'VE HEARD MANY PEOPLE MENTION, THE ONLY WAY TO SECURE, UH, IS TO SECURE THAT DATA IS TO NOT COLLECT IT AT ALL.

THERE'S NO LEGAL MECHANISM THAT YOU HAVE TO PREVENT THE STATE FROM FORCING YOU TO SHARE THAT DATA IN REAL TIME WITH DPS, WHO'S TRYING TO GO AFTER PEOPLE WHO ARE SEEKING ABORTION, HEALTHCARE OR HEALTHCARE FOR THEIR TRANS KIDS, THERE'S NOTHING YOU CAN DO TO PREVENT ICE FROM GATHERING THAT DATA TO TARGET OUR COMMUNITY MEMBERS.

FRANKLY, I AM SHOCKED TO SEE SOME OF THE SPONSORS ON ITEM 56, AND IT CALLS INTO QUESTION YOUR DEDICATION TO THE PROTECTION OF OUR COMMUNITY MEMBERS.

MANY OF THE ARGUMENTS OF THOSE WHO HAVE SPOKEN IN FAVOR, HE DISCONNECTED.

SO WE WILL CALL HIM SO THAT HE CAN CONCLUDE HIS STATEMENT.

CASSIE SODO ON 56, 86, 87 91.

HI, MY NAME IS CASSIE SORAN SHE? HER PRONOUNS.

I'M A DISTRICT NINE RESIDENT AND I'M SPEAKING AGAINST A L P AND IN SUPPORT OF THE A P A I ALSO OPPOSE ITEMS, 87 AND 91.

UH, DATA SHOWS A L P ARE LARGELY INEFFECTIVE.

WE DON'T NEED TOOLS OF

[00:40:01]

MASS SURVEILLANCE, PERPETUATING HARM BY PUTTING RESIDENTS ALREADY UNJUSTLY DISCRIMINATED AGAINST AT RISK.

THE SYSTEM WE HAD IN 2019 GAVE ICE AGENTS AND OTHER POLICE DEPARTMENTS DIRECT ACCESS TO PEOPLE'S DATA.

BOTTOM LINE, WE CAN'T TRUST A P D WITH DATA ON THE MOVEMENTS OF PEOPLE, NOT SUSPECTED OF VIOLATING ANY LAW.

IT WILL UNDOUBTEDLY HARM MORE PEOPLE THAN IT WILL HELP, UH, TO THINK OTHERWISE IS A GRAVE AND MORAL MISTAKE.

FURTHERMORE, I SUPPORT THE APO A AS IT WILL DETER POLICE BRUTALITY AND MISCONDUCT AND CREATE A LITTLE BIT MORE TRANSPARENCY.

THE CURRENT POLICE CONTRACT PROHIBITS OPO OR ANYONE ELSE BESIDES THE POLICE FROM GATHERING EVIDENCE OR INTERVIEWING WITNESSES, THE APO A WILL ALLOW ALL LEGITIMATE COMPLAINTS TO BE INVESTIGATED AND HELD ACCOUNTABLE INSTEAD OF IGNORED.

WHAT MORAL REASON IS THERE TO VOTE AGAINST TRANSPARENCY? UH, PLEASE SUPPORT THE APO A AND REJECT AL THANK YOU, SARAH SUMMERS ON 56, 86, 87 AND 91.

HI, MY NAME IS SARAH SUMMERS AND I LIVE IN DISTRICT NINE.

I'M A SINGLE PARENT, A GRADUATE STUDENT AT UT AND A MEMBER OF THE SOCIAL ACTION COUNCIL AT BIRTH HUMANITARIAN UNIVERSALIST CHURCH, AUSTIN.

I'M CALLING YOU TO SPEAK AGAINST A L P AND FORD, A P A A L GET EVERYONE'S LICENSE PLATE.

YET ONLY 0.0 0.5% OF THESE SCANS ARE CONNECTED TO ANY CRIME.

ADDITIONALLY, AS OTHER SPEAKERS HAVE SAID, DATA IS STORED AND MASSIVE AMOUNTS OF DATA COLLECTED FROM A LPR HAS BEEN LEAKED BEFORE, LIKE IN THE UK, AS ANOTHER SPEAKERS POINTED OUT, I'LL REMIND YOU THAT A ARE PROVEN TO BE UP TO 35% INACCURATE, TEXAS A AND M RESEARCH HAS ALSO SHOWN THAT WEATHER CAN AFFECT A CAMERA'S ABILITY TO READ A LICENSE PLATE CORRECTLY.

