I, BECAUSE THERE'S MORE EXPECT, UH, IN TERMS OF REVENUE, BUSINESS REVENUE, REVENUE.

UM, AND THAT HAS, UH, ONE POINT, UM, MAINLY, UH, UH, SINCE APRIL, SO YEAR OVER YEAR, MORE, UH, ON EXPENSE.

UM, THE, THE EXPENSE, UH, WE HAD A ALMOST

[2. June 2023 Financial Results presented by Rajeev Thomas, Deputy Chief, Finance.]

A 39% INCREASE IN OPERATING EXPENSES YEAR OVER YEAR.

UH, MOST OF THAT IS DRIVEN BY A NEW, UM, EXPENSE ITEM THAT HAS COME ONLINE, WHICH IS OUR VANDERLANDE CONTRACT, WHICH IS HANDLING THE BAGGAGE SYSTEM OPERATIONS AND MAINTENANCE.

UH, THERE WERE STARTUP COSTS ASSOCIATED WITH THAT.

AND, UH, ALSO RECURRING MONTHLY COSTS OF ALMOST $400,000.

THE STARTUP COSTS WERE ABOUT $500,000, AND FOR A SUM OF ABOUT $900,000 IN TOTAL, UH, IN THIS MONTH, THAT DID NOT HAPPEN LAST YEAR.

UH, PARKING EXPENSES WERE ALSO HIGHER, ABOUT 350,000 VERSUS LAST YEAR.

WE HAVE MORE PARKING SHUTTLE DRIVERS AND, YOU KNOW, MORE PASSENGERS, UH, ALSO, UH, THAN LAST YEAR.

UH, SO OVERALL, UH, THE EXPENSES INCREASED 39%, BUT IT WAS IN LINE WITH WHAT WE BUDGETED.

WE DID BUDGET TO HAVE OPERATING EXPENSES OVER $11 MILLION IN THE MONTH OF JUNE, AND THAT IT CAME IN LINE WITH OUR, OUR BUDGETED ESTIMATES.

UH, SO FOR THE YEAR, WE ARE STILL, UH, TRENDING YEAR TO DATE, WE ARE STILL TRENDING UNDER BUDGET AND ALSO UNDER C Y E ON OUR OPERATING EXPENSES.

UM, WE KNEW, YOU KNOW, COMPARED TO THE PANDEMIC ERA, YOU KNOW, PEOPLE ARE NOW GOING OUT AND SHOPPING MORE THAN, UH, YOU KNOW, JUST GETTING PACKAGES AT HOME.

SO I DON'T KNOW WHETHER THAT IS NOW A TREND THAT HAS KIND OF STABILIZED, BUT WE'VE SEEN THAT DECLINE IN CARGO FOR THE PAST FEW MONTHS.

BUT IT'S KIND OF STAYING STEADY, BUT YEAR OVER YEAR COMPARISONS ARE LOWER.

OKAY, SO THIS IS THE PRESENTATION OF THE 2024 BUDGET THAT IS IN THE PROCESS OF GETTING APPROVED BY CITY COUNCIL THIS WEEK.

CITY COUNCIL IS GOING THROUGH WORK SESSIONS THIS WEEK, AND THE HOPE IS THAT NEXT WEEK IT'LL BE FINALIZED.

UM, SO IN TERMS OF THE PASSENGER PROJECTIONS FOR THIS YEAR AND NEXT YEAR, UH, IN OUR ESTIMATE, WE HAD PROJECTED ABOUT 11.1 MILLION PASSENGERS, OR IN PLANE, SORRY, IN PLANE PASSENGERS IN 2023, FISCAL YEAR 2023, NOT, THIS IS NOT CALENDAR YEAR, THIS FISCAL YEAR.

AND RIGHT NOW, YOU KNOW, LOOKING AT THE LAST COUPLE OF MONTHS THAT WE'VE HAD A LITTLE SOFTNESS, ALMOST 1% TO 2% DECLINE IN PASSENGERS, UH, VERSUS JUNE, UH, WE DID SEE A LITTLE INCREASE OF ABOUT ONE TO 2%.

UH, THAT 11.1 MILLION UNEMPLOYMENTS MIGHT FALL A LITTLE SHORT.