WE'VE ALSO SEEN PRIVATE DATA USED TO TARGET WOMEN SEEKING REPRODUCTIVE CARE ALREADY.

AS WHEN FACEBOOK SHARE INFORMATION WITH POLICE, A L P R DATA, UH, CAN BE USED AND WEAPONIZED IN THIS WAY.

POLICE DO NOT RENEW THIS CONTRACT WITH AUTOMATIC LICENSE PLATE LEADERS FOR APO A CITY COUNCIL MADE A COMMITMENT TO REALIZING RACIAL JUSTICE AND EQUITY IN 2020.

AND WE KNOW A HUGE PART OF THIS INCLUDES POLICE ACCOUNTABILITY, THE A WILL HELP PROTECT BLACK AND BROWN COMMUNITIES IN OUR CITY AND WAIT FOR THE MAY BALLOT.

THANK SPEAKER.

TIME HAS EXPIRED.

THANK YOU, ALICIA TORRES ON 56.

HELLO.

MY NAME IS TORRES.

I'M CALLING TO I'M A MEMBER OF DISTRICT, UH, THREE, AND I'M CALLING, UM, AGAINST ITEM SIX AND IN SUPPORT OF ITEM 86, IT SHOULD BE ITEM 86 SHOULD BE PASSED.

UM, TODAY WE ARE CITY THAT, UM, THROUGH ACTION REALLY WANTS SENT, UH, THOSE MOST DIRECTLY IMPACTED, UM, IN REGARDS TO AUTOMAT LICENSE PLATE RE UH, AUTOMAT LICENSE PLATE READERS.

I THINK THE, THE COMMUNITY HAS SPOKEN LOUDLY CLEAR TODAY.

UM, THIS IS SOMETHING THAT WE DID AWAY IN 2020, BECAUSE IT SHARED THAT IT DIDN'T KEEP US SAFE.

UM, I THINK, AND THE OTHER MEMBERS HAVE OTHER COMMUNITY MEMBERS HAVE BROUGHT UP THAT THIS IS A TOOL THAT WITHOUT ANY TRUE AND HONEST, INTENTIONAL POLICE ACCOUNTABILITY CAN AND WILL BE WEAPONIZED AGAINST US.

UM, WE ALSO SHOULD NOT BE LED TO BELIEVE THAT IF, UM, PROVIDED THIS TOOL, UM, THIS DATE WILL NOT COME IN AND FURTHER WEAPONIZE IT AGAINST US.

WE SHOULD NOT ALIGN OURSELVES TO THE STATE OF OUR, OF OUR STATE AND THE MOVEMENT TO THE EXTREME RIGHTS THAT WE'RE DOING AND, UM, TO PRETEND TO PROTECT US VIA SOME AMENDMENT.

THANK YOU, SPEAKER YOUR TIME HAS EXPIRED, NOT PASS LIST FOR TODAY.

THANK YOU FOR PARTICIPATING WITH US TODAY.

WE APPRECIATE IT.

THANK YOU, MEGAN.

MEGAN MARVIN ON 56, 86, 87 AND 91.

GOOD MORNING.

MY NAME IS MEGAN MARVIN.

I LIVE IN WORK IN DISTRICT THREE.

I DO NOT SUPPORT REINSTATING A L P CAUSE THE POLICE SHOULD NOT POSSESS THAT KIND OF DATA WITHOUT A WARRANT.

AND IT WOULD BE INCREDIBLY IRRESPONSIBLE IF YOU APPROVE A LPRS WITHOUT PASSING THE POLICE OVERSIGHT ORDINANCE DIRECTLY AND IMMEDIATELY WAITING FOR A LOW TURNOUT ELECTION IS NO MORE DEMOCRATIC THAN PASSING AN ACT THAT WAS BROUGHT TO YOU BY OVER 30,000 CONSTITUENTS.

NOW, THE DELAYING UNTIL MAY IS EFFECTIVELY A DELAY UNTIL 2027.

AND YOU KNOW THAT THE CONSEQUENCE OF ANY DELAY WOULD BE BORN BY THE SAME GROUPS OF PEOPLE WHO HAVE BEEN BEARING THE BURDEN OF POLICE MISCONDUCT

[00:45:01]

ALL ALONG LIKE OUR FIRST SPEAKER.