I THINK IT'LL, WE'LL BARELY JUST MAKE IT TO 11 MILLION IN THAT ESTIMATE FOR FISCAL YEAR, UH, 23

AND NEXT YEAR, WE HAD PROJECTED A 4% INCREASE IN UNEMPLOYMENTS OVER THAT.

UM, SO WE'LL SEE WHETHER, UH, YOU KNOW, THE PASSENGER TRAFFIC PICKS UP SOME PICKS UP OR NOT, BUT IT IS, YOU KNOW, PROJECTED TO BE ABOUT 11 AND A HALF MILLION IN PLACEMENTS.

SO WE'LL SEE HOW THE REST OF THE YEAR GOES, UH, IN TERMS OF PASSENGERS.

BUT, YOU KNOW, SOMETIMES THERE IS SOME SOFTNESS AND IT COMES BACK VERY FAST.

SO, UM, SO IT IS A, IT IS A CONSERVATIVE FORECAST AND THE 4% IS BELOW OUR LONG-TERM AVERAGE.

UH, OVER 20 YEARS WE'VE BEEN AVERAGING OVER 5%.

SO WE DID EXPECT A LITTLE RECESSIONARY IMPACT WHEN WE WERE PUTTING TOGETHER THE BUDGET ABOUT TWO, THREE MONTHS AGO.

AND, YOU KNOW, WE'LL SEE WHETHER WE CAN OUTDO IT OR NOT.

UM, SO NEXT SLIDE PLEASE.

SO FOR OUR REVENUES, UH, THE WAY WE PROJECTED OUR REVENUES IS ONE METRIC THAT WE LOOK AT IS REVENUE PER UNEMPLOYMENTS.

UM, AND IN, IN, UH, IN FISCAL YEAR 23, WE ARE PROJECTING OUR REVENUE PER APPOINTMENTS TO BE ABOUT $23 AND 86 CENTS.

UH, IN THE 22 ACTUALS, WERE $23 AND 16 CENTS.

AND IN THIS BUDGET YOU'LL SEE THAT THE PROJECTION IS FOR REVENUE PER APPOINTMENTS OVER $24.

UH, WE THINK WE CAN ACHIEVE IT.

UH, RIGHT NOW, YEAR TO DATE, WE ARE AVERAGING OVER $24.

SO, UH, NEXT YEAR WITH THE FULL YEAR IMPACT OF THE PARKING RATE INCREASE AND ALSO ADVERTISING REVENUE INCREASE, WE SHOULD SEE A HIGHER REVENUE PER EMPLOYMENT.

UM, INTEREST INCOME IS ALSO RISING DUE TO INCREASE IN OUR TREASURY RATES.

IF THE, IF THE, YOU KNOW, UH, THE FED DOESN'T CUT THE RATES, WE WILL HAVE HIGHER INTEREST INCOME NEXT, UH, NEXT YEAR TOO.

AND WE DIDN'T PUT INTO ANY, UH, ACCOUNT FOR ANY SIGNIFICANT INCREASE IN LANDED WEIGHTS FOR NEXT YEAR.

WE ARE ESSENTIALLY KEEPING IT FLAT.

WE JUST DON'T SEE THE, THE GROWTH IN, IN, IN THE, THE, THE NUMBER OF LANDINGS.

UH, THERE WILL BE SOME INCREASE IN SEEDS, BUT IT'S NOT GONNA BE MATERIAL IMPACT ON THE LANDED WEIGHTS.

UH, TERMINAL RENTAL RATES ARE INCREASING, UH, AS YOU'LL SEE IN THE, IN THE NEXT SLIDE, UH, DUE TO HIGHER O N M COSTS AND ALSO THE HIGHER DEBT SERVICES THAT IS COMING IN, UH, COMING INTO PLAY.

UH, SO TERMINAL RENTAL RATES, WHICH ARE BASED ON THOSE COSTS ARE INCREASING FOR THE AIRLINES.

UH, RENTAL CAR AVERAGE DAILY RATES ARE, ARE EXPECTED TO BE WHERE THEY ARE.

WE'VE SEEN SOME DECLINES IN RENTAL CAR RATES RECENTLY, UH, LAST YEAR WE WERE LOOKING AT ALMOST $80 RATES, UM, ON AN AVERAGE DAILY RENTAL.