AND YOU KNOW THAT TOO, IF OFFICERS KNOW THEY WILL FACE DISCIPLINE FOR MISCONDUCT IN BRUTALITY, THEY WILL DO IT LESS.

AND THAT'S WHAT WE'RE AFTER.

THANK YOU FOR YOUR TIME.

LOGAN MORALES, HELLO CITY COUNCIL.

MY NAME IS LOGAN MORALES AND I'M A RESIDENT OF DISTRICT FIVE.

I'M SPEAKING TODAY IN SUPPORT OF THE AUSTIN POLICE OVERSIGHT ACT AND ITS IMMEDIATE PATHOGEN TO LAW BY COUNCIL.

I UNDERSTAND SOME OF YOU WANT TO DELAY A VOTE ON THIS UNTIL MAY IN ORDER TO SEE WHAT THE VOTERS SAY, BUT WE ALREADY KNOW WHAT THE VOTERS SAY.

I SPENT THIS SUMMER ACTUALLY TALKING TO THEM AND ASKING THEM TO SIGN A PETITION THAT WOULD CREATE A SYSTEM OF TRANSPARENCY AND ACCOUNTABILITY THROUGH THIS ACT.

OUR SMALL TEAM COLLECTED OVER 33,000 SIGNATURES AND JUST A, A FEW SHORT MONTHS.

SO WE ALREADY KNOW THIS HAS BROUGHT VOTER SUPPORT.

ADDITIONALLY, I'M VERY FRUSTRATED WITH THE NOTION THAT WE SHOULD DELAY THE VOTE BECAUSE THAT IS AN INCREDIBLY PRIVILEGED STANCE TO BE ABLE TO TAKE.

MAYBE YOU CAN AFFORD TO DELAY THIS VOTE, BUT THINK OF ALL OF THE MARGINALIZED COMMUNITIES IN AUSTIN WHO CANNOT AFFORD TO WA PLEASE ACCOUNTABILITY, PLEASE MISCONDUCT IS HAPPENING NOW.

AND IT'S GOING TO KEEP HAPPENING UNTIL MAY.

AT THE VERY LEAST, THE PUBLIC SHOULD KNOW ABOUT IT.

AND THIS ACT IS THE WAY TO DO IT.

WE NEED POLICE OVERSIGHT.

NOW, NOT LATER ALSO TO LEAVE OFF, I URGE YOU TO VOTE NO ON A THANK YOU FOR YOUR TIME.

BEN SU AS MANY CALLERS HAVE ALREADY MENTIONED, WE NEED POLICE OVERSIGHT RIGHT NOW.

NO DELAY THERE'S OVERWHELMING SUPPORT FROM THE COMMUNITY.

IT WAS JUST DEMONSTRATED BY THEN COLLECTING SO MANY SIGNATURES THAT YOUR OWN CITY CLERK WASN'T ABLE TO GET IT ONTO THIS NOVEMBER BALLOT, A DELAY, UH, UNTIL YOU KNOW, MONTHS LONG, UH, TO A LOW TURNOUT ELECTION, WON'T SERVE THE, THE INTERESTS OF DEMOCRACY.

THERE IS MASSIVE SUPPORT FOR THIS.

YOU HAVE THE POWER TO ENACT THAT.

GO AHEAD AND DO THAT TODAY ON 86, NO, ON 87.

AND IT'S NO ON LICENSE PLATE READERS.

THIS DATA WILL BE ABUSED AND IT'LL, IT'LL GET OUT OF YOUR HANDS.

EVEN YOUR BEST INTENTIONS WILL BE MISUSED BY THE STATE AND BY FEDERAL ENTITIES THAT DON'T HAVE OUR INTERESTED IN MIND.

UH, YOUR RECORDS, YOUR VOTES ON THIS WILL GO DOWN IN RECORD AND IT WILL BE A SIGN TO FUTURE GENERATIONS TO YOUR STANCE ON THE PROTECTION OF INDIVIDUALS WHO ARE BEING TARGETED RIGHT NOW, PLEASE VOTE NO ON SHELBY BOHANNON ON 86.

HI, UM, MY NAME IS SHELBY BOHAN.