AND NOW IT HAS FALLEN TO, I THINK LAST MONTH WAS ABOUT $65, BUT REVENUES ARE KIND OF STAYING STEADY, TOTAL GROSS REVENUES AND, AND THERE'S A NEW CONTRACT FOR ADVERTISING REVENUE.

SO THAT IS ALSO EXPECTED TO INCREASE REVENUES, BUDGET TO BUDGET BY ABOUT $2 MILLION.

AND PARKING REVENUE, WE EXPECT TO INCREASE BY ABOUT FIVE TO $7 MILLION DUE TO THE $2 INCREASE THAT WE INSTITUTED, I THINK BACK IN APRIL, WHICH WILL HAVE A FULL YEAR IMPACT NEXT YEAR.

AND OTHER REVENUES ARE JUST RISING BASED ON CONTRACTUAL OBLIGATIONS.

UH, YOU KNOW, UH, C P I INCREASES IN LEASE OBLIGATIONS.

SO, NEXT SLIDE PLEASE JI, MAY I INTERRUPT FOR JUST A SECOND? SURE.

THE RIDESHARE, UBER, LYFT, AND TAXI, UM, UH, CONTRIBUTION TO THE REVENUE IS THAT WE DON'T HAVE A RATE INCREASE PLAN FOR THAT, BUT WE DO HAVE, BASED ON VOLUMES, IF THE VOLUMES KEEP GOING UP, THE IMPACT FROM JUST IN THE VOLUME SIDE OF IT.

SO TOTAL REVENUES, UM, ARE GOING TO $289 MILLION IN THE PROPOSED BUDGET FOR 2024.

AND COMPARED TO WHERE WE DID THE BUDGET IN 2023, WHICH IS ABOUT $237 MILLION, UH, THAT IS ALMOST A 22% INCREASE BUDGET TO BUDGET.

UH, BUT OUR ESTIMATE FOR THIS FISCAL YEAR, YOU CAN SEE IS ABOUT 265 MIL, $65 MILLION.

SO THAT IS ABOUT A 9% INCREASE IF YOU LOOK AT ESTIMATE THIS YEAR'S ESTIMATE VERSUS NEXT YEAR'S BUDGET.

SO, LIKE I MENTIONED BEFORE, YOU KNOW, WE TIE TO AT THAT REVENUE PER PLAN METRIC, AND YOU CAN SEE AT THE BOTTOM THERE, UH, THE REVENUE PER EMPLOYMENT THAT WE ARE SHOOTING FOR IS $24 AND 99 CENTS FOR NEXT YEAR.

AND THAT HAS EVEN BROKEN DOWN FURTHER.

UH, IF YOU LOOK AT AIRLINE REVENUE PER EMPLOYMENT, THAT'S $12.

AND THEN THE NON-AIR AIRLINE REVENUE COMPONENTS, WHICH ARE LIKE PARKING, LIKE YOU MENTIONED, THE, THE RIDE SHARE, THE T N C, THE RENTAL CAR, AND THE CONCESSIONS

SO WE ARE GONNA CONCENTRATE ON FILLING THOSE POSITIONS, UH, BEFORE WE ASK FOR ANY MORE IN FOLLOWING YEARS.

SO, ON THE OPERATING EXPENSE SIDE, AND THIS IS JUST AIRPORT OPERATING EXPENSES, NOT, UH, CITY ALLOCATED EXPENSES THAT WE GET, UH, PASSED DOWN FROM, UH, THE CONTROLLER'S OFFICE OR THE, UH, FOR LAW, ET CETERA THAT THE CITY DOES.

SO THIS IS JUST STRICTLY AIRPORT EXPENSES.

SO AIRPORT EXPENSES ARE GOING UP 13.5% BUDGET TO BUDGET.

UM, THERE ARE TWO DRIVERS FOR THIS.

ONE IS THAT VANDERLANDE CONTRACT THAT I MENTIONED, UH, THAT WAS CAUSING THAT INCREASE IN EXPENSES THIS YEAR.

THAT EXPENSE WASN'T BUDGETED THIS YEAR.

UH, IT CAME ON AFTER THE BUDGET WAS DONE LAST YEAR, AND THE FULL YEAR IMPACT OF THAT IS FIVE AND A HALF MILLION DOLLARS.

SO THIS WORK BEFORE WAS DONE BY AN AIRLINE CONSORTIUM.