I'M A RESIDENT OF DISTRICT NINE AND I'M DEMANDING THIS COUNCIL TO IMMEDIATELY ADOPT THE AUSTIN POLICE OVERSIGHT ACT AND NOT WAIT TO PLACE IT ON THE MAY BALLOT.

THE CITY OF AUSTIN NEEDS THIS LEGISLATION IN PLACE AS SOON AS POSSIBLE TO ENSURE IT HAS AN IMPACT ON THE ONGOING POLICE CONTRACT NEGOTIATION.

I'M ALSO DEMANDING THAT THE COUNCIL REJECTS A L PR, WHICH WOULD PUT BROWN AND BLACK PEOPLE, UNDOCUMENTED IMMIGRANTS, AND THOSE SEEKING ABORTIONS IN SERIOUS DANGER.

THE CITY OF AUSTIN HAS PAID OUT OVER 14 MILLION IN SETTLEMENTS, JUST FROM THE 2020 PROTEST, BUT HAS NOT DISCIPLINED ANY OFFICERS, INCLUDING THOSE INDICTED BY A GRAND JURY FOR THEIR CONTACT CONDUCT.

DURING THOSE PROTESTS, NOR HAS THE DEPARTMENT ISSUED DISCIPLINE OVER THE MORE THAN 100 EXAMPLES OF FALSE ARRESTS IN EXCESSIVE FORCE.

AFTER AN AUDIT OF BODY CAM VIDEO, THE VOTERS OF AUSTIN ELECTED YOU TO PASS LEGISLATION AND YOU MUST PASS A P A DIRECTLY AND IMMEDIATELY RESTORING REASONABLE AND BASIC FUNCTIONS TO THE OFFICE OF POLICE OVERSIGHT WITH A NO BRAINER AND HAS WIDESPREAD REPORT OF SUPPORT WITH AN OVERWHELMING 33,000 SIGNATURE SELECTED WHEN THE CITY NEGOTIATION WITH THE APA.

THANK YOU HAREN ZABARI ON ITEM 56 HAREN ZABARI PLEASE UNMUTE CYNTHIA VAN MAN MANON ON 86.

GOOD MORNING, MARI COUNCIL.

I'M CYNTHIA VAN MANNON, EXECUTIVE DIRECTOR OF THE TRAVIS COUNTY DEMOCRATIC PARTY.

AND I'M SPEAKING ON BEHALF OF T CBP TODAY IN SPORT OF ITEM

[00:50:01]

86, AUSTIN RESIDENTS OVERWHELMINGLY SUPPORT CITIZEN O OVERSIGHT AND GREATER ACCOUNTABILITY OF OUR POLICE DEPARTMENT T CDP ENDORSED BY RESOLUTION MAJOR IMPROVEMENTS TO POLICE, ACCOUNTABILITY AND TRANSPARENCY DURING THE LAST CONTRACT NEGOTIATION IN 2017, AND WE ENDORSED THE AUSTIN POLICE OVERSIGHT ACT IN JUNE OF THIS YEAR, WE TRUST THE ELECTED MEMBERS OF THE AUSTIN CITY COUNCIL TO REPRESENT AUSTIN RESIDENTS AND THEIR OVERWHELMING SUPPORTIVE ACCOUNTABILITY AND OVERSIGHT IN THE UPCOMING POLICE CONTRACT NEGOTIATIONS, REGARDLESS OF THE MECHANISM BY WHICH THAT IS ACCOMPLISHED.

WE TRUST YOU TO MAKE DECISIONS THAT WILL BUILD TRUST AND FOSTER A PUBLIC SAFETY SYSTEM THAT WORKS FOR ALL TONIGHT.

THANK YOU FOR YOUR CONSIDERATION, JEN MAR ON 86.

HI, I'M JEN MARGULIES DISTRICT ONE SPEAKING TODAY IN FAVOR OF THE POLICE OVERSIGHT ACT ITEM 86 AND AGAINST ITEM 56, THE AUTOMATIC LICENSE PLATE READERS MAKING THE RIGHT VOTES ON BOTH.

THESE MEASURES WILL ALLOW AUSTIN TO CONTINUE BUILDING TOWARDS OUR PUBLIC SAFETY VISION, WHICH VOTERS AND THE MAJORITY OF COUNCIL HAVE IDENTIFIED OVER AND OVER AGAIN AS CRUCIAL PRIORITY FOR OUR CITY.