SO WE ARE NOW, THE AIRPORT IS GONNA TAKE OVER OR THE EXPENSE RELATED TO THAT, BUT WE ARE GOING TO RECOVER THAT THROUGH AIRLINE RATES AND CHARGES.

SO THAT'S WHY YOU'LL SEE, UH, SOME THE TERMINAL RENTAL RATES, ET CETERA, INCREASED DUE TO THIS.

BUT IF YOU BACK OUT THAT MANAL LAND D CONTRACT, WHICH IS SORT OF A NEW EXPENSE, AND ALSO WE HAD ALSO PLANNED FOR $3 MILLION INCREASE IN LEGAL EXPENSES DUE TO, BECAUSE WE DIDN'T KNOW WHEN THE SOUTH TERMINAL SETTLEMENT WAS GONNA OCCUR.

IF YOU BACK THOSE TWO ITEMS OUT, UH, YEAR OVER YEAR, THE EXPENSES ARE GROWING, GOING ABOUT GOING UP ABOUT 7%.

NEXT SLIDE PLEASE.

SO THIS IS JUST A DETAIL ON WHAT IS COMPOSING THOSE INCREASES IN EXPENSES.

UH, YOU CAN SEE THE PERSONNEL COSTS ARE GOING UP ABOUT $1.4 MILLION.

UH, THIS INCLUDES A 4% WAGE INCREASE THAT, UH, THE ALL THE CITY EMPLOYEES ARE RECEIVING.

AND ALSO WE DO HAVE SOME INCREASE IN THEIR FOR OVER TIME AND TEMPORARY EMPLOYEES THAT, YOU KNOW, AS ON AN AS NEEDED BASIS IF WE NEEDED TO DO THAT.

IF PASSENGER TRAFFIC DOES PICK UP MORE THAN WE EXPECT.

ON THE CONTRACTUAL SIDE, YOU CAN SEE WHERE THE EXPENSES ARE GOING UP, ABOUT 16 AND A HALF A HALF MILLION DOLLARS.

UH, I I TALKED ABOUT THE VANDER LAND EXPENSE, WHICH IS THE FIVE AND A HALF MILLION.

THE 3 MILLION IN LEGAL EXPENSES, PARKING EXPENSES ARE GOING UP ABOUT ONE AND A HALF MILLION DOLLARS.

UH, WE DO HAVE, UM, MORE, UM, SHUTTLE DRIVERS AND WE ARE TRYING TO HIRE MORE.

SO THERE'S EXPENSES THROUGHOUT THIS YEAR WE'VE SEEN INCREASE.

UM, THERE'S ALSO JANITORIAL STAFF AUGMENTATION COSTS, UH, BECAUSE OF THE VACANCIES THAT WE HAVE IN JANITORIAL SERVICES, WE HAVE ALMOST A 40% VACANCY IN JANITORIAL SERVICES.

WE HAVE TO HAVE, WE AUGMENTING THAT WITH CONTRACT LABOR.

UM, IT IS ALSO INCREASING BY ONE AND A HALF MILLION DOLLARS AND BUILDING MAINTENANCE, UH, WE HAVE STAFF AUGMENTATION IN BUILDING MAINTENANCE TOO FOR, UH, PLUMBING FOR ELECTRICIANS, ET CETERA.

SO THAT'S ALSO CAUSING THAT INCREASE YEAR OVER YEAR.

SOME OF THIS IS OFFSET BY VACANCY SAVINGS, BUT YOU SEDUCE SEE THAT INCREASE IN THE CONTRACTUAL SIDE HERE AND COMMODITIES ARE GOING UP ABOUT $700,000.

SO THOSE ARE THE MAIN EXPENSE DRIVERS NEXT YEAR.

UH, THIS COMES INTO PLAY IN OUR AIRLINE RATES AND CHARGES.

UH, YOU CAN SEE THE DEBT SERVICE IS GOING, THIS IS NET OF P F C APPLICATION, UH, IS GOING FROM 57 MILLION TO 67 MILLION, WHICH IS ANOTHER 10 MILLION INCREASE, WHICH IS ALSO DRIVING UP AIRLINE RATES IN THE, AT THE TERMINAL TOO.

SO IN SUMMARY, UH, YOU CAN SEE FOR FISCAL YEAR 24, YOU KNOW THAT THE REVENUES ARE $289 MILLION.