FIRST OF ALL, CIVILIAN OVERSIGHT OF LAW ENFORCEMENT SHOULD BE NON-NEGOTIABLE.

WE'VE SEEN WHAT HAPPENS.

YOU'VE HEARD TODAY WHEN WE LET THE POLICE POLICE THEMSELVES, IT'S COSTLY IN TERMS OF HUMAN LIVES AND CITY DOLLARS OVER 30,000 AUSTINITE DEGREE.

AND WE CAN'T LET ANOTHER CONTRACT NEGOTIATION GO FORWARD WITHOUT HAVING FIRST RESTORED.

THE BASIC ACCOUNTABILITY AND TRANSPARENCY MEASURES AND EMPOWERED POLICE OVERSIGHT OFFICE PROVIDES AS CO PLATE READERS.

THE ONLY WAY TO GUARANTEE THAT SURVEILLANCE DATA DON'T END UP BEING USED AGAINST IMMIGRANTS, ABORTION SEEKERS, TRANS HEALTHCARE SEEKERS, PEOPLE OF COLOR SURVIVORS OR ACTIVISTS IS TO NOT GATHER THAT DATA IN THE FIRST PLACE, ESPECIALLY WHEN RESEARCH HAS SHOWN.

THERE'S ABSOLUTELY NO CLEAR PUBLIC SAFETY BENEFIT IT'S SAFETY THEATERS.

THAT MIGHT BE NEAT FROM A TECH POINT OF VIEW, BUT IS AGAIN COSTLY AND DEEPLY DAMAGING TO OUR COMMUNITY.

PLEASE VOTE YES ON 86 TODAY AND NO ON ITEM 56.

THANK YOU, MEG HELP IN ON 86.

GOOD MORNING.

MY NAME IS MEG HALPIN.

I LIVE IN D SEVEN AND I'M CALLING THIS STRONGLY URGE Y'ALL TO VOTE YES ON 86, AS WELL AS NO ON 56.

I WANNA ECHO THOSE CALLERS BEFORE ME WHO SAID THE BEST WAY TO LIMIT THE ABUSE OF DATA COLLECTED ABOUT OUR COMMUNITY IS TO NOT COLLECT IT.

AND THE BEST WAY TO LIMIT VIOLATIONS TO OUR CONSTITUTIONAL RIGHTS IS TO STOP AUTHORITARIAN AND INEFFECTIVE MASS SURVEILLANCE OF OUR COMMUNITY LICENSE PLATE READERS, FURTHER THE CRIMINALIZATION OF POVERTY IN OUR COMMUNITY VIA DATABASES OF WARRANTS, OF FOLKS WHO CAN'T AFFORD TO PAY FINES, FEES, AND TICKETS.

AND WE KNOW THAT THEY DISPROPORTIONATELY SURVEIL NEIGHBORHOODS THAT ARE LOW INCOME AND COMMUNITIES OF COLOR.

I ALSO WANNA URGE Y'ALL TO VOTE, TO PASS 86 WITHOUT DELAY.

THE FIGHT AGAINST MASS SURVEILLANCE IS INEXTRICABLY TIED UP TO AN URGENTLY NEEDED RECKONING WITH RACISM AND POLICING IN AUSTIN.

WE HAVE TO TAKE THIS OPPORTUNITY TO RECOGNIZE THE ROLE OF SURVEILLANCE IN EXACERBATING, THE INHERENT RACISM OF OUR LAW AND IMMIGRATION ENFORCEMENT SYSTEMS. PLEASE STOP INVESTING OUR RESOURCES AND MASS SURVEILLANCE OF OUR COMMUNITY SO THAT WE CAN CONFRONT THESE SYSTEMIC HARMS ONLY.

THEN WE'LL BE BEYOND THE THANK YOU.

YOUR TIME HAS EXPIRED.

ROBIN SCHNEIDER, 86, ROBIN, PLEASE UNMUTE BETH BUFFET ON 86.

HI, UH, MY NAME IS BETH BUFFET.

CAN YOU HEAR ME? YES.

I LIVE IN DISTRICT EIGHT.

I'M SPEAKING AGAINST ITEM 56 AND I AM SPEAKING IN SUPPORT OF ITEM 86.

UM, REGARDING 56, A LPRS ARE GENERATING MILLIONS OF DATA POINTS ON THE MOVEMENT OF PEOPLE WHO AREN'T EVEN SUSPECTED OF VIOLATING LAWS WHILE PUTTING MULTIPLE CATEGORIES OF AUSTIN RESIDENTS AT RISK.

UH, THE ONLY TRULY SECURE DATA IS THE DATA NOT COLLECTED AND THE POLICE ARE WELL FUNDED ENOUGH STARTING MY SUPPORT OF ITEM 86, TRANSPARENCY AND ACCOUNTABILITY REQUIREMENTS ARE NOT BARGAINING SHIPS.

THE POLICE SHOULD BE ABLE TO HOLD IN NEGOTIATION WITH THE CITY.

THE CITY SHOULD NOT BE FORCED TO CONCEDE EVEN MORE MONEY LOCKED IN FOR YEARS TO COME BY STATE LEGISLATION IN EXCHANGE FOR EXTREMELY BASIC AND MINIMAL TRANSPARENCY AND OVERSIGHT FROM THE AUSTIN POLICE ASSOCIATION.

UM, JUST JOINING THE CHORUS OF PEOPLE WHO ARE AGAINST 56 AND SUPPORTING 86, UM,

[00:55:01]

FROM DOWN HERE IN SOUTH AUSTIN.

THANKS FOR YOUR HARD WORK, ROBIN SCHNEIDER.

HI, THIS IS ROBIN SCHNEIDER.

I'M UH, NOW A DISTRICT THREE RESIDENT.

I HAVE BEEN A DISTRICT NINE RESIDENT.

I WAS IN THE CITY CHI COUNCIL CHAMBERS WHEN THE COUNCIL A FEW YEARS AGO, BRAVELY STOOD UP TO THE POLICE UNION AND REJECTED THE CONTRACT.

UM, AND I WAS SO PROUD OF OUR CITY FOR FINALLY, UM, LISTENING TO PEOPLE WHO HAVE BEEN VICTIMIZED BY THE POLICE.

THIS IS YOUR CHANCE TO REALLY STAND UP FOR STRONG POLICE ACCOUNTABILITY BY VOTING YES, ON 86, IF YOU DELAY UNTIL MAY, UH, THERE IS NO GUARANTEE THAT THE POLICE CONTRACT THAT'S BEING NEGOTIATED NOW THAT HAS TO BE COMPLETED IN MARCH IS GOING TO BE COVERED.

UM, SO IF YOU WANT TO HAVE A LEGACY, UH, ON POLICE OVERSIGHT AND POLICE ACCOUNTABILITY, IT IS TIME TO VOTE.

UM, YES.

ON 86, ESPECIALLY THE COUNCIL MEMBERS AND MAYOR WHO ARE DEPARTING THE COUNCIL.

THIS IS YOUR OPPORTUNITY TO LEAVE A LEGACY OF JUSTICE.

IF YOU THINK BLACK LIVES MATTERS.

THIS IS ERICA FLOES MS. FLOES PLEASE UNMUTE MUNIB ISLAM ON 86 AND 87.

HELLO, GOOD MORNING.

MY NAME IS NEEDS ALA.

I'M A MASTER STUDENT HERE AT LBJ SCHOOL OF PUBLIC AFFAIRS AND A LONGTIME AUSTIN RESIDENT IN D NINE.

I'M TESTIFYING FROM WORK CURRENTLY IN FAVOR OF ITEM 86 AND AGAINST ITEM 56, 87 AND 91.

I REALLY HOPE THAT THE CITY COUNCIL, UH, VOTES IN FAVOR OF THE AUSTIN POLICES OVERSIGHT ACT AND I'M URGING MY OWN COUNCIL MEMBER, KATHY TOVO AS WELL AS THE REST OF THE ESTEEM BODY TO VOTEES SO THAT WE CAN PUT A RELIABLE SYSTEM OF CIVILIAN OVERSIGHT INTO OUR CODE AND MAKE IT LAW.

NOW, UM, WE WANT TO KEEP THAT PROMISE OF PROVIDING A SPACE AND EQUITABLE AUSTIN FOR ALL FOLKS, REGARDLESS OF THEIR BACKGROUND, POLICE BRUTALITY, MISCONDUCT ARE REPREHENSIBLE, AND THEY MUST BE APPROPRIATELY DEALT WITH BY AN INDEPENDENT BODY OF CIVILIANS.

AND I AM HOPING THAT, UH, WE DO PASS 86, UH, AND WITHOUT FURTHER DELAYS.