SO WHEN YOU LOOK AT THAT NET INCOME, YOU'LL SEE ABOUT IN FISCAL YEAR 23, C Y E, THERE'S ABOUT 40 MILLION OF APPLICATIONS OF THOSE FEDERAL RELIEF.

SO WHEN YOU BACK THAT OUT YEAR OVER YEAR, WE ARE VERY CLOSE IN TERMS OF NET INCOME.

SO THAT WAS OUR OPERATING EXPENSES.

SO WE'LL HAVE TO KIND OF LOOK AT THAT AND SEE WHAT THE REQUIREMENT THERE IN TERMS OF STAFFING, BUT WE WILL DO A COMBINATION OF BOTH IF WE HAVE TO.

AND THEN THE ADDITIONAL 3 MILLION IN LEGAL FEES, IS THAT RELATED TO THE SOUTH TERMINAL OR IS THAT JUST MOST OF IT WAS, WE ARE HOPING IT WOULDN'T CONTINUE INTO NEXT YEAR.

THE ONLY, UM, THEY CAN ONLY EXPECT THE 4% COST OF LIVING INCREASE, BUT NOT THE PREVIOUS, UM, UH, INCENTIVE PAY? NO, THE PREVIOUS INCENTIVE IS IN THERE.

THE 10% RETENTION, THIS BUDGET RE IS BILLED ON THE 10% RETENTION.

UM, BUT DID A, JUST A, A REMINDER THAT, UH, WHEN THE, THE TRO AIR FORCE BASE WAS DECOMMISSIONED IN 1993 AND CONVERTED TO A B I A AS PART OF THE BRAC PROGRAM.

AND THIS IS REALLY KIND OF THE BASIS OF THIS ORDINANCE, UM, AND OF ITSELF AS, UM, THE, UH, COLLECTIVE, UM, UM, VARIANCES THAT YOU WOULD HAVE TO HAVE TO, UM, TO, UH, OPEN AN, AN AIRPORT, A COMMERCIAL AIRPORT.

IT WAS ALSO, IT ALSO ADDRESSED CODE VARIANCES NECESSARY TO CONVERT A BASE TO CITY OWNED PROPERTY.

IN 2012, AN UPDATE TO THE M D P ADDRESSED CHANGES IN DRAINAGE PLANNING REQUIREMENTS AS WELL AS FUTURE DEVELOPMENT NEEDS AS A U S KNEW THEM AT THE TIME, IT STATED THAT THE ORDINANCE BE REVIEWED EVERY 10 YEARS.

IN 2022, A U S D S D AND WATERSHED BEGAN THE REVIEW OF THE ORDINANCE TO ADDRESS ANY UPDATES TO THE CODE DRAINAGE REQUIREMENTS.

AND NOW BECAUSE WE HAD IT, UM, KNEW THAT A, A VERY DETAILED 10 YEAR DEVELOPMENT PLAN.

THE M D P SERVES AS REGULATORY FRAMEWORK TO GUIDE DEVELOPMENT WITHIN THE AIRPORT BOUNDARY.

IT SERVES AS AN OMNIBUS POPULATION OF PRE-APPROVED VARIANCES TO CERTAIN SECTIONS OF THE CODE IF NEEDED, PROVIDING CLARITY FOR CODE REVIEWERS WHEN REVIEWING, BUILDING, AND SITE PLANS FOR NEW REDEVELOPED AND EXISTING INFRASTRUCTURE.

THE TIMING OF THIS REVIEW ALIGNS WITH THE A E D P, WHICH ALLOWED FOR A MUCH MORE DETAILED REVIEW.

UM, BECAUSE OF THE POTENTIAL DEVELOPMENT CHANGES IN IN ADDITIONS ARE MORE DEFINED THAN PREVIOUSLY.

IT IS IMPORTANT TO NOTE THAT THIS ORDINANCE ALIGNS FUTURE AND NEW DEVELOPMENT WITH CURRENT CITY CODE.

DUE TO UPDATES OF WATER DRAINAGE CODE ELEMENTS, IT WAS NECESSARY TO DEFINE CERTAIN SECTIONS FOR THE CODE REVIEWERS FOR CLARIFICATION, WE'LL GO TO THE NEXT SLIDE AND, UM, I'LL GO THROUGH EACH ONE OF THE PROPOSED VARIANCES.