THANK YOU SO MUCH FOR YOUR TIME AND CONSIDERATION.

I REALLY APPRECIATE IT.

ERICA FLO ON 86, ERICA, PLEASE UNMUTE CARMENS ON 86 AND 87 MORNING MAYOR, MAYOR COUNCIL.

I'M HERE TO SAY YES ON 86, NO.

ON 87, THIS AUSTIN POLICE OVERSIGHT ACT IS YOUR OPPORTUNITY TO PASS A CRITICALLY IMPORTANT PIECE OF POLICY TODAY.

RIGHT NOW WE'RE LOSING OVERSIGHT.

EVERY TIME A REPORT GOES INTO INTERNAL AFFAIRS AND DISAPPEARS, WE'RE AWARE OF THE PROBLEMS, BUT NOT ABLE TO TAKE ACTION ON CASES LIKE THOSE YOU'RE HEARING TODAY.

YOU CAN SPARE US AN ADDITIONAL ELECTION BECAUSE THERE'S SO MUCH TO DO.

YOU KNOW, WHEN IT COMES TO CAMPAIGNING, EDUCATING THE PUBLIC ON CIVIC ISSUES, YOU CAN TAKE AN IMPORTANT STEP TOWARD EQUITY AND JUSTICE BY CREATING ACCOUNTABILITY TODAY, AS ONE OF YOUR PRO-POLICE CALLERS SAID EARLIER, SHE REALIZES THERE ARE BAD POLICE OFFICERS, BUT EVENTUALLY THEY'LL GET CAUGHT.

ONLY IF YOU, AS OUR ELECTED OFFICIALS, GIVE US THE TOOLS AND SYSTEMIC STRUCTURES TO HOLD THEM ACCOUNTABLE.

BE THE CHANGE TODAY.

THANK YOU, RACHEL SHANNON ON 86 AND 91.

GOOD MORNING.

MAYOR ADLER MEMBERS OF CITY COUNCIL IS RACHEL SHANNON 21 YEAR RESIDENT OF DISTRICT ONE.

THE TIME TO PASS POLICE OVERSIGHT IS NOW NOT IN MAY.

WHEN ACCOUNTABILITY BECOMES A BARGAINING CHIP OF THESE CONTRACT NEGOTIATIONS, THERE'S POPULAR SUPPORT FOR IT.

THE CITY HAS STILL FAILED TO ISSUE DISCIPLINE OVER THE MORE THAN A HUNDRED EXAMPLES OF FALSE ARREST AND ACCEPTED FORCE FROM AUDIT THE BODY CAMERA VIDEOS.

WHEN ARE WE GONNA TAKE THIS SERIOUSLY? MEANWHILE, AUSTIN AIMS TO BE A SANCTUARY CITY FOR IMMIGRANTS, REPRODUCTIVE RIGHTS

[01:00:01]

AND TRANSGENDER RESIDENTS, BUT IT'S ENTERTAINING MORE SUPPORT FOR SURVEILLANCE THAT STANDS TO CRIMINALIZE ALL THESE PEOPLE.

IN ADDITION TO THE BLACK AND BROWN COMMUNITIES ALREADY ADVERSELY OVER SURVEYED, THIS IS A DIRECT CONFLICT OF THE WELL-FORMED RESEARCH OF THE RPS RECOMMENDATIONS.

YOU KNOW, THERE'S NO AMOUNT OF PRIVACY PROTECTIONS THAT IT ENSURE THAT CAN ENSURE COLLECTED DATA WILL NOT BE MISUSED OR SHARED.

THE ONLY TRULY SECURE DATA IS THE DATA NOT COLLECTED.

PLEASE RESPECT OUR FOURTH AMENDMENT RIGHTS REPRESENT AND PROTECT OUR DIVERSE, AMAZING COMMUNITIES OF PEOPLE.

NO, A L PRS ARE NOT WORTH THE PRICE OF HUMAN RIGHTS POLICE OVERSIGHT NOW.

THANK YOU.

YOU SPEAKER YOUR TIME HAS EXPIRED.

ERICA.

FLOES ERICA FLOES OKAY.

SHE DISCONNECTED.

LAST SPEAKER WE HAVE IS LINDSAY IGNATOWSKI ON 56 AND 86.

OH, HI.