UM, WE, UM, WE'VE GOT INFORMATION FROM LAW THAT WHEN, UM, THE ORDINANCE GOES TO, UM, PLANNING COMMISSION ON AUGUST 22ND, WE WILL HAVE THAT DRAFT ORDINANCE, UM, DONE WITH ALL THE BACKUP EXHIBITS IN THERE AS WELL.

SO THAT SHOULD BE, UM, READY BEFORE THAT MEETING.

UM, START WITH THIS ONE.

WITH THESE, UM, THE VARIANCES TO, UM, SECTION 25 22, UM, MULTIPLE STRUCTURES FROM THE STROM AIR FORCE BASE REVERTED TO THE CITY OF AUSTIN AS PART OF THE BASE REALIGNMENT.

AS FEDERAL STRUCTURES MOST WERE EXEMPT FROM CITY REQUIREMENT TO OBTAIN A SITE DEVELOPMENT PERMIT.

THIS ALLOWS A US TO USE THE AIRPORT'S MASTER SITE PLAN AS THE PROJECT SITE PLAN TO OBTAIN BUILDING DEMOLITION PERMIT FOR EXISTING AIR FORCE STRUCTURES OVER 10,000 SQUARE FEET.

ALL LAND DEVELOPMENT AND BUILDING DEMOLITION WILL ADHERE TO THE LAND DEVELOPMENT CODE, AND IN AN INDIVIDUAL SITE DEVELOPMENT PERMIT WILL BE ATTAINED FOR SECTION 25 2.

REGARDING ZONING SUB CHAPTER E, THIS REQUESTED BY, UM, DEVELOPMENT SERVICES DEPARTMENT D S D, THE VARIS CLEARLY STATES THAT A U S WILL ENSURE SUSTAINABLE CONSTRUCTION PRACTICES AS IT GROWS IN THE CAMPUS WIDE PEDESTRIAN PATH SYSTEM.

THIS JUST ALIGNED CITY CODE TO SIMPLIFY SAN SITE PLAN REVIEW AND SECTION 25 5 44.

IT'S AN ADMINISTRATIVE IN NATURE AND DICTATES HOW TO SUBMIT SITE PLAN APPLICATIONS FOR REVIEW GIVES ADDED FLEXIBILITY FOR REDEVELOPMENT OF A LARGE, COMPLICATED SITE THAT WAS BUILT WITH OVER 100 INDIVIDUAL SITE PLANS.

THIS ALLOWS FOR OVERLAPPING SITE PLANS UNDER REVIEW CONCURRENTLY, WE'LL GO TO THE NEXT SITE PLEASE FOR SECTION 25 DASH FIVE DASH 81 A U S HAS A MASTER SITE PLAN ENCOMPASSING THE ENTIRE 4,200 ACRE CAMPUS THAT ILLUSTRATES EXISTING AND ULTIMATE BUILD OUT CONDITIONS ON A LONGER PLANNING TIMEFRAME THAN A SMALL INDIVIDUAL DEVELOPMENT.

THE MASTER SITE PLAN WILL HAVE PERIODIC REVIEW AT LEAST EVERY 10 YEARS AMONG D S D, UM, WATERSHED PROTECTION DEPARTMENT AND A U S MASTER SITE PLAN WILL CONTINUE TO BE UPDATED AS DEVELOPMENT AND REDEVELOPMENT OCCURS ON SECTION 25 DASH 7 15 2.

HALF INCH CAPTURE IS APPLIED TO THE C D A WITH COMPENSATORY TREATMENT IN AREAS OUTSIDE OF THE DEFINED C D A FOR OVERALL QUALITY TREATMENT AREAS ON THE CAMPUS.

TAXIWAYS AND APRONS HIGHLIGHTED IN THE GREEN AREAS ARE AREAS THAT A U S WILL EXPAND THE CRITICAL WATER QUALITY ZONE.

UM, SO WE WILL GO ABOVE AND BEYOND WHAT CODE REQUIRES AROUND NATURAL WATERWAYS AND CREEKS.

AVAILABLE MITIGATION MEASURES WILL INCLUDE ANNUAL TREE PLANTING ON A U S PROPERTY OUTSIDE AN AIRCRAFT SAFETY AREA, AND PROTECTED AIRSPACE.

THIS ONLY APPLIES TO AREAS WHERE TREES ENCROACH ON PROTECTIVE AIRSPACE PRESENTING AN IMMINENT HAZARD TO LIFE OR PROPERTY.

AND THE LAST ONE, UH, LAST VARIANCE, UM, TO, UH, CHAPTER 25 DASH NINE IS THE RETROFIT AND EXISTING OF APPROXIMATELY 750,000 SQUARE FOOT TERMINAL TO MEET THEIR WATER REUSE CODE REQUIREMENTS WOULD, UM, CAUSE SUBSTANTIAL, UM, OPERATIONAL IMPACT TO THAT INFRASTRUCTURE OF THE EXISTING BARBARA JORDAN.

IT'S IMPORTANT TO NOTE THAT THE NEW CONCOURSE AND ANY NEW VERTICAL STRUCTURE, ANY INFRASTRUCTURE LIKE THE CENTRAL UTILITY PLANT, THE PARKING GARAGES AND ANY OTHER FACILITIES THAT TRIGGER THE REQUIREMENTS WILL COMPLY WITH A WATER FORWARD CONSERVATION REQUIREMENT.

AND WE'LL EITHER USE RAINWATER HARVEST HARVESTING OR RECLAIMED WATER FOR TOILET FLUSHING.

AND SO IN THAT VEIN TODAY, I HAVE A COUPLE OF SLIDES I'M GONNA GO OVER WITH YOU ON WHAT WE'VE DONE OVER THE PAST, UH, MONTH FOR THE M D P ORDINANCE UPDATE.

UH, ABOUT A MONTH AGO, AS YOU'RE ALL FAMILIAR WITH, THERE WAS THE ENVIRONMENTAL COMMISSION MEETING WHERE THIS ITEM CAME BEFORE, UH, THAT BODY AHEAD OF THAT MEETING.

THERE WAS AN EMAIL FROM THE COMMUNITY, UH, WITH, UH, A NUMBER OF NOTED CONCERNS.

WE WORKED WITH SUMMER'S TEAM TO RESPOND TO ALL OF THOSE CONCERNS AND QUESTIONS, UH, OUTLINING ALL OF THE INFORMATION, UH, THAT YOU JUST HEARD FROM SUMMER AND ADDRESSING, UH, SOME OF THOSE SPECIFIC, UH, CONCERNS.

WHAT WE REALLY WANTED TO DO WITH THAT EMAIL WAS TO REITERATE WHAT THIS ORDINANCE IN THIS UPDATE IS DOING AND WHAT IT IS NOT DOING.

UH, THE COMPETITIVE, UM, BIDDING PROCESS, UH, IS A ONE STEP, UH, CONTRACTOR SELECTION PROCESS.

IT'S A LOW BID, UH, PROCESS AND IT INCLUDES A LUMP SUM PROCESS.

AND, AND ITS TECHNICAL REQUIREMENTS ARE A HUNDRED PERCENT, UH, DESIGN, UH, COMPLETED DESIGN CONSTRUCTION DOCUMENTS.

THE OTHER VARIATION OF THAT PROCESS IS CALLED A COMPETITIVE SEALED PROPOSAL, WHICH IS VERY MUCH THE SAME EXCEPT THAT IT INCLUDES A BEST VALUE AND NON-PRICE FACTORS.

UH, SO WHEN THEY SELECT THE CONTRACTOR IN THE COMPETITIVE SEAL PROPOSAL, THEY'RE NOT JUST LOOKING AT LOW PRI, LOW BID OR LOW PRICE, THEY'RE ALSO LOOKING AT OTHER FACTORS OF WHICH PRICE IS, UH, A FACTOR.

I UNDERSTAND THE F A A IS RELEASING STANDARDS FOR THOSE, THIS IS FOR, UM, ADVANCED AIR MOBILITY DEVICES THAT TAKE OFF LIKE THAT.

AND, UM, SOME OF THEM ARE ELECTRIC AND I KNOW THAT THERE'S AT LEAST ONE COMPANY IN THE AREA THAT IS WORKING ON THOSE.

THERE ARE ABOUT EIGHT OF THEM NATIONALLY.

L A X IS SORT OF FOLLOWING THEM, TRACKING THEM PRETTY CLOSELY.

AND I WOULD LIKE TO KNOW WHAT, WHETHER THERE ARE PROVISIONS OR WHAT PROVISIONS THERE MIGHT BE IN THE, UM, THE EX.