Y'ALL UM, I ALREADY DID GET MY CHANCE TO SPEAK ACTUALLY, BUT THANK YOU SO MUCH, MAYOR.

THAT CONCLUDES THE, UM, REMOTE SPEAKERS.

WE'VE TRIED WITH MISS FLOSS SEVERAL TIMES.

I'M NOT SURE IF SHE'S JUST MUTED AND CAN'T HEAR US, BUT HOW WOULD YOU LIKE TO PROCEED? LET'S GO TO THE, UH, IN PERSON SPEAKERS.

OKAY.

FIRST SPEAKER IS SHANTE MARSHALL ON ITEM 86.

UM, GOOD AFTERNOON.

MY NAME IS SHANTE MARSHALL.

UM, HERE TODAY TO SPEAK IN FAVOR OF THE POLICE OVERSIGHT ON MAY 18TH OF THIS YEAR, MY BROTHER BRANDON MARSHALL WAS SUBJECT OF A JOINT OPERATION BETWEEN AUSTIN POLICE, SOUTH METRO TECHNICAL UNIT AND DEPARTMENT OF PUBLIC SAFETY.

THE GOAL OF THEIR OPERATION WAS TO ARREST MY BROTHER FOR ACTIVE WARRANT.

HOWEVER, ON THIS DAY, MAY 18TH AT APPROXIMATELY 6:30 PM.

THE OPERATION ENDED WITH MY BROTHER BEING SHOT BY FOUR POLICE OFFICERS FROM APD AND ONE DPS OFFICER ULTIMATELY LEAVING HIM WITH EIGHT TO 10 GUNSHOT WOUNDS.

UM, THE MAIN FOCUS WAS TO GET HIM ARRESTED, BUT I HAVE QUESTIONS WAS THE OPERATION THOUGHT OUT WAS THE EXTENT OF FORCE AND THE PLAN OF ACTION NECESSARY.

UM, THE POLICE, UM, OFFICIALS NEVER MADE THEMSELVES KNOWN TO BRANDON.

THEY NEVER USED POLICE SIRENS.

THEY NEVER ANNOUNCED OVER THE BULLHORN WHO THEY WERE.

THEY NEVER MOTIONED FOR HIM TO PULL OVER HIS VEHICLE.

THEY SIMPLY FOLLOWED HIM FOR HOURS.

UM, AFTER HE ATTENDED TO HIS AFTER WORK, AS HE ATTENDED TO HIS AFTER WORK DUTIES, AT WHICH ONE POINT HIS CHILDREN WERE EVEN, EVEN IN HIS CAR, THEY DEFLATED HIS TIRES, CAUSING HIM TO ULTIMATELY HAVE TO PULL OVER.

UM, I AM FOR THE POLICE OVERSEEING ACT BECAUSE I WANT TO SEE JUSTICE FOR THIS TYPE OF BEHAVIOR FROM THE POLICE DEPARTMENT.

THANK YOU.

NEXT SPEAKER IS GU BEK ON ITEMS 1 23, 24, 25, 34 36 37 38 39, 40 41 42 43, 64, 86, 88 AND 89.

ALL RIGHT, LET'S GET TO THE NITTY NITTY.

MY NAME IS GUSTAVO PENA.

I WAS TOLD I WAS, UH, GOING, I WAS AT, UH, THE, THE SECOND FLOOR.

I WAS INVITED BY TWO COUNCIL MEMBER AIDS.

WE WERE GONNA TALK ABOUT ISSUES.

UH, THIS IS NOT RELEVANT TO WHAT THEY'RE YOUR, YOUR, UH, YOUR HAVE, LISTEN, WHAT HAD HAPPENED WAS THIS GOOD? UH, YOUR SAVIO TOLD ME TO LEAVE.

I HAD TO LEAVE.

I SAID, I HAVE PERMISSION TO SPEAK, UH, OVER HERE ON MY TWO COUNCIL MEMBER AIDS.

AND I'M NOT GONNA MENTION THEIR NAMES, BUT THIS CHARACTER WAS WRONG IN WHAT HE DID.

AND, AND, AND TELLING ME THAT I HAVE TO LEAVE.

I DIDN'T HAVE TO LEAVE, BUT I LEFT BECAUSE I TELL YOU WHAT MY, MY SON, MY BLOOD WAS BOILING.

OKAY.

I'M GONNA LEAVE IT AT THAT.

I WANNA SAY TO YOU ALSO,
